1. On August 29, 2012, a complaint alleging violations of 42 U.S.C. section 1983 and
negligence was filed in the Superior Court of the State of California, Kings County, entitled
Phillip Spector v. California Department of Corrections, et al., Case No. 12C0261 (the
complaint), a copy of which is attached as Exhibit 1.
2. On September 5, 2012, the Office of the Attorney General accepted service of the
complaint for Defendant Kumar.
3. This is a civil action which this Court has original jurisdiction under 28 U.S.C. § 1331,
and may be removed under 28 U.S.C. § 1441 (b) in that it arises under 42 U.S.C. § 1983.
