1. These Regulations may be cited as the Parish Councils (General Election) (Leave and Symbols) Regulations, 1947.

2-(1) Subject to the provisions of paragraph (2), every employer shall permit each of his employees to be absent from his work on polling day for three hours in addition to the normal meal hour.

(2) The provisions of paragraph (1) shall not apply to any em- ployee whose work on pollins day cnmniences at or after 10 a.m. or concludes before or at 2 p.m.

3.-41) There shall be printed upon every ballot paper, opposite to the name of each candidate printed thereon, one or other of the symbols set out in the Schedule. schedule.

(2) The symbol to be printed opposite to the name of each candi- date shall be the symbol allocated to that candidate by the Chief Electoral Officer in manner following, that is to say-

Immediately after the proclamation of election shall have been made and before nomination day every prospective candidate in each electoral division shall forward to the Chief Electoral Officer a written application that he be allocated one of three of the prescribed symbols which he shall specify in the application in the order of his preference, and the Chief Electoral Officer shali, upon the nomination of the prospective candidate

as a candidate and subject to the provisions of paragraph (3), in his absolute discretion, allocate to such candidate one of the prescribed symbols which may, or may not, be one of the three symbols specified in his application :

Provided that if a person is nominated as a candidate who has not made an application pursuant to this regulation the Chief Electoral Officer shall, subject to the provisions of paragraph (3). in his absolute discretion, allocate to such person one of the prescribed symbols which has not been allocated to any other candidate in the same electoral division at that election.

(3) In exercising his absolute discretion under this regulation, the Chief Electoral Oficer shall have regard to any desire of which he is aware that candidates in the several electoral divisions who belong to the same political party or group should have allocated to them the same symbol in each electoral division.

Directions to Electors

Each elector may vote only at one polling station and for only one candidate.

The elector will go into one of the compartments and with a black lead pencil there provided place a crgss within the white space containing the name of the candidate for whom he votes, thus X.

The elector shall then fold the ballot paper so that the initials of the presiding officer and the numbers on the counterfoll can be seen and the counterfoil de- tached without opening the ballot paper; he shall then return the ballot pa er so folded to the Presiding Officer who shall in full view of those present, incfuding the elector, remove the counterfoil, destroy the same and lace the ballot paper in the ballot box. The elector shall then forthwith quit the poiing station.

If an elector inadvertently spoils a ballot paper he may return it to the Pre- siding Oflicer who on being satisfied of the fact will give him another.

If an elector votes for more than one candidate or places any mark on the ballot paper by which he can afterwards be identified his vote will be void and will not be counted.

1. These By-Laws may be cited as the Parish Councils (Clarendon) By-Laws. 195 1.

2. In these By-Laws- "the Council" means the Parish Council for the parish of Claren-

don;

"the Secretary" means the Secretary of the Council.

GENERAL

3. The offices of the Council shall be at May Pen and shall be opened daily (Sundays and public holidays excepted) for public business from 9.00 a.m. to 4.00 p.m. except on Saturdays when they will be closed to the public at 12 noon.

4. Every resolution of the Counci,l', now or at any time hereafter appearing on its minutes shall be deemed to have been regularly introduced and passed notwithstanding any irregularity in the introduc- tion or passing thereof, and shall be valid and effectual to all intents and purposes, and every such resolution shall be deemed to have received the assent of the Council on the day on which the minutes show that such resolution was passed.

5. No resolution duly carried shall be altered or rescinded unless seven days' notice that its alteration or rescission is to be proposed shall have been given to every Councillor.

6. All queries from the Audit Office in connection with the Council's accounts shall be dealt with by the Council's officers and submitted to

the Chairman of the Council prior to transmission to the Auditor General; such queries and copies of the replies thereto shall be placed before the Council at its monthly meetings.

7. Tenders addressed to the Council shall not be opened except in the presence of the Council or of the committee appointed to consider the particular tender and every tender so addressed shall be properly sealed.

8. All correspondence, documents and accounts intended for presen- tation to the Council shall reach the Secretary at least ten clear days before the meeting at which it is intended that they shall be considered.

9. Petitions to the Council may be sent to the Secretary or may be presented by any Councillor provided that such petitions are properly and respectfully addressed.

10. The Secretary shall- (i) cause a notice convening each regular meeting to be published

in the Gazette at least seven days before such meeting and shall forward a copy of such notice to each Councillor at least seven days prior to the meeting, provided that omission of such publication shall not invalidate the proceedings of any meeting;

(ii) keep the minutes of the meetings of the Council and of committees of the whole Council and shall circulate a copy of such minutes to the C~unci~lors and shall be responsible for the custody of all documents placed before the Council.

11. The minutes shall record the names of Councillors who attended the meeting and the decisions arrived at at such meeting, and shall. after confirmation, bz signed by the Chairman. In the case of divisions. the minutes shall state the numbers and names of Councillors who voted for and against the question, and of those who declined to vote.

MEETINGS 12. The regulax meeting of the Council and of the Local Board of

Health shall be held in the Council's room at May Pen commencing at 10.00 a.m. and closing at 4.00 p.m. on the second Thursday of each month or as near to that date as may be convenient. The Council shall adjourn for luncheon at 1.00 p.m. and resume at 2.00 p.m. Five Councillors, including the Chairman or other presiding Councillor shall constitute a quorum at all meetings of the Council or committee of the whole Councit.

13. On the day appointed for the meeting, the Chairman or other presiding Councillor shall call the meeting to order at 10.00 a.m. or soon thereafter as a quorum shall be present. If there is no quorum by 12 noon the meeting, if a regular one, shall stand adjourned until the next monthly meeting, and if a special meeting, sine die.

14. The declaration of new Councillors may be taken when they present themselves for the purpose at any time after the reading of the minutes, provided that no business is thereby interrupted.

15. No Councillor shall leave a meeting of the Council except with the consent of the Chairman.

16. The Chairman, or in his absence, the Vice-chairman, may postpone any meeting of the Council if the occasion so warrants:

Provided, however, that every Councillor be notified at least five days before the date of postponement.

17. Should any meeting be adjourned before the business for the day has been completed, the remaining business shall be taken up and be disposed of before all ordinary business at the next meeting.

18. The Chairman, or in his absence, the Vice-chairman, may at any time by giving such notice to the Councillors as in his discretion the circumstances require, call a special meeting of the Council', and shall also do so on the requisition of not less than five Councillors. Notice of such a meeting shall specify the business to be considered and only business so specified shall be considered.

19. In the event of the Chairman, or in his absence, the Vice-Chair- man, refusing to call a meeting when requested by five Councillors so to do, it shall be competent for the Secretary on receiving directions in writing from the five CouncillorsStating the nature of the business proposed to be transacted, to issue notices for the meeting; the time of such meeting must be stated in the directions and shall allow of at least seven days' notice.

20. The public may be admitted to any meeting of the Council provided that silence and order are preserved and the proceedings in no way interrupted and provided also that the Council may by special vote hold its meetings at any time behind closed doors. The Chairman. at his own desire or on the request of any Councillor, may mder either

that the Council room be cleared of all members of the public or that a particular person shall withdraw therefrom.

ORDER OF BUSINESS

21. An agenda of the business of each meeting shall be prepared by the Secretary and a copy thereof sent to each Counci,llor seven days prior to the date fixed for the meeting.

22. The business of each meeting of the Council shall be transacted in the following order-

(a) reading of notice convening the meeting;

(b) confirmation of the minutes of the previous meeting;

(c) business arising from the minutes of the previous meeting; (d) apologies for absence;

(e) announcements by the Chairman;

(f) notices of motion arising from announcements;

(g) unfinished business of farmer meetings;

(h) business in accordance with notice or law;

23. The business of each meeting of the Local Board of Health shall be as set out in items (a) to (n) of by-law 22.

24. Prior to the commencement of every meeting the Secretary shall lay on the table : -

(a) agenda for the day;

(6) Secretary's letter book;

(c) the diaries and monthly returns of officers;

(6) log books of managers of water works, and complaint books;

(e) accounts paid since the last meeting of the Council;

(f) the minutes of the meeting of the Poor Relief Committee.

25. All business shall be dealt with in the order appearing on the agenda save that matters relating to the same subject but not listed together may be considered at one and the same time and provided that if it is in his opinion expedient so to do the Chairman may vary the order of items on the agenda unless the majority of the Councillors present shall object to such a procedure.

26. Matters not listed on the agenda shall not be introduced or discussed at any meeting unless it is decided by a three-fourths majority of the Councillors present that the matter is one of urgency.

SPEAKERS

27. Any Councillor desiring to speak at a meeting of the Council shall stand in his place and address himself to the Chairman. If two or more Councillors shall rise to speak at the same time, the Chairman shall decide which of them shall have priority.

28. Each Councillor not having a direct pecuniary interest in the matter under debate shall be entitled to speak for five minutes on any one subject; but the mover of an original motion shall be entitled to ten minutes in his opening address and the Council may at any time by vote without debate decide to extend the time allowed to any speaker.

29. Every speaker shall confine himself to the question under consideration or to an amendment to be proposed by himself, o r to a question of order.

30. Notwithstanding any provisions of these By-Laws a Councillor may at any stage of a debate explain any portion of his speech which has been misrepresented, provided that such explanation shall be strictly confined to a correction of the misrepresentation and shall not introduce any new mattm.

31. Except when the Council is in Committee and subject to the provisions of bylaw 30, no Councillor other than the mover of an origin- al motion or resolution shall be entitled to speak more than once in any debate. A Councillor who has exhausted his right to speak to an original motion may speak on any amendment being moved, when such an amend- ment raises a new question.

32. When the Chairman rises to speak on any question under debate any Councillor then speaking or offering to speak shall resume his seat, and thereafter all Councillors other than the Chairman shall maintain a respectful silence during the speech of the Chairman.

33. A Councillor shall not read his speech but may read extracts from written or printed papers in support of his arguments.

MOTIONS

34. A notice of motion shall hold good for the next meeting if for any reason it is not considered at the time appointed, but shall not be considered, when after two successive meetings, no one appears to introduce it.

35. Except by written request of the Councillor who gave the notice, no Councillor save the one who gave such notice of motion, shall be entitled to move same.

36. No motion involving the expenditure of money (save in cases of emergencies as nlay arise from flood damage to roads, epidemics of diseases, or other like circumstances) shall be discussed at a meeting unless notice thereof was given at least three days prior to the meeting at which such motion is to be considered.

37. Every motion or amendment made at a meeting shall, if required by the Chairman, be reduced into writing and handed to him with the names of the mover and seconder appended thereto.

38. No motion may be debated unless and until it has been seconded by a Councillor.

39. The mover of an original motion shall be entitled to speak once when moving his motion and once by way of reply but not otherwise. In reply he shall confine himself to matters raised in his opening speech or during the debate. After the mover has commenced his reply no other member may speak to the motion.

40. Except with the unanimous consent of the Councillms present at a meeting of the Council no motion which has been negatived within the past three months may be brought forward for debate.

41. When a motion has been duly carried no other motion which sub- stantially contradicts, overrides or repeats the motion which has already been carried may be put to the same meeting of the Council.

42. On a motion far the question having been put and carried the original motion shall be put from the chair without further debate of any kind.

43. On a motion for adjournment of a debate being carried it will devolve on the speaker in the debate to continue his speech at the next sitting of the Council or committee.

44. A motion that has been seconded shall not be withdrawn without leave of the seconder and the consent of the majority of the Councillors present at the meeting.

45. The Chairman shall have power to refuse to allow any motion which he considers to be improperly or disrespectfully worded or not to be within the scope of parochial administration to be put to the meeting and discussed.

46. When the Chairman is of opinion that a motion comprises two or more propositions he may divide such a motion into as many parts as he may consider necessary and propose each part from the chair as a separate question which, if passed, shall form a separate reso- lution.

AMENDMENTS

47. At any stage of a debate on a motion an amendment of such motion may be moved and seconded. A motion may be amended in the following manner : -

(a) by inserting words; (b) by striking out words; and (c) by striking out some words and inserting others.

48. (i) Whcn an amendment to a motion has been moved and seconded, no further amendments to the motion may be moved until the first amendment has been disposed of; if the amendment be carried the motion as amended shall be the motion before the meeting upon which a further amendment may be moved.

(ii) If the first amendment be negatived then a subsequent amendment to the original motion may be moved and seconded, but only one amendment shall be considered at any time.

49. Every amendment must be solely relevant to the motion on which it secks to affect and shall be framed so as to form an intelligible and consistent sentence, whether alone or in its propea place in such motion and must not be merely negative, dilatory or obstructive, nor must it be designed to override the purposes of the meeting or to be inconsistent with anything already agreed upon.

50. When there is before the meeting a motion which embodies several distinct propositions, the Chairman shall have power to refuse an amendment which is moved at a stage of the debate not appro- priate for the same.

51. When a motion or amendment which has become a substantive motion has been put from the chair and declared by the Chairman to be carried, no further proposal's for amending the motion or the amendment shall be entertained.

POINT OF ORDER

52. No Councillor shall interrupt a speaker in the debate save for the purpose of raising a point of order. The same point of order may not be raised more than once at the same meeting.

53. Every appeal on a point of order shall be made promptly on the occurrence of the incident that gave rise to the appear and such appeals shall be made to the Chairman.

54. On a point of order being raised, the Councillor then speaking shall resume his seat until the Chairman shall have given his decision on the point raised. The Councillor who raised the point of order shall resume his seat so soon as he has concluded his appeal to the Chairman.

55. The decisions of the Chairman on all points or order, difference of opinion or on the intarpretation of any by-law or as to the practice of the Council, shall be final' and shall be immediately submitted to without debate by the Councillors of the Council. It shall, however, be competent for any five Councillors to have a protest entered on thc minutes of the meeting or for any ten Councillors to demand by notice of motion that the matter be reconsidered by the full Council.

VOTE ON QUESTIONS

56. Except as otherwise provided, all questions shall be decided by a majority of the votes of Councillms present at a meeting of the Council.

57. The Chairman at every meeting shall have an original as well as a casting vote.

58. When a debate on a motion has been terminated the Chairman shall put the question for decision by replies of "aye" or "no" and shall declare how he thinks it has been determined.

59. (i) Any Councillor may request a division to decide any ques- tion and such a request may be made either before m after the Chair- man has declared how he thinks the question has been determined.

(ii) When a division has been requested the Secretary shall ask each Councillor separately how he desires to vole and record the vote of each Councillor.

60. When the vote is taken by a division, the division shall decide the question. Should there be an equality of votes, the Chairman shall be at libmty to give his casting vote; if he declines to do so, the motion shall be deemed to have been negatived.

61. If a Councillor states that he voted in error or that his vote has been counted wrongly, he may claim to have his vote altered, provided that such request is made as soon as the Chairman has announced the numbers and before he shall have declared the result of the division.

62. A Councillor shall not vote on any subject in which he has a direct pecuniary interest.

63. It shall be competent for any Councillor to decline to vote on any question.

64. The voting at the election of Chairman and Vice-chairman of the Council shall be preceded by nomination and sliall be by ballot.

65. Where the majority of the members present at any meeting so desire it the vote shall be taken by closed ballot.

BREACHES OF ORDER

66. If any Councillor uses offensive, abusive or objectionable language and refuses, when called upon, to withdraw and apologise to the satis- faction of the Chairman, or if any Councillor refuses to accept and act upon a ruling by the Chairman or commits any breach of these By-Laws, the Chairman may require him to withdraw from the meeting.

67. If any Councillor disturbs the good order of a meeting and persists in such disturbance the Chairman may adjourn the meeting.

Quesiions arld Answers

68. Questions may be put through the Chairman by any Councillor to any other Councillor or officer of the Council conccrning any measure pending before the Council, or on any matter within the scope of parochial administration.

69. If a question be asked without notice it shall be oompetent for the Chairman or Councillor or officer concerned to require that notice shall be given. All questions and notices of questions if required by the Chairman shall be put in writing and handed to the Secretary.

70.-(1) A question shall not contain axgunients, inferences, opinions, imputations, epithets, ironical expressions or hypothetical cases; nor shall a question include statements not strictly necessary to render the question intelligible.

(2) A question shall not contain charges which the Councillor who asks the question is not prepared to substantiate.

(3) A question shall not be made the pretext for a debate.

(4) A Councillor may ask a supplementary question far the purpose bf further elucidating any matter o l fact regarding which an answer has been given; but a supplementary question must not be used to introduce matter not included in the original question.

71. Every answer shall be confined to the points contained in the question and shall include only such explanations as may be necessary to give a fair or honest answer to the question. When requested, any Councillor or officer shall give his answer in writing.

COMMITTEES 72. The Council during session may resolve itself into a committee

of the yhole Council when it deems it necessary; the Chairman, Vice- Chairman or Councillor presiding shall be the Chairman of the com- mittee. The action taken in committee shall immediately be confirmed on the resumption of the Council. The proceedings of a committee of the whole Council shall be recordcd in the minute book of the Council and shall be taken as sufficient report e n such proceedings. The committee of the whole Council shall be subject to the By-Laws governing the Council except that there shall be no restrictions as to the number of times a Councillor may be permitted to speak and that no sub-committee may be appointed therefrom.

73. Such committees (either standing oir select) as may be necessary for facilitating the business of the Council may be appointed from time to time.

74. The standing committees shall be appointed by the Chairman and shall submit their reports to the Council promptly. They shall have the right to the services of the Secretary, the Superintendent of Roads and Works and any other officer of the Council they may require.

75. The Chairman and Vice-chairman of the Council shall be ex officio members of a!] committees.

76. The following standing committees shall be appointed annually at the meeting at which the election of Chairman and Vice-chairman of the Council takes place or at the meeting immediately following such election---

(a) finance committee (h) roads and works committee (c) public health and sanitation committee.

77. Selcct committees shall be appointed for specific purposes on resolutions passed by the Council, the mover of the resolution being appointed Chairman ol' the committee. A select committee shall report to the Council within three months of the date of appointment, failing which it shall cease to exist as from the date of the expiration of the said period of three months.

78. The proposals of all standing and select committees shall be submitted to the Council for approval from time to time and every Committee shall be subject to such restrictions as may be imposed by the Council in its terms of reference.

79. The public shall not be admitted to the meetings of any com- mittee except with the unanimous consent of the Councillors present and such consent may be withdrawn at any stage of the proceedings.

CONSTRUCTlON AND AMENDMENT OF BY-LAWS

80. Should any question arise which is not covered by these By- Laws or in cases of doubt, the Rules of Procedure as laid down in "May's Parliamentary Practice" shall apply.

81. These By-Laws shall not be altered or amended unless notice of the proposed amendment shall have been given to each Councillor not less than fourteen days prior to the date of the meeting at which such amendment will be proposed and unless every motion altering or amending the By-Laws shall be passed by a majority of not less than two-thirds of the Councillors present at the meeting.

CUSTODY AND USE OF THE COUNCIL'S COMMON SEAL

82 .41 ) The common seal of the Council shall be kept under the personal charge of the Secretary of the Council and shall be secured by him in the iron safe in his office and there kept by him under lock and key at all times except when it is in authorized use.

(2) All documents requiring the seal of the Council shall be sealed only in pursuance of a resolution of the Council and in the presence of the Chairman and two members of the Council. An entry shall also be made in the Minutes of the Council of eveay document sealed.

1. These By-Laws may be cited as the St. Ann (Parochial Officers) By-Laws, 1928.

Ofice of Superintendent

2. The Superintendent shall be the chief executive officer and adviser of the Parish Council in relation to the roads and works of the parish. He shall be in charge of all roads and bridges under the care, control, management or superintendence of the Council within the limits of the parish and shall be responsible for their maintenance in good order and condition. He shall be also in charge of and responsible for the maintenance in good order of all buildings, tanks, pounds, cemeteries and other property of the Council or under the care or control of the Council.

3. It shall be the duty of the Superintendent to carry out or cause to be carried out during each financial year all work which the Council authorizes or instructs him to do. He shall be responsible for all such work being executed with materials and workmanship of good and durable quality according to the approved designs and for the expenditure thereon.

4. The Superintendent shall obtain a copy or copies of enactments relating to roads and to the buildings and works in the parish or in any way affecting his office; he shall make himself thoroughly conversant with all the provisions of such enactments, and shall take care that they are strictly complied with by himself and by all persons under him, and use his best endeavours to enforce compliance therewith by the public.

5. The Superintendent shall exercise all possible vigilance to detect any encroachments or threatened encroachments on the roads, and shall at the earliest possible opportunity warn any person or persons so encroaching or attempting to encroach to desist. He shall at once report any such case to the Council, and submit a notice (in duplicate) to be served on the proper party, unless the warning previously given by him shall have been complied with.

6. All works shall so far as possible be done by contract, or piece work or task work. Day labour shall only be resorted to in cases where it is impracticable to measure up the work or to specify and value the task, or where it is not possible to get the work taken up at reasonable prices.

7. The Superintendent shall make inspection of the entire length of every drivable road, and of every building and work in his parish at least once in every six months or at such longer interval as the Council may approve and note in his diary the date of visit, condition of such road, building or work, actual work done by him and his recommenda- tion and remarks thereon and report to the Council. He shall also from time to time report to the Council any repairs, additions or alterations not already authorized which he may consider necessary to any such road, building or work, with an approximate estimate of the cost thereof.

8. The Superintendent shall make regular inspection of such roads, buildings and works, as are under his direct management and charge and at least once in every fortnight such roads, buildings, and works on which money is being expended. He shall state the date of visit, actual work done and make recommendations and remarks thereon.

9. In case of any special work involving large expenditure the Superintendent shall make such regular visits and for such length of time at each visit, as may be necessary to ensure its being carried on in accordance with the designs and specifications, with proper economy and in an efficient and workmanlike manner. He shall carefully examine all materials and workmanship and the setting out of each work spending a reasonable time directing and inspecting operations and shall give to the Assistant Superintendent in charge of the district such orders and instructions as may be necessary to ensure the maintenance of the proper standard of work and materials.

10. The Superintendent shall keep or cause to be kept in a separate book, or on a separate sheet, the cost of each work in progress in the same detail as the authorized estimate of such work so that a comparison of the two may, at any time be readily made and he shall, also from time to time, make, or cause to be made an estimate of the cost of completing such work, and he shall without delay report to the Council any deviation from the authorized estimate which may appear likely to arise from necessary additional and unforeseen work, or from the omission of work provided for but not required or from variation in the price of materials or workmanship or any other cause and when reporting completion of the work he shall supply the actual cost giving details of materials used, etc.

11. The Superintendent shall make or cause to be made and furnished to the Council any surveys, sections, and reports which he shall from time to time be instructed to make for any existing or proposed public road, building or work. He shall also perform any other special duties and services, which the Council shall, from time to time prescribe. But in no case must any work or occupation be allowed to interfere with the ordinary duties specified without special authorization from the Council.

12. Bills for goods supplied shall be compared with orders and checked and initialled by the officer receiving the goods, and by the Superintendent before being sent up to the Secretary of the Council for payment. No goods are to be received or paid for, unless in accordance with an order on the proper form, and signed by an officer authorized so to do. Any officer receiving goods so supplied without an order will be held liable for the payment thereof.

13. Before passing the account of any contractor, the Superintendent shall satisfy himself by actual check and measurements and by any other means, in his judgment necessary, that the work charged for has been efficiently done and properly executed according to the terms and conditions of the contract. Failure on the part of any officer in this respect will be regarded and treated seriously.

14. The pay lists shall be made up by the Headman of the several gangs, or by the Assistant Superintendent, from information supplied by the Headman. Every pay list shall be carefully checked by the officer immediately in charge of the work and certified by him. With that object the Superintendent and Assistant Superintendent shall, at every opportunity, check the task work slips or other orders issued by

the Headman, with the labourers actually at work and the work per- formed by them, which shall frequently be actually measured up by the Superintendent and Assistant Superintendents.

15. Wages shall be paid fortnightly on Friday evening or Saturday, or as may be otherwise authorized but the pay lists are to be made up to Wednesday evening; all orders for work in the ensuing fortnight must be issued and given out the Thursday or Friday following. The pay lists are to be certified by the Superintendent and forwarded to the Secretary of the Council at latest by noon on Friday in every week and the Secretary of the Council shall advise the Pay Clerk of the amount required and hand over the bills to him for payment. Headmen and Assistant Superintendents shall always be present when their gangs are being paid.

16. The accounts of contractors, tradesmen, and others shall not be made out by an employee of the Department. All accounts and pay lists shall be carefully checked in the office of the Superintendent, care being taken that the "Head of Service" and the particular item to which they are chargeable are correctly and fully stated and that the information required as to the amount of expenditure and liabilities under the item is duly noted in the place appointed for it. All accounts shall give full and clear particulars of the work charged for, or of the materials supplied and reasons for the payment of unusual charges if any.

17. On the back of every pay list, or if necessary, on a separate sheet, a summary shall be given, showing in detail the cost of each work for which payment is made, the total of which shall agree with the total of the pay list. Special care shall be taken that all bills forwarded to the Secretary to the Parish Council are properly headed and correct in all particulars to avoid delay and inconvenience in payment.

18. The Superintendent shall keep a diary, which shall at all times be available for inspection, in which he shall enter consecutively against each day a statement of the public duties performed by him on that day. On the termination of each year the Superintendent shall keep his diaries on file in his office.

19. The Superintendent shall reside within the limits of the parish at a place to be approved by the Council, and shall not at any time be absent from the parish without permission. Should he be unable at

any time through illness to attend to his duties he shall forthwith have such circumstances reported to the Chairman of the Council. He shall devote all necessary and reasonable time and energy to the faithful discharge of his duties.

20. The Superintendent shall be responsible for all tools, materials and appliances in use for the maintenance of the roads, bridges, buildings or works of the parish. He shall keep an inventory of all plants, tools, mules, carts, harness, furniture, appliances and other goods and chattels of the Council and at the end of the financial year make a return of same showing the condition and approximate value. He shall also at the end of each financial year or oftener if required make' a return of materials purchased and show the surplus remaining in hand. He shall also make an annual report showing the dates of visits of each road and street the work done during the year and submit proposals for allotments for the ensuing financial year.

21. The Superintendent shall be in attendance at all meetings of the Council.

22. The Council reserves the right of making such additional by-laws as it may from time to time deem necessary and of amending or repealing any that may be found unworkable in practice or that the Council deems fit to so amend or repeal.

Ofice of Assistant Superintendent

23. Each Assistant Superintendent will have assigned to him such sub-division of the parish in which he is stationed, or such particular work or works as the Council shall direct. If he be assigned a sub- division, he will take direct charge and management under the order of the Superintendent of all the work of the Department within that sub-division, except special works (which shall mean any work other than maintenance and upkeep, specially authorized by the Council exceeding an expenditure of $20). He shall organize the work of his division transmitting to the Superintendent every fortnight a proposed plan of work in advance and a report of all work done the previous week.

24. The Assistant Superintendent of each sub-division shall visit every part of the drivable roads and every work under his charge at least once in every three months, giving the dates of visik, work performed, recommendation and remarks and he shall initial task work slips on the roads visited.. He must visit bridle roads and village streets at least once in every six months.

25. The Assistant Superintendent shall keep a diary, which shall at all times be available for inspection in which he shall enter consecutively against each day a statement of the public duties perlormed by him on that day.

26. The Assistant Superintendent shall require each headman, or himself make out from the time book by Wednesday evening fortnightly, the pay list of the workmen and labourers employed during the week up to Wednesday morning. After carefully checking and signing the pay lists he shall forward them to the Superintendent not later than Wednesday evening. All orders for work in the ensuing fortnight shall be issued and given out on the Thursday or Friday following. The Assistant Superintendent shall measure up as completely as possible all work done and append to each pay list a summary of the work for which payment is to be made, showing the class of work and cost thereof. The total cost of the work according to the summary shall correspond with the total of the pay bill to which it relates. Assistant Superintendents and headmen shall be present always when gangs are being paid.

27. The Assistant Superintendent shall be advised of all work being done in his division and if required to do so, he shall check the hands at work and the quantities of work done by them, with the time book or notes kept by the headman or foreman in charge. He shall check all materials received on the works, see that they are in accordance with the orders given and of the proper quality. He shall refuse to receive and shall not take possession nor take custody of any tools and materials which are defective or which may be supplied without a proper order or in excess of the order or orders given. He shall make a return of all materials received and show how they have been disposed of.

28. The Assistant Superintendent shall keep and supply to the Superintendent such notes and accounts of measurements and cost of every work in progress and in such form and detail as the Council shall direct. He shall keep the Superintendent fully informed of the state of progress of each work and of the expenditure thereon, the materials supplied, their quality and quantities, the requirements of the work, and any circumstances that may arise during its progress requiring attention or consideration. At the same time he shall exercise proper judgment and discretion, so as not to have perishable materials on hand going to waste or deteriorating.

29. The Assistant Superintendent of each sub-division shall reside within that sub-division at a place to be approved by the Council. He shall not absent himself therefrom without leave.

30. Each Assistant Superintendent before each allotment meeting shall prepare and forward to the Superintendent the list of roads in his district, the proposed allotment thereon and make recommendation for increase or decrease, stating causes. He shall also prepare a list of all tools, all furniture, instruments and other property belonging to the Council and state the condition and approximate value, and forward to the Superintendent with a return of all the roads and streets in his district, dates of visits, and remarks thereon.

31. The Council reserves the right of making such additional by-laws as it may from time to time deem necessary and of amending or repealing any that may be found unworkable in practice or where the Council deems fit to so amend or repeal.

OFFICE OF PAY CLERK

32. All pay lists shall be paid by the pay clerk or other person specially authorized. In no case shall any pay list be paid by the person by whom it was made out. Members of.the Council shall be invited to take occasional opportunities for being present at the payment of wages for the purpose of observing whether any irregularities are being practised.

33. The time and place at which each gang will be paid, shall in all cases be notified to the gang, and should be the same from week to week; neither day, place nor hour should be changed unless circum- stances absolutely require that they should and then only on special authority from the Council. The paying officer shall attend punctually at the place named and wait for a reasonable time in .order to pay persons who may be late.

34. Every payment on a pay list must be witnessed by a person who can read and write. The payer and the witness must both be satisfied as to the identity of the payee. The witness must write his initials and date of payment opposite to. the name of each person paid at the time the money is paid, and also sign his name in full at the foot of the pay list. No payment shall be made to a proxy. except under exceptional circumstances and upon the production of a written order signed by the claimant.

35. If any of the work-people named in any pay list shall fail to attend at the appointed time and are unpaid, the list shall nevertheless be sent back to the Secretary of the Parish Council in due course to be dealt with and audited. The pay clerk shall make a list of all unpaid amounts and forward to the Superintendent stating number of bill and nature of claim. Note shall be kept by the Superintendent of any such unpaid amounts, and if the persons subsequently apply for pay- ment the amount shall be entered on a subsequent pay list for the same item, or if the work of that item is completed, an account for the payment duly receipted and witnessed shall be sent in, in either case reference shall be made by quoting number and date, to the pay list on which the amount was originally charged.

36. When paying wages, the paying officer shall always have the Headman's book and task work slips before him which slips shall be collected and forwarded to the Superintendent. He shall also, as an additional check on the correctness of the entries in the pay lists. occasionally ask the work-people, before paying them, to state what work they have done and what amount they claim.

1. These By-Laws may be cited as the Public Gardens (Spanish Town and Old Harbour) By-Laws, 1902.

2. The gates shall be opened every day from 6.00 a.m. until 10.00 p.m.

3. No person shall convey any load through or into the Garden, save plants and materials being used for the improvement of the Garden.

4. All games, such as running. jumping, rolling hoops or flying kites, are prohibited within the Garden.

5. No person shall sell or expose for sale any article within the Garden.

6. Public meetings shall not be held or public addresses delivered within the Garden.

7. No person shall pluck any flower, leaf or in any way injure any shrub, tree or bed or take a cutting from any plants. Nor shall any person climb any tree or throw any stone in, or from or into the Garden.

8. No horse, mule or donkey shall be brought into the Garden, hand carts or barrows shall not be carried into or through the Garden, except in use for repairs of the Garden.

9. The Keeper shall attend in person during the hours when the gates are open.

10. No placards, handbills or any other written or printed paper, forms or devices, shall be posted up or placed on the guns or gateways or any other portion of the Garden.

11. Employees giving away flowers, leaves, etc., or allowing any visitor to take them, are liable to instant disn~issal.

12. Visitors shall not cut or pick any flower, leaf or twig, nor in any way injure any plant.

13. Visitors shall not climb any tree nor walk on any bed or border.

14. Visitors shall observe strictly any notices that may be exhibited for their guidance.

15. A bell shall be rung five minutes before closing time as a notice to visitors.

16. Any person who, while in the Garden, conducts himself in a disorderly manner, or who is not properly clothed, or who contravenes any of these By-Laws, will be prosecuted and is liable to a penalty not exceeding four dollars for each offence.

17. A copy of these By-Laws shall be posted up at a conspicuous place at the entrance gates of the Gardens for the infornlation and guid- ance of the public and the gardener.

1. These Regulations may be cited as the Savanna-la-Mar Electric Light, Lines and Works Regulations, 1954.

2. The electric lighting of the town of Savanna-la-Mar and other places within the area covered by the licence shall be under the control of a committee which shall be called the Electric Light Committee of the Westmoreland Parish Council, hereinafter referred to as "the Committee".

3. The Committee shall consist of six Councillors of the Westmoreland Parish Council to be appointed by the said Council. one of whom shall be nominated by the Council to be Chairman. Three members shall form a quorum.

4. Each member of the Committee shall have one vote and the Chairman in addition to his original vote shall have a casting vote. In the absence of the Chairman from a meeting of the Committee the members prcsent shall elect one of their number to preside.

5. The Secretary of the Council shall be secretary of the Committee but in his absence from any meeting of the Committee he shall nominate one of his staff to act.

6. The Committee shall meet once per month on the last Wednesday in each month but if any matter of urgency shall arise between meetings, it shall be the duty of the Chairman to summon a meeting to discuss such matter by giving two days' clear notice to each member of the Committee.

7. Within the estimates, the Committee shall appoint a visiting consultant and a resident manager and such other staff as may be deemed necessary from time to time, temporary or permanent and take all administrative action needful for the efficient conduct of the electric light undertaking :

Provided, however, that the appointment of the visiting consultant and the resident manager shall be subject to the approval of the Council.

8. The Committee shall have the power to suspend the manager with or without pay and may recommend his dismissal to the Council:

Provided, however, that if such suspension be for more than one month same shall be suhject to the approval of the Council.

The Committee may suspend with or without pay or dismiss any other employee. The Committee is also empowered to make any temporary appointment resulting from the suspension or dismissal of the manager.

9. The manager shall have the right to suspend any subordinate employee in the undertaking and in the case of employees paid at the rate of less than $300 per annum, to dismiss them and subject to the approval of the Committee employ others in their place. He shall immediately report to the Committee through the Secretary any such suspension or dismissal.

10. The manager shall submit a report to the Committee at each meeting and such report shall be in the hands of the Secretary at least twenty-four hours before a meeting. In the event of an emergency the manager shall report to the Chairman through the Secretary.

11. Every applicant for current shall forward an application to the Secretary of the Council in the form prescribed by the Committee and the Secretary in consultation with the manager may grant such applica- tion.

12. Subject to the payment of the prescribed rates current will be supplied to each applicant whose application has been granted at his line fence or where no line fence exists the boundary of the premises nearest the public road, from which point the applicant shall provide connection to his premises at his own cost.

13. Current will be turned on to the premises of the accepted applicant when such deposit as decided upon by the Committee has been paid. Prior to current being turned on to any premises, the installation shall be first approved by the manager or other person appointed by the Committee in that behalf who shall issue a certificate accordingly which certificate the applicant shall present to the Secretary of the Council with the necessary fees. The Secretary shall then issue instructions to the Manager or other responsible officer to turn on current.

14. Inspection by the manager or anyone authorized by him in that behalf may be carried out at any time during the day or night while the service is in operation for the purpose of testing the installation and where necessary for the removal of the Council's property.

15. Current supplied through meters shall be in accordance with the schedule of rates prescribed by the Committee and where current is un- metered the rates shall be by written agreement between the Conlnlittee and the consumer.

16. The Secretary under the provision of section 15 of the Electric Lighting Act may cut off the supply of current from any person for neglect to pay any charge for electricity or any other sum due from them to the undertaking in respect of the supply of electricity.

17. A person shall be appointed by the Committee to collect rates and shall have power to institute proceedings in the name of the Council against defaulters.

1. These Regulations may be cited as the Parish Council (Olivier Park, Port Antonio) Regulations, 1908.

2 The gates shall be open every day from six o'clock in the morning until seven o'clock in the evening except on Sundays and public holidays; on which days they shall be opened from six o'clock in the morning, until ten o'clock in the evening.

3. No person shall enter the Park save at the times and during the hours hereinbefore provided for the gates to be open. And no person shall enter the Park from the Caneside River save at the landing place or places provided.

4. No person shall carry any tray, box, bowl, basket or load into the Park; and no person shall sell or expose for sale any article within the Park (save by permission of the Chairman of the Parish Council, or in his absence, by the Chairman of the Olivier Park Committee or the Secretary of the Parish Council) and at the place or places provided for that purpose.

5. No person or persons shall hold, or congregate together for the purpose of holding, or addressing any public meeting within the Park.

6. No person shall pick, damage or destroy any flower, leaf or fruit in the Park; or in any way injure any tree, shrub, plant or root in the Park. nor take any cutting therefrom.

7. No person shall climb any tree, or walk on any flower bed in the Park or in any other place in the Park where walking is by notice or other device prohibited.

8. No person shall cut. break, injure or destroy any bench, fence, gate, gate-post, or erection or any box, pot, vessel, hose, appliance, or any other article or fixture kept in or belonging to the Park.

9. No buggy, cart, hand-cart, barrow, motor-car, or other vehicle or carriage (except babies' perambulators) shall be driven or taken into the Park; and no horse, mule. donkey and no cattle or other beast of burden shall be led, driven or taken into the Park.

10. No person shall take any dog into the Park unless the same is being led.

11. No person shall ride any bicycle, tricycle or motor cycle in the Park, but any rider of the same may dismount at the gate and wheel his bicycle, tricycle or motorcycle over the pathway from the gate to the band stand or other place appointed for the purpose and there leave the same until he desires to depart when he may wheel his bicycle, tricycle or motorcycle over the same pathway to the gate and thence leave the Park.

12. No person shall indulge in running jumping kite-flying or other game, or shall fish in the Caneside River except in or from that portion of the Park reserved for a recreation ground.

13. Any person who behaves or conducts himself in a disorderly manner or who is suffering from any contagious or infectious disorder. or who contravenes my of these Regulations may be removed from the Park by any person duly authorized by the Parish Council to do so, or by a Constable.

14. The Gardener and all persons whom he may call to his assistance, may kill and destroy any goat, pig or poultry found within the limits of the Park.

15. Any person doing any act in contravention of any of these Regulations shall on conviction summarily before the Resident Magistrate be liable to a penalty not exceeding fifty dollars.

3. The parish landing shall be used for the embarkation and disembarkation of persons or passengers, and of their personal luggage only.

4. No boat shall remain alongside for a period longer thin is necessary for the embarkation or disembarkation of persons or their luggage.

5. No person shall sit on the wall, or the steps, or on any portion of the parish landing or loiter about the said landing.

6. No person shall use any portion of the parish landing as a urinal or latrine.

7. No person shall destroy. break, cut, or deface any portion of the building or wall at the parish landing.

8. Any person guilty of a breach of any of these Regulations, shall be liable on conviction before a Resident Magistrate to a penalty not exceeding four dollars.

1. These Regulations may be cited as the Parish Council (Ferry Boat at Berrydale. Golden Vale and Windsor Fordings of the Rio Grande River, Portland) Regulations. 1928.

2. Whenever the river shall be in flood or too high to be crossed on foot with safety any person desiring to cross such river may apply to the Keeper of the boat or his assistant to be ferried over in such boat at any of such fordings.

3. The hours for crossing in the boat shall be from 6 o'clock a.m. until 8 o'clock p.m. on every day. Every person desirous of crossing in such boat at any other time shall pay to the Keeper or his assistant as under, viz.-

5. All fees payable in pursuance of regulations 3 and 4 shall be paid in advance.

6. Every person whilst being ferried across the river in such boat shall remain seated and their head-loads, luggage or freight shall be disposed of and placed in such boat in such manner as shall be directed by the Keeper or his assistant and every such person after W i g ferried across the river shall immediately leave such boat and remove thereout any head-load, freight or luggage at the point of disembarkrnent with as little delay as possible.

7. Persons to be carried across the river shall not exceed six in number on each trip of the boat and no person shall be entitled or permitted to enter such boat when there shall be already six persons therein for the purpose of crossing.

8. Every person making use of such boat as aforesaid shall do so at his personal risk.

9. The Keeper or his assistant may refuse to ferry across the river any person whenever the river shall be in flood or running too high for the boat to be worked with safety or when real danger shall be apprehended and every such refusal shall be reported by the Keeper or his assistant at the earliest opportunity in writing to the Superintendent of Parochial Roads and Works and the ground for such refusal shall be stated.

10. The Keeper of the boat when the boat shall not be in use shall have it drawn up in a safe place and kept properly secured or if moored at the river bank securely fastened to prevent its drifting away or becoming damaged and such Keeper or his assistant shall be in attend- ance at the bank of the river at such fording for the purpose of ferrying persons across on every day when the river shall be in flood or running too high to be crossed on foot with safety.

11. The time which shall be occupied between each trip of the boat shall not exceed twenty minutes and the Keeper or his assistant shall use all reasonable despatch in the ferrying across of persons.

12. The boats shall not be used or employed for any purpose other than that of a Ferry Boat without the permission of the Superintendent of Parochial Roads and Works nor shall any such boat be removed

13. Every person shall obey all reasonable orders of the Keeper of the boat or his assistant conducive with safety to the boat and/or of the persons therein and shall conduct himself in a fit and proper manner whilst in such boat.

14. No person shall sit or climb upon or enter into any boat except for the purpose of being ferried across the river and in the presence of the Keeper or his assistant.

15. No person shall in any manner damage, injure, deface or destroy any boat or any part thereof or any implements or fastening used in connection therewith nor remove, carry away, make use of, or in any way interfere with any such boat, implements or fastening.

1. These Regulations may be cited as the Parish Council (Court House, Buff Bay) Regulations, 1936.

2. The Buff Bay Court House shall be under the control of the Superintendent of Parochial Roads and Works for the parish of Portland. who shall from time to time inform the Superintendent of Public Wo4s for the parish of any repairs necessary to the said building.

3. The Superintendent of Parochial Roads and Works shall keep a correct inventory of the furniture in the building in a book to be provided for the purpose, and shall report in writing to the Council any damage to the building or furniture by anyone using the same.

4. A Keeper shall be appointed by the Council and he or she shall keep clean, the entire building and furniture, save and except that portion occupied by the Assistant Collector of Taxes, and shall on the written authority of a Councillor, the Secretary of the Council or a Magistrate, allow strangers to inspect the building :

Provided, however, that if none of rhese persons is available the Keeper may use his or her dis&etion in allowing such inspection.

5. The Chairman, or in his absence, the Vice-Chairman of the Council, may let, or if he shall think fit, grant free of charge, use of that portion of the building known as the Town Hall for the purpose of public entertainments or religious or secular meetings, to any person or persons applying for the same.

6. Every application for the use of the Town Hall shall be in writing addressed to the Secretary of the Parish Council, and shall state the purpose for which the Town Hall is required. The Secretary shall submit the application for the consideration of the Chairman or in his absence the Vice-chairman of the CounciL

7. Subject as appears in regulations 8 and 9 a fee of one dollar shall be paid for each night or day on which the Town Hall is used, save and except on occasions on which permission has been granted for the free use of the same.

8. Any person or persons requiring the use of the Town Hall for public entertainments for their own profit shall pay in advance a fee of two dollars for each night for which the Hall is required and if the entertainment is held during the day time a fee of one dollar shall be paid for each day.

9. Before any application is granted for the use of the Town Hall the applicant shall deposit with the Assistant Superintendent of Parochial Roads and Works for the No. 4 Division of the parish, the sum of ten dollars from which the fee for the use of the building shall be deducted, and out of which the cost of making good any loss or damage to the building or furniture or of cleaning left undone by such applicant shall be defrayed together with any expense which may be incurred through a breach of these Regulations by the applicant. The deposit, minus the fee payable for the use of the Hall shall be returned by the Assistant Superintendent for the No. 4 Division to the applicant provided there is no claim by the Council arising out of any matter mentioned in the foregoing portion of this regulation.

10. Any person or persons requiring the use of the Town Hall for rehearsal shall be permitted to use the same free of charge for a period not exceeding ten nights.

11. If any applicant desires to use the Town Hall for purposes of a cinematograph exhibition he shall first effect insurance of the building against loss or damage by fire to the amount of $3.000.

12. Any person or persons using the Town Hall shall see that the entertainment or function held therein is terminated by 2 o'clock a.m., and shall have all lights in the building properly extinguished.

13. After the Town Hall has been used it shall be handed over in good order to the person in charge of the building by the person or persons to whom the use thereof was granted and the furniture, lamps and other appliances shall be returned to the person in charge of the building in the same condition as that in which they were delivered.

14. If any person or persons shall obtain permission for the use of the building and shall not use the same, the amount of the deposit paid by him or them shall be refunded in full.

15. If any person shall disturb any public entertainment or religious or other assemblage of persons in the said building. or use any offensive language therein, or insult any person therein, he shall be liable to be removed from the building.

16. Any person or persons who shall persist in any objectionable noise or behaviour shall be liable to be removed from the building.

17. No person shall be permitted to enter the building in a state of intoxication, and if any person is found to be in such a stale and is disturbing the public peace, he shall be liable to be removed from the building.

"vehicle" means device upon or by which any person or property is or may be transported or drawn upon a public road in what- ever manner the same may be operated, drawn or propelled.

4. The driver of a vehicle travelling upon any public road intersecting any "Through" street shall bring such vehicle to a full stop at or immediately before the intersection and shall not proceed into or across such intersection until such time as this may be done with safety having regard to the traffic which is actually at the time proceeding along such "Through" street.

5. The driver of a vehicle travelling upon any public road other than a "Through" street, intersecting any "Main" street shall bring such vehicle to a full stop at or immediately before the intersection and shall not proceed into or across such intersection until such time as this may be done with safety having regard to the traffic which is actually at the time proceeding along such "Main" street.

6. At every intersection at which vehicles are required to stop under these Regulations a sign or device bearing the word "Stop" shall be erected in such a position and be provided with letters of such a size as to be clearly legible from a distance of at least fifty feet from the point at which vehicles are required to stop.

7. Regulations 4, 5 and 6 shall have effect within the area of the town of Montego Bay bounded on the north by the northern side of North Street, on the south by the southern side of Bamett Street, on the east by the eastern side of Cottage Road, the northern side of Humber Avenue to Duke Street, Duke Street, Princess Street, Dome Street. on the west by the sea, but shall not apply to any intersection during such time as a member of the Jamaica Constabulary Force shall be on point duty in uniform regulating traffic at such intersections.

8. No vehicle shall be parked for more than half an hour on St. James Street from Barnett Street to the thoroughfare known as the Square.

9. No motor truck shall be parked on the thoroughfare known as the Square.

10. No motor truck shall be parked on Market Street from Harbour Street to the thoroughfare known as the Square.

11. Motor vehicles will be allowed to park facing south along the entire length of Harbour Street on the east side, except at the intersec- tions of streets.

1. These Regulations may be cited as the Parish Council (Public Shed-Black River) Regulations, 1938.

2. The Shed erected in the town of Black River shall be known as the "Black River Public Shed".

3. The Shed has been erected for the convenience of visitors to the town and shall not be used by the residents of the said town as a stable. coach house or garage.

4. No one will be allowed to use the Shed between the hours of 5.30 a.m. and 6 a.m. daily.

5. The Shed has been divided into two portions-

(1) the front portion, to be used for animal drawn vehicles (cart and wagons excepted) and such vehicles shall have priority over any other kind of vehicle;

(2) the back portion, to be used for the accommodation of the animals which are not prohibited by regulations 7 and 8.

6. No person shall allow any unconsumed portion of fodder given to animals in the Shed to remain therein but shall remove the same.

7. No entire horse, entire ass, entire mule nor cart shall be allowed within the Shed.

8 No donkey, mule and horse with panniers on their backs will be allowed within the Shed.

"place of amusement" means any place open to the public, whether for a fee or free of charge, for the purpose of entertainment and, without limit to the generality of the foregoing includes a cinema, dance hall, club, open air dance venue, amusement arcade, any place where a coin operated amusement machine is open to the public, a festival, discotheque, roller disco, or skate rink;

"prescribed requirements" means the requirements prescribed in these Regulations, for the grant of a licence.

3.--(I) No person shall operate a place of amusement in the parish of St. Thomas, other than under the provisions of a licence granted to that person in respect of the place of amusement.

(2) A person requiring a licence shall apply in writing to the Secretary First of the Council in the form set out in the First Schedule and shall submit with Schedule such application-

Second Schedule (a) the appropriate licence fee specified in the Second Schedule;

(6) proof of insurance, with a reputable insurance company, in respect of public liability, fire and allied perils; and

(c) where the licence is in respect of a building, a certificate from the Fire Commissioner confirming that satisfactory fire precautions are in place.

(3) The Council may grant exemption from payment of any licence fee upon proof by the applicant that the amusement is being held for the purpose of raising funds for the benefit of the local community.

Third 4. Every licence shall be in the form set out in the Third Schedule, or as near Schedule thereto as circumstances permit, and shall-

(a) state whether the licence applies to a building only, grounds only, or both a building and grounds;

(6) sufficiently identify all buildings and grounds to which the licence applies;

(c) state the type of amusement in respect of which the licence is granted;

(4 state the date on which the licence becomes effective and the date on which the licence expires;

(e ) be signed by the Secretary.

5 . 4 1 ) For the purpose ofconsidering an application for a licence the Council shall-

(a ) direct an authorized person to visit and inspect the building or grounds in fespect of which the application is made; and

( b ) inform the applicant of such direction.

( 2 ) For the purpose ofcarrying out any inspection under this regulation, an authorized person may, on producing documentary evidence of his authorization if required to do so-

(a) enter upon and examine the building or grounds in respect of which the application is made; and

(b) require the applicant to furnish such further information as the authorized person considers necessary to assist the Council in deciding whether or not to grant the licence.

(3 ) Upon completion of an inspection, the authorized person shall make a report thereon in writing to the Council.

(4 ) Where the Council is satisfied that a building or grounds inspected under paragraph (2) meets the prescribed requirements, the Council may grant a licence in respect of that building or grounds upon such terms and conditions, if any, as the Council thinks fit.

6 . 4 1 ) Subject to paragraph (2 ) the Council may refuse to grant a licence, or revoke any licence, if the Council is satisfied that-

(a ) the applicant or licensee has been convicted of a criminal offence; or

( b ) any of the prescribed requirements is not being complied with; and shall, in writing, notify the applicant or licensee of such decision and the reason therefor.

( 2 ) The Council shall not revoke a licence under paragraph ( I ) ( b ) until after the expiration of the time specified in a notice served under paragraph (3) .

(3) Where the Council is satisfied that any of the prescribed requirements is not being complied with, the Council shall serve a written notice on the licensee, setting out the areas of non-compliance and requiring the licensee to comply within a time specified in that notice.

( 4 ) Where the Council refuses to grant a licence, the Council shall refund to the applicant all licence fees paid in respect of the application.

(5) An applicant or licensee who is aggrieved by a decision of the Council under paragraph ( I ) , may appeal against that decision, in writing, to the Minister.

7 . 4 1 ) The Council may from time to time direct an authorized person to visit and inspect any building or grounds in respect of which a licence has been granted, for the purpose of determining whether the prescribed requirements are being complied with, and the provisions of Regulations S(2) and (3 ) shall apply, with necessary modifications, to such inspection.

(2) Where a direction is made under paragraph (I), the Council shall inform the licensee of the direction.

8.-(1) The Council may provide services in connection with any place of amusement, and collect remuneration therefor.

(2) Any money collected under paragraph (1) shall be paid into the accounts of the Parish Council and shall be applied and accounted for in the same way as other money accruing to or belonging to the Parish Council.

9. Where the Chairman of the Council is satisfied that the circumstances so warrant, he may grant an emergency licence for a period not exceeding seven days.

10. The Council shall not grant any licence in respect of a building unless the Council is satisfied that the following requirements are met-

the building is so constructed as to provide safe occupation and use by the public and can be maintained in a sanitary condition;

the building has sufficient ventilation and sanitary conveniences for the use of the public;

all seats, fixtures and fittings in the building are so arranged as not to interfere with free access to passages, aisles and exits;

the building is supplied with adequate lighting which does not require the use of open flame;

all passages, aisles and staircases of the building are of sufficient width, and in any event are not less than four feet wide, and are in such proportion to the seating'accommodation of the building as to allow free movement withid, into, and out of, the building;

adequate precautions are in place to ensure that no person below the age of sixteen years is admitted to the place of amusement during the hours of eight o'clock in the forenoon and six o'clock in the afternoon Monday through Friday, with the exception of such charitable events as the Council thinks fit;

adequate security measures are in place to ensure that no person enters the building with a firearm or other weapon; and

the maximum number of person which the building can safely accommodate is prominently displayed.

11. The Council shall not grant any licence to carry on a cinematograph exhibition unless the Council is satisfied that all machinery used for the purpose of such exhibition is enclosed in a room or structure and the following requirements are met-

(a) all entrances and exits for the room or structure are suitably placed and are each fitted with a self-closing, close-fitting, door of fire- resistant material satisfactory to the Fire Commissioner, and made to

open outwards on solid frames of fire-resistant material rebated at the top so as to give one inch of overlap;

all doors, openings and joints, of the room or structure are so constructed and maintained as to prevent, so far as is possible, the escape of smoke into any other part of the place of amusement;

any openings, in the room or structure, for a projector lantern do not exceed two in number, are not larger than is necessary for effective projection and observation, and are covered with glass which cannot easily be removed;

every projector lantern opening is fitted with a screen of fire-resistant material, which can be released from inside the room or structure so that the screen automatically closes with a close-fitting joint and no string or cord forms part of the apparatus for releasing the screen;

no furniture is placed or kept inside the room or structure, except one iron shelf not exceeding two feet in length by six inches in width;

the place of amusement has insurance coverage, with a reputable insurance company, in respect of public liability, fire and allied perils.

every opening through which any pipe or cable passes into the room or structure is bushed and sealed; and

the place of amusement has adequate emergency lighting.

12. The Council shall not grant any licence in respect of grounds unless the Council is satisfied that the following requirements are met-

the grounds are so situated and maintained as to ensure that the health and safety of the public is protected;

the grounds have a sufficient number of safe and clearly defined entrances and exits;

the grounds are adequately lighted;

there is maintained for the grounds insurance coverage, with a reputable insurance company, in respect of public liability, fire, and allied perils; and

adequate precautions are in place to ensure that no person below the age of sixteen years is admitted to the grounds at any time between the hours of eight o'clock in the forenoon and four o'clock in the afternoon, Monday through Friday, with the exception of such charitable events as the Council thinks fit.

13. Where, af'ter the grant of a licence, the Council is satisfied that any building or grounds to which the licence applies is altered in construction or layout, without the written authorization of the Council, the licence shall be revoked.

14. A person who contravenes any provisions of these Regulations commits an offence and is liable, on summary conviction before a Resident Magistrate to a fine not exceeding ten thousand dollars and, in default of payment of that fine, to imprisonment for a term not exceeding three months.

15.-(1) A person who operates a place of amusement immediately prior to the 27th day of September, 1999 shall, within ninety days from that date apply in writing for a licence under these Regulations.

(2) Where an application is made under paragraph (I), the operation of (

the place of amusement referred to in that paragraph may be continued for a period of six months from the date of such application or until the licence is granted or refused or the application is withdrawn, whichever is the latter.

1. These Regulations may be cited as the Falmouth (Trelawny) Town Hall Regulations. 1954.

2. The Falmouth Town Hall is intended for use primarily in the development and promotion of cultural and social advancement.

3. Applications for the use of the Falmouth Town Hall shall be ad- dressed to the Secretary of the Parish Council, Falmouth, and shall s t a t e

(i) the purpose for which the Hall is required; (ii) the date or dates on which it is to be used; (iii) the duration of use in hours; and

(iv) that the applicant agrees to comply with these Regulations and bear all expenses incident to the use of the Hall and to My the cost of making good any damage done thereto while the same is in his possession.

Each application shall be accompanied by a deposit of 5Oc and such deposit shall be forfeited and credited to the funds of the parish if the application is granted and the Town Hall is not used. but if the appli- cation is refused, the deposit will be returned to the applicant.

4. Applications for use of the Town Hall shall be submitted for con- sideration to the Chairman or Vice-chairman of the Parish Council or to the nearest available Councillor.

5. When the use of the Hall has been granted the applicant shall lodge with the Secretary of the Parish Council a further deposit of $16.30 in cash before the use of the Hall may be obtained.

6. The fees for the use of the Town Hall shall be as follows-

(a) for the use of the Hall, piano and furniture for purposes of a dance not exceeding 10 hours, $12.00:

(b) for purposes of a concert or any other entertainment not exceed- /-

ing 4 hours, $4.00;

(c) when the lights of the court room are also used, there shall be an extra charge at the rate of 20c per hour.

7. Recognized welfare, religious, charitable, agricultural, educational and cultural organizations may, in the discretion of the Chairman of the Parish Council, be granted a waiver or reduction of the specified rental fee, but must comply with all other conditions prescribed by these Regu- lations for the loan or hire of the Town Hall.

8. At least two persons shall be provided by the Parish Council to act as firemen and be in attendance while the Hall is in use by a hirer, the cost of the remuneration of such firemen to form part of the fees prescribed under regulation 6 for the use of the Hall, save and except in cases where the use of the Hall is granted under regulation 7 when the cost of the remuneration of the firemen shall be for the account of the hirer.

9. The Secretary of the Parish Council shall notify the Superintendent of Parochial Roads and Works for Trelawny of the grant of the use of the Town Hall and the Superintendent shall inspect the building before the same is handed over to the applicant.

10. After the use of the building the Superintendent shall examine the building, furnishings and fittings, and if he is satisfied that no damage I,

has been done, he shall give a certificate to that effect.

11. On the receipt of a certificate that no damage has been done to the building, its furniture and its fixtures, the Secretary shall return to the applicant or his agent the amount deposited under regulations 5 and 6 after the appropriate deductions have been made therefrom.

12. Any damage occasioned to the building or its furnishings shall be assessed by the Superintendent of Parochial Roads and Works and the amount thereof deducted from the amount deposited under regu- lations 5 and 6. If the damage is assessed at an amount in excess of the amount deposited, the amount deposited shall be withheld and applied towards the cost of making good the damage. The remainder of the cost of making good such damage shall be claimed and recovered from the applicant or his agent.

1. These Regulations may be cited as the Public Meetings (Trelawny) Regulations. 1961.

2. No persons shall call together, gather, hold, address or attend any meeting or gathering of persons in any thoroughfare or public place with- in the parish of Trelawny-

(a) except between the hours of twelve o'clock noon and eleven o'clock in the night on week days or between the hours of six o'clock in the morning and nine o'clock in the night on Sun- days :

Provided that the Chairman of the Parish Council, or in his absence, the Vice-chairman, or in their absence, the Senior Police Officer for the parish. may from time to time and sub- ject to such conditions as may be specified, grant permission in writing to any person to call together, gather, hold, or ad- dress a meeting at any time of the day or night; or

(b) within two hundred yards-

(i) of any court house when a court is sitting; or

(ii) of any church, chapel or other place of religious worship when any religious or public service is being held therein.

&-d l ) Every person intending to hold any such meeting shall give notice to the Senior Police Officer for the parish of his intention so to do not less than twenty-four hours prior to the holding of such meeting.

(2) No person shall call together, gather, hold or address any mceting unless the notice required by paragraph (1) has been given.

4. No person attending any meeting or gathering in any thoroughfare or public place-

(a) shall stand, sit, or be in any position so as to obstruct, hinder or impede the free passage of vehicles, persons or animals along or across any thoroughfare or public place;

( b ) shall, except in obedience of the directions of a constable, cause or take part in the removal of a meeting or gathering from one thoroughfare or public place to another.

5. Every person attending any meeting or gathering in any thorough- fare or public place shall obey all reasonable orders of a constable given-

(a) for the purpose of affording a free passage along or across any thoroughfare or public place; or

(h) in relation to the route to be followed when going to or leaving any such meeting or gathering.

6. Every person contravening the provisions of any of these Regu- lations shall be guilty of an offence and shall be liable upon summary conviction before a Resident Magistrate to a penalty not exceeding fifty dollars.

1. These Regulations may be cited as the Parish Council (St. James) (Public Parking Places) Regulations, 1963.

2 In these regulations-

"attendant" means a person appointed by the Council as an attend- ant of a parking place;

"parking place" means a place not being a part of a main road or parochial road appointed by the Council at which members of the public may on payment of a licence fee park motor vehicles.

3. Any person in charge of a motor vehicle shall be entitled upon paying a licence fee to park the vehicle in such position on a parking. place and for such time as is hereinafter prescribed.

4. Every person desiring to park a motor vehicle at a parking place shall apply to an attendant for a licence so to do and shall pay the pre- scribed fee and upon the issue to him of a licence in such form as the Council may from time to time by resolution prescribe shall park the vehicle in such position on the parking place as shall be indicated by the attendant.

5. The amount of the fee paid, date and the hour of parking and the hour at which the licence expires shall be marked by the attendant on every licence issued by him.

6. Every person in charge of a vehicle which is driven on to a parking place shall-

(d) at the expiration of the time for which a licence was granted /

remove the vehicle from the parking place or pay the fee for ', a licence for a further period.

7. Every vehicle parked on a parking place shall remain at the owner's risk and the Council shall not be responsible for any loss or damage to the vehicle by any cause whatever including negligence on the part of anj agent or servant of the Council.

8. The fees payable for a licence to park shall be such sums (not ex- ceeding the sums set out in the Schedule) as the Council may from time to time fix and determine in respect of each parking place.

9. A copy of these Regulations and of the schedule of fees for the time being in force shall be kept posted on every parking place within the limits of the town.

10. Every person in any manner offending against these Regulations shall be liable on summary conviction to a penalty not exceeding ten dollars and in default of payment to imprisonment not exceeding one month.

4. Every premises within the limits of the area described in the Schedule shall be numbered.

5. Save where the Council shall by resolution otherwise determine

(a) streets and premises already named and numbered shall retain the names and numbers by which they were known at the time of coming into operation of these Regulations until the name of such street or the number of any such premises shall be changed in accordance with these ReguIations;

(b) premises on streets running from north to south shall be num- bered by allotting the number 1 to the first premises on the western side of the street at the southern end and by allotting the number 2 to the first premises on the eastern side of the street at the southern end, and the remaining premises shall be numbered consecutively so that premises on the western side of

the street will have odd numbers and the premises on the eastern side of the street will have even numbers;

(d) premises on streets not running directly from north to south or from east to west shall be numbered from the end which is nearer the south with the odd numbers on the left and the even numbers on the right;

(e) where any holding is created after a street has been numbered every such holding shall be assigned as a number such numeral with the addition of such fraction or letter of the alphabet as the Secretary of the Parish Council may direct;

(f) the Secretary of the Parish Council may upon the application of any person and upon the payment of such sum (not exceed- ing twenty-five cents) as the Council may from time to time by resolution determine issue to such person a certificate stating the number allotted to any holding and as to any change in the numbering of such holding;

(g) the Council may from time to time by resolution require that the several premises on any street or part of a street within the Parish of St. James shall be numbered and may by the same or another resolution prescribe the side on which the even and odd numbers shall respectively be placed and the points at which such numbers shall commence.

6. The Council may by resolution change the name of any street or the number of any premises and shall cause notice of every such resolu- tion to be published in the Gazette.

7. The Council may by resolution, either generally or in respect of any particular street, prescribe the material, form, shape, size, design, colours and other particulars of name signs and number signs and deter- mine the places and positions in which such signs are to be affixed.

9. The owner or occupier of every premises within the limits of the area described in the Schedule or fronting on a road or part of a road mentioned in a resolution under sub-paragraph (g) of regulation 5 shall keep affixed on such premises in a conspicuous position at or near the main entrance from the street a number sign of the form, size, shape design, and colours approved by the Council containing the number allotted to such premises.

10. Where land is sub-divided in accordance with the approval of the Council under the Local Improvements Act the owner of the land shall provide such standards and affix such street name signs at such places as the Council may direct.

11. The Council may supply to any person applying therefor street signs and number signs upon payment of such sum (not exceeding one dollar for each street sign and twenty cents for each number sign) as the Council may from time to time by resolution determine.

12.-(1) If any person shall fail for seven days after notice from the Secretary of the Parish Council requiring him so to do to affix any sign which he his required under these Regulations to affix or to replace with a new sign any sign which may have been removed, destroyed or de- faced the Council may cause such sign to be affixed and may recover from such person the appropriate sum provided in regulation 11 together with the additional sum of twenty-five cents for the cost of affixing the sign.

(2) A notice under this regulation may be addressed to the owner or occupier of any premises without any person being named therein and may be sent by registered post and shall be deemed to be served on the third day following the posting thereof.

13. No person shall deface the number of any premises or the name of any street or remove, damage or destroy any board sign or plate on which such number or name is written, painted or printed.

14. Any person who fails to comply with or commits any breach of these Regulations shall be guilty of an offence and shall on summary conviction for such offence be liable to a penalty not exceeding ten dollars and in default of payment thereof to imprisonment with hard labour for fourteen days.

1. These Regulations may be cited as the St. James Parish Council (Jarrett Park, Montego Bay) Regulations, 1978.

2. In these Regulations, unless the context otherwise requires- "authorize? person" means-

(a) any person employed by the Council in or about any work in connection with the improvement or maintenance of the park, or the servant or agent of such person; or

(b) the holder of a licence granted under regulation 6; or

(c) any person authorized in writing by the Committee for the purposes of these Regulations;

"chairman" means the chairman of the Committee;

"the Committee" means the Pub!ic Parks and Gardens Committee appointed by the St. James Parish Council under section 96(2) of the Act;

"the Council" means the St. James Parish Council:

"officer" means the Secretary, the Superintendent of Parochial Roads and Works, the Clerk to the Committee or any person authorized in writing by the Committee to act on behalf of any of the persons aforesaid;

"person" includes a club or organization; "the park" means the area described in the First Schedule and

unless otherwise specified, includes the pavilion; Schedule.

"Secretary" means the Secretary of the Council.

3. The management and control of the park is hereby vested in the Committee which shall, in carrying out any duties or in the exercise of any powers conferred upon it by these Regulations, act in accordance with such direciions as may from time to time be given to the Committee by the Council

4. Subject to regulation 8, any person requiring the use of the park shall, not less than twenty-eight days before the date on which such use is required, make application to the Committee in 'the form

Second Schedule. set out in the Second Schedule.

5. The Committee may, if it sees fit, refuse to grant permission to any applicant to use the park.

6 . 4 1 ) The Committee may grant to any person, a licence to use the park-

(a) for the playing of games; or

(b) for any other purpose approved by the Committee and speci- fied in the licence.

(2) An application for a licence under paragraph (1) shall be accompanied by the appropriate fee and a schedule of dates and fixtures in respect of the period for which the licence is granted.

(3) Such licelice shall---

(a) state the name of the person to whom it is granted; and

(b) if granted under sub-paragraph (a) of paragraph (1). be valid for a period of twelve months from the date on which it is granted; or

(c) if granted under sub-paragraph (b) of the paragraph, be valid for such period, not exceeding three days, as may be specified therein.

7.-(1) Where the Council intends to use the park for any public purpose the chairman shall, not less than ten days before the date on which such use is intended, give written notice of such intention to any person who is the holder of a licence under regulation 6.

(2) The notice mentioned in paragraph (1) shall serve to suspend the right of use granted under regulation 6, in respect of the date on which the park is used by the Council pursuant to paragraph (1).

(3) Any person who is affected by such suspension shall be entitled to a refmd of fees in respect of the period for which his right is so suspended.

8. Any person who intends to make application as specified in regulation 4, within any period other than the period specified in regulation 4, may make such application to the Secretary who may, if he sees fit, waive the time limit required by that regu!ation.

9.-41) Pursuant to a licence granted under these Regulations- (a) the game of cricket shall be played in the park during the

period commencing on the 1st day of February and ending

on the 31st day of August in each year (hereinafter referred to as "the cricket season"); and

(b ) the game of football shall be played during the period com- mencing on the 1st day of September and ending on the 31st day of January in the following year (hereinafter referred to as "the football season").

(2) The games of cricket and football shall bc played only during the cricket season and the football season, respectively.

(3) The holder of a licence under regulation 6 (1) ((1) shall submit to the Committee a schedule of fixtures before the beginning of the season in respect of which his licence is granted

10. If an officer is satisfied that- (a) the condition of the park or any part thereof is, at any time

in an unsuitable condition for the playing of games, or is in a dangerous condition; or

(b) the pavilion or any portion thereof is in a condition which renders it unsafe to the public,

he may. by notices posted in conspicuous places in the park and the pavilion, prohibit the playing of games in the park or thc entry of any person into the pavilion or any portion thereof, for any period during which such conditions exist.

11 .41 ) The fees payable in respect of the use of the park or the pavilion shall, subject to paragraph (2), be those sct out in the Third Schedule and, except as otherwise provided in these Regulations, shall Third

(2) The Committee may, if it sees fit, grant permission to any charitable or non-profit organization to use the park at a reduced rate or free of cost.

(3) The Committee may require any applicant for a licence, as a condition precedent to the grant of such licence, to give security of such amount as the Committee may specify, to be held by the Ccmmittee for the payment of any sum accruing to the Committee by way of fees or by way of any damage arising from the use of (- the park by the applicant and admitted by him.

(4) The security mentioned in paragraph (3) shall be given within such time as the Committee may specify and may be given either-

(0) by deposit with the Committee of the amount of the security or of a bond in such form for such amount and with such sureties as the Committee may in any case approve; or

( I ; ) partly by bond npproved by the Committee as aforesaid and putly by deposit with the Committee as it may specify.

12. The Committee shall be responsible for the rolling of the pitch in preparation for each came of cricket to be played during the cricket season and the cost of such preparation shall be recovered from the holder of a licence under regulation 6.

13. Where any damage is occasioned to the grounds of the park or any installations in the park, the cost of repairing such damage shall be borne by the person using the park in accordance with the tcrms of his licence, at the time when such damage occurred.

14. Any disputes regarding the use of the park or the right to such use shall be referred to the Secretary who shall, in dealing with such disputes, give effect to any directions which may be given to him by the Committee.

15.--(I) Subject to paragraph (2), no person other than an authorized pcrson shall-

(a) enter or remain in the park at any time other than the times specified in paragraph ( 2 ) ; or

( 0 ) place. wheel. drive or cause to be driven in or around the park. any barrow, cart, truck or wheeled vehicle of any kind.

(2) The park shall be open to the public during the periods specified in a licence granted under regulation 6 or whenever the park is being used by the Council as specified in regulation 7.

(3) The park or any part thereof may be closed for such period as the Council may direct.

(4) No person other than an authorized person may enter and remain in the park while there is in existence a notice stating that the park is closed to the public.

16. No person other than an authorized person shall in the park-

(a) remove, uproot, destroy or injure any tree, shrub or plant; (b) pick any flower, fruit, leaf, twig or branch; (c) dig, cut or take any turf, sod, gravel, sand, clay or other

substance: (d) climb any tree, gate, fence or railing or enter any enclosure

the entry of which is prohibited by notice, or walk on any border or flower bed.

17.-(1) No person shall remove, injure, deface by writing or other- wise any building, structure, statue, ornament, seat, wall. railing or thing in or enclosing any part of the park or wilfully damage or deface any lawn, road or path.

(2) No person shall affix or exhibit any notice, advertisement or other written or pictorial matter on any tree, building or other structure in the park except on such structure or building as the Committee may approve for such purpose.

18. No person shall in the park, without the prior permission of the Committee, erect or place any post, rail, fence, photographic apparatus. tent. booth, screen. stand, swing or other structure.

19. No person shall bring any dog into the park or cause such dog to remain in the park unless that dog is restrained by a leash.

20. No person shall bring any horse, ww, goat or other animal into the park or cause such animal to enter and remain in the park.

21. No person shall in the park, throw or deposit any bottle, tin, container, glass, paper or other rubbish, otherwise than in receptacles provided for that purpose.

22. No person shall wilfully break any glass, china or simiIar sub- stance in any open space or on any road or path in the park.

23. No person shall in the park, conduct himself in a disorderly or indecent manner or be indecently clothed.

24. No person shall wilful!y and unreasonably interfere with the comfort of or cause annoyance to any other person using the park.

25. No person shall hold a meeting in the park on behalf of any political party or any candidate of such party.

26. No person shall in the park, deliver any address in support of or in opposition to any political party or any address dealing with the programme or policy or any candidate of a political party.

27. No male person over the age of six years shall enter or remain in any pan of the park reserved for the use of female persons and indicated by notices to the effect exhibited in such part of the park.

28. No person shall use any open space in the park for the purpose of camping unless he has obtained the prior permission of the Committee.

29. No person shall wilfully and unreasonably interfere with any person using the park in accordance with these Regulations.

30. No person shall in the park, sell or expose for sale, any article without the prior permission of the Committee.

31. No person shall resist, obstruct or interfere with or incite or aid any other person to resist, obstruct or interfere with any officer or authorized person in the exercise of any duties or powers conferred upon such officer or authorized person by these Regulations.

32.-31) Any officer or authorized person may, by the use of a reasonable amount of force if necessary-

(a) remove or order the removal from the park of any person who contravenes any of t l~e provisions of regulations 15 to 31, or order such person to leave the park; or

(6) issue a warning to such person not to re-enter the park for any specified period without the prior permission of an officer or authxized person.

(2) Any person who-

(a) fails to leave the park when ordered to do so by an officer or authorized person; or

(b) re-enters the park in contravention of a warning issued to that person undcr sub-paragraph (b) of paragraph (1) shall be guilty of an offence.

(3) Where the person to whom a warning is issued under this regulation is a clu~b or other organization, or where such warning is issued to not less than lhrce members of a c!ub or organization, the Committee may, if i t sees fit, suspend the licence issued to such club or organization for such period not exceeding one month, as the Committee may determine.

33. Any person who contravenes ally of the provisions of regulations 15 to 31 shall, on summary conviction before a Resident Magistrate, be liable to a fine not excceding fifty dollars.

4. No person shall leave any vehicle with or without animals harnessed to it upon any street or public thoroughfare, or on the side thereof. except in case of accident and in case of accident for no longer time than may be necessary.

5. No horse, mule or ass shall be permitted to pass through any street, lane or thoroughfare in the town of Port Antonio, without being led or so secured as to prevent the same from running at large, and no horse. mule, ass, cattle, sheep or goat shall be permitted to stray about the streets or thoroughfares of the town of Port Antonio.

1. These Regulations may be cited as the Parish Councils (Boats ply- ing for Hire in the Harbours of Port Antonio) Regulations, 1909.

2. All boats plying for hire, and every person in charge of a boat ply- ing for hire shall be licensed.

3. The Parish Council may, upon the recommendation of the Super- intendent of Police or other competent person duly appointed for the purpose of examining boats plying for hire, and if satisfied with the fittings and sea-worthiness of any boat, and upon payment to the Secretary of the Council of a fee of fifty cents, issue a licence for the use of such boat, and such licence shall state the number of persons and the weight of freight the boat shall carry:

Provided, however, no boat of less dimension than 14 feet, by 3 feet 6 inches beam, by 18 inches deep shall be licensed to carry freight.

4 The Parish Council may. after making such enquiries as may be deemed necessary, and after being satisfied with the character and fitness of any person who is above eighteen years of age and upon payment to the Secretary of the Council of a fee of fifty cents, issue a licence to such person to ply for hire.

5. No person shall ply for hire in any unlicensed boat or carry or receive for carriage therein for reward, any passenger or goods whatso- ever.

6. Every person duly licensed and in charge of a licensed boat shall be responsible for the maintenance of good order in such boat and the lawful commands of such licensed person shall be obeyed by all persons on board.

7. Every licensed boat shall have legibly painted in white on a black ground, in large letters and numbers not less than three inches high, the regisbred number thereof on its bow, and on its back-board shall also be painted the owner's name.

8. Every licensed person in charge of a boat shall wear on the front- portion of his hat the number of his licence, which number shall be in figures of not less than one and a half inches in length.

9.-41) The Secretary of the Parish Council and the Superintendent of Pdice for the parish shall keep a register of the owners of boats and persons licensed under these Regulations, and the number of such licences.

(2) All licences must be renewed on the 1st April, of each year.

(3) Every licensed boat equipped and afloat shall be deemed to be plying at all times.

10. No person shall demand, receive or take for freight or passage money, or otherwise as reward for or in respect of the receiving, loading. carriage, landing or delivery of any passenger or goods to or from any boat whatsoever. any payment or reward over or beyond the amount of money ailowed therefor in the scale of charges sanctioned by the Parish Council and annexed to these Regulations.

11. The owner of every licensed boat, and the licensed person in charge of every boat'shall keep in such boat, a card with the scale of charge sanctioned as aforesaid, correctly and legibly printed thereon, and pro- duce the same and afford an inspection thereof to every passenger on demand, and likewise to any other person on whom any demand for the service of such boat or of the coxswain or crew thereof mav be made.

12. All licensed boats shall be manned with minimum crews as iollows-

13. Only one boat or wherry, whether or not the same shall be duly licensed. shall go alongside a ship's ladder at one time, and the person in charge of every such boat or wherry shall, while alongside such ship's ladder, be subject to the orders of the Master or other Officers or Petty Officers of such ship with respect to going alongside or departing from such ship's ladder.

14. All licensed boats and wherries whatsoever shall be subject to the orders and directions of the constable or other Police Officer regulating boat traffic.

15. Any person, boatman, or passenger in a licensed boat disobeying or resisting the lawful orders of any Constable or other Police Officer. or guilty of disorderly conduct, or extorting or attempting to extort im- proper charges shall be guilty of an offence against these Regulations.

16. Every person who shall be guilty of any offence against these Regulations shall be liable on conviction to a penalty not exceeding four dollars, and in default to imprisonment not exceeding thirty days with or without hard labour.

3. Any person found loitering in any street or lane in the said towns may be ordered by any Justice of the Peace or member of the Constab- ulary Force to "move on and keep moving" and any refusal or neglect to obey such order shall be an offence against these Regulations.

4. Any person who does any act in contravention of these Regulations shall on summary conviction before a Resident Magistrate or two Justices of the Peace, be liable to a penalty not exceeding four dollars and in default of payment to imprisonment for a period not exceeding thirty days with or without hard labour.

1. These Regulations may be cited as the Morant Bay (Preservation of Order in Streets and Public Places) Regulations, 1932.

Persons Loitering in Streets

2. No person shall loiter in any street, lane or thoroughfare.

3. Any person found loitering in any street, lane or thoroughfare may be ordered by any Justice of the Peace or member of the Constabulary Force to move on and to keep moving.

Preservation o f order at Places of Public Amusement . 4. No person shall smoke in any place of public amusement unless

smoking is expressly permitted therein.

5. No person shall behave in a noisy or in a disorderly manner in any place of public amusement nor shall any person cause annoyance to any other person therein, nor shall any person stand in any aisle, passage or on any staircase or on any doorway or otherwise cause any obstruction therein or thereon.

6. Any person who acts in contravention of regulation 4 or 5 may, in addition to any other punishment, on request of the management, be re- moved from such place of public amusement by any constable or by any- one representing the management.

7. A place of public amusement under these Regulations shall be and include any building or land in or upon which any concert, entertainment or meeting iq held to which the public have access free or on payment of a fee for admission.

Traffic and Street Impediment

8. East Street, north of Main Street, shall for half an hour before, during and for half an hour after any entertainment or performance in the Empire Theatre be a one way drive from north to south, and all vehicles shall park during such period north of Main Street, on the eastern side of East Street only, and be under the supervision and direction of any constable. Any person violating this regulation may be stopped by any constable and any disregard of the order of any constable acting thereunder shall be a breach hereof.

9. No vehicle shall park, stop, or remain standing with any part there- of within six feet of any street or lane intersection, nor shall any vehicle park or stop in front of any drive-way opening on any street or land. Any constable may, with necessary assistance, remove or require to be re- moved, any vehicle parked in contravention of this regulation.

10. No person shall create or allow any encroachment, or impediment or any nuisance in any street (which includes lanes and thoroughfares) and any such encroachment, impediment or nuisance may be removed by any constable or by any officer of the Council.

Penalties

11. The penalty for a breach of any of these Regulations shall be a fine not exceeding four dollars, with imprisonment in default of payment of the fine, for a period not exceeding thirty days with or without hard labour.

1. These Regulations may be cited as the Montego Bay (Restriction of Animals on Thoroughfares) Regulations, 195 1.

2. No animal shall be driven, led or ridden over or along St. James Street between its junction with Barnett Street and the south side of the square known as the Parade, except for the purpose of loading or un- loading any goods or articles on or from any vehicle drawn by such ani- mal or on or from any receptacle carried on and by such animal and in no case shall such animal remain on the said street for more than half an hour.

3. Any person who contravenes these Regulations shall be guilty of an offence and shall be liable on summary conviction before a Resident Magistrate to a penalty not exceeding fifty dollars.

1. These Regulations may be cited as the Parish Council of Man- chester (Slaughter House) Regulations, 1963.

2. In these Regulations, unless the context otherwise requires-

"the Council" means the Parish Council of Manchester;

"lairs" means the part of the Slaughter House assigned for the reception and examination of animals intended to be slaugh- tered;

"pen" means the portion of the Slaughter House which shall be set aside and assigned to such owners as may desire to keep ani- mals for any period before placing them in the lairs for slaughter;

"the Slaughter House" means the land and premises described in the Schedule; S C ~ ~ ~ U I C .

"the Superintendent" means the person for the time being appointed by the Council to perform the duties of the Superintendent of the Slaughter House.

3. The staff of the Slaughter House shall consist of the Superintendent and such other persons as may from time to time be appointed by the Council and such persons shall hold office during the pleasure of the Council.

4. The Superintendent shall-

(a) be responsible for the proper care of the buildings and premises and for the cleanliness and sanitation thereof and for the disci- pline of the other employees and the observance of these Regu- lations;

(b) keep a book in which he shall record daily the following particu- lars of animals offered for slaughter-

(i) the description, sex, colour and marks of each animal admitted to the lairs;

(ii) the name and address of the butcher or other person by whom brought in;

(iii) the name and address of the person from whom the ani- mal was purchased:

(iv) the name of the person by whom the animal was bred and the name of the property where bred;

(v) the amount of fees paid and by whom;

(vi) the date of the slaughter of any animal;

(vii) the date of condemnation of any animal, carcass or part of carcass of any internal organ or part thereof and the reason for condemnation;

(c) examine the aninials offered for admission and refuse to admit any animal which 'shall from any cause appear to him unfit for slaughter for human consumption;

((1) cause to be removed from the Slaughter House any person or persons who shall entcr, or be upon the Slaughter House with- out a permit or his special permission or who shall commit any breach of these Regulations;

( ) from time to time with the consent of the Council assign a place in the Slaughter House buildings and premises for the carrying on of the various activities which should or may properly be carried on in the said buildings and premises;

(f) daily prepare a statement of the fees collected and forward such statement together with the amount collected to the Secretary of the Council.

5. The Slaughter House shall be opened at such hours as shall be fixed from time to time by the Council.

6. Every animal intended to be slaughtered shall be brought alive to the lairs not less than six hours before the time at which it is proposed to slaughter the same and every person desiring to slaughter shall give not less than twenty-four hours notice specifying the animals to be slaugh- tered and the time of the slaughter save and except that any person may be exempted froni this regulation in the following cases-

(a) accidental injury to any animal necessitating its immediate slaughter:

(b) any animal slaughtered in accordance with the Butchers Regu- lations by reason of the refusal or incapacity of the animal to travel :

Provided that in such cases all animals so slaughtered shall forthwith be brought into the Slaughter House for examination and stamping and the full slaughter fees be paid thereon.

7. Every person who desires to have an animal admitted to the Slaughter House shall in writing set out the particulars specified in items (i), (ii). (iii). (iv) of paragraph (b) of regulation 4 and shall certify that such animal is free from any contagious or infectious disease and shall sign such particulars and certificate.

8. The scale of fees *established by the Council shall be payable for the use of the Slaughter House for the slaughter of animals and shall be paid before slaughter.

9. No animal shall be admitted to the Slaughter House before 6 o'clock in the morning or after 6 o'clock in the afternoon provided that the Superintendent may in his discretion permit any animal or turtle to be admitted to the Slaughter House within the prohibited hours upon the payment of such extra fees as may be prescribed by the Council.

10. The uncondemned carcass (or uncondemned portion of a carcass). internal organ or part of an organ of every animal slaughtered and dressed at the Slaughter House shall, immediately after it has been mark- ed with the brand or other mark for the time being prescribed by the Council, be removed from the Slaughter House by the person who brought the animal into the Slaughter House :

Provided that the carcass of every animal slaughtered and dressed at the Slaughter House may at the risk of the owner remain overnight on the premises of the said Slaughter House and until the hour fixed for the opening of the public markets at Mandeville and Newport on the day following such slaughter but the person on whose behalf the animal was brought into the Slaughter House shall cause such carcass or the un- condemned portion, internal organ or part of an organ to be removed not later than two hours after such hour. The Council shall not be answerable in damage for any loss, however, arising to any such carcass. internal organ or part thereof.

11. No person shall remove or cause to be removed from the Slaughter House the carcass of any animal or any part thereof to any place within the limits of any market other than the public markets or to a licensed meat shop.

12. No person shall-

( r r ) rcmove any tripe from the Slaughter House until after the same has bccn clcaned to the satisfaction of the Superintendent or any person duly authorized to act for him;

(6) on any pretence sell any meat in the Slaughter House;

(c) remove any carcass or part thereof from the Slaughter House until it has been marked or branded with the mark or brand for the time being prescribed by the Council;

(d) do or cause any damage to be done to any building. cattle, pen or appurtenance of the Slaughter House or to any utensil or property whatever of the Council used therein;

(e) light any fire or cook on the Slaughter House premises without the permission of the Superintendent;

( f ) use any part of the Slaughter House except the place especially provided for the purpose as a urinal or latrine or for the de- posit of any rubbish, waste or any filthy deleterious or obnoxious matter;

(g) create or cause any disturbance or use any obscene, abusive or insulting language or swear or otherwise misbehave in the said Slaughter House or any part thereof;

( h ) enter upon the Slaughter House premises unless holding a permit from the Council or by special permission of the Super- intendent;

(i) take or permit to accompany or follow him any dog into the Slaughter House premises;

(j) spit in the Slaughter House or any part thereof; (k) take into or cause to be taken into the Slaughter House

premises alcohol in any form whatsoever;

(1) smoke in the Slaughter House or any part thereof.

13. No person suffering from any infectious or contagious disease shall enter or remain on the Slaughter House premises, or handle any meat meant for human consumption.

14. Permits to enter upon the Slaughter House shall be granted free of charge and shall be revocable by the Council at any time in its sole discretion and shall, if not sooner revoked, expire on the 31st day of March next after the date of the grant thereof.

15. Twenty-four hours after any animal has been placed in a pen in the Slaughter House the owner thereof shall provide such animal daily with sufficient food or fodder which, in the case of cattle, shall not be less than a bundle of grass of the weight of twenty-eight pounds for each animal.

16. Every animal brought into the Slaughter House shall be there placed and remain at the sole risk of the owner, and the Council shall not be liable to anyone for any injury or damage to such animal however such injury or damage may be caused whether by the neglect, default, omission or otherwise of the Council's servants or agents.

SCHEDULE (Regulation 2)

DEFINITION OF BOUNDARIES OF THE MANDEVILLE SLAUGHTER HOUSE

All that piece or parcel of land situated at Waltham in the parish of Manchestcr containing by survey two acres and butting northerly on lands in the possession of Norman Vassell and James Hudson, southerly and easterly on lands in the posses- sion of James Hudson and westerly on the parochial road leading from Waltham to Mandeville.
