THE OWNER of a Kenilworth buildingmay have to demolish the constructionwork added.
The additional work done on the buildingis allegedly a threat to patrons and the Cityof Cape Town has applied for court orders todemolish the first-floor work.
Planning and Building Development Man-agement director Cheryl Walters says: “AHigh Court application to obtain a number ofcourt orders is to direct the owner of 166 2ndAvenue, Kenilworth to demolish a timberdeck which encroaches over City-owned landand the work on the first floor which did notcomply with the approved plans.”
The building formerly housed Italian res-taurant Trattoria Angelico, but it has been
vacant for about three months, according toneighbouring outlets.
Attempts to reach the owner, Alan Muller,were unsuccessful.
Paul Dobson, owner of tavern Hobnobs op-posite the building, says: “I understand theCity and the owner have been in court withregards to what is to happen with the build-ing.”
Dobson adds he believes the City wants thebuilding restored to the state it was in in 1998.
Walters says: “The court granted an inter-im order for the owner to give reason why thefinal order should not be granted on 28March.
“The matter was postponed to 30 May witha timetable to file papers. The attorneys forthe owner filed a notice of opposition on 21May.”
After this incident, the City obtained a
court order to compel the owner and his attor-neys to file the papers.
When in court on 30 May, another post-ponement was requested, but this was forMuller to launch review proceedings againstthe City’s decision to refuse to rezone the landupon which his building was encroaching.
“If the rezoning was completed, it wouldpermit the sale of this land to Muller after fur-ther processes had been completed, but thisrezoning decision had been finalised in May2010,” says Walters.
Ward 59 councillor Ian Iversen sent Dobsonand others a notice about the complex saying:“Mr Muller has been instructed many timesby the Cape Town municipality to address theproblems, but he has chosen to ignore all offi-cial notices.”
Tenants of the remaining businesses saythey know nothing of the alleged demolition,
but one of the tenants, who prefers to remainanonymous, says: “Some of these allegationsare not true and so many locals have lost jobsbecause of it, but I don’t want to be involved.”
Walters says the court granted a postpone-ment until 10 September for the review appli-cation and the demolition order to be heardat the same time.
“It must be noted that these proceedingsare not instituted in terms of the City’s Prob-lem Building bylaw, but due to the fact thatthere are deviations from approved buildingplans and building plans for the deck, whichis in any event encroaching upon City-ownedland,” says Walters.
Muller did not respond at the time of goingto press, but his lawyer Robert Younglesonsays: “The matter is currently sub-judice andI am not entitled to speak about it. It is nota public matter, it is still before the courts.”

We salute our community workersWe salute our community workersDear reader,
Last week I had theprivilege and honour ofmeeting two inspiration-al community workers;Ebrahim Hull ofLansdowne and Ottery’sKeith Blake.
Both men are passion-ate about serving their communities, altru-istically, and asking for nothing in return.
Charismatic Ebrahim visited our officesand regaled us with his knowledge of thedynamics and pulse of both young and oldin his community.
Ebrahim has been a resident ofLansdowne for 38 years and is known as the“Mayor of Groenvlei”.
Day and night, he is always on call whenhis communityneedshim,but thishumble,modest man does not want praise, high-lighting instead the good work of other un-sung community heroes.
At one stage, Ebrahim was secretary offive different organisations simultaneous-ly, in addition to holding a demanding full-time senior job in the furniture business.
His concern for the challenges faced bysociety, especially young people, is toppedonly by the action he takes to address social
issues such as vagrancy, drug abuse andcrime.
Among others, he was the founder ofsome community structures, has been in-volved in sport and cultural bodies, servedhis local mosque and was a radio presenter.
Luckily for wife Gadija, this is all in thepast and Ebrahim can now focus primarilyon being a doting husband and father to histhree sons and daughter and grandfatherto 12 granddaughters and four grandsons.
My meeting with Ebrahim was followedby a visit to Keith’s home and I was warmlywelcomed by Keith, his wife Tina, adorablegranddaughter and the family’s dog – whowas perhaps not so pleased to meet me.
A retired police captain, Keith is called“Kaptein” by the many underprivilegedpeople whose lives he touches.
With Tina at his side, he tirelessly servespoor communities and the couple alwayshave a meal for the poor who come knock-ing at their door.
Keith is a regular letter writer to People’sPost. Tina, he says, is his soulmate, hisvoice of reason and the editor of the numer-ous letters he sends us.
A gate they had recently put up, has hadto comedown, they say, as it obstructs theirview of “their people” – referring to thehomeless and other needy people who come
to them for food.Assisted by others like them and their
family, including three sons, the couple’sfocus is providing relief, love and prayerto residents in informal settlements andother underprivileged areas.
Over the years they have taken goodssuch as food, clothes and blankets to theneedy, ensuring that Christmas cheer pre-vails in the poorest of communities andproviding Easter eggs and pickled fish tohundreds of poor people over Easter. Theirprayers and public appeals have alwaysbeen answered abundantly, with truck-loads of goods coming their way and find-ing its way through them to those in need.
Both Keith and Ebrahim are spiritualpeople, expecting nothing in return fortheir good deeds which impact on hun-dreds, if not thousands, of lives.
Their philosophy, positivity and eternalhope in the face of despair provehowsignif-icant a difference one person can make;that it really does begin with one.

RESIDENTS in Rosebank and Mowbrayare frustrated that plans for Durban Roadmay affect their property valuations.
Their concerns were raised at the Rose-bank and Mowbray Civic Association annualmeeting on Wednesday where the main topicof discussion was the future of Durban Road.
Association chairperson Jonathan Hobdaysays: “It is a concern to the communitywhether the road is going to be developed intoan eight-lane highway and what will happento the property value.”
Councillor for ward 57, Brett Herron, andcouncillor for ward 58, Matthew Kemp-thorne, explained the process involved.
The manager for Transport Network Infra-structure Development, Tony Vieira, allayedconcerns.
Vieira says: “No major changes will bemade in the near future, we would have to gothrough a public participation process beforeimplementing anything. We need to engagethe concerns of the community.”
Vieira says for the next three years therewill be no widening of the road or improve-ments, adding for “the next eight to 10 years,there is no development set for the Klipfon-tein/Durban Road public transport corri-dor”.
Herron added the City’s focus is on the Met-ro South-east with regard to public transportcorridors. He says “with the Integrated RapidTransport trunk routes into Claremont and
Wynberg we are looking at Lansdowne andWetton Road”.
Residents were put off by the inability ofCity representatives to give a definite answeron whether Durban Road would be developedor not, but, saysVieira, they have “confirmed42 road schemes (will) be abandoned”.
This includes the Wynberg bypass, whichwould have divided Maynardville.
Richard Matzopoulous, a resident of Mow-bray for the past 10 years, says he is two-minded about whether the road should be de-veloped.
“If the City does this properly – if the roadis developed correctly – it could be a goodthing because for the traffic it experiencesdaily Durban Road is rather dangerous. Ifthey could decrease the volume of cars usingthe road, things could improve and it maypush the property value up again,” says Matz-opoulous.
Herron and Kempthorne said the Citycouldput in traffic calmingmeasures tomakethe road safer, but Kempthorne adds: “Thesemeasures are costly. In my ward I have 78 pro-posals for traffic calming measures and theytotal R7 million. The City only has R3.2 mil-lion budgeted for these measures whichmeans I will only be able to implement threeperhaps. But we have to assess which aremost important.”
James White-Phillips, a resident of LittleMowbray for 40 years and former chairper-son of the civic association, expressed con-cerns about property values.
White-Phillips is currently head reservistat Mowbray police.
He says: “We are concerned about the prop-erty value. What is most frustrating is the un-certainty about this (and) that the City repre-sentatives will not so much as give a ‘worst-case scenario’. All they say is ‘it is up for
review’ and that it isn’t on the list to bescrapped.”
Another resident, who preferred to remainanonymous, says: “The Mowbray transportinterchange is too small for the traffic vol-umes it experiences.
“Having two Golden Arrow buses takingthe bend at the same time is an accident wait-ing to happen.
“Something needs to be done about the sizeof the interchange and smaller buses will beneeded if they don’t.”
Besides the fate of Durban Road, Hobdaygave general feedback regarding the status ofcrime and other developments in Mowbray.
Says Hobday: “There has been steady
progress with problems experienced in thearea, such as a real improvement in Mow-bray’s Central Business District.
“It isn’t spic-and-span, but it is most cer-tainly a lot better.
“Crime at certain hot-spots have alsodropped and sector policing is a brilliant ini-tiative which I think should be expanded.”
Patrols by a number of different neighbour-hood watches and private security compa-nies were also commended for their goodwork.
Hobday added efforts will be made to cleanup the land along the railway lines as it is a“pigsty and a cesspit of litter and other activi-ties”.

PLANS to refurbish the open space ofPrincess Vlei into a natural fortress wastaken to a higher level on Saturday.
A People’s Rally, hosted by the PrincessVlei Forum (PVF), attracted more than 2 300people. The event also saw the signing of apetition to save the vlei from being devel-oped into a mega-mall.
The proposed development by InsightProperty Developers is expected to comprisea 9090m² shopping mall and a 100m² taxirank, leaving only a 30m buffer strip fromthe vlei’s shore for recreational purposes.
It has been a tug-of-war between the own-ers of the land, the City of Cape Town, theprovincial Department of EnvironmentalAffairs and Development Planning andthose opposing the development since theplans were initially submitted more than 15years ago. In November the City’s SpatialPlanning, Environment and Land Use Man-agement Committee (Spelum) turned downthe developer’s application for the extensionof the rezoning.
The developers, in turn, appealed to theMEC for Environmental Affairs and Devel-opment Planning Anton Bredell, who ap-proved the application for the land to be re-zoned from public open space to business.
But there is still no clarity on whether thedevelopment has received a final approvalfrom the City. And those in opposition to thedevelopment have decided to launch the Peo-ple’s Plan – a plan to refurbish the land andrecreational space, a walk-way around thevlei, a community garden, a market place
and an Environmental and Socio-natureCentre where the history of the Cape Flatswill be curated (“Plans for the Princess”,People’s Post, 5 June).
At the rally Philip Bam, chairperson of theLotus River and Grassy Park Civic Associa-tion (Logra) and a founder of PVF said: “Oneof the wonderful things this campaign hasdone for us is it has brought us to realise whowe are – in this way they took away our herit-age and inheritance. Just as we are restoringthe fynbos here at the vlei, we will restoreour dignity.”
Also showing his support for the plan wasCosatu provincial chairperson Tony Ehren-reich. “Don’t for a minute believe those whowill tell you workers will stand with thesebig business interests because it will provideus jobs. We know we need jobs in this coun-try, but much more importantly we know weneed to defend and sustain our heritage andthat is why Cosatu is standing behind thePrincess Vlei committee,” he said.
“This is not about politics and it is notabout race; it is about assuring ourselvesthat we must stand on the side of justice. Weneed places where we can come together asblack and white in a real space, like the Prin-cess Vlei. But those spaces are shrinking –they are being taken away, but they shouldbe expanding. We want to assure you thatwhile we will sign petitions and pray for thePrincess Vlei, we will also not hesitate tofight for the legacy of all our people.”

Properties were selected to appear on the Sixth Supplementary Valuation Roll to the 2009 General Valuation Roll (SV06) Roll in terms ofsection 78(1) of Act if the property a) was incorrectly omitted from the Valuation Roll; b) has been included in the municipality after the lastgeneral valuation; c) has been subdivided or consolidated after the last general valuation; d) has undergone a substantial increase or decrease inmarket value since the last general valuation; e) was substantially incorrectly valued in the last general valuation; f) must be revalued for any otherexceptional reason; g) of which the category has changed.
In terms of Section 49(1)(a)(ii) of the Act, any property owner or person who so desires may lodge an objection with the municipal manager inrespect of any matter reflected in, or omitted from the valuation roll, within the abovementioned period.
Objections may only be lodged in respect of properties valued on the SV06 Roll. The owners of these properties will be notified of theirSV06 valuations in writing at the postal address currently held on the City’s database.
Attention is specifically drawn to the fact that in terms of section 50(2) of the Act an objection must be in relation to a specific individual propertyand not against the supplementary valuation roll as a whole. ENVIRONMENT lovers now have a newapplication to share what they see.
Kenilworth Racecourse Conservation Ar-ea (KRCA) and the SA National Biodiversi-ty Institute (Sanbi) recently launched iSpot.
Sanbi representative Sarah Hutchinsonsays: “The launch consisted of a number ofbioblitz sessions which aim to identify asmany species as possible at a particular siteand date.”
The launch consisted of bioblitz walksthrough the conservation area at Kenil-worth Racecourse and a workshop.
Tony Rebelo, of the institute, says: “Theinitiative is brilliant because we would liketo have people and experts interacting onwhat they see around them, not only in con-servation areas.”
After the bioblitz the participants, whorecorded what they saw on cameras, wouldjoin the workshop which explained how theapplication functions.
KRCA representative Skye Marks says:“It is a fun way for people who are interest-ed in the same things to engage with eachother.
“Besides the fun aspect, it is also an edu-cational tool because if you, for example, donot know about a specific species, someoneelse may be able to tell you what it is.”
Marks says unknown species can be re-searched by scientists, which will “helpwith the discovery of new species”.
Dubbing the application “Facebook fornature”, Marks says it is rather simple touse.
After logging onto the website, a profileneeds to be created. After inserting the nec-essary credentials, ‘observations’ can be
uploaded. Picture format can only be JPEGand a variety of tags can be used when iden-tifying the content of the observation.
Before the observation is completely up-loaded, the user will be required to identifythe location of where they saw the specificspecies on a map.
Marks says: “There is a fun element add-ed to the application in that the more plantsyou identify correctly, the more points youearn. There’s no prize for the most points,but makes budding conservationists wantto learn more in order for them to be correctand earn the points.”
The idea for iSpot started in 2008 underthe Open University in the UK and after itgrew substantially in popularity, the found-ers decided to try it in a biodiverse countryand chose South Africa.
Hutchinson says: “Sanbi decided theyneeded a citizen science initiative and
agreed to try it. We released it in March 2011and it has proven to be successful becausewe now have 750 users who have submittedover 15 000 observations.
“The site is now completely user-driven,with experts sharingknowledgewithbegin-ners and more people are learning about na-ture.”
For those who are hoping to learn moreabout the application, Hutchinson saysSanbi could be hosting more workshops forschool groups and the public in the near fu-ture.

Robberies at knifepointRONDEBOSCH police are warning resi-dents to be vigilant when on foot.
Two people were robbed at knife-point atRondebosch Common on Wednesday.
The station’s spokesperson, Warrant Of-ficer Lyndon Sisam, says: “The incident tookplace at 16:15 at a time when it is still rela-tively light. This calls for concern becausemany people use the Common.”
Two men approached the victims. One ofthe suspects pulled a knife and robbed themof their cellphones and a pair of designersunglasses.
Another incident took place later in theevening while the victim was walking inLower Nursery Road.
Just before reaching the subway, threemen confronted him.
“One of the suspects pulled a knife androbbed the victim of his phone. After rob-bing him, they fled by foot in the directionof Mowbray,” says Sisam.
Police are asking residents to be vigilantespecially when walking at night.
Sisam says: “People need to be extra vigi-lant, especially now when it gets darker ear-lier.”

Give, but through proper channelsYOUR article “Pennies for thehomeless – hand up or hand-out”(People’s Post, 12 June) refers.
The Rondebosch community has,over many years, earned a reputa-tion of generosity toward the poor.Even in these tough financial times,when many people are confrontingtighter household budgets and aresuffering from donor fatigue, ourcommunity is still giving generous-ly in our streets, at our robots andto the caller at the front door.
Such generosity is to be applaud-ed; nonetheless, there are some un-fortunate side-effects that have be-come more commonplace in recentmonths and need to be recognisedand addressed.
The first is that the volume of va-grants and homeless living inRondebosch has substantially in-creased. Our magnet of generosity
is attracting more of these unfortu-nate people into our streets andopen spaces.
With them come the problems as-sociated with sleeping rough, suchas lack of toilet facilities and uncol-lected garbage.
The second is that the volume ofvehicle break-ins and theft of valua-bles, food and fuel from these vehi-cles has increased. This is not theresult of organised crime; it is op-portunistic crime driven by need.
The third is the number of threatsand assaults that have occurred inpublic spaces as a result of drunkenincidents perpetrated by the home-less who use money, generouslygiven by residents, to purchase liq-uor. This often leads to noisy con-frontations and injuries.
The way we give to the poor andhomeless needs to change to ad-
dress the increase in crime in ourarea. We should not think to reduceour giving, but to modify how dona-tions are channelled in the future.
Giving to the poor via churches,mosques and NGOs is to be encour-aged while the handing-out of cashat robots or in the streets must bediscouraged.

THE Kenpark U23 Arising Stars tourna-ment came to a thrilling end on Sundaynight when penalties were needed to sepa-rate Woodlands United and Glendene FCin the final of the competition.
Both teams went into the tournament withsignificant advantages over the other ama-teur sides who took part.
Therefore their presence in the final wasnot that surprising.
Woodlands United were able to call on theexperience and quality of the coach and sevenof the players who helped them win the DuluxIntercommunity Cup recently.
Glendene boasted the steadying hand of thecoach who guided their first team to a third-place finish in the Vodacom League, the thirdtier of South African football.
The final was a contrast of styles as Glend-ene played their free, attacking style through-out the tournament while Woodlands pre-
ferred to sit back and launch quick counter-attacks.
However, it was Woodlands who took thelead in the fourth minute when Kyle Simmslotted home a loose ball after a mid-air colli-sion between the Glendene goalkeeper, a de-fender and a Woodlands attacker in the box.
It took only a few minutes for Glendene torestore parity when diminutive strikerFaizel Johnson scored after he chased downa neat through-ball.
The Mitchell’s Plain side regained the leadearly in the second half when Wesley Jassentapped home a low cross, but Glendene equal-ised soon after through striker Shane Pat-tersen.
Glendene’s forwards threatened through-out the rest of the game and the ten minutesof extra time which followed, but neither sidecould score the winning goal, and penaltykicks were needed to find a winner.
In the end, Glendene won the shoot-out andthe game, and were crowned champions ofthe tournament.
Glendene coach Heshaam Ibrahiem saysthat while he was happy with the victory, thebiggest prize his side won was the experiencethey gained at the tournament.
“We came to this tournament to developour boys, this is our U19 team.
“We’re giving them a chance to be mentallystrong and learn how to cope with the pres-sure.
“They did really well and they played thestyle of football we want, with ball possessionand counter attacking from the wings and in-side.
“I’m very happy with the football weplayed. We did not come to the tournamentto win it.
“We actually came to develop these boys,”Ibrahiem says.
The two finalists took vastly differentroutes on their road to the last match of thetournament, with Glendene scoring 11 goalsin their six games and Woodlands scoringjust two, drawing all of their games and win-ning on penalties in all three of their games
in the knockout rounds.The Mitchell’s Plain side drew their group
games against Bayhill United, Battswood FCand Juventus 0-0 and overcame Strandfon-tein FC on penalties after another 0-0 drawin the last of 16 match.
Woodlands won through on penalties againin the quarter and semi-finals after drawingLeeds Lentegeur and Greenwood Athletic 1-1respectively.
Glendene, meanwhile, scored eight goals inthe group stage, beating Stephanian Ottery3-0 and Junction Rovers 5-0 before losing toBeacon Spurs.
They then won all three their knockoutgames against Heath Athletic, tournamenthosts Kenpark United and Mr PriceParkhurst 1-0 in the last 16, quarter-final andsemi finals respectively.
Juventus won the plate final of the tourna-ment after beating Kensington AFC 1-0.

FALSE BAY rugby club are indanger of being sucked into therelegation mire after losing theirsixth match this season over theweekend.
The Constantia-based club cur-rently occupy seventh place on theSuper League A table after gaininga total of 14 points from the ninegames they have played this year.
False Bay hosted SkotschekloofWalmers at Philip Herbstein on Sat-urday and should have been wellrested and brimming with confi-dence after winning two games onthe trot before their bye the week-end before last.
The home side started off betterthan their opponents and it seemedas if everything was going to planwhen flyhalf Stef Swanich openedthe scoring after only two minutesof play.
However, the visitors weren’treading from the same script andthey took the lead six minutes laterwhen wing Ghafoer Luckan collect-ed a chip kick into the goal area toscore.
False Bay replied two minuteslater with a drop goal from Swanichto regain the lead, but this would bethe last time they had an advantageon the score board. The hosts couldnot keep up with Skotschekloof’shigh intensity game and their de-fence was breached again in the15th minutes when Zahier Rylandcut through their line and put
through a well-timed chip. Open-side flanker, Kuselo Moyake, col-lected the ball to score the first of
his two tries in the game.False Bay launched several poor
tactical kicks in the game and one
lead directly to a try when opposi-tion fullback Wilfred Pieterse gath-ered the ball and passed to outside
centre Danwill Erasmus, who out-paced the home defence to score un-derneath the posts.
SKW started the second half with14 players after lock Anton Lambre-chts was sin-binned in the 38thminute of the first half, but contin-ued scoring with two penalties ear-ly on.
Adnaan Osman seemingly putthe game to rest when he scoredSkotschekloof’s fourth try in the20th minute of the second half.
But the try seemed to lift FalseBay and they started their fightback five minutes later with a try,and then claimed another in the35th minute.
It seemed as if False Bay were ontheir way to staging a momentouscomeback, but SK Walmers repliedalmost immediately with a try fromMoyake to put the result beyonddoubt. The game finished with thescore at 39-21 to SKW.
In hindsight, False Bay’s bye theweekend before last seemed tobreak their momentum rather thanprovide them with much neededrest.
Theywill haveanotherbreak thisweekend before entering a difficultrun of games that will see them playtwo sides to whom they lost to inApril.
False Bay host Durb-Bell, whobeat them 23-7 on Friday 29 June,then play Hamiltons – who won thereverse fixture 49-3 in Greenpointon Saturday 7 July. They will thenface SK Walmers again on Saturday14 July.
