At a recent TXSHRM meeting, we heard from ROB SHALLENBERGER, CEO of “Becoming Your Best.” Rob was passionate about us becoming our best. He came into the Dallas Cowboy Association and they were not functioning as well as they should have been. Jerry Jones Jr. stated, “the “Becoming Your Best” seminar was extremely effective for our group.” I had the pleasure of spending 2.5 hours with Rob, I was inspired! He tells the story of him being at a football game and there was a flyover of jets. He pointed to the sky and said I am going to do that. Guess what, he did. He and his brother did a flyover together at a football game. When he saw the jets flyover the first time, he became laser focused on his life’s ambition. I was so inspired that I bought my boss and my coworker the book and the planner as well. If you sign up for the email, you can take a personal productivity assessment. The TXSHRM group took the assessment and ranked in the top, we were somewhat proud. To do what we do every day we have to be planners and organizers. Of course, there are those days that NOTHING gets done, except the fire that has presented itself. If you have written out your plan for the week, you can go back and revisit your plan, so you don’t lose track. Have you written down your personal vision for yourself, your family, or your career? It is powerful to put in writing. I encourage you to go to the website and read about becoming your best. First, I want to thank you for allowing me this opportunity to serve as President of PHRA for 2018. Due to circumstances beyond our control, I will be president for 2019 as well. At least I know what to expect! Edie Harvey will be the President Elect for 2019 and President for 2020.

At a recent TXSHRM meeting, we heard from ROB SHALLENBERGER, CEO of “Becoming Your Best.” Rob was passionate about us becoming our best. WT SHRM/HR Students Currently Seeking Internships or Employment

Presented by Brad Howard “Conducting Proper Investigations and Pitfalls of Improper Investigations” Conducting proper workplace investigations is one of the most challenging duties that HR professionals must undertake because complaints of employee misconduct are usually generated and investigated in the HR department. Prompt and effective investigation strategies are very important skills for HR professionals to have in the workplace and are a key component to limiting liability, which can create defenses for the employer in future cases. Therefore, this energetic presentation will cover the best practices involving the scope of the investigation; HR’s role in the investigation; investigative reporting; and pitfalls of improper investigation. It is an interactive tutorial that provides HR professionals with resources on the proper, and improper, way to conduct investigations. This session will give participants the knowledge and tools needed to conduct a proper HR workplace investigation and adequately informs participants of all the pitfalls to be avoided in improper investigations.

December Meeting Details

I am Shawrlette Uy, a Management student from West Texas A&M University. Through the

College of Business, I have learned how to effectively manage employees in a business

setting leading me to my interest in Training and Development and Human Resources.

Though my main interest lies in Training and Development, I am open to intern, train and

work in the Human Resources department where my educational skills and background in

Critical Issues in Human Resource Management, Recruitment and Selection, and Leadership

and Teamwork would be beneficial. A set of skill sets I can utilize, but are not limited to, are

communication and interpersonal skills, problem-solving, adaptability, attention to detail,

and proficient use of Microsoft Office Excel as a certified specialist. Likewise, I am exploring

the SHRM-CP certification that WTAMU invests for its students, which I believe would be

beneficial for your company, as well as to myself by gaining an advantageous work

experience with an internship. I have an updated resume that I will be more than glad to

provide upon request.

On November 6, 2018, the United States Supreme Court issued an opinion holding that all state and

local governments are covered employers under the Age Discrimination in Employment Act (“ADEA”),

regardless of size. Mount Lemmon Fire Dist. v. Guido, ___ U.S. ____, 2018 WL 5794639, at *5 (Nov. 6,

2018). In doing so, the Supreme Court overruled several Circuit Court opinions, dating back to the

1980s, finding that the ADEA applied to only those state and local governments with twenty or more

employees.

Two former employees of an Arizona fire district filed age discrimination claims against their former

employer, a small public employer, after they were laid off. In the lawsuit, the two oldest employees of

the Fire District claimed their terminations violated the ADEA. In response, the Fire District claimed it

was not subject to the ADEA because it was too small to meet the ADEA’s definition of “employer,”

which generally requires employment of twenty or more people.

However, on appeal, the Supreme Court considered the plain language of the ADEA’s definition of

“employer” and, specifically, the fact that Congress failed to include the “twenty or more employee”

requirement immediately before the section addressing state and local governments. Reading the

definition in such a plain way, the Supreme Court found that the ADEA applies to all state and political

subdivisions, regardless of the number of employees.

Prior to the Supreme Court’s opinion, several federal circuit courts, including the Sixth, Seventh, Eighth

and Tenth Circuits, held that the ADEA did not apply to governments with fewer than twenty

employees. Now, all state and local governments will be required to comply with the ADEA.

This new opinion will obviously have the largest impact on small state and local governments that, until

now, were treated as exempt from the ADEA’s requirements. Prior to Guido, employers, courts, and

governmental agencies alike operated under the assumption that the ADEA applied only to those

employers with twenty or more employees, regardless of whether the employer was a private entity or

public employer.

Now, only private employers with fewer than twenty employees are exempt from the ADEA. In

practice, this means public employers with less than twenty employees must ensure that they are in

full compliance with the ADEA.

ADEA Now Applies to All Governmental Entities, Regardless of Size
