I now take the 8265 (Page Hea th Lane, Holmsdale Road) to Bromley Common (kU) and then follow Hayes Lane to West WICkham where I work for a subsidiary of AXA. For historical reasons - country house estates like Sundridge Park. and the paucity of bridges for traffic to pass under railway lines - it has always been difficult f or residents east of Bromley to venture south west: to the West Wickham area.     Re: E'"tion of Gates at 5t Georges Road, Bickley

    I write further to my letter of Novembef 2008, a copy of which is attached to protest against the dosure of the gales outsicIe $t Georges Church and I understand the planned dosure of the gates al the junction of Pines Road and Woodlands Road. I have also heard it rumoured thaI keypads are shortly to be installed at the gales outside 5t Georges Road denying access to all those who do not have knowtedge of the code . Myunderstanding is that these roads are unadopled public highways over which the general public have rights of way.

    I have IrYed in the area for the past 24 years (although only at my current address for the last 4) and have used these roads on many occasions over the last 24 years . without obJf3C1ion.

    I would appreciale your assurance thai the local authority is doing everything possible 10slop the inappropriate erectiorl and closure of these gates and to ensure that these roads remain open for all to use.

    part of the BickJey Park Estale. During this period I so drove on average at least 3 times a week (term timeonly).

    5 During the period 1996-2007, I drove on a frequent but ad-hoc basis through

    various roads forming part of the Bickley Park Estate .

    6 Since February 2007 to the present day. I have used Woodlands Road and 51

    Georges Road on a dai ly basis (teRn time only) to take my daughter to school in Blackb rook lane.

    7. Prior 10 the erection of the electronic gates nowsited a t 51 Georges Road , my

    use of the roads at Bickley Park Esta te as above, has been unch allenged and uninterrup ted .

    I have Jived in Eastmead Close for more than 30 years. When the house was purchased, the road was included in the sale andhas been adopl:ed and lTainlained by the London Borougb since thaltime. By COlltIUl, Woodlands Road is an 'unadapted highway' (nola privatc road as indicated on the signagc) and the public have a right 10 ICCe$S without rC5trictioR. Surely. what they arc trying to achieve is illegal. There arc also f... too IDoIny tplintet groups and something as seric:xu as this should beundet one umbrclla with greatet representation from Bromley CowKil.

    II would be disastrous 10 have electronic gates et the Pines Road end of Woodlands Road. The residents of Pines Road are far more tolerant as they cndure parking during the week from commuters using the nearby Bickley Station as well as a school bus picking up children going to school. In spite of'a NO ENTRY sign at !he Bickley Park Road end, motorisu ignore this sign quite often. There is already so much activity in this arca that the installation of electronic gates would bedangerous and hazardous

    I ern writ ing to you on ~h al f of th e Engleficld Residents' Association (ERA) In Woodlands R~ in Bid:ley ward to ask for your asststance regarding recent road developments, which have taken place In our immediate surroundings.

The residents at Englefield have received severill unsolicit ed mailings from iI smili lgroup of Bickley residents Informing usof development s, wh ich bave taken place, restricting ilCCesS to the read on which we live. We now face a set of sate s, whic h i1U: kept closed on St Georges Road, by 5t Georges Church. Only as a vehicle Is within a very short distance of these gates «1 m) do the gales open. Additionally road markings have been painted onto the road surf ace at the approaches to one of the ent rances onto Woodlands Road at Its Junctio n with Pines Road. At present road marking s at this southern entry/exit state : ' No entry' on one side ilnd 'No exit ' on the other, yet local road users are used to select ively using two entry/ exit pointsonto Pines Road.

    None of those In atten dance at a recent Directors Meet ing of the ERA w as in favour of these changes. The Directo rs of ERA would welcome your adviCeon what can be done about the act ions of those operat ing the Woodlands Road Maintenance Fund· or the BPl referred to in recent mail ings to Englefield and we assume other Woodlands Road residents.

    M y understand ing upon mgving back to live in Woodlands Road allain In 2006, net th e -Estate-· l had lived in the road from the t ime of my birth in 1958 unti l 1982- was that I was becoming a resident on an unadopted road, but st ill pay Cguncil tax to the l B Bromley fer its Environmental servic es. I am therefore writ ing this letter firs tl y to Councillor Colin Smith, since th e council website cites you are Portfolio Holder for Environment and one of our councillors for the Bickley ward.

    For many years I visited Mike and Sytvia Burberl)' (now deceased) who lived in the house (now demolished and rebuilt) on the comer of Hawthorne Road and 51Georges Road. My (now) wife joined me for d inner and evenings of bridge. we were maffied in 1981 in Chislehuf$1 Methodist church and the house was my base before the service. weat first lived in my Wimbledon flat and then a Croydon townhouse before seeking a 4 bedroomed deta ched house in the london Borough of Bromley (circa 1982)

    Our search led us to a house in Sutherland Avenue, Bigg in HiD which is situated on an unadopted road. The dinner conversation involved the implications of iv ing on an unadoptecl highway. Hawthorne Road had previously been made up and SI Georges Road remained unadapled. We were informed of the road charges incurred in the making up of Hawthorne Road . The couple loki us that, although the ir address was Hawthorne Road, they would be liable for road charges if St Georges Road were to become adopted. II was quite clear that they regarded SI Georges Road as unadcpted public highway.

    No mention was ever made that 5t Georges Road could be private. My wife and I lived in a private road (Tipton Drive ) in Croydon. By this time we were quite familiar with various categOlies of highway and the management company arrangements in a private road. It was clear that no such arrangements existed in St Georges Road.

Although I never had any specific discussions about its status. I certa inly regarded it as a publ ic highway . The road sign in Pines Road indicates a no through road to Bickley Point and a through road 10the left . I have also attended weddings at the church on the comer of SI Georges Raad and Bickley Park Road and parked with other guests in SI Georges Road .

    I. I. Jon Channen was first employed by Bromley Council in 1983 as a planning and litigation solicitor. I was subsequently appointed to head up the child care and social services section of the legal division .

    2. In 1990 I left to work for a small planning firm in the west end of Landon and at the same time I moved my home from Walthamstow to a propertynear the centre of Bromley about a mile away from Bickley.

    3. I returned to work for BromleyCouncil in 1991 from which date I have primarily concentrated on contractual matters on behalfof the Council although I have, on occasions, also dealt with a variety of other matters including disputes over the status of highways.

    4. Over the years I have become aware ofa number of roads within the Borough where residents have or had erected notices or taken other step s to dissuade the pub lic from using the roads.

    5. In the case ofSt George's Road I have since I firstcame to Bromley always understood this to be a public highway. During my initial two years at the Council I tended to view sites as part of my planningwork by travellingwith planning or other officers but from )985 1acquired my own vehicle and was able to travel more freely around the area. I do not recall seeing any signs or gates at Woodlands Road or St George's Road until about 2006.

    6. I used to travel southwards down Pines Road, then east along Woodlands Rd and thence south along St George's Road to its junction with Bickley Park Road. My daughter attended Bullers Wood School during the period 2001- 2008 and this was a useful rat run to avoid the congestion at the mini roundabout at the junction of ChisIehurst Road and Widmore Road. Until 2006 there were no signs or gates along the route.

    7. In late 2006 a "Private Road" notice and some whitegates appeared at the junction of Woodlands Road and Pines Road

  • / and at the junction of St George' s Road and Bickley Park Road. I reported this fact to the Highways section of the Council. However the gates remainedopen and I continued to use the road on a daily basis and no one ever stopped me. .

    8. Then at some date after my daughter had stopped attending school l had cause to trav el down the road and found the gates at the junction of St George's Road and Bickley Park Road had been closed and some sort of camera insta lled. When I dro ve up to the gates they (very) slowly opened although it certainly inhibited my progress along the road. I do not know if the gates would have opened if! had sought to travel northwards along St George's Road.

    9. I am aware that the junction between Pines Road and Bickley Park Road was made one way many years ago as a result of a traffic order made by the GLC. The order prevents traffic exiting southwards from Pines Road. However there is no "dead end" sign at the northern entrance to Pines Road which indicated to me that all parties expec ted southbound traffic to be able to leave Pines Road along Woodlands Road and exit

    onto Bickley Park Road . 10. I have no doubt that ,like me. many motori sts have used

    these roads as a rat run 1to avoid tra ffic congestion and the action of installing gates will have materially contributed to the congestion elsewhere on the Borough's road network.

    11. I also do not like the idea o f being watched on ccrvcameras without knowing who is monitoring my movements.

    I would have thought that the publiC would have acquired the right of way for veh icles by nowSImply by the passageof more than 40 odd years.

    I don"t know whether LB8 has been asked for PlaMing Permission for such a gate (it that's what it is) but if so, I would like to express the hope that Planning Permission is denied.
