Verreyn le Roux and Terrence Blake were found not guilty in the Cape High Court on Friday 16 August. They say they will pursue legal action against the officers. They claim to have been wrongfully arrested and assaulted by a po- lice officer and reservists. Le Roux says: “The judge was shocked to hear about the lack of evidence from police and found me not guilty. I now plan to take this matter further because I feel there were some incorrect things said about me and now I would like to clear my name.” In June last year, both men attended a farewell function at a local pub when Blake noticed that a Metro Police officer was busy writing him a parking violation ticket. He says he approached the officer and was told by a Diep River police reservists to “shut up” (“Under fire”, People’s Post, 12 June 2012 ). When Blake reminded the re- servist he was not allowed to speak to him in such a manner, the officer repeated him- self, using expletives. Le Roux came out of the pub to find he had also been ticketed. He said he heard the re- servist screaming at Blake to “shut up”. When Le Roux approached the reservist and pointed out that he had no right to speak to Blake in that manner, he was told not to interfere and he could be arrested. The incident quickly spiralled out of con- trol, resulting in the reservist calling for back-up and eventually arresting the men for resisting arrest and charging them with assault on a police officer. “When we got into court, I explained to the judge that I merely placed my hand on the shoulder of the officer, who then turned around and said I assaulted him,” Le Roux says. Both were held at the Diep River Police Station. Le Roux’s lawyer was quickly con- tacted and they were released the following morning. “I am not going to let this slide and I am planning to take action against this police station,” says Le Roux, who is himself a former reservist at the Diep River Police Sta- tion. Blake says police thought they were “su- per cops” and believed they could treat peo- ple any way they liked. “It was plain police brutality because we did nothing wrong. They thought just be- cause they are wearing a uniform, they could treat us the way they want,” Blake says. “I was upset from the beginning and I still am. This whole thing was just com- pletely unnecessary.” Moses Dlamini, spokesperson for the Inde- pendent Police Investigative Directorate (IPID), says: “If the men were wrongfully ar- rested and they have witnesses, they have to lay a civil complaint against the officers involved. “If there is assault involved, we will inves- tigate. The outcome of the investigation and the punishment the officers receive, if they are proven guilty, will only be determined by the court.” Dlamini confirms the matter is currently still being investigated by the IPID. “The investigation is complete and the docket will be sent to the DPP for a decision shortly,” he says. Diep River police station commander Colonel Moses declined to comment on the possible charges being made against the of- ficers. “We are not aware that the men intend to sue the police and if it is the case, then they are well in their right to do so. We will have to wait and cross that bridge when we get there,” says Moses. He says police have not received the docu- ments from court as yet and that the station was unable to revise the court’s findings. “We cannot comment on something that has yet to appear before a judge, but we will wait for the documents to arrive from court before we share any further information,” Moses says. Le Roux and Blake say they are seeking legal advice to pursue the matter. GOOD JOB: As part of Wom- en’s Month celebrations, the women at Steenberg Police Station were honoured at a formal function held at the station’s boardroom on Thursday. The women re- ceived certificates, gifts and medals to highlight their ef- forts when fighting crime in their community. To go with their gifts, they were also treated to breakfast. Some of the female officers received medals for the efforts and professionalism displayed on the streets every day. Tampering with evidence at a crimescene could result in criminals gettingaway with murder.

It also, inevitably, means there is no clo-sure for loved ones.And, police say, evidence collected at

crime scenes found to have been tamperedwith or collected incorrectly is inadmissiblein court.

Warrant Officer Frank Jaftah from theprovincial Forensics Unit says police havelostmany cases because of a lack of evidencein court. “People often touch the evidence orwash surfaces because they’re not knowl-

edgable about solvingcrimes.”Commander at the Se-

rious andViolent CrimesUnit Captain Henry Pe-tersen says people wantto assist the police withcrimes and end up pick-ing up evidence fromcrime scenes mistakenlythinking they’re helping.“Each time a different

evidence sample is col-lected different glovesneed to be used. This is toprevent DNA from beingtransferred and tam-pered with,” Petersensays.Opportunistic crimi-

nals are no help, either.He refers to a case inwhich a delivery truckand a security van cameunder fire.“Community members

got involved at the crimescene and stole the at-tacker’s gun. The gunwas later found in aneighbouring communi-ty, but the evidence fromthe initial crime scenewas tampered with. Thethief was charged with defeating justice andtheft,” he says.Jaftah says theDNAProject is being rolled

out to train people about the correct proce-dure to follow at a crime scene.“The thingswe look for are not always vis-

ible with the naked eye. Sometimes we evenfind that police officers just walk throughthe crime scene,” he says.“Since 2011 I’ve travelled the province ed-

ucating prosecutors, the public and policeofficers about evidence, exhibits and how tobehave at crime scenes.”Veronica Cloete attended the workshop

and wants to see these education drives of-fered to other communities, too.“I learned where I should stand and what

to do when there’s a shooting,” she says.For Shereen Hendricks the highlight of

the workshop was learning what to do aftergunfire. “At shootings and murders peopleusually only look for bullets and don’t real-ise they’re damaging the scene by not con-trolling the crowd,” she says.“Now I know about the importance of foot-

prints, hair and clothing at crime scenes.”The DNA Project, an organisation which

assists the police to educate the communityabout the preservation of evidence, wasstartedafter founderVanessaLynch’s fatherwas murdered and the crime scene was con-taminated.“There are a number of projects which we

provide, and educating people about the im-portance of protecting DNA evidence foundon crime scenes is just one of the facets of

our organisation,” she says. “It was initiallydifficult to convince people to let us conductworkshops, but now we’re conductingawareness workshops with police officerswho arrive at the scene first, but are notqualified to collect evidence. Their job is tocordon off the crime scene, and our aware-ness workshops facilitate their understand-ing of why it is important to do this so thatwhen crime scene investigators arrive,there is uncontaminated and valuable evi-dence still preserved on the scene.”Lynch says the workshops are free and all

the material is provided.Last week themuch debated DNABill was

voted into Parliament which will include aDNA database of individuals who have beenarrested. “The new lawmakes it mandatoryto take DNA samples from suspects at thetime of arrest and then before their releasefrom prison,” she says.“All offenders convicted of serious violent

crimes which include rape, murder andtheft, who are in prison, as well as paroleesand remand detained individuals will alsohave to give samples of their DNA. This lawwill allow police officers to take samplesfrom arrestees and convicted offenders,which will eliminate suspects and preventwrongful convictions. Only the sex of theconvicted person will be revealed on the da-tabase.”Kathleen Dey of Rape Crisis says the win-

dow in which a rape survivor can have evi-dence collected is 72 hours.“Most do not know the importance of this

time period and are not aware of the impor-tant steps to take to preserve as much evi-dence as possible,” she says.“Research which the organisation under-

took last year shows a lack of understandingof the criminal justice systemwas themajorfactor stopping people from reporting andthus securing evidence immediately.”Policing and Forensic Investigation aca-

demic Professor Rudolph Zinn says courtsplace a large focus on DNA and science.“Police statistics for successful investiga-

tions vary because there’s a large differencein results when compared with convictionrates,” he says.The police base its 60% success rate on ar-

rests, whereas the court’s 7% success rate isbased on convictions.“This low success rate is largely based on

lack of evidence pointing to perpetrators be-cause of inadmissible evidence collectedfrom crime scenes.”The question of inadmissible evidence has

led to police recruiting an additional 900fieldworkers to process scenes, Zinn says.“Police also need to look at how they train

their officers. There’s a lack of accountabili-ty and mismanagement at middle manage-ment levels.”

The recent closure of a shebeen in Re-treat has given the community hope forthe future.

After several complaints, the shebeen in10th Avenuewas slammedwith a R2 500 fineand was given a written undertaking tocease operating by Sunday 1 September.The City of Cape Town confirms that the

owners of the shebeen pled guilty on 31 Julyfor contravening Section 30 of the Land UsePlanning ordinance.Retreat resident Franklyn Adams is over

the moon after the receiving the news. Hesays residents battled for answers and solu-tions. “This shebeen caused a number ofproblems for this community and I cannotunderstand how this sort of operation wasgiven permission and it is situated right inthe middle of a residential area,” he says.“The closure of this shebeen should be an

example to other illegal shebeens in the com-munity, because there are plenty of themcurrently operating. That is no secret.”Another resident, Yasmeen Davids, was

delighted to be informed that the shebeenwill no longer be allowed to operate.“Our community is bombarded with so-

cial issues and one of them is alcohol abuse.It does not help to have these sorts of busi-nesses running from residential areas. Itsends out a really bad message,” she says.Kevin Southgate, Steenberg Community

Police Forum (CPF) chairperson, confirmsthat a number of complaints had been re-ceived regarding the operations at the 10thAvenue shebeen.He explains that the business had the re-

quired licence to run a shebeen, but thehouse was not zoned to run a business from.“This action is very good and positive for

our community, because we do know thereare plenty of shebeens currently operatingin our community without the required per-mission and licensing,” he says.At a CPF meeting on Wednesday 21 Au-

gust, the City was requested to use the sameapproach when tackling other illegal she-beens in the area. Southgate says the actionby theCity is “mostwelcomed” andhas been

“positively accepted” by the community, butwould still like to send out a stern warningto other shebeen owners dodging the law.“We still feel that theCity shouldnot allow

shebeens or liquor outlets to be runningfrom the middle of a residential area. Wehope this becomes a test case and others willalso have the full might of this legislationthrown at them,” he says.Ward councillor Jan Burger says closing

down the shebeen in 10th Avenue was a“lengthyprocess”, but is satisfied tohear theaction by the City has been well received.He remains confident that the City will

continue to be “persistent”, but requeststhat the public also get in on the act.“It’s also up to the public to assist the City

After months of hard work the new andimproved victim support room at theRetreat Railway Police Station will be

opened later today.Sergeant Jacky Nortier explains the sta-

tion was previously under the managementof national government, but now forms partof the Wynberg Police Cluster.

“For several months Antoinette vanHaght was the only counsellor volunteer-ing at the station. Due to the new manage-ment structure, our station has gained thesupport of the Kirstenhof Police Station aswell as their victim support counsellors,”she says.

Van Haght says she is excited about thenew room as it will make people comforta-ble.

“When people are comfortable and theyfeel safe, they are able to talk freely and thishelps them deal with what has happened,”she says.

Kirstenhof Police Station victim supportcounsellor Sandy Graham says when shefirst visited the room which consisted of abed and bathroom she knew it needed a re-vamp.

“I was saddened to see the state of theroom, which looked more like a hospital

than a safe haven for victims of crime,” shesays.

Peter Mouton of the Kirstenhof Commu-nity Police Forum (CPF) stepped in andwith the help of local businesses, revampedthe room.

“We received help from Cardinal flooringspecialists, Indigo Blinds and TafelbergFurnishers in Tokai. The CPF often hostsfundraisers to help support the victimrooms like the annual golf day,” he says.

Nortier explains that due to its location,police officers often assisted people with in-cidents which took place in other areas.

“We have offered counselling to many dif-ferent people over the years. Because weare located at the Retreat train station wefind that many people come from the sur-rounding areas in the southern suburbs toreport incidents and require counselling.

Graham says it is important for the pub-lic to be informed of the service being of-fered at the station.

“It’s a safe place where people can cometo talk about what they experienced. It’s al-so important to note that sometimes vic-tims of crime do not want to report it butmay need the counselling to deal with thetrauma,” she saysV For more information call Sergeant Jacky Nortieron (021) 710 5125.

“Nippers are ‘lifeguards-in-training’, be-tween the ages of eight and 14. We also offera Starfish programme for children aged fiveand six and MicroNippers for children agedseven and eight.”

Nippers, at Fish Hoek Lifesaving Club, of-fers children the opportunity to learn var-ied water skills like surf swimming, bodyboarding and knee boarding; how to com-pete and interact within a team; water safe-ty and training, and basic First Aid train-ing.

The Starfish and MicroNippers learn theimportance of water safety, sea conditions,dolphin diving, flag systems, boogie board-

ing and, most importantly, how to have fun!For those moms and dads who may be

worried about safety, fear not. Safety is ofparamount importance at Fish Hoek Life-saving Club. Lifeguards are on duty everyweekend and every day during October, De-cember and April school holidays from 10:00until 18:00.

Safety officers, shark spotters and par-ents are on duty at every training session.An exclusion net and shark shields are usedfor water safety.

And no nipper goes in the water if it isnot safe.

Fish Hoek Surf Lifesaving Club has a pro-fessional management and coaching teamand is a fun and competitive family club.

up to the seventh generation, VW has beenchallenging themselves.Pure perfectionwith each generation.Or,

shall I say, pur-fection. The Golf is, and al-ways will be, a wild cat.Awesome to look at, yet taunt it and it

turns into a tiger ready to pounce.Stretches of road turn into its hunting

grounds. Other road users turn into itsprey. Luckily, this time round, I was thehunter and not the hunted.My favourite hunting ground (road) in

Cape Town CBD has to be De Waal Drive.If you don’t knowwhere it is, it’s a little slipway just off the M3 taking you into the ur-ban jungle.Not reallymy favourite during rush hour

traffic, although the views are spectacular,it is the best when traffic has cleared.It so happens to be a favourite to the Golf

7 as well. The car becomes one with theroad. I wasmerely a passenger in the driverseat. There was no work for me to do. TheGolf stuck on that road, like white on rice.It didn’t lean into the corners; it became

one with the corners. Each and every oneof them, without fail.I was told once by someone on a 4x4 track

that the onlyway to successfully go througha track is to trust your car 100%.And that goes for any road and any car.

Without trust there isnothing. Iwould trustthe Golf 7 with the lives of all my loved ones– no doubt.Imake it sound like I drove theGTI,when

in actual fact, I drove the 1.2F TSI.Hold on! 1.2FGolf?Really?Thoseweremy

first thoughts.The Golf is supposed to be the big boy in

the VW family. Now it sounds like a 1stgrader?! After driving the 1.2F was con-vinced someone had lied to me, and that init must have been at least a 1.6.This car packs a punch that could send

Mike Tyson all the way back to his glorydays in the ’80s.It might be the baby of the family, but it’s

the straightA’s baby. The one that the fami-ly brags about at braais. The one that kicksout 77kW. The one that has BlueMotiontechnology that gives you about 100km per4.5F.The new generation Golf hasn’t changed

Sunday.The finalwas the culmination ofmonths of qualify-

ingmatches and over 40matches at theweekend, andpitted together two of the title favourites.People’s Post is the tournament’s printmedia spon-

sor.The Urban Warriors breezed through the group

stages, quarter-finals and semiswith a perfect recordas expected, scoring 13 goals and conceding just one.ASD had a less a comfortable route to the final,

drawing against United FC in the group stage andscraping past Bishop Lavis on penalties in the semis.Buoyedby their success in the earlier rounds,Ajax

needed no time to settle in the final and were in all-out attackingmode as soon as the firstwhistle sound-ed.The defending champions won the midfield battle

and imposed their style of play on the game to takefull control and keep ASD pinned in their own half.Ajax regularly got in behind the opposition de-

fence, but couldn’t come up with an accurate finalball to take the lead.The second half started as the first had, with Ajax

pushing for a breakthrough and ASD hesitant tocommit numbers to attack.Though theUrbanWarriors continued to look dan-

gerous, they seldomthreatenedand found theopposi-tion keeper up to the task when tasted from longrange.Neither team found a goal in the remaining min-

utes, and, in the end, Ajax won 4-3 on penalties, afterthe match ended in a goalless draw after regulartime, to take their sixth title in the 10th instalmentof the Challenge.Meanwhile, tournament hosts Santos had a tour-

nament to forget. The People’s Team finished sixthoverall, after finishing second in 2012.Pinelands clubOldMutualAcademy finished fifth,
