APHA is the data controller in respect of any personal data that you provide when you complete National List and Plant Breeders’ Rights Application Forms, Technical Questionnaires, Authorisation of Agent and Assignment of Rights forms. APHA will use your personal data primarily for the purposes of producing the Public Record of National Lists and Grants of Plant Breeder’s Rights in accordance with The Seeds (National Lists of Varieties) Regulations 2001 (as amended) and the Plant Breeders’ Rights Regulations 1998. Your personal data will be disclosed to the Devolved Authorities, NIAB and the British Society of Plant Breeders for the administration of DUS tests and VCU trials. 2. Applications for National Listing or Plant Breeders’ Rights for Genetically Modified

Candidates

Customers considering applying for National Listing (NL) or Plant Breeders’ Rights (PBR) of plant species which contain Genetically Modified Organisms (GMOs) should contact Fera Varieties and Seeds at the earliest opportunity for advice and certainly in advance of submitting the application.

Notes:

Roses: The minimum plant quantity requirement is eight plants.

Requesting Authorities must forward their paperwork to the test centre within 10 working days of the final deadline for applications, to allow time for planning the trial.

The deadlines apply to vegetatively propagated varieties except where specifically indicated, and assume all material to be container grown.

Different dates will apply to varieties flowering over winter or in very early spring. Please ask for further information.

No plant material should be sent until specifically requested. Submission periods may be varied slightly from year to year to take account of National Holidays etc., and applicants should read any instructions they receive with care.

Plant breeders who are intending to make applications and/or submit seed for Plant Breeders’ Rights and/or National List tests and trials in the 2016 season in respect of the following species are asked to arrange for these to be sent to the address below so as to arrive no later than the dates given. Please note that if the closing date falls at a weekend or on a Bank Holiday, applications/seed must be received by the next working day. Applications and/or seed/plant material received after these dates cannot be considered for tests and trials in the 2016 season.

BSPB will request seed for VCU trials. Wheat, barley, oats and field bean seed for DUS plots will normally be requested by APHA.

However, please note that seed for VCU authentication and all winter oilseed rape samples should still be sent to the Seed Handling Unit at NIAB, Whitehouse Lane, Huntingdon Road, Cambridge, CB3 OLE.

National List and Plant Breeders’ Rights application forms, Technical Questionnaires and Technical Questionnaire confidential part (which is optional) and species specific appendices to the Technical Questionnaire can be downloaded from the Forms catalogue on the GOV Website. Electronic submission is now possible.

Plant Breeders' Rights The Plant Varieties Act 1997

Section I - Applications for Plant Breeders' Rights Section IV - Proposed Grant or Refusal of Applications Section VI - Proposed Surrender or Termination of Grants and Declaring Rights Null and Void

Written representations and/or requests to be heard by the Controller or by a person appointed by him for that purpose may be made regarding proposals made in Section IV & VI above. Only written representations may be made regarding applications under Section I.

For Sections I & IV, representations may be made by the applicant, any person who has a substantial interest in an application which is the subject of one of these proposals or who is in a position to provide evidence which is likely to be material to its consideration. For proposals under Section VI, representations may be made by the holder of rights, any person who is the holder of a licence to exercise any Plant Breeders’ Rights in the plant varieties in question and any persons whose financial interests are likely to be affected by the decision.

The representations and/or requests to be heard must be sent to the Controller by 18 October 2016. Written representations should be accompanied by a fee of £30.00 (Cheques should be made payable to APHA). If a hearing is granted then a fee of £65.00 is payable before it is held.

Any representations received will be circulated by the Controller to all interested parties and a period of 21 days allowed for subsequent representations to be made. The Controller shall then be entitled to make a decision after he has received any further representations but may, if he considers it desirable, allow further representations.

If a hearing is to be held then at least 14 days notice will be given to all parties. Any supporting documents relating to the hearing must be made available to the Controller at least 7 days before the hearing. Written representations and or requests to be heard should be forwarded to the Controller at the following address:

NATIONAL LISTS

Section IV - Proposed Additions and Refusals Section VI - Proposed Deletions Any person who would be affected by a proposed decision in Section IV & VI above may make representations to the National Authorities in writing, or be heard by a person appointed by National Authorities for the purpose, or if they wish, make both written representations and be heard. The representations and/or request to be heard must be received by the National Authorities not later than 18 October 2016 if they relate to proposed additions and refusals and not later than 31 December 2016 where they relate to proposed deletions. Written representations should be accompanied by a fee of £30.00. (Cheques should be made payable to APHA). If attendance at a hearing is granted then a fee of £60.00 is payable before it is held.

Persons affected means as the case may be: a) The person who has made the application for the addition of a plant variety to a National List, the

application for the renewal of the period during which a plant variety may remain in a National List or the application to be indicated in a National List as a maintainer of a plant variety;

b) Any person appearing to the National Authorities to have sufficient interest in the matter to which the proposed decision relates;

c) Any person or organisation appearing to the National Authorities to be representative of a class of persons likely to be affected by the decision.

Proposed Names Any person who wishes to object to either the approval of a proposed name or the approval of a proposed change of name on the grounds that it is unsuitable on one or more of the grounds set out in Regulation 3 of The Plant Breeders' Rights (Naming and Fees) Regulations 2006 or in Regulation 6(2) of The Seeds (National List of Varieties) Regulations 2001(as amended) may make written representations. These must set out in full the reasons for the objection and must be delivered not later than 31 December 20l6. They should be accompanied by a fee of £30.00 and addressed to the Controller (for Plant Breeders’ Rights) or the Secretary of State for Environment (for National Listing) at the above address.
