Smiley van Zyl, whose wife was murdered in a robbery in 2008, has instituted a damages claim against the ministers of Justice and Safety and Security for failing to protect his wife. Smiley says he hopes to win the caseand set a precedent to keep the promise he made to his wife before her life support machines were switched off. “There are two sides to why I chose to do this. The one side is I made a vow to my wife, on her death bed, that she would not become just another South African murder sta- tistic,” says Smiley. “And the second is that I prom- ised her that I would turn her death into something meaningful for soci- ety so she did not die in vain.” Jane van Zyl was shot and killed by Gershwin Hartzenberg, who was 25 years old at the time, in the drive- way of her Bergvliet home on 13 April 2008. She had just returned from dropping off her husband at the Constantiaberg Medi-Clinic, and was waiting for the electric gates at her home to open when Hartzenberg struck. Hartzenberg had been released on bail less than two weeks earlier, on 1 April 2008. According to the damages claim documents, Hartzenberg was ar- rested by Kirstenhof police on 30 March 2008 and taken to Wynberg Magistrate’s Court the following day to appear on a charge of armed robbery, but was returned to Kirst- enhof police station because his docket had been misplaced. He was then taken back to court the following day (1 April) and re- leased on bail because he had been in custody for over 48 hours. Within two weeks he had killed Jane van Zyl. Hartzenberg shot Van Zyl once in the head but she did not die immedi- ately and spent 12 hours on a life support machine before it was turned off. The documents also state that the court was not informed that Hartzenberg had several other cas- es pending at the time – including armed robbery, attempted murder, kidnapping and several charges of theft. Smiley believes that the govern- ment failed to protect his wife when it allowed Hartzenberg back on the streets. “The person who murdered my wife had a history of serious crimes pending against him. Looking at the charges and the circumstances, he definitely did not qualify for bail,” says Van Zyl. “Yet the authorities allowed him back on the streets and they failed in their duties when they did this.” Hartzenberg was later found guilty of Jane’s murder and sen- tenced to life in prison,as well as an additional 10 years for a different armed robbery and five years for il- legal possession of a firearm. Hartzenberg is currently serving his term in Pollsmoor Prison. Smiley added that many other South Africans had found them- selves in similar situations before. “If you look at the statistics, she is probably one of thousands who died in the same way, which shows you that there is something wrong with the system – and it’s the sys- tem that I’m trying to address.” Smiley filed the papers at the Cape High Court on Wednesday 6 April. Gerhard Kotze, Smiley’s attor- ney, says he is confident of victory even though only one precedent ex- ists. Alix Jean Carmichele is the only person to have successfully sued the South African Ministers of Safe- ty and Security and Justice. Carmichele was attacked by Francois Coetzee in a small village named Noetzie, around 12 kilome- tres from Knysna, on 6 August 1995. Coetzee had previously been con- victed of indecent assault and housebreaking, and was out on bail after being charged with rape when he attacked Carmichele. “I’m very confident that we’ll win because I think we’ll be able to es- tablish that the criminal who mur- dered Smiley van Zyl’s wife would not have been out on the streets if the law had been applied properly,” says Kotze. “He was arrested shortly before her murder and my instruction is that if the prosecutors and/or the police had done their job, he wouldn’t have been released. And if he hadn’t been released then Mrs van Zyl wouldn’t have been mur- dered.” However, Kotze is under no illu- sions that the case will be easy. He feels it is the responsibility of attorneys to do their part in the fight against crime by taking up tough cases such as this. “I feel very strongly that we have a duty as attorneys to take on cases like this,” said Kotze. “The state has got to be held ac- countable for this. We have a huge crime problem in this country and have to fight it on all fronts.” At the time of her murder, Jane was 52 and had been married to her husband for over 33 years. Smiley no longer lives in the same house and says that although he has moved on with his life, he will only have complete closure once he has fulfilled his promise to his wife. “If my wife had died of natural causes then I would have received closure at the funeral and moved on,” says Smiley. “But she did not die of natural causes. “She died because the system failed us as law-abiding citizens. And if we all walk away and move on then nothing will ever change.” Kotze says the case could take up to three years to get to court if the Ministers of Justice and Safety and Security refuse to settle out of court, due to the lengthy waiting list at the Cape High Court. AFTER more than three years, aBergvliet man has taken the firststeps to fulfilling a promise hemade to his wife on her deathbed.

Smiley van Zyl, whose wife wasmurdered in a robbery in 2008, hasinstituted a damages claim againstthe ministers of Justice and Safetyand Security for failing to protecthis wife.

Smiley says he hopes to win thecaseand set a precedent to keep thepromise he made to his wife beforeher life support machines wereswitched off.

“There are two sides to why Ichose to do this. The one side is Imade a vow to my wife, on her deathbed, that she would not become justanother South African murder sta-tistic,” says Smiley.

“And the second is that I prom-ised her that I would turn her deathinto something meaningful for soci-ety so she did not die in vain.”

Jane van Zyl was shot and killedby Gershwin Hartzenberg, who was25 years old at the time, in the drive-way of her Bergvliet home on 13April 2008. She had just returnedfrom dropping off her husband atthe Constantiaberg Medi-Clinic,and was waiting for the electricgates at her home to open whenHartzenberg struck.

Hartzenberg had been releasedon bail less than two weeks earlier,on 1 April 2008.

According to the damages claimdocuments, Hartzenberg was ar-rested by Kirstenhof police on 30March 2008 and taken to WynbergMagistrate’s Court the followingday to appear on a charge of armedrobbery, but was returned to Kirst-enhof police station because hisdocket had been misplaced.

He was then taken back to courtthe following day (1 April) and re-leased on bail because he had beenin custody for over 48 hours. Withintwo weeks he had killed Jane vanZyl.

Hartzenberg shot Van Zyl once inthe head but she did not die immedi-ately and spent 12 hours on a lifesupport machine before it wasturned off.

The documents also state that thecourt was not informed thatHartzenberg had several other cas-es pending at the time – includingarmed robbery, attempted murder,kidnapping and several charges oftheft.

Smiley believes that the govern-ment failed to protect his wife whenit allowed Hartzenberg back on thestreets.

“The person who murdered mywife had a history of serious crimespending against him. Looking atthe charges and the circumstances,he definitely did not qualify forbail,” says Van Zyl.

“Yet the authorities allowed himback on the streets and they failedin their duties when they did this.”

Hartzenberg was later foundguilty of Jane’s murder and sen-tenced to life in prison,as well as anadditional 10 years for a differentarmed robbery and five years for il-legal possession of a firearm.

Hartzenberg is currently servinghis term in Pollsmoor Prison.

Smiley added that many otherSouth Africans had found them-selves in similar situations before.

“If you look at the statistics, sheis probably one of thousands whodied in the same way, which shows

you that there is something wrongwith the system – and it’s the sys-tem that I’m trying to address.”

Smiley filed the papers at theCape High Court on Wednesday 6April.

Gerhard Kotze, Smiley’s attor-ney, says he is confident of victoryeven though only one precedent ex-ists.

Alix Jean Carmichele is the onlyperson to have successfully suedthe South African Ministers of Safe-ty and Security and Justice.

Carmichele was attacked byFrancois Coetzee in a small villagenamed Noetzie, around 12 kilome-tres from Knysna, on 6 August 1995.

Coetzee had previously been con-victed of indecent assault andhousebreaking, and was out on bailafter being charged with rape whenhe attacked Carmichele.

“He was arrested shortly beforeher murder and my instruction isthat if the prosecutors and/or thepolice had done their job, hewouldn’t have been released. And ifhe hadn’t been released then Mrs

van Zyl wouldn’t have been mur-dered.”

However, Kotze is under no illu-sions that the case will be easy.

He feels it is the responsibility ofattorneys to do their part in thefight against crime by taking uptough cases such as this.

“I feel very strongly that we havea duty as attorneys to take on caseslike this,” said Kotze.

“The state has got to be held ac-countable for this. We have a hugecrime problem in this country andhave to fight it on all fronts.”

At the time of her murder, Janewas 52 and had been married to herhusband for over 33 years.

Smiley no longer lives in thesame house and says that althoughhe has moved on with his life, hewill only have complete closureonce he has fulfilled his promise tohis wife.

“If my wife had died of naturalcauses then I would have receivedclosure at the funeral and movedon,” says Smiley.

“But she did not die of naturalcauses.

“She died because the systemfailed us as law-abiding citizens.And if we all walk away and moveon then nothing will ever change.”

Kotze says the case could take upto three years to get to court if theMinisters of Justice and Safety andSecurity refuse to settle out ofcourt, due to the lengthy waitinglist at the Cape High Court.

Steurhof residents finallywin housing battleLIAM MOSES

THURLOUGH WARREN has waged afive-year battle for the right to buy thecouncil house he has been renting since1990.

And last week he was finally notified thathe could purchase the house from the Cityof Cape Town.

Warren lives in Steurhof Estate, a govern-ment-owned cluster of cottages in Diep Riverwhich residents have been leasing from gov-ernment.

Warren says the prospect of owning ahome for the first time in his life has madehim ecstatic.

“There’s nothing better, no better feelingthan knowing that you’re going to become ahomeowner,” says Warren.

“The mere fact that my daughter was bornhere makes this mean so much to me. Andwhere else am I going to find a house? Prop-erty is expensive these days.”

Warren is a founding member and theformer chairperson of the Steurhof Civic As-sociation, an organisation which has beenlobbying for the right to purchase the housessince it was formed in 1996.

There 138 cottages in Steurhof and all legaltenants whose rental bills are up to date andwho do not own other property will be al-lowed to purchase the houses they are stay-ing in.

Warren was notified via a letter which hepicked up at the council offices on Wednes-day 13 April.

Eighty other residents with similar cir-cumstances to Warren have also received thesame letter.

CarolBew, thewardcouncillor for theareasays the prices of the homes will differ ac-cording to the size of the cottage and the fi-

nancial situation of the tenant.“The prices will vary because there are

one, two and three-bedroom houses,” saidBew. “The prices will probably vary betweenR7 000 and R11 000 and then the tenant willqualify for a subsidy. And people will all getdifferent subsidies.”

Warren’s three-bedroom house has beenpriced at R12 000, but he will only pay aroundR4 500 because he receives a R7 500 subsidy.

The conditions for purchasing the housesare as follows:

. Tenants must personally occupy thehouse when applying to purchase.

. Only the registered tenanthas the optionto purchase.

. The tenant or his/her spouse must notbe the owner of any property or vacant land.

. The property will be sold in its presentcondition.

. Thepurchaserwill be responsible for themaintenance of the property.

. The purchaser will be liable for the pay-ment of rates as from the date of purchase.

. The purchaser will be liable for insur-ance on the building from the date of regis-tration of transfer.

. Purchasers may qualify for a write-off(subsidy) on the purchase price in terms ofthe Enhanced Extended Discount BenefitScheme, provided they are eligible.

. If purchasers make use of this subsidy,the property will be subject to an eight yearpre-emptive right.

. Should purchasers not make use of thissubsidy, they will have to pay the purchaseprice in full and the eight year pre-emptiveright will not apply.

Thousands of unemployedon City’s databaseMELISSA LE ROUX

THERE are nearly 10 000 residents on theRondevlei Subcouncil’s job seekers data-

base, and not enough jobs to go around.

The database tallies the number of people in vari-ous wards who are waiting to be employed by theCity of Cape Town.

Anyone who wishes to be notified of a possiblejob has to fill out a form at the subcouncil’s office.

“There aren’t sufficient job opportunities for thepeople in the community. When there is a need, onlyabout 10 or 15 people are chosen,” says councillorfor Ward 66, George March.

The types of jobs that are given to those on thedatabase include street, beach, canal, park and ille-gal dump site clean-ups.

When a job comes up, 10 candidates are selectedat random and sent to an interview with the con-tractor.

“Many people in the community are complainingthat the same people get chosen for jobs all the time.It is out of our hands though.

“And that’s why we sit with a big group of peoplewaiting anxiously for jobs from the council. We can-not create enough jobs to give to a larger group ofpeople,” says March.

There is a skills training centre inOttery –aLotus

River, Ottery, Grassy Park Residents’ Association(Logra) civic initiative – where unemployed mem-bers of the community can acquire electrical andplumbing skills.

The training centre runs a seven-week courseand, at the end, participants receive a certificate.

The centre also provides further assistance for sixmonths to those who want to start their own busi-nesses.

Councillor for Ward 72, Jan Burger, says he is ex-periencing the same demand for job allocations inhis ward.

Burger says there are hardly any permanent jobs,and a solution needs to be brought to the table soon.

“Whatever jobs we can create, like street clean-ing, are not sustainable, and the few people who doget jobs are only employed for a month or two,” hesays.

According to Burger, there is not enough supportand financial backing from the department of socialand economic development.

“The only thing we as councillors can do is workthrough portfolios – parks, social and economic de-velopment – and maybe, if you’re lucky – roads,”says Burger.

Various projects are in the pipeline to create morepermanent income-generating jobs, including there-launch of the Gateway to Flats Fleamarket, nextto the M5, as well as the vegetable tunnel in Retreat.

HIV/Aids drive for CapricornTAURIQ HASSEN

AN HIV/Aids awareness cam-paign aimed at young women isheading to Capricorn.

The African Centre for HIV/Aids management at the Universi-ty of Stellenbosch will conduct theawareness campaign on FreedomDay, Wednesday 27 April.

Joan Abrahams, project coordi-nator, says Capricorn is the idealarea to conduct the campaign, be-

cause of the high incidence of teen-age pregnancy in the area.

“The problem is, you find manyyounger girls living and sleepingwith older men in this area, sosome sort awareness needs to beconducted,” says Abrahams.

The event will consist of talks,video sessions, educational pro-grammes and testing, which isopen to the community.

“We want this to be a communi-ty initiative and want the commu-

nity to come out in their numbersand attend the event,” Abrahamsexplained.

Priscilla Maasdorp, a parent liv-ing in Capricorn, welcomes theawareness campaign with “openarms”.

“This is really a problem in ourcommunity and many of the girlsdo not know the dangers of HIV/Aids. They take it for granted, sothe timing is perfect,” saysMaasdorp.

At the age of 17, Maasdorp’sdaughter gave birth to her firstchild and later tested positive forHIV/Aids.

“It was the saddest day in my lifewhen those results came back, al-most like a feeling you cannot real-ly believe, but we faced it andthat’s reality,” says Maasdorp.

She encouraged parents to sendtheir daughters to the campaign,saying: “You really don’t want towake up when it’s too late.”

The campaign will be held at theThrown Tabernacle Church inCapricorn, starting at 13:00.

“This is a really important eventfor the community and this eventis an ideal opportunity for you toeducate yourself about the situa-tion happening around you,” Ab-rahams says.

Honest scrapyard ownerdelivers thief to policeMELISSA LE ROUX

A MAN was arrested withinhours of allegedly selling stolenmetal in Retreat on Tuesday 5April, thanks to the diligence of alaw-abiding scrapyard.

After a string of burglaries inSomerset Park in Retreat in thepast three weeks, thieves re-moved tap fittings and copperpipes from Solly Klassen’s backyard in the early hours of themorning. “I was asleep and I gotwoken by the sound of the tap be-ing pulled off my wall, and thenthe water.

“My neighbours were a greathelp in rushing to assist me at03:00 while I was trying to stop thewater that was gushing out at themains – a very good chain reac-tion of concern and helpfulness,”says Klassen.

A few hours later, at about08:15, Klassen “took a chance” bygoing to the All Scrap scrapyardin 10th Avenue to ask that they beon the “look-out” for his specifictap fittings.

“A person was trespassing onmy property; coming onto myproperty and causing damage toit – that is what motivated me.

“They listened to me very care-fully and both the owner and hisassistant were very helpful.

“At about 10:00 I got a call fromthe owner, telling me that tap fix-tures fitting the description ofmine had been sold to the scrapy-ard. I went in to identify them,and, as it turned out, they weremine,” he said.

Anyone selling scrap metal atAll Scrap must provide an identi-ty number, and a photograph is

taken of the seller.Klassen reported the theft to

Steenberg Police Station, andthey were able to trace the culpritthrough the information provid-ed by the scrapyard.

Greg Kloots, the owner of AllScrap, says every second-handshop should implement the sys-tem: “We try our best – it’s notgood for any business to be seenas a place that is buying stolengoods. We keep a record of every-thing that is brought into theshop.”

According to the Second HandGoods Act 23 of 1955, all second-hand dealers must:

. Keep a description of goods.

. Get the signature, name andidentity number of the client.

. Keep a number of copies ofthe clients’ identity document orpassport; and

. Retain documents for fiveyears.

“Greg has always been doing alot to curb stealing in the area. Heis always willing to look out forany goods that might have beenstolen that are brought into theshop,” says ward councillor, JanBurger. The suspect appeared inthe Wynberg Magistrate’s Courton Wednesday 6 April and will bereappearing on Friday 27 May.

The spokesperson for Steen-berg Police Station, Warrant Of-ficer Hermanus van Dyk, saysthere have been few reports of sto-len goods from properties in thepast few weeks.

People’s Post attempted to gainmore information about the sus-pect from Steenberg Police Sta-tion, but was unable to do so at thetime of going to print.

Girl hurt falling into street drainLIAM MOSES

A GROUP of Westlake resi-dents are upset after a teen-age girl fell into and had herfoot lodged in a street drainlast week.

Ashlin Simons (14) waswalking home from schoolwhen her right leg up to herknee became trapped in astormwater drain on LingsWay on Monday 11 April.

The girl suffered cuts andbruises to her leg.

According to LawrenceGamedale, a Westlake resi-dent, Simons’ leg was so tight-ly lodged in the drain that heand a another man had to usea hammer and chisel to freeher.

“She was walking homefrom school and she fell intothe hole and got stuck,” saysGamedale.

“I called another man tobring a hammer and chiseland we broke the tar and con-crete around the edge of thedrain grid to get her out. Ittook about an hour.”

According to Gamedale andother Westlake residents, itwas the second time thatsomeone had fallen into thesame drain.

Rose Simons, Ashlin Si-mon’s mother, says she re-mains very concerned by theincident even though herdaughter only suffered minorinjuries.

“I was very disappointed be-cause there are a lot of chil-

dren who play in the roadaround the drain and they canget hurt,” said Simons.

“I want them to close thedrain so more people don't gethurt. While in Westlake Peo­ple’s Post also observed anoth-er badly-covered drain in thearea.

The underground storagearea covered by a cementblock apparently belongs toTelkom and contains severalwires.

According to Gamedale andMzukisi Ngonyama, anotherconcerned Westlake resident,both drains have been report-ed to Denis Joseph, the wardcouncillor for the area, butnothing has been done.

Joseph says he knows noth-ing about the stormwaterdrain but that the under-ground structure belongingto Telkom has been reportedand will be fixed soon.

“I’m not aware that anydrain is open, I only know ofdrains that are blocked full ofsand and I have reportedthose to the council,” saysJoseph.

“I also know about anotherdrain that is poorly coveredand I reported that to Telkom.I’m sad that this happenedand somebody got hurt.

“If it was brought to my at-tention, I would have actedupon it.

“I will go out and respondto it immediately.”

Hip Hop champions in the Battle of theGiants Hip Hop Championship WorldTrial Circuit at Sun City recently.

In the group’s hearts though, they werethe champions: “We did ourselves proud.We didn’t have that much time to rehearsewhen we were at Sun City, but we put allour time into it. We were the only CapeTown crew in the competition, and thefeedback we received, was very uplifting,”says Shannon Foure, a member of thegroup.

Street Stylers, which consists of nineteenage boys from areas such as Ottery,Fairways, Southfield, Muizenberg, Plum-stead and Athlone, finished second, be-hind Artistic Intelligence from Johannes-burg.

The annual Hip Hop competition, whichwas held from Wednesday 30 March toMonday 4 April, is an “intense battle” ofthe best dance crews from around thecountry.

It attracts over 500 entries, with dancersfrom as young as eight battling it out tosee who has the best moves on the dancefloor.

Street Stylers have been dancing togeth-er since 2007, and each of the boys dancedfor many years before forming a group.Some took part in solo competitions andothers danced “just for the love of it”.

The Street Stylers are members of the

South African Dance Teachers’ Associa-tion, and qualified to compete at the WorldChampionship competition by comingsecond in the national competition.

“The competition is tough, but we prac-tised hard – about four hours a day – inone of the halls in Chukker Road, Ken-wyn,” says 19-year-old Blake Williams –

who danced and co-choreographed in Afri-ka Ablaze’s dance production, “DancersDon’t Cry,” performed on 30 and 31 Marchat Cape Town International ConventionCentre (CTICC), and who has also compet-ed in solo competitions for three years.

The group competes in various genresof dance, such as Breakdancing, Poppingand Locking, a hard-hitting movementthat is a clean dance style, Krumping, con-sisting of bigger dance movements ex-pressing anger, Whacking, Vogue, House,Lyrical Hip Hop.

They even made up their own dancestyle, which they call Thuggin’ – made upof new-school dance moves and “lots ofgimmicks”.

The talented crew shared their joy andexcitement at their achievement with Peo-ple’s Post.

“Even though the competition wastough and intense, we came second in thecountry and we are very proud of ourachievement.

“It was one of the best experiences of mylife,” says Williams.

Street Stylers will compete in three na-tional competitions before showcasingtheir moves at the World Trial CircuitChampionships in October in Austria –where they have their sights firmly set onfirst place.

Prices have gone up, but there is no evi-dence of change. There is no difference be-tween 1st and 3rd class. Trains are filthyand who knows what health hazards arelurking around, especially on those materi-al seats. They should really launch a hy-giene campaign, because the majority ofcommuters are well-prepared but most ofthem smell like death.

I know most of the people are not well off,but if they can be informed about hygiene

This year the City has taken a proactive ap-proach to curbing rising death tolls by offer-ing free roadworthy safety checks to moto-rists ahead of the Easter weekend.

But inevitably, with most holidays excesskicks in. Alcohol and drug use will, no doubt,again have a huge impact on how well motor-ists obey the rules of the road.

And as schools and institutions of higherlearning also close for the break, the numberof inexperienced drivers and young passen-gers on our roads will also increase.

A road safety initiative in Australia callson families to check-off a range of safe drivingmethods, such as putting a curfew on nightdriving for young people.

Shouldn’t local motorists draw up the samecontract with themselves, pledging not todrive when intoxicated, and choosing insteadto put their keys down and sober up first?

Similarly if you’re a passenger, wear a seat-belt at all times and, when confronted by adifficult situation, choose not to get into a carwith an intoxicated driver.

An accident can happen in a second as a re-sult of the smallest oversight. Personal re-sponsibility is your safest bet to stay alive onour roads, so be responsible for yourself andthose around you.

FREEDOM DAY on 27 April will be cel-ebrated with a creative spirit when theGenerations Cafe in Epping hosts aBand Aid fund-raiser in conjunctionwith theWesternCapeMusiciansAsso-ciation.

CalvinPeters, of thevenuebetterknownas The G Spot, says this event is to cele-brate music that played a part in the free-dom of this country, and to raise moneyfor musicians who are in despair.

“Theparticularbeneficiaryat this eventwill be guitarist Julius May, a young manwho became susceptible to substanceabuse and other temptations as well as thepitfalls of the industry like alcohol.

“After a suicide attempt three monthsago, Julius decided to turn his life aroundand go to a rehab for cleansing and to re-start his life.

“Ironically 27 April, which is FreedomDay, will mark Julius’s discharge from re-hab and the talented young guitarist haspledged to assist other aspiring musoswho experience the same struggle in theindustry.

“He will also perform with his band onthe day,” said Peters.

Peters added that Julius was one of themost talented guitarists to come up duringrecent times, sharing the stage with manyof the legends around town over the years.

Many of the musicians are supportinghim through this time and will be offeringtheir time and talents to take to the stage.

These include musicians such asJonathan Rubain, Allou April, Blackkur-

rant, Sammy Webber, The Next Step,Brown Suga, and many more, but any art-ists who would still like to perform canjust rock up on the day.

Fires will be provided for a “bring ’nbraai” and the doors will open at 14:00. Thelive action will kick off at 16:00, with a min-imum donation of R40.

SEVENTEEN anguishedyouth footballers current-ly in theUnitedStatesmay

have been disqualified –through no fault of theirown – from the annual DallasCup for under-15s.

This harrowing experience forthe youth footballers as well assome of their parents – who werepart of the tour group – broke outinto the open on Sunday.

On Sunday, seven players ar-rived in Dallas – while the otherswere on later flights, due to visaproblems that bedevilled the toureven before it got off the ground.

Parents called this newspaper tosay that the players of the Arch-bishop Desmond Tutu Ikapa Uni-ted team – headed by tour coordi-nator Basil Palanyandi – weredevastated and year-ning to return homeas soon as possible

The children hadcalled their parents tosay the team had beendisqualified on thegrounds that it hadnot met the registra-tion deadline, as allthe members had notarrived in time for theopening day, Sunday17 April.

The tour debacletook another contro-versial turn yester-day (Monday) whenPeople’s Post informed DanVaughan – the aide for Archbish-op Desmond Tutu – at his office inMilnerton about the unfortunateexperience of the tour group in

Dallas.In a subsequent statement,

Vaughan explained that the Arch-bishop’s office was no longer re-sponsible for the Dallas tour.

“About two years ago the Arch-bishop’s office, following inqui-ries to the office, became con-cerned that the Archbishop’s sup-port of the Dallas tours was beingmisrepresented and that it was notreceiving financial reports re-garding the fundraising. In March2009, Basil Palanyandi was ad-vised that the Archbishop wouldcontinue to lend his name to theproject only if audited financialstatements were provided and oth-er conditions regarding misrepre-sentation were adhered to.”

Vaughan said that no furthersupport by the Archbishop couldbe assured until Palanyandi hadprovided information. “Palanyan-di provided a file of documents but

did not comply withour request for audit-ed financial state-ments. ArchbishopTutu’s support forthe tours was accord-ingly withdrawn andhe has not endorsedthe project since then[2009],” said Vaughn.

Palanyandi has co-ordinated the tourson his own since2006, after it was runby the old Safa-Wes-tern Province from2000.

The tour deba-cle – which must rank among theworst embarrassments for SouthAfrican sport – unfolded when thedelay in the issuing of visas sawthe group’s scheduled flights to

Dallas on Sunday 10 April beingcancelled.

The visas were only issued bythe US Consulate in Cape Town onMonday 11 and Tuesday 12 April,áfter which the entire tour groupof 25people (including the 17youthfootballers) were stranded in CapeTown awaiting flights. They wereonly able to get seats to Dallas thispast Friday and Saturday.

But Elizabeth Kennedy Tru-deau, the spokesperson for theUnited States Diplomatic Missionto South Africa, said that the USEmbassy is not to blame for the de-lay in visas for the tour group.

“The US Embassy cannot dis-cuss the details of any individualvisa case. Every applicant goesthrough the same visa applicationprocess to determine their eligibil-ity for a US visa. The United Statesgovernment is in no way involvedin the organisation of this tourna-ment (Dallas Cup), so we cannotaddress the concerns with the or-ganisation or management,” saidTrudeau.

Some parents, however, claim

that Palanyandi blamed the em-bassy for the visa delays, whereasthey are pointing fingers at himfor not “fulfilling his duties cor-rectly and timeously”.

When this newspaper asked Pa-lanyandi on Wednesday 13 April togive his side of the story, he de-clined to comment because he was“too busy dealing with visas”. OnFriday 15 April, Palanyandi saidin an email message: “Your call re-garding the Archbishop DesmondTutu Ikapa United team – no com-ment. You are however invited toattend the report back meetingonce the team returns. Will giveyou date, time and venue for thatmeeting”.

The Safa Cape Town (Safa CT),of which Palanyandi is an execu-tivemember (headof fixtures), hasdistanced itself from the DallasCup controversy.

Norman Arendse, the presidentof the Safa CT, said the Safa CTwas not at all involved in the tourarrangements. “It is the responsi-bility of the SA Football Associa-tion (Safa) to approve all tours toforeign countries – and not for aregional affiliate to do so”.

Arendse, however, expressedconcern that the Safa had not li-aised with his association prior toapproving the tour. “We (Safa CT)will summon Palanyandi to ameeting after he returns fromAmerica, said Arendse, express-ing his disappointment that youthplayers were subjected to such anexperience.

The LFA Cape District, ofwhich Ikapa United is an associ-ate, said: “As Cape District LFA,we have not received any com-plaint from any parents over thelast ten years regarding the Dal-

las Cup Tournament.“Like any club (Ikapa), reques-

ted permission from Cape District,Safa and Safa CT to partake in theDallas Cup tournament. We con-cede that we are aware that theteam did not leave as originallyscheduled due to visa problems.

“We are, however, unaware ofthe financial implications as nofunds were directed via Cape Dis-trict for this tour. Cape District isnot in a position to comment onthe operational issues for thistournament or any other tourna-ment hosted by any other club.

“Therefore it is recommendedthat you contactMrPalanyandi di-rectly with regard to the Dallastournament,’’ said Grant Adams,the general secretary of the LFACape District.

However, several angry parents– such as former Springbok rugbyplayer Dale Santon – are furiousabout the trauma their childrenhave experienced over the pastfortnight. It cost Santon overR20 000 for airfare and other ex-penses to send his son, a memberof Wynberg-St John’s AFC, on hismaiden overseas tour.

Winston Faulmann, whose sonis a member of the Western CapeSports School, spent over R60 000for him and his wife to join thetour group. He is calling for an ur-gent meeting “to put the recordsstraight once and for all”.

What irks the parents even fur-ther is that their children were ab-sent from school for five days,while on stand-by for flights.
