ODA investigated and applicator violated ORS634.372(2), which states A person may not: … As a pesticide applicator or operator, intentionally or willfully apply or use a worthless pesticide or any pesticideinconsistent with its labeling, or as a pesticide consultant or dealer, recommend or distribute such pesticides. During 2015 Mr. Richesin was an Oregon-licensed CPAand was responsible for all his pesticide application activities. On or about August 17, 2015 Mr. Richesin intentionally applied pesticides to an onion field in Oregon.The pesticides were sprayed onto a frequently flood-irrigated field, in a manner that allowed the product to drift onto neighboring property and contact anunprotected person working in the area, which was inconsistent with label provisions. Additionally, applicator violated ORS 634.372(9), which states A person maynot: … As a pesticide operator, engage in the business of, or represent or advertise as being in the business of, applying pesticides upon the land or property ofanother, without first obtaining and maintaining a pesticide operator’s license. The operator also may not engage in a class of pesticide application business that isnot specifically authorized by license issued by the State Department of Agriculture. The operator also may not employ or use any person to apply or spraypesticides who is not a licensed pesticide applicator or pesticide trainee.
