IntroductionWe are very pleased to introduce Youto the Allianz Pet Insurance Policyand thank You for insuring with Us.

Please read this policy carefully toensure that it provides the cover Yourequire. If the Schedule details donot agree with the details You havecompleted on Your Proposal Formthen please return it immediatelywith a note of the changes thatshould be made.

Please advise Us immediately of any change which may affect the cover provided – for example using Your Pet for business purposes.

Please note that You are only eligiblefor this insurance if You areordinarily resident in the Republic ofIreland.

This Policy (which includes and shallbe read as one document with theSchedule, Endorsements, ProposalForm and Declaration), evidences acontract of insurance between theInsured and Allianz.

We will, subject to the terms,conditions, limitations andexclusions of this Policy, indemnifyYou against loss, damage or legalliability which occurs during anyPeriod of Insurance for which Youhave paid or agree to pay thepremium.

The Law Applicable to the ContractThis policy shall be governed by and construed in accordance with the laws ofIreland and will be subject to the jurisdiction of the Irish courts.

Insurance Act 1936 (or future amendments thereto)All monies which become or may become payable by the Company under thisPolicy shall in accordance with Section 93 of the Insurance Act 1936 bepayable and paid in the Republic of Ireland.

Finance Act 1990 (or future amendments thereto)The appropriate stamp duty has been or shall be paid in accordance with theprovisions of Section 113 of the Finance Act 1990.

DefinitionsAny word or expression which isgiven a specific meaning in thisPolicy, will have the same meaningwherever it appears.

The Insured/You/YourThe person(s) named on theSchedule under the title Insured.

Policy YearThe time during which We give coveras set out in the Schedule. This isnormally 12 months but may be lessif the pet(s) has been added to Yourinsurance during the 12 month period.

Clinical SignsChanges in the pet’s normal healthystate, its bodily functions orbehaviour.

IllnessSickness, disease and/or anychanges to the pet’s normal healthystate, including mental andemotional disorders.

TreatmentAny examination, consultation,advice, tests, x-rays, medication,surgery, nursing and care, which isrequired to treat an Illness or Injuryand is provided by a veterinarypractice, a certified Clinical AnimalBehaviourist or a member of one ofthe following organisationsfollowing a vet’s instruction:

• The Association of Pet BehaviourCounsellors

• The Canine and Feline BehaviourAssociation

• The Association of CharteredPhysiotherapists in AnimalTherapy

• The National Association ofVeterinary Physiotherapists

• The International Association ofAnimal Therapists

• The Canine HydrotherapyAssociation

or equivalent accrediting bodies inIreland, subject to review andapproval by Allianz.

Market ValueThe price generally paid for ananimal of the same age, breed,pedigree, sex and breeding ability atthe time You got Your Pet.

Clinical HistoryA chronological record (computerprintout or photocopy) of theoriginal clinical notes as made bythe vet at the time of allconsultations.

ExcessThe amount payable by You for eachIllness or Injury that is treatedduring the Policy Year that is notrelated to any other Illness or Injurytreated during the same Policy Year.This also means that when theTreatment dates of an Illness orInjury fall into two or more PolicyYears You pay an Excess for eachPolicy Year. You may also pay apercentage amount on each andevery Veterinary Fees claimdepending on the age of Your Pet.This percentage is shown on YourSchedule if it applies.

InjuryA physical Injury or trauma causedimmediately by an accident. Not anyInjury that happens over a period oftime and not contributed to, in anyway, by a previous disease process inthe body.

General Conditions1. Throughout the Policy Year You must take care of Your Pet, arrange and

pay for Your Pet to have a yearly health check and dental examination andany Treatment normally recommended by a vet to prevent Illness orInjury. Failure to do so may affect payment of claims. Such Treatmentsmay include neutering, descaling of teeth, worming, flea and tickTreatments, blood tests and screening, nail clipping, dewclaw removal,grooming, routine emptying of anal glands, removal of anal glands anduse of pheromones and prescription diets.

2. You must arrange for Your Pet to be kept vaccinated against the following:Dogs: Distemper, hepatitis, leptospirosis, parvovirus and kennel cough.Cats: Feline infectious enteritis, feline leukaemia and cat flu.If You do not keep Your Pet vaccinated, We will not pay any claims thatresult from any Illness it must be vaccinated against.

3. If, when You claim, there is any other insurance under which You areentitled to payment, We will only pay Our share of the claim.

4. If You have any legal rights against another person in relation to Yourclaim, We may take action against them in Your name at Our expense. Youmust give Us all the help You can and provide any documents We ask for.

5. If any claim under this Policy is in any respect fraudulent, or if anyfraudulent means or devices (including inflation or exaggeration of theclaim, or submission of forged or falsified documents) are used by You oranyone acting on Your behalf to obtain any benefit under this Policy, allbenefit is forfeit.

6. You agree that any vet has Your permission to release any information Weask for about Your Pet. If the vet makes a charge for this, You must pay thecharge.

7. When We offer further periods of insurance, We may change the premiumand conditions, and add exclusions because of Your Pet’s history.

8. We will not guarantee on the phone if We cover a claim. You must send Usa claim form that has been properly filled in. We will then contact Youwith Our decision.

9. If You make an alteration to Your Policy We will re-calculate Your premiumwhich may result in an additional premium due to Us, or a premium dueto You. If the alteration to the policy results in an additional premium dueto Us, or a refund due to You, We will only charge or refund such premiumprovided this amount is greater than or equal to €25 plus applicableGovernment Levy.

10. If We receive a request to pay the claim payment directly to a veterinarypractice, We reserve the right to decline this request.

11. If the Veterinary Fees You are charged are higher than the fees usuallycharged by a general or referral practice, We reserve the right to requestan independent opinion from a vet that We choose. If the vet We choosedoes not agree with the Veterinary Fees charged We may decide to payonly the Veterinary Fees usually charged by a general or referral practice.

12. If We consider that the veterinary Treatment Your Pet receives may not berequired, or may be excessive when compared with the Treatment that isnormally recommended to treat the same Illness or Injury by general orreferral practices, We reserve the right to request an independent opinionfrom a vet that We choose. If the vet that We choose does not agree withthe veterinary Treatment provided, We may decide to pay only the cost ofthe veterinary Treatment that was necessary to treat the Injury or Illness,as advised by the vet from whom We have requested the independentopinion.

13. This Policy will be voidable in the event of misrepresentation,misdescription or non-disclosure of any material facts i.e. thosecircumstances which may influence Us in our acceptance andassessment of this insurance. If You are in any doubt as to whether a factis material or not please disclose it. This condition applies at inception ofYour Policy, when a section is being added to Your Policy and at renewaleach year.

14. You may cancel the Policy at any time by written notice. If there has beenno claim during the current Period of Insurance We will return premiumfor the un-expired Period of Insurance. We may also cancel the Policy atany time by sending notice by registered letter to You at Your last knownaddress. The notice is effective from midnight on the seventh dayimmediately following the date of the registered letter. We will return aproportionate part of the premium provided there is no claim during thecurrent period of insurance.

15. All differences arising out of this Policy shall be referred to an Arbitratoror if necessary to two Arbitrators, one to be appointed by each of theparties within one month after having been requested. The Arbitratorsshall appoint an Umpire who shall sit with the Arbitrators and in the caseof disagreement the Arbitrators shall submit to the decision of theUmpire. The making of an award shall be a condition precedent to anyright of action against Us. Differences not referred to arbitration within 12calendar months from the date on which the difference occurred will bedeemed to have been abandoned. NOTE: This condition does not affect

your right to refer any claim or query to the Financial ServicesOmbudsman's Bureau, details of which are included at the end of thisPolicy under "Consumer Information".

16. The observance by You of the terms, conditions and endorsements of thisPolicy as far as they relate to anything to be done or complied with by You will be a condition precedent to any liability of the Company.

The CoverIn return for the correct premium, We will provide cover as described in the following sections ifthey are shown on Your Schedule.

Section 1: Vet FeesThis section applies in the Republic of Ireland, and for not more than 30 days in any period ofinsurance for temporary visits to the UK, the Isle of Man and the Channel Islands as long as thepurpose of the travel is not to seek veterinary treatment.

What We will not pay

1. More than the MaximumAmount Payable.

2. The cost of any Treatment for:• an Injury that happened or

an Illness that first showedClinical Signs before YourPet's cover started; or,

• an Injury or Illness that is thesame as, or has the samediagnosis or Clinical Signs asan Injury, Illness or ClinicalSign Your Pet had before itscover started; or,

• an Injury or Illness that iscaused by, relates to orresults from an Injury, Illnessor Clinical Sign Your Pet hadbefore its cover started,

no matter where, in or on Your Pet’s body, the Injury happenedor the Illness or Clinical Signs were noticed.

3. The cost of any Treatment for:• an Illness that first showed

Clinical Signs within 14 daysof Your Pet's cover starting;or,

• an Illness which is the sameas, or has the same diagnosisor Clinical Signs as an Illnessthat first showed ClinicalSigns within 14 days of YourPet's cover starting; or,

What We will pay

The cost of any Treatment Yourpet has received during thePolicy Year for an Illness orInjury.

The Maximum Amount Payableunder this section is displayedon Your Schedule.

What You pay

For each Illness or Injury that istreated during the Policy Yearand is not related to any otherIllness or Injury treated duringthe same Policy Year, You mustpay the Excess as shown on YourSchedule.

• an Illness that is caused by,relates to, or results from aClinical Sign that was firstnoticed within 14 days ofYour Pet's cover starting,

no matter where, in or on Your Pet's body, the Clinical Signs were noticed.

4. The cost of any Treatment a vetnormally recommends toprevent Injury or Illness.

5. The cost of any Treatment,including cosmetic dentistry,that You choose to have carriedout that is not directly relatedto an Injury or Illness.

6. The cost of killing andcontrolling fleas, generalhealth improvers and anyTreatment in connection withpregnancy, lactation or givingbirth.

7. The cost of food, including foodprescribed by a vet, exceptwhere it is used to dissolvebladder stones and crystals inurine (and then only for aperiod of 3 months after thecondition has been diagnosed).

8. The cost of vaccinations,spaying and castration exceptthe cost of treating anycomplications arising fromthese procedures.

9. The cost of treating any Injury orIllness deliberately caused byYou or anyone living with You.

10. The cost of having Your Pet putto sleep, disposed of, crematedor the cost of a post mortem.

11. The cost of house calls unlessthe vet confirms that movingYour Pet would damage itshealth, regardless of Yourpersonal circumstances.

12. Extra costs for treating Yourpet outside usual surgeryhours, unless the vet believesan emergency consultation isnecessary.

13. Costs resulting from an Injuryor Illness specified as excludedon Your Schedule or generallynot covered within these termsand conditions.

14. Any costs for treating an Illnessor Injury after the last day ofthe Policy Year.

15. The cost of dental Treatmentunless Your Pet’s annual dentalchecks are up to date. A vetmust have checked Your pet’steeth within 12 months priorto the onset date of a claim. Ifany Treatment wasrecommended as a result ofthis annual check–up thismust be carried out at Yourexpense.

16. The cost of hospitalisation andany associated veterinaryTreatment, unless the vetconfirms it is essential to therecovery of Your Pet.

17. The cost of transporting Yourpet to and from a veterinarypractice. We will, however,cover any care administered bya vet or a veterinary nurse(under vet’s instructions)during transport.

18. Pre-anaesthetic bloodscreening and intra-operativefluids for short procedures(under 40 minutes) in healthyanimals under 5 years of age.We will, however, cover thecost of placing an intra-venouscatheter in all anaesthetisedpets.

19. The cost of training aids, forexample muzzles, leads,clickers etc. We will, however,provide cover towards trainingaids when recommended byan approved AnimalBehaviourist and used as partof a behaviour modificationprogramme. The MaximumAmount Payable towardstraining aids is displayed onYour Schedule.

20. The cost of pheremones,except where they are used bya vet in an effort to treat ordiagnose an acute behaviouralcondition (and then only for amaximum of one month). Wewill also cover the cost ofpheremones whenrecommended by an approvedAnimal Behaviourist as part ofa behaviour modificationprogramme, (and then only fora maximum of 3 months).

How to claimBefore Your Pet is treated, You must make sure that the vet is prepared to complete theTreatment section of Our claim form and provide detailed invoices supported by detailed clinicalrecords.You must fill in all policyholder sections of the claim form and ask Your vet to fill in theTreatment section. We will not pay for the supply of this information.Please note that if the claim form is not fully completed it will be returned.For a claim form for Veterinary Fees, please phone our Claims Team on 1890 48 48 48.Alternatively, Your vet may have a supply of Veterinary Fees’ claim forms.Please send Us:• The claim form fully completed.• The invoices setting out the costs involved.In the case of claims for referral vets please ensure that Allianz has received a claim form and areferral letter from the original treating vet.If the claim is for Treatment in Great Britain, the Isle of Man and the Channel Islands please sendUs also the booking invoice for Your journey or any other official documents to show the dates ofYour journey.

When to claim• For life-long illnesses that require ongoing Treatment e.g. diabetes, arthritis, heart diseases

etc., You should submit Your claim form at the end of the Policy Year. • In all other cases You are required to submit Your claim form at the end of Treatment or the

end of the Policy Year if the Treatment has not finished by this time.

What We will pay

The cost of advertising if Your petis stolen or goes missing duringthe Policy Year.The reward You have offered forthe recovery of Your Pet if it isstolen or goes missing during thePolicy Year. This must first beagreed with Allianz.

The Maximum Amount Payableunder this section is displayedon Your Schedule.

What We will not pay

1. More than the MaximumAmount Payable.

2. Any reward that We have notagreed to before You advertisedit.

3. Any reward not supported by asigned receipt giving the fullname and address of theperson who found Your Pet.

4. Any reward paid to any personliving with You or employed byYou.

Section 3: Boarding Kenneland Cattery FeesThis section applies in the Republic of Ireland only.

What We will pay

The following costs for theduration of Your hospital stay:1. The cost of boarding Your Pet

at a kennel or cattery; or2. A daily rate towards the cost

of someone looking after YourPet but only where this persondoes not live with You. Theamount of this daily rate isdisplayed on Your Schedule.

The Maximum Amount Payableunder this section is displayedon Your Schedule.

What We will not pay

1. More than the MaximumAmount Payable.

2. Any amount if You are inhospital for less than 4 days.

3. Any costs resulting from Youhaving to go into a hospitalbecause of an Injury or Illnessfirst occurring or showingsymptoms before Your Pet wascovered.

4. Any costs resulting from Youbeing pregnant, giving birth orany Treatment that is notrelated to an Injury or Illness.

5. Any costs resulting from Yougoing into a hospital for theTreatment for alcoholism,drug abuse, drug addiction,attempted suicide or selfinflicted injuries.

6. Any costs resulting fromnursing home care or fromconvalescence care that Youdo not receive in a hospital.

How to claimFor a claim form for boarding kennel and cattery fees, please phone Our Claims Team on 1890 48 48 48.Please send Us:

• A Claim form filled in by Your doctor or consultant and by the owner of the boarding kennel or cattery.

• An invoice from the kennel or cattery or written confirmation from the person looking after Your Pet.

We will not pay for the supply of this information.

Section 4: Theft and StrayingThis section applies in the Republic of Ireland only.

What We will pay

The price You paid for Your Pet ifit is stolen or goes missingduring the Policy Year and is notrecovered or does not return. IfYou did not pay for Your Pet orhave no formal proof of howmuch You paid, We will pay theMarket value of Your Pet.

The Maximum Amount Payableunder this section is displayedon Your Schedule.

What We will not pay

1. More than the MaximumAmount Payable.

2. Any amount if You or the person looking after Your Pet has freely parted with it, even if tricked into doing so, unless someone was looking after or transporting Your Pet in return for money, goods or services.

Special condition that applies to this sectionIf Your Pet is found or returns, You must repay the full amount We have paid You.As soon as You discover Your Pet is missing, You must:

• Tell the Gardaí and ask for the crime reference number or written confirmation of Your report.

• Tell all vets within a reasonable distance of the area where Your Pet was last seen. • Fill in a claim form if Your Pet has not been found within 30 days.

Note:Your attention is drawn to Section 2 of this Policy where We cover advertising costs etc.

Section 5: Death from InjuryThis section applies in the Republic of Ireland only.

What We will pay

The price You paid for Your Pet ifit dies or has to be put to sleep bya vet during the Policy Year as aresult of an Injury caused by anaccident. If You did not pay forYour Pet or have no formal proofof how much You paid, We willpay the Market Value of Your Pet.

The Maximum Amount Payableunder this section is displayedon Your Schedule.

What We will not pay

1. More than the MaximumAmount Payable.

2. Any amount if the deathresults from an Injury thathappened before Your Pet’scover started.

3. Any amount if the deathresults from an Injury orIllness specified as excludedon Your Schedule or generallynot covered within the termsand conditions of this Policy.

4. Any amount unless, a vet hasput Your Pet to sleep as a resultof an Injury that cannot betreated and believes it was nothumane to keep Your Pet alivebecause it was suffering.

How to claimFor a claim form for accidental death, please phone Our Claims Team on 1890 48 48 48.Please send Us:

• A death certificate from Your vet.• The pedigree certificate and a receipt showing the amount You paid for Your Pet.• Your claim forms fully completed.

We will not pay for the supply of this information.

Section 6: Death from IllnessThis section applies in the Republic of Ireland only.

What We will pay

The price You paid for Your Pet ifit dies or has to be put to sleep bya vet during the Policy Year as aresult of an Illness. If You did notpay for Your Pet or have noformal proof of how much Youpaid, We will pay the MarketValue.

The Maximum Amount Payableunder this section is displayedon Your Schedule.

What We will not pay

1. More than the MaximumAmount Payable.

2. Any amount if the deathresults from Injury or Illnessfirst occurring or showingClinical Signs before Your Pet’scover started.

3. Any amount if the deathresults from an Illness firstoccurring or showing clinicalSigns within 14 days of YourPet’s cover starting.

4. Any amount if the deathresults from an Illness which isthe same as an Illness in anypart of Your Pet’s body that firstshowed Clinical Signs before orwithin 14 days of Your Pet’scover starting.

5. Any amount if the deathresults from an Illness ordisease in any select breedaged 5 years or over or anyother pet aged 8 years or over.

6. Any amount if the deathresults from an Injury orIllness specified as excludedon Your Schedule or generallynot covered within the termsand conditions of this Policy.

7. Any amount unless a vet hasput Your Pet to sleep becauseof an incurable Illness andbelieves it was not humane tokeep Your Pet alive because itwas suffering.

1. Any travel andaccommodation expenses Youcannot recover if You have tocancel Your holiday during thePolicy Year because Your Pet isinjured or shows the firstClinical Signs of an Illness upto 7 days before You leave andrequires immediate life-savingsurgery.

2. If Your Pet is staying in theRepublic of Ireland during Yourholiday, any travel andaccommodation expenses Youcannot recover if You have tocut short Your holiday duringthe Policy Year because YourPet:- goes missing; or - is injured or shows the first

Clinical Signs of an Illnesswhile You are away andrequires immediate life-saving surgery.

What We will not pay

1. More than the MaximumAmount Payable.

2. Any costs relating to a holidayYou booked less than 28 daysbefore You were due to leave.

3. Any costs resulting from anInjury or Illness We havespecified as excluded on YourSchedule or generally notcovered by the terms andconditions of this Policy.

4. Any costs resulting from anIllness first showing ClinicalSigns before Your Pets coverstarted.

5. Any costs resulting from anIllness first showing ClinicalSigns before or within 14 daysof Your Pets cover starting.

How to claimFor a claim form for holiday cancellation, please phone Our Claims Team on 1890 48 48 48.Please send Us:• A claim form which You and Your vet have filled in; and the booking

invoice and cancellation invoice from the travel agent, tour operator or other holiday sales organisation.

• The invoices must show the date of the booking, the dates of the holiday,the total cost of the holiday, the date You decided to cancel or return home and any expenses You cannot recover.

We will not pay for the supply of this information.

Section 8: Third Party LiabilityThis section applies in the Republic of Ireland only.In this section, You and Your means You or any person looking after or handling Your Pet withYour permission.

What We will not pay

1. More than the Maximum Amount Payable.

2. Any costs or expenses incurredin defending You which Wehave not agreed beforehand.

3. Any compensation, costs andexpenses resulting from anincident which takes place as aresult of Your profession,occupation or business.

4. Any compensation, costs andexpenses if You are legallyresponsible only because of acontract You have entered into.

5. Any compensation, costs andexpenses if the person who iskilled, injured or falls ill liveswith You or is employed by You.

6. Any compensation, costs andexpenses if the propertydamaged belongs to You or anyperson who lives with You or isemployed by You.

7. Any compensation, costs andexpenses if You, or any personwho lives with You, or isemployed by You is responsiblefor or looking after the propertythat is damaged.

8. Any compensation, costs orexpenses if You are deemedresponsible under the law ofany country, other than theRepublic of Ireland.

must never send any replies to any of these documents.

General ExclusionsAll sections in this policy do not cover the following:

1. Any animal less than 8 weeks old.2. Dogs being used for guarding, racing, track racing or coursing.3. Any amount if You break the animal health or importation laws or

regulations of the Republic of Ireland or United Kingdom.4. Any amount if Your Pet is confiscated or destroyed by government or public

authorities, or under the Control of Dogs Act 1986 and Control of Dogs(Amendment) Act 1992 Republic of Ireland or the Animals Act 1972 UnitedKingdom and/or because it was worrying livestock.

5. Any costs incurred because the Department of Food and Agriculture in theRepublic of Ireland or the Ministry of Agriculture, Fisheries and Food in theUnited Kingdom, have put restrictions on Your pet.

6. Any loss caused by war, riot, revolution or any similar event.7. Any loss caused by, connected to or resulting from any device failing to

recognise, interpret or process any date as it’s true calender date.8. Any amount resulting from diseases transmitted from animals to humans.

Any amount if the Pet suffers from a notifiable disease as defined by theDepartment of Agriculture, Fisheries and Food at the time of thenotification of the claim.

9. Any amount for travel to seek Veterinary Treatment abroad, except wheretreatment is not available in the Republic of Ireland and pre- authorisationhas been granted by the Allianz Pet Claims Department.

Right of withdrawalYou have the right to withdraw fromthis policy, provided You have notmade a total loss claim, within 14days of the latest of:(1) the starting date of cover, or (2) the date on which You receive

the full terms and conditions of Your Policy.

Withdrawal effectively means that nopolicy was ever in place, and You mayexercise this right by notice inwriting to Us at the address givenabove, quoting Your Policy number.Should You exercise this right We willrefund You any part of Your premiumYou have paid less an administrationfee. If the cover is motor insurance,the premium cannot be refundeduntil the Allianz Certificate of MotorInsurance and Insurance Disc havebeen returned to Allianz. Please notethat the right of withdrawal does notapply if the insurance policy underwhich insurance cover is provided isfor less than 1 month.

Governing law The laws of Ireland will apply to YourPolicy and the Irish courts will havejurisdiction to hear any dispute.

Policy Alteration, Additional andReturn Premiums When You make an alteration to YourPolicy We will re-calculate Yourpremium, which may result in anadditional premium due to Us, or areturn premium due to You. If thealteration to the policy results in an
