    1. As directed by enclosure ( I ) , a preliminary inquiry wasconducted in accordance with reference (a) into the al legedmisconduct by the Commanding Officer , USS PONCE (LPD 15). Theal legat ions stem from an anonymous complaint f i led with the U.S.Fleet Forces Inspector General 's off ice , enclosure (2).Findings of Fact

    1. A hotl ine complaint was lodged through the U.S. Fleet ForcesInspector General website on 14 Apri l 2011, al leging misconductto include creat ing a hos t i l e work environment, humiliation ofsubordinates, preferent ia l t reatment, abuse of power and verbalabuse by the Commanding Officer (CO) of USS PONCE. (Encl 2)2. The CO of USS PONCE i s CDR Etta Jones. CDR Jones has beenin cotmualld since 24 October 2010. (Enel 44, 45)3. The Executive Officer (XO) of USS PONCE i s LCDR KurtBoenisch. LCDR Boenisch has been onboard since January 2010.(Encl 42, 43)4 .. The Command Master Chief (CMC) of USS PONCE i s 1 bZc 11 b7G I. CMDCM has been onboard for three years . (Encl 40, 41)Preferent ia l Treatment5. Several PONCE off icers and Chief Petty Officers hold theperception tha t the CO gives preferent ia l t reatment to the

The CO has conducted female-only off ice r meetings in herstateroom, invi ted the female off icers to her stateroom fo rmovie and popcorn night , has offered the use of the CO's sedanwhen in por t and has bought female off icers gi f t s . (Encl 4, 8,9 , 1 2 , 1 5 , 1 7 , 4 3 ) ,7. Some of the recipients of the CO's preferent ia l t reatmentfee l uncomfortable and s ta te tha t it affects the i r cred ib i l i tywithin the wardroom. (Encl 15, 38, 39)8. Several off icers and Chief Petty Officers bel ieve the COt r ea t s cer ta in male off icers worse than others ; these off icersinclude I bIc I, I bie I , I hZe and 1 b7c I.(Encl 6, 9, 13, 20, 25 ,43)9. While the ship was in por t Bahrain, RDML Klein (Commander,Expeditionary Strike Group Five) requested an "a l l gir ls" photoand invi ted a l l of the female off icers to dinner a t her home.(Ericl 8, 15, 17, 18, 39)10. The CO considered regret t ing the invi ta t ion fo r the dinnerhosted by RDML Klein, but was advised to accept by the XO andCMC. (Encl 37, 41, 43)11. The male off icers were not invi ted to the dinner a t RDMLKlein 's residence and several f e l t th i s to be a dis t inc tprofessional disadvantage. (Encl 15, 18)12. Several off icers and enl is ted share the perception tha t theCO gives preferent ia l t reatment to I hZe ! . b7e hasnot I!Itood Office:r of the Deck (OOD) since she quall.fl.ed inOctober 2010, and has been standing Engineering Officer of theWatch Under Ins t ruc t ion (EOOW U/I) since mid-October 2010 andfai:led to qual i fy unt i l 22 April . She has repor tedly missed U/Iwatches frequently and without repercussions. (Encl 4, 6, 9, 14,15, 18, 20, 25)13. I bI c has been referred to as the CO's "daughter ,""god-child," or "CO's Special gi r l . " (Encl 5, 9, 20, 39, 43)14.     15. b7c I was put in for a Navy-Marine Corps CommendationMedal (COM) as an end-of- tour (EOT) award; several of the crewbelieved tha t more deserving off icers received only Navy-MarineCor,ps Achievement Medals (NAMs). (Encl 4, 13, 16, 20, 25)16. Several male off icers have been given counseling sheets forshowing up a few minutes la te fo r assigned watches. (EncI18)17. Several off icers perceived tha t I btc I, the formerI I, was also shown preferent ia l t reatment by the CO; towit, the CO bought her gluten-free pizza and had it prepared inthe wardroom on pizza night . (Encl 12, 17, 18, 20)18. Sometimes the CO would buy food fo r the ent i re Wardroom.(Encl 8, 12)19. On one occasion, I b7c I and I h7c I accompanied theCO on l iber ty in Seychelles. These off icers f e l t they had nochoice but to accompany the CO. (Encl 39)20'. The CO created a group of second-tour division off icerstha t she has dubbed the "gatekeepers." This group i s in chargeof murder boards fo r upcoming OODs and Combat Information CenterWatch Officer (CICWOs). (Encl 5, 14, 19, 37, 39, 45)21. At the gatekeeper meetings, the CO s ta ted tha t she knewthese private meetings were driving the XO and department heads"crazy" because they did not know what was occurring. (Encl 6,14)22. The CO f requent ly tasks division off icers and Chief PettyOff icers direc t ly without going through or informing the chainof command. (Encl 6, 14, 37)23. The Captain frequently reminds the off icers tha t th is i sher ship. (Encl 24)24. I h1c I s ta ted the CO appears to have l i t t l e or noregard fo r input from senior leadership onboard the ship. Hisbe l ie f i s tha t senior leadership has perpetuated th i senvironment by not taking fu l l ownership and responsib i l i ty andrel inquishing the i r authori ty to the CO because of conf l ic t .(Encl 24)25. In teract ions between the CO and the embarked USMC and USAFsenior leadership were conducted with proper respect for rank

    and posi t ion. There was an i ssue of wardroom protocol with theUSAF off icers tha t was resolved in an appropria te manner. (Encl32, 43)26 . . PONCE has published a command philosophy, which i savai lable on the in t ranet homepage, and i s posted outside theAdmin Office. The philosophy encourages Sai lors to "Do theRight Thing." (Encl 3)Abuse of Power27. While in por t Aqaba, Jordan, I b7G - ' was assigned OOD inpor t . He received a ca l l from I bIe I asking i f he wanteq. togo on a dive t r i p with the CO, responded tha t he was on watch,but f e l t he could not say "no" to the CO so he found a re l ie fand went with her. The cost of the dive t r ip was $100. (Encl 4,18)28. The CO purchased several boxes of cigars to se l l during the"beer on the pier" event in Aqaba. (Encl 12, 17, 43, 45 )29. Some of the cigars tha t the CO purchased were CUban and shebrought them onto the ship fo r storage between sa les evehts.(Encl 45)30 : Officers f e l t they had to se l l the cigars because they wereasked by the CO. The proceeds from the sales were given back tothe. CO. There was no accountabil i ty for th i s money. (Encl 12,17)31. The CO purchased popsicles and directed the Food ServicesOfficer to place them for sale in the sh ip ' s store f reezer .Sales of these i tems were processed through a separate account.ThE! proceeds fLolli the sale went to the s h ~ p ' s dependents daycruise and were not comingled with those of the Ship's Supplydepartment accounts. The CO was not reimbursed fo r her costs .(Encl 17, 45)32. There i s no evidence of Commissary/Exchange runs fo r thebenef i t of the CO. The CO s ta ted she did not direc t sh ip ' scompany to conduct such runs. (Encl 17, 23, 41, 45 )33. The CO authorized the use of MWR funds to purchase commandcoins and beverages for dist inguished vis i tor s from the GreenBay Packers on 23 February 2011. (Encl 12, 76) .

    34. The CO purchased M&Ms to be used as an incent ive fo r ara f f l e held to defray cos ts for the Tiger Cruise. Two M&Mra f f le s have been held on the ship . The money fo r the M&Ms camefrom the CO and she was paid back from the sa le . (Encl 4, 6, 7,45)Abusive Behavior35. The f i r s t nigh t the CO was in command, she had an a l l khakimeeting in the wardroom and explained how many CO's had beenrel ieved in recen t years but t ha t "she would not go down alone."(Encl 14)36. Several off i ce rs bel ieve the morale of the sh ip ' s crew hasgrea t ly decreased s ince the CO has taken over command. (Encl 7,14, .18, 19, 41)37. Several off i ce rs and crew have s ta ted the CO i s a micromanager and "gets in the weeds" on many things. (Encl 6, 12,24, 39, 43)38. The CO "loves a ton of information." (Encl 27, 43)39.. The CO ins t i tu ted mandatory Saturday night of f ice r dinners .At some of the dinners , movies were played. At one dinner ,several off i ce rs perceived they were directed to watch the"Caine Mutiny." (Encl 4, 6, 13, 14, 17, 37)40. After the viewing of the "Caine Mutiny," several junioroff icers s ta ted they were required to climb the mast fo r a lo f tt ra in ing . (Encl 4, 6, 13, 14, 18, 37)41. The CO said I bI chelp with h is socia l sk i l l s . i s a "puddle of shi t" and needsCEncI 17)42. b7c L s ta ted the CO to ld her to "take off herglasses ," and the CO "smacked" the forehead of I hleplayful ly . The CO ca l led her a "dumb ass" fo r standing in l ineto buy an MWR tour t i cke t since she i s the sa les of f ice r .b7c did not welcome t h i s physical conduct. (Encl 17)43 . The CO s ta ted she -never cal led I hZe I a "dumbass ," but t ha t she " l ight ly touched" her on the forehead, andt ha t I blc I laughed aloud. The CO s ta ted her commentsand act ions were a l l in j e s t . (Encl 45)

    44. While I bZe L was s tanding OOD on the bridge, the COt o ld him: " In t e r ru p t me again and I wi l l take a gigan t ic s h i ton you." This was in f ron t o f sev e ra l o f f i c e r s and en l i s t edp resen t on t he b r idge and embarrassed the o f f i ce r . (Encl 4, 12,1 4 ~ 1 6 , 18, 24, 37, 41, 43, 45)45. CDR Jones has re fe rred to females as "lumpy people ." Thisterm led to th e opinion t h a t "lumpy people" go t t r ea t edd i f fe ren t ly . (Encl 12)46. The CO has s t a t ed a t meetings with Off icers and Chiefs t h a tif they disobey her o rders , t h a t she wi l l "crush" o r "des t roy"them. (Encl 4,6,17,18,25,41,43)47. The CO descr ibes ce r t a in of f ice r s as "sp ec i a l ," " i d i o t s" o r"dumb." (Encl 4, 39)48. The CO has descr ibed the l eaders on the ship as "fuckedup." (Encl 5, 6, 8, 18)49 .. The CO's ac t ions and words cause per sonne l to second guessthemselves. (Encl 5, 6, 9, 16, 25)50. The CO of ten y e l l s and bera tes subordinates over th ecommand common on th e hydra. (Encl 4, 6, 12, 14, 41)51. The CO overuses th e 1MC and hydra so much t h a t she crea tesconfus ion and th e crew of ten t u rn s it o ff o r down so as not tol i s t e n to her . (Encl 9, 12, 25)52. I b7r.., I (OPSO) formerly wrote a l l the watch b i l l s .The CO requested to review them and would change themcomplete ly , so she took over th e t ask of wri t ing the watchb i l l s .(Enel 4, 12)53. There i s a percep t ion of an unfa i r d is t r ibu t ion o f watchesamongst o f f i ce r s . The of f i ce r s th e CO does not l ike rece ive twoto three watches, while others s t and none. (Encl 4)54. Some Department Heads have the percep t ion they have noi npu t in the rankings fo r th e DIVOs/junior o f f i c e r s in t h e i rdepar tments . (Encl 4, 6)55. The CO d i r ec t ed t h a t 24 hour g r a f f i t i watches be s tood inthe heads by th e F i r s t Class Pe t t y O f f i ce rs . The doors wereremoved in some heads by order o f the XO . The crew was

When the CO i s on the bridge, she diver ts the watchstanders at tent ion from the i r dut ies to focus direct ly on her.(Enel 18)65. The CO has created safety concerns amongst the off icers andcrew. While I b7c I was standing OOD, the CO directed him toorder the Conning Officer to use a r ight 5 degree rudder whilethe sea painter was connected to the 7 meter RHIB on the por tquarter of the ship during recovery. I b7c t recommendedagainst her order fo r fear tha t it would cause the s tern of theship to swing in the direct ion of the ~ I B . I b7C I wasdirected by the CO to never disobey her orders and to follow thel a s t order given. (Encl 18)

After f ive minutes, the CO directed PONCEto make the approach with USS PEARY even though ROMEO was notclosed up. Despite th i s , CDR Jones fai led to repor t - via anymeans - the hazing event of 15 March to higher author i ty or toaccount for it in her overal l assessment of shipboard cul ture.Details of th is event were reported to her several days beforeshe t ransmitted the f ina l SITREP on the 16 March berthing"wrestling" event and before she provided a wrap up report toCommander, Amphibious Squadron FOUR. Based on my observation ofher in te l lec t and review of her correspondence, I can onlyconclude tha t she del iberately withheld th i s information as itwas a t odds with the shipboard "picture" and way ahead she hadalready se t t l ed upon and begun to socia l ize with higherauthori ty. At worst, she purposefully concealed th i sinformation; a t best , her judgment in this area i s unacceptablypoor.2. Executive Officer
