    Dear Sirs/Madame:Following the ruling by the First District Court of Appeals in June that the Parking Lease

    among the City of Cincinnati, th e Port Authority, Guggenheim and XeroxCorporation could proceed without first being subject to referendum on th e measure by th epublic, the City of Cincinnati quickly signed th e lease behind closed doors.

    The Port Authority, a supposedly public agency, apparently deliberated for a few days,asked for some amendments to th e Lease and then executed an amended version allowing th ePort to terminate th e Lease at the discretion of the Port. Thereafter, th e Port apparently beganboth negotiations with th e City for its "piece of th e pie," and began to conduct some duediligence review of th e plan.

    All of th e foregoing actions by both th e City and th e Port have been shrouded in secrecy.Please understand that before all of the foregoing actions took place, 19,803 citizens

    signed petitions to place th e issue on the ballot because the public very much wanted a say onthis plan. The petition drive was spurred by hundreds of petitioners united by their oppositionto or at least their heartfelt concerns about the Lease plan. Please understand th eimportance of the s tatement made by these circulators and petition signers: in th e pas t 30years there has been maybe one successful City-wide referendum other than this one. Theyare exceedingly difficult to organize successfully. The challenges of the petition drive werecompounded by the threats of public safety layoffs from th e Mayor, Manager and Council, thelegal uncertainty hanging over th e drive, and th e Easter holiday that was near the end of theeffort. Still, we collected more than 2.5 times the minimum required signatures in a short 30-day timeframe to place th e issue before th e voters.
