Partner agreement
Conditions:
❖ USAGE: Affiliated Partner hereby acknowledges to prescribe Courseware of Van HarenPublishing for the intended course, when the trainer material is being used in any way for thefilling of the intended course.
❖ Affiliated partner states not to copy, share or use the Van Haren Publishing Courseware andTrainer material in any way after termination of this affiliated agreement to avoid penalty oflost revenues compensation from Van Haren Publishing.
❖ Contract duration: Affiliated partner agrees to a term of this agreement for one year, startingon the day it has been signed by both parties until the same date the following year.
❖ Affiliated partner agrees to a notice of termination of 3 month in advance of the intendedtermination date if the partner wants to terminate the contract after the one year term hasbeen fulfilled. If there is no termination request after the one year term has been fulfilled, thiscontract will continue on a three month term with the possibility to terminate this contract asstated above.
❖ Affiliated Partner agrees to follow and respect the regulations and quality requirements of
the Accreditation body.
❖ Affiliated Partner states not to copy or share the Van Haren Publishing courseware to avoid
penalty of lost revenues compensation from Van Haren Publishing
❖ These training materials, in any form, and including any subsequent updates, is licensed by
Van Haren Publishing to the Affiliated Partner for exclusive use for training purposes only. The
Affiliated Partner may be an individual, a partnership, an incorporated business, or similar
legal entity. Van Haren Publishing retains full and complete title to all training materials under
the protection of international copyright and intellectual property laws.
❖ LICENSE: this agreement authorizes the Affiliated Partner with non-exclusive rights to use the
training materials for educational purposes of the company's employees or customers for
training purposes.
❖ RESALE: this license agreement specially prohibits the reselling of any of the training
materials, in part or whole, and including any and all derivative works.
❖ TRANSFERABILITY: this license agreement is solely between Van Haren Publishing and the
Affiliated Partner. This license agreement is non-transferable.
❖ LIABILITY: Van Haren Publishing, its Directors, employees, or agents shall not be held liablefor any direct or indirect damages resulting from the use of any training materials. By agreeingto this license agreement, the Affiliated Partner agrees to indemnify, defend, and holdharmless Van Haren Publishing from and against all claims.
❖ CONTROVERSY: any controversy in relation to the terms of this license agreement shall be
governed and interpreted in accordance with the law of the Netherlands. If

❖ ACCESS: Affiliated Partner may not have material made available and/or accessibleon-line or any public forum, without protecting access with a user name andpassword
Additional conditions in case of The Open Group products (TOGAF® &
ArchiMate®):
❖ Duration In case of selecting TOGAF® or ArchiMate® This agreement is binding for a
duration of one year starting from the day of signing. The agreement will continue for an
undetermined duration when a notice of termination has not been given before the end
of the initial one year duration. When the agreement has passed on to an undetermined
duration, there is a termination notice period of 3 month in advance of the intended
termination date.
❖ Obligation The undersigned of this document agrees hereby that it will follow allregulations in regards to the affiliation requirements from the Open group. Theseaffiliation requirements include:
- Usage of The Open Group logo’s according to their requirements
- Submitting of quarterly voucher reports: Complete the template provided by the VHPand send it to [email protected] by the 5th day of the following quarter(5th of April – 5th of July – 5th of October – 5th of January).
- Purchasing and provide students at any time an equivalent amount of exam voucherrelated to the TOGAF® and/or ArchiMate courseware is mandatory when purchasing thiscourseware
- The Partner will offer training courses that always include order Courseware, Examvoucher (Order trough Van Haren of through The

Upon completion of this document Van Haren Publishing will deliver the
following:
• PowerPoint sheets for training including trainer instructions
(To be found in the note pages of the Power point presentation)
• For every courseware package ordered the product described states what productwill be delivered.
