PART 1-PRELIMINABLY
Citation
1. Theseregulations may be cited as the Pearling General Regulations1991.
Commencement
2. Theseregulationsshall comeinto operationon the day, or the first of thedays,as the caserequires,fixed undersection2 of the Act.
Interpretation
3. In theseregulations,unlessthe contraryintentionappears-"approved"meansapprovedby an inspector;"catcherboat"meansboat usedto take, or attempt to take,pearloysters;"designatedcontainer" or "panel" meanscontainerof a type specified in
Schedule1;"dump", whenusedas-
a a noun, meansarea of Western Australian waters where pearloystersare held or placed;or
b a verb, meansplacepearloysterson a dump;"filled", in relation to a designatedcontainer,meansfilled with the number
of pearloystersprescribedby regulation5 in respectof containersof theparticulartype to which the designatedcontainerbelongs;
"fleet master"meansmasterof a boat nominatedin a notice of pearlingorhatcheryactivity to be the fleet masterof 2 or more boats using thesamedump;

"holding site" means area of Western Australian waters to which aprohibition or restriction made under section 19 of the Act applies,which prohibitionor restrictionis expressedto be madefor the purposesof this definition;
"licensee"meansholderof a pearlinglicenceor hatcherylicence;"notice of pearlingor hatcheryactivity" meansnoticeof pearlingor hatchery
activity referredto in regulation12;"operatedpearl oysterdump"meansdump-
a situatedwithin a holding site; andb usedsolely for the purposeof dumping pearl oysterswhich have
beenseededin pearlseedingoperations;"operationboat" meansboatusedfor carryingoutpearlculture techniques;"returnedpearloysterdump"meansdump-
a situatedwithin a holding site; andb usedsolely for the purposeof dumping pearl oysterswhich have
been subjectedto pearl seeding operationsbut have not beenseeded;
"seeding"meansspecificpearlculture techniqueof insertinga nucleusintoa pearl oyster;
"tag" meanspearloysteridentification tag issuedunderregulation24 1;"taggeddesignatedcontainer"meansdesignatedcontainerto which a valid
tag hasbeen affixed;"transportboat"meansboat usedfor transportingpearloysters.
PART 2-PRESCRIBEDMATTERS
Australian GeodeticDatum
4. 1 For the purposesof section 4 2 of the Act, the Australian GeodeticDatum is definedby an ellipsoid-
a havinga semi-majoraxis equatorialradiusof 6 378 160 metresandaflatteningof 1
298.25and
b fixed by the position of the origin, being the JohnstonGeodeticStationin the NorthernTerritory of Australia.
2 The JohnstonGeodetic Station referred to in subregulation1 shall betaken-
I II . 0 I IFa to be situatedat 25 55 54.551 5 southlatitude andat 133 12 30.077 1
eastlongitude;andb to have a ground level elevation of 571.2 metresabovethe ellipsoid
referredto in that subregulation.
Numbersof pearloystersprescribedin respectof particular types of containers
5. For the purposesof section 8 4 of the Act, the numberof pearl oystersprescribedin respectof a particular type of containerreferredto in Schedule1is a numberequal to the total numberof compartments,pocketsor slots in acontainerof that type.

Application fees
6. An applicantundersection22 of theAct for the issueor renewalof-
a a farm lease,or a right conferredon a personby a farm lease,shall payto the ExecutiveDirector an applicationfee of $200.00;
b a pearling licenceor pearlingpermit shall pay to theExecutiveDirectoran application fee of $250.00;or
c a hatchery licence or hatchery permit shall pay to the ExecutiveDirector an applicationfee of $250.00.
Retirementsprescribed in respectofholdersof pearl divers’ licences
7. 1 For the purposesof section 26 2 a of the Act, the holding by theholder of a pearl diver’s licence of a current certificate from a medicalpractitioner to theeffect that-
a the medical practitionerhasexaminedthat holder in accordancewithAustralian Standard2299 entitled "Underwater air breathingoperations"; and
b in the opinion of themedical practitioner,thatholder is fit to work asaprofessional diver using a diving apparatus involving the use ofcompressedair for 12 monthsfrom the dateof that certificate,
while diving is a requirementprescribedin respectof that holder.
2 That part of the Australian Standardreferred to in subregulation1 awhich provides that medical examinationsfor commercial divers are to becarried out at 6 monthly intervals does not apply in respectof examinationscarriedout for thepurposesof this regulationin accordancewith thatAustralianStandard.
3 In subregulation1-"current certificate" meanscertificatethe dateof which is not more than 12
months prior to the dateof the diving referredto in that subregulation;
"medical practitioner" meansperson referred to in paragrapha of thedefinition of "medical practitioner" in section 3 1 of the Medical Act1894.
Annual feesin respectof certain licences
8. For the purposesof section 27 1 b of the Act, the annualfee in respectof-
a a pearldiver’s licenceis $20.00;b a pearlboat licenceis $80.00; or
c a pearlboat master’slicence is $20.00.
Transfer fees
9. An applicantundersection32 of theAct for the transferof-
a a farm lease,or aright conferredon a personby afarm lease,shall payto the ExecutiveDirector a transferfee of $250.00;
b a pearling licence, or a right other than a quota referred to inparagraphd conferredon a personby a pearling licence, shall pay tothe ExecutiveDirector a transferfee of $250.00;
c a hatchery licence, or a right other than a quota referred to inparagraphd conferredon a personby a hatcherylicence,shall pay tothe ExecutiveDirector a transferfee of $250.00;or
d part, or all, of a quota referredto in section 32 5 a or b of the Actshall pay to the ExecutiveDirector a transferfee calculatedat the rateof 25cper pearloyster forming part of that quota.

Prescribedmannerof saleof seizedpearloystersor pearloyster spat
10. For the purposesof section 55 1 a ii and b i of the Act, theExecutiveDirector may, with the approvalin writing of the Minister, sell therelevantpearl oystersor pearloyster spat-
a at public auction;orb by tenderor by privatetreaty.
PART 3-PRESCRIBEDFORMS
Annual notice of intent
11. A licenseeshall, before 31 Decemberin eachyear, completean annualnoticeof intent in the form of Form P1 in theSchedulein respectof theyear nextfollowing thatyear and lodgethat annualnoticeof intent with an inspectoratBroomeor at suchother placeasmay be approvedin writing.
Penalty: $500.
Notice of pearling or hatchery activity
12. A licenseeshall not use,or permit or suffer his or her agent,employeeorsubordinateto use,an aircraft or boat to carry out pearlingor hatcheryactivitiesunless-
a the licenseehasdescribedthepearlingor hatcheryactivities in a noticeof pearlingor hatcheryactivity in the form of Form P2 in the Schedulecompletedby the licensee;and
b the licenseehas prior to that use lodged the notice of pearling orhatchery activity referred to in paragrapha with an inspector atBroomeor at suchother placeasmay be approvedin writing.
Penalty: $2 000.
Pearl oyster fishing daily log sheet13. 1 Subject to subregulation2, the master of a catcher boat shall
completefor eachday on whichpearloystersaretakenor attemptedto be takenby 2200 hourson that day a pearloysterfishing daily log sheetin the form ofForm P3 in theSchedule.
Penalty: $2 000.
2 In completinga pearloysterfishing daily log sheetundersubregulation1,themasterof the relevantcatcherboat shall-
a completethe section of Form P3 headed"Dive time" in respectof eachdive madefrom that catcherboat immediatelythat dive ends;
b complete,subjectto regulation 14, thesectionof Form P3 headed"Pearloystertakenby diver number" in respectof eachdive madefrom thatcatcherboat within 20 minutesof the end of that dive; and
c enterthe datein the spaceprovidedin the top left handcornerof FormP3 at the beginningof eachday and, in any event,before the first diveis madefrom that catcherboat on that day.
Penalty:$2 000.

Diver’s catchrecord log sheet14. 1 The master of a catcherboat required by regulation 13 2 b to
completethe section of Form P3 headed"Pearl oyster takenby diver number"may, insteadof completingthatsectionwithin 20 minutesof the endof the diveconcerned,completeadiver’s catchrecordlog sheetin the form of Form P4 in theSchedulein respectof eachdive madefrom the catcherboat.
2 The masterof a catcherboat who completesa diver’s catchrecordlog sheetundersubregulation1 shall-
a completethe diver’s catchrecordlog sheetwithin 20 minutesof the endof the dive to which it relates;and
b transfer the information enteredin eachdiver’s catch record log sheetcompletedduring the courseof a particular day to the pearl oysterfishing daily log sheetcompletedunderregulation 13 in respectof thatday by 2200 hourson thatday.
Penalty: $2 000.
Dump record log sheet
15. 1 Subject to this regulation, themasterof a boatwhich is used-
a to takeanddumppearl oysters;b to takepearloysterswhich aretransferredto a dumpboatand dumped;
orc to transportanddump pearloysters,
shall makea completerecordof that dumping for eachday of thatdumpingin adump recordlog sheetin the form of Form P5 by 2200 hourson that day.
Penalty: $2 000.
2 Subregulation1 doesnot apply to or in relation to pearloystersdumped-
a on a pearloysterfarm; orb on an operatedpearl oysterdump or returnedpearl oysterdump.
3 When 2 or more boats,the mastersof which arerequiredby subregulation1 a or b to makea completerecordof dumpingon thesamedump, areunderthe control of a fleet master-
a the fleet mastershall comply with subregulation1 a or b, as thecaserequires, in respect of both or all of thoseboats as if the fleetmasterwere the masterof eachof thoseboats; and
b themasterof eachof thoseboatsother than the fleet mastershall notcomply with subregulation1 a or b, as thecaserequires,in respectof his or her boat.
Penalty: $2 000.
4 The completerecordreferredto in subregulation1 shall for thepurposesof subregulation3 be takento be onecopy of Form P5 containingthe necessaryparticulars in respectof both or all of theboatsreferredto in subregulation3.
Transport log sheet
16. 1 Subject to subregulation2-a thepilot of an aircraft which is usedfor transportingpearloysters;orb themasterof a transportboat,
shall, prior to the transportof pearloysters,completeatransportlog sheetin theform of Form P6 in the Schedule.
Penalty: $2 000.

2 Subregulation1 doesnot apply to or in relation to pearloysters-a transportedentirelywithin the areaof a pearl oysterfarm;b transporteddirectly from a dump to an operationboat situatedon a
holding site for the purpose of being subjected to pearl seedingoperations;
c held on boarda boatactually engagedin taking, or attemptingto take,pearl oysters;or
d transportedentirelywithin a holding site afterhavingbeensubjectedtopearl seedingoperations,whetheror not they have been seeded,onboardan operationboat situatedon aholding site.
Transport seeding log sheet17. The master of a boat which is used to transportpearl oysters directly
from a dump to an operationboat situatedon a holding site for the purposeofbeingsubjectedto pearl seedingoperationsshall-
a prior to that transport, completea transportseeding log sheetin theform of Form P7 in the Schedulein respectof the pearl oystersto betransported;and
b carry the transportseeding log sheetreferredto in paragrapha onthatboat during that transport.
Penalty: $2 000.
Holding site operation log sheet18. 1 Subject to subregulation2, the masterof an operation boat shall
completea holding site operation log sheet in the form of Form P8 in theSchedulefor eachday on which-
a pearl oystersare receivedor held on board the operationboat for thepurposeof beingsubjectedto pearlseedingoperations;or
b the operationboat is used for pearl seedingoperations,by 2200 hourson that day.
Penalty: $2 000.
2 Subregulation1 doesnot applyto or in relation to pearloysterswhich areon apearloysterfarm.
General requirements in respectof prescribed forms19. 1 All formsreferredto in this Partmaybe issuedin log booksinsteadof
looselog sheetsto personsrequiredby this Part to completethoseforms.
2 If a log book referred to in subregulation1 is issued in respect of aparticular aircraft or boat, the personcompleting the forms in that log bookshall-
a do so only in respectof that aircraft or boat;b usethoseforms in numericalsequence;andc causethat log book to be retainedon boardthat aircraft or boat until
31 Decemberof the year in which that log book was issued.
Penalty: $2 000.
3 The licensee under whose licence an aircraft or boat referred to insubregulation2 is usedshall retain every log book issued in respectof thataircraft or boat for a period of 2 yearsfrom 31 Decemberof the year in whichthat log book wasissued.
Penalty: $1 000.

4 A personcompletinga form referredto in this Part shall do so in indelibleink.
Penalty: $1 000.
5 Subject to regulation 20, a personrequiredby this Part to completea formin the form of Form P3, P5, P6or P8 shall lodgetheoriginal of that form with aninspectorat Broome or at such other placeas may be approvedin writing-
a if a notice of pearling or hatchery activity has been lodged underregulation 12 in respect of the period during which that form wascompleted,within 3 daysof the endof the relevantpearlingtrip; or
b if a notice of pearling or hatcheryactivity has not beenlodged withinthemeaningof paragrapha, on demandby an inspector.
Penalty: $2 000.
6 In subregulation5 a-"pearling trip" meansduration of use of an aircraft or boat to carry out
pearling or hatchery activities describedin relation to the aircraft orboat in the relevantnoticeof pearling or hatcheryactivity.
Power of inspectorto direct delivery of form
20. 1 Notwithstandinganything in theseregulations, an inspectormay, ifhe or sheconsidersit necessaryto do so, in writing direct a personrequiredbythis Part to completea form referredto in regulation 19 5 to deliver, or causeto be delivered,that form to suchpersonat suchtime andplaceasare specifiedin that direction instead of lodging that form in accordancewith regulation19 5.
2 A personto whom a directionis given undersubregulation1 shall complywith that direction.
Penalty: $2 000.
PART 4-DESIGNATED CONTAINERS AND TAGS
Pearl oystersto be held in designatedcontainers
21. 1 Subject to this regulation, a personshall not, without the writtenapproval of an inspector, hold pearl oysters otherwise than in a designatedcontainer.
Penalty: $1 000.
2 Subregulation1 doesnot apply to or in relation to a pearl oyster if thepearloyster- -
a is removedfrom adesignatedcontainerfor thepurposeof subjectingthepearl oyster to pearl seedingoperationson board an operation boatsituatedon a holding site;
b is beingheld on a pearloysterfarm; orc is beingtakenby the holderof apearldiver’s licence.
3 A personshall not, without the written approvalof an inspector,hold in adesignatedcontainer more pearl oysters than the number prescribed byregulation 5 in respect of containers of the type to which the designatedcontainerbelongs.
Penalty:$1 000.

Pearl oysters to be placed in taggeddesignatedcontainersafterbeing taken
22. 1 The master of a catcher boat shall, subject to subregulation 2,ensure that pearloysterstaken by diving from the catcherboat are placedintaggeddesignatedcontainerswithin 20 minutes of the end of the dive duringwhich that taking took place.
Penalty:$1 000.
2 It is adefenceto a chargeof committing an offenceundersubregulation1to showthat-
a a threat to the safety of the crew of the catcherboat from which therelevantdive was madepreventedcompliancewith that subregulation;or
b the catch of pearl oystersmadeduring the relevantdive was so largethat it wasnot possibleto comply with that subregulationin respectofall or any of thepearl oystersin that catch.
Manner in which designatedcontainersto be filled23. The masterof a catcherboat shall, unlessan inspectorotherwisedirects
in writing, ensurethat the designatedcontainerson boardthecatcherboat arefilled consecutivelyin such a way that no more than 2 partly filled designatedcontainersare on boardthe catcherboatat any onetime.
Penalty: $1 000.
Issue and allocation of pearl oyster identification tags24. 1 An inspectorshall, on theapplication of a licensee-
a who satisfies the inspector that he or shewishes to take any pearloysters;
b whoselicence is subjectto a condition referredto in section26 2 c ord of the Act; and
c who has lodged an annual notice of intent under regulation 11 for thecalendaryear during whichpearl oystersare to be taken,
issue to the licenseesufficient pearl oyster identification tags to identify thepearloysterstakenunderthe licence of the licensee.
2 A licenseeto whom tags havebeenissuedshall allocatesufficient of thosetagsto eachboat used by or on behalf of the licenseefor thepurposesof his orher licenceto enablethe crewof thatboat to comply with theseregulations.
Tagspecifications25. Eachtag shall-
a be of alocking type; andb carry a serial number.
Useand possessionof tags26. 1 A person,other than-
a a licenseeto whom particular tagshavebeenissued; orb a member of the crew of a boat to which particular tags havebeen
allocated under regulation 24 2 who uses, or has in his or herpossession,thosetagson boardtheboat,
shall not useor havein his or her possessionthosetags.
Penalty:$2 000.

2 A personwho usesany tagsshall do so in theorderof their serial numbers.
Penalty: $2 000.
Transfer of tags -
27. When particular tags have been allocated to a boat under regulation24 2, the licenseewho so allocatedthosetagsshall not transferthosetags toanotherboat unless-
a the other boat is used by or on behalf of that licenseeunderhis or herlicence;and
b that licensee has recorded that transfer in the relevant notice ofpearlingor hatcheryactivity.
Penalty: $2 000.
Boat not to be usedfor taking pearl oystersunlesstags allocated to, and on board, boat
28. A personshall not use, or permit or suffer his or her agent,employeeorsubordinateto use, a boat to takeor attempt to take pearl oystersunless-
a tags have been allocated under regulation 24 2 or transferred inaccordancewith regulation27 to, and areon board, theboat; or
b an inspectorhasin writing exemptedtheboat from theoperationof thisregulation.
Penalty: $2 000. -
Affixing of tags - -29. 1 Subject to subregulation2, a personwho is placing pearl oystersin
a designatedcontainershall, assoonas the designatedcontaineris full, affix atagto thedesignatedcontainerby pulling the locking tail of the tag throughthelocking headof the tag.
Penalty: $2 000.
2 If thereareinsufficient pearloysterswith which to fill the last designated- containerin whichpearloystersareplacedafter the last dive of thedayhasbeenmade,thepersonwho is placingpearloystersin that designatedcontainershallaffix a tag to thatdesignatedcontainerin themannerspecifiedin subregulation1 assoonas the last pearloysterhasbeenplacedin that designatedcontainer.
Penalty:$2 000.
3 A personshall not affix a tag to a designatedcontainer if anothertag isalready affixed to the designatedcontainer.
Penalty:$2 000.
Removalof tags30. 1 A licenseeto whomtagshavebeenissuedshall ensurethat, unlessan
inspectordirects otherwisein writing, all of thosetagswhich havebeenaffixedto designatedcontainersareremovedtherefromby midnight on 31 Decemberoftheyear in which thosetagswere so affixed.
Penalty:$1 000.
2 A personwho removesa tag from a designatedcontainershall renderthetag incapableof being usedagainundertheseregulations.
Penalty:$1 000.

PART 5-DUMPING OF PEARL OYSTERS
Division 1-Dumpsother than dumpson holdingsites
Division 1 not to apply to certain dumps
31. This Division doesnot apply to or in relation to a dump made-
a in accordancewith-i any relevantcondition of a licence;orii any written directiongiven by an inspector,
by the holderof a farm leasewithin his or her pearl oysterfarm;or
b on a holding site with pearloysterswhich havebeensubjectedto pearlseedingoperationson boardan operationboat situatedon the holdingsite.
When dumping of pearl oysters permissible
32. 1 A person shall not dump or attempt to dump, or permit or suffer hisor her agent,employeeor subordinateto dumpor attempt to dump,pearl oystersunless-
a that dump hasbeenidentified by a number in a dump record log sheetreferredto in regulation15 before thepearl oystersaredumped;
b that dump is markedby a masterbuoy consistingof a surfacefloat-i which hasa diameterof 75 cm or more;ii which is brandedwith the numberof that dump as recordedin the
dumprecord log sheetreferredto in paragrapha precededby anapprovedabbreviatedreferenceto the licenseeusing that dump;and
iii which has attached to it an aluminium radar reflector with asurfaceareaof not lessthan 1.5 squaremetres;
c subjectto subregulation2, thosepearl oystersare dumped in taggeddesignatedcontainers;
d all taggeddesignatedcontainersreferredto in paragraphc are whendumped attached to a long line which has surface floats 15 cm indiameterattachedto eachendof the long line;
e the 2 surfacefloats referredto in paragraphd are brandedwith thesameidentifring number,which number is different from the identifying numberwith which thesurfacefloats attachedto anyother long lineat that dump are branded;
f all long lines at that dump are within a radius of 200 metresof thesurfacefloat referredto in paragraphb or of a surfacefloat which-i hasa diameterof 75 cm or more; andii is brandedwith an approvedabbreviatedreferenceto the licensee
usingthatdump;
g all taggeddesignatedcontainersattachedto a long line are capableofholding the number of pearl oysters prescribed by regulation 5 inrespect of containersof the type to which those tagged designatedcontainersbelong; and
h thosepearloysterswere takenunder the licence of the licenseeusingthat dump.
Penalty:$2 000.

2 Subregulation1 c does not apply to or in relation to pearl oystersdumped-
a on a pearloyster farm; orb on a holding site immediately after having been subjectedto pearl
seedingprocedureson board an operationboatsituatedon the holdingsite.
Nomination and duties of fleet masters
33. 1 If 2 or more boatsareto use the samedump or dumps, the licenseeusing that dump or those dumps shall in the relevantnotice of pearling orhatchery activity completed by that licenseenominate one of the mastersofthoseboatsto be the fleet masterof thoseboatsat that dump or thosedumps.
Penalty: $2 000.
2 A fleetmastershall ensurethat this Division is compliedwith in respectofthepearl oystersdumpedby theboatsto which his or her nominationrelates.
Penalty: $2 000.
Map of long lines in relation to masterbuoy34. The master of a boat using a dump or, if 2 or more boats are using a
dump, the fleet masternominatedin respectof the dump, shall-a subject to paragraphb, makeand retain on boardhis or her boat an
accurateand up to datemap showingthe identifying numbersreferredto in regulation 32 1 e of the long lines on the dump and thedisposition of thoselong lines in relation to the masterbuoy referredtoin regulation 32 1 b; and
b if so requestedby an inspector, lend to the inspector for a reasonabletime themapreferredto in paragrapha or provide the inspectorwitha legible copy of that map.
Penalty: $2 000.
Only onelicenseeto useparticular dump35. A licenseeshall not use, or permit or suffer his or her agent,employeeor
subordinateto use, a dump which is already used by or on behalf of anotherlicensee.
Penalty: $2 000.
Division 2-Dumpson holding sites
When operatedpearl oyster dumps andreturned pearl oysterdumps permissible
36. 1 Subject to subregulation2, a personshall not dump or attempt todump, or permit or suffer his or her agent, employeeor subordinateto dump orattempt to dump, pearl oysterswhich have been subjectedto pearl seedingoperationson a holdingsite unless-
a the holding site is markedby a master buoy consistingof a surfacefloat-i which hasa diameterof 75 cm or more;ii which is brandedwith a number identifdng that surface float
precededby an approvedabbreviatedreferenceto thelicenseeusingthe holdingsite; and
iii which has attachedto it an aluminium radar reflector with asurfaceareaof not lessthan 1.5 squaremetres;

b thosepearl oystersare dumpedin designatedcontainers;c all designatedcontainersreferredto in paragraphb arewhendumped
attachedto a long line which has surface floats 15 cm in diameterattachedto eachendof the long line;
d the 2 surfacefloats referred to in paragraphc are brandedwith thesameidentifying number,which number is different from the identifying numberwith which thesurfacefloats attachedto any otherlong lineon the holding siteare branded;

Penalty: $2 000.
2 A personshall not dump or attempt to dump,or permit or suffer his or heragent,employeeor subordinateto dump or attempt to dump, in the samedumpon a holding site both pearl oysterswhich havebeen seededin pearl seedingoperationsand pearl oysters which have been subjected to pearl seedingoperationsbut havenot beenseeded.
Penalty: $2 000.
Duties of masters of operation boats
37. The master of an operation boat situatedon a holding site shall ensurethat the Act and theseregulationsare complied with in respectof the holdingsite.
Penalty: $2 000.

38. The master of an operationboatshall-a subject to paragraphb, make and retain on boardthe operationboat
an accurateand up to date map showing the identifying numbersreferredto in regulation36 1 d of the long lines on theholding site onwhich the operationboat is situated and the disposition of thoselonglines in relation to the masterbuoy referred to in regulation 36 1 a;and
b if so requestedby an inspector,lend to the inspectorfor a reasonabletime the map referredto in paragrapha or provide the inspectorwitha legible copy of thatmap.
Penalty: $2 000.
PART 6-PEARL SEEDING OPERATIONS ON HOLDING SITES
Pearl seedingoperations to be conductedonly on farm leasesor holding sites
39. A person shall not conduct pearl seedingoperationselsewherethan on afarm leaseor holding site.
Penalty: $2 000.

40. A personshall not conductpearl seedingoperationson a holding siteunlessprior noticeof thosepearl seedingoperationshasbeen given in a noticeof pearling or hatcheryactivity.

Circumstancesin which pearloysterscan be held on operation boat
41. The masterof an operationboat shall ensurethat loosepearloystersorcontainerswhich-
a containpearl oysters;butb are not tagged,
are not held on board his or her operation boat unlessthat operation boat issituatedon a holding site and pearl seedingoperationsarebeing conductedonthat operationboat.
Penalty: $2 000.
PART 7-TRANSPORTING OF PEARL OYSTERS
When transporting of pearl oysters permissible
42. A personshall not transportor attempt to transport, or permit or sufferhis or her agent,employeeor subordinateto transportor attempt to transport,pearl oysters by any meanson, in, over or from Western Australian watersunless-
a thosepearloystersarein taggeddesignatedcontainersandprior noticeof that transport hasbeen given in a notice of pearling or hatcheryactivity;
b prior to that transport, thosepearloystershavebeen-i held on a holding site;ii subjectedto pearlseedingoperationson the holding site referredto
in subparagraphi; andiii held in designatedcontainers, and an inspectorhas in writing
approvedthat transport;c thosepearloystershavebeentakenby, andarebeingheldon, acatcher
boat and the catcher boat is still actually engagedin taking pearloysters;
d thosepearl oystersare transportedentirely within a pearloysterfarm;e thosepearloystersare, on theday on which they aretakenby acatcher
boat, transported by the catcher boat or a dump boat, in taggeddesignatedcontainers,directly to thenearestdump other thana dumpon a pearloyster farm;
U thosepearloystersare-i in designatedcontainers;ii held on or transportedto an operationboat situated on a holding
site; andiii transportedentirely within the holding site referredto in subpara
graphii; org an inspectorapprovesin writing that transport.
Penalty: $2 000.

43. 1 Prior noticeof transportreferredto in regulation42 a maybevariedby notice lodged-
a in writing; orb by facsimileor telex transmission,
with an inspectorat Broome or at such other place as may be approved inwriting not less than 24 hoursbefore the relevant transport takes place, andprior noticeof transportso varied hasthesameeffectasprior noticeof transportnot so varied.
2 Notice may be lodgedundersubregulation1 by-a the pilot of the relevantaircraft;b the masterof the relevantboat; orc the licenseeusingthe relevantaircraft or boat.
Contents of notices
44. Prior noticeof transport referredto in regulation 42 a or notice lodgedunder regulation43 1 shall state-
a the dateof transport;b the identifying particularsof the aircraft, or the nameand numberof
the boat, to which the relevantnoticerelates;andc the source, location, number and destinationof the pearl oystersto be
transported,and the time and dateof arrival of thosepearl oystersatthat destination,
and, if any of the particularsreferredto in paragrapha, b or c is omittedfrom the relevantnotice, that notice is deemednot to havebeengiven or lodged,as thecaserequires.
PART 8-GENERALMiscellaneousoffences
45. A personshall not, exceptwith the written approval of the ExecutiveDirector or in accordancewith a condition imposedon a licenceor permit-
a take or attempt to take, or permit or suffer his or her agent,employeeor subordinateto take or attempt to take, pearloystersby any meansexceptby diving andby hand;
b have on board a boat any equipmentcapable of being used for thetaking of pearloysters,other than pearl diving equipment;
c kill, or permitor sufferhis or her agent,employeeor subordinateto kill,a pearloysterexcept for-i pearlseedingoperationson a holding site or pearl oyster farm; orii pearlharvestingpurposeson a pearl oysterfarm;
d haveon boardacatcherboatany deadpearloyster;ore conduct or attempt to conduct, or permit or suffer his or her agent,
employeeor subordinateto conductor attempt to conduct,pearlculturetechniquesexcepton a holding site or pearl oyster farm.
Penalty: $2 000.
Sizesof letters and numbers on floats
46. A personwho for the purposesof theseregulationsbrandsa float withletters or numbersor both shall do so with letters or numbersor both each ofwhich is not less than 6 cm high and 1 cm wide.
Penalty:$500.

47. A person,other than a licenseeauthorizedundersection 19 of theAct tousea holdingsite, shall not-
a usethe holding site for pearling or hatcheryactivities; orb transportpearl oystersto theholdingsite, without thewritten approval
of theExecutiveDirector.
Penalty: $2 000.
Pearl boat licence number
48. 1 A pearl boat licence shall identify the boat in respectof which it isissuedby assigningto that boata number,consistingof lettersand numbersornumbersonly, which is different from the numberassignedto any other boat byanotherpearlboat licence.
2 The masterof a boat in respectof which apearl boat licenceis issuedshallensurethat thereis at all times legibly painted-
a in black on a yellow background;andb in letters andnumbersor numbersonly, as the caserequires,each of
which is not less than 30 cm high and 5 cm wide or is of such otherdimensionsasareapprovedin writing,
on both sidesof the hull of that boatat the turn of the bow the numberassignedto that boat by the pearlboat licence.
Penalty: $500.
3 A personshall not own, control or usea boatbearinganumberreferredtoin subregulation2 unlessa pearlboat licence is in forcein respectof thatboat.
Penalty: $500.
4 A personwho owns or controls a boat bearinga number referred to insubregulation2 shall not permit or suffer another personto use that boatunlessa pearlboat licence is in force in respectof that boat.
Penalty: $500.
