Sub:- Scheme of auto renewal of consents based on self certification

Board intends to initiate auto renewal ofconsent to operate for Green (investment more than 50

lakhs) and Orange categories ofindustries which will submit a self certification on compliance of

Environmental regulations. The strategies for effective implementations of environmental

regulations include enforcement and compliance aspects which are being handled simultaneously

with the consent.

In order to expedite the consent, it is now proposed to emphasis enforcement aiid compliance as

discrete activities along with the responsibility ofdeclaring the compliance ofregulations by the

industry while seeking renewal ofconsent. Initially the proposed scheme of auto renewal of

consent based on self certification will be rolled out for the Green and Orange categories of

industries.

The key features of this scheme are as under:

I .The auto renewal of consent will be applicable tbr the industries when there is no increase in

overall production capacity and also in pollution load.

2.In case there is increase in capltal investment the industry shall submit corresponding fees for

consent to establish ancl also difference in consent to operate fees.

3.ln case, the capital investment is decreased, then the industry need to apply in prescribed

application form.

4.Industry will have to submit a self certification on compliance ofearlier consent conditions.

This self certification shall be submitted by the authorized offrcial of the industry,duly authorized

by the owner/board ofdirectors.

5.The auto renewal will be availed for maximum 5 terms subject to payment of requisite fees.

6.The format of self certification by industries is enclosed as Arurexure-'A'.

We are submitting our consent renewal application iorm in prescribed format along with-

the necessary fees for the same. We wish to apply for auto renewal of our existing

consent referred above.We undertake the following:

I . We have valid consent to operate from JSPCB vide above refened letter and copy of

the same is enclosed.The present details ofthe manufacturing process and all other

information as required under the prescribed consent application form are same as

per the earlier consent application submitted for above referred consent and therefore

the same may be considered for present application.

2. The capital investment of the industry, as the earlier consent granted by JSPCB vide

above refened consent was Rs.-------------lakhs. The Capital investment for the

proposed consent auto-renewal is Rs.----------------------lakhs.(The change in capital

investment, if any, is only due to investrnents in infrastructure development,

clean technology,pollution control system and better production management.There

is no increase in production or pollution load than as referred in the earlier granted

consent. We are submitting corresponding fees for consent to establish and

made on pro-rata basis,duly supported by the chartered Accountants certificate to that

3. The production or manufacturing was as per the consented limits during the validity

period of the earlier consent for which renewal has been applied.

4. We are complying with the consent conditions.

5. We undertake to comply with any further condition which may stipulated by JSPCB

in future and also, undertake to pay all the charges/fees/demands in future.

6. This unde(aking has the approval ofthe Board of Directors ofthe industry and copy

ofthe resolution of the Board is attached herewith.

Procedure for submissing online Applications

P1.For making an application for obtaining consent to operate the

applicant shall go through the State Pollution Control Board website at URL www.jspcb.org or http://jhkocmms.nic.in in the home page of the URL. Please click on “online application”.

2.Registration : Before submitting the application online, the applicant

has to register , for the new users user ID and password is to e generated by clicking on the “ New Industry Link of the website” .

3.The existing users who has ID and password they can login directly to

OCMMS.

Industry user need to select “Industrial login” after registration to fill up their application immediately after signing up with OCMMS website and same login and password is to be used for subsequent applications. STEPS FOR ENTERING INDUSTRY DETAIL INFORMATION FOR NEW INDUSTRY REGISTRATION

1.After filling all details of Industry Details there is an option to fill up Occupier details. In occupier details “Hint Question” is very important for user because it is required in the case of change in password or when password is forgotten.

2.E mail address is also important in occupier details. Because of this mail address user will receive information from OCMMS.

3.The next important point is “Do you want to send login credential in mail?” To receive information by E-mail ‘Yes’ is selected .

Change Password Option

On home page, the industrial user has to select “industrial login”, and user ID and password with captcha code are to be entered and login to be clicked . The first login shall be with auto generated password, however this password should be changed for security aspects.

STEPS FOR FILING OF APPLICATION ONLINE

1.The applicant can apply their consent application by clicking on “apply for consent”. The applicant has to select CTO,CTE and Authorisation under Hazardous waste (Managementy,Handling & Transbounday)Rule,2008.

2. Similarly the applicant can register under Health Care Unit for Authorisation under Bio-Medical Waste( M & H) Rule,1998 and Municipal Solid Waste (M & H ) Rule,2000.

- Workflow MPART - A 3.The user can save this application in his account for making some changes in application, user need to save this application by selecting “In progress”(at the bottom of page). 4.In progress application will not submitted to JSPCB office and can be modified by the user. 5.Once the applicant filled up the application form completely and upload all the required documents the applicant can select button ‘completed’ and followed by ‘save’. 6.Then window will open for online payment option.The applicant can select option for payment either by Credit Card/Debit Card/Internet Banking. 7. After successful online payment the application will reach to JSPCB Office. 8.Then application will be automatically submitted to the Regional Office. 9.Then scruitiny of application alongwith supporting documents is done and subsequent inspection is carried out.

10. On successful completion completion of inspection application is approved/rejected. 11. Upon approval certificate is issued online to the applicant. 12. The certificate can be downloaded by the applicant. NOTE- Please note down the application number for future reference.
