In view of the fact that you have waived your right to attend the predetermination hearing set for Thursday, December 23, 2010, I have made my decision regarding the recommendation of discipline.

I have carefully reviewed the facts in this matter, including the guidelines set forth in Policy 4.2.3.22 "Crashes Involving City Vehicles", for points assessed and resultant discipline. Therefore, you are assessed one point for the crash you were involved in on December 4, 2010 and that, combined with the three points assessed previously within a two-year period, totals 4 points and I concur with the recommendation of a one-shift suspensiOn. The date of the suspension will be determined in conjunction with your supervisors.

2.3.35.4 Damage: Members shall be held accountable for damages resulting from accidents wherein the evidence shows abuse, carelessness, negligence and/or a violation of a traffic ordinance.

Summary: (attach additional sheets as needed)

On December 4, 2010, at 3:40 pm, Officer Fantauzzi was backing out of a parking space at the Chase Bank located at 7700 South Dixie Highway in West Palm Beach in his marked patrol vehicle. Another vehicle was attempting to pull into the parking space on the south side next to Officer Fantauzzi. Officer Fantauzzi did not see any traffic behind him and continued to back out. The left rear ofFanauzzi's police vehicle struck the right front fender and door of the other vehicle, a 2001 Toyota Camry. The Toyota Camry received minor damage (approx. $500.), there was no damage to the police vehicle, and there were no injuries sustained.

Pursuant to a traffic crash review, Officer Fantauzzi was found to be at-fault/careless involving a minor violation and one point was assessed. Officer Fantauzzi had a previous at-fault traffic crash on December 16, 2009 in which he was found to be careless, received three points, and a four-shift suspension. Due to this incident, and the previous at-fault accident, Officer Fantauzzi has accumulated four points within the past two-year period. The actionable guidelines in the departments 'Crashes Involving City Vehicles Policy' ( 4.2.3.22) provides for disciplinary action.

Recommendation:

A one-shift suspension without pay.

Traffic Crash Review: Officer Ivan Fantauzzi

Today I met with Major Can to review a traffic crash involving Officer Fantauzzi.

On December 16,2009 at approximately 6:56a.m., Officer Fantauzzi was driving his marked police vehicle southbm.md on Military Trail when he struck the raised concrete median. The vehicle sustained damage to both driver side wheels and tires which required replacement.

Officer Fantauzzi has not had any other vehicle crashes in the two-year period preceding this incident. We have classified tllis crash as a serious violation due to the level of carelessness and we recommend that he receive three points. We feel that the four shift suspension he received regarding this incident is appropriate.

On December 16,2009, at approximately 6:56am, Offi.cer.Fantauzzi w!ls operatffig a marked police vehicle when he stJ:uck the raised concrete .curb of the center median strip southbound on Military Trail at Union-square Blvd. The vehicle sustained damage to both the front and fear driver side tires and rims requiring replacement. Officer Fantauzzi did not immediately report the crash to his supervisor but fust.drove the vehicle from the scene on flattened tires to the parking lot of police headquartets and parked it. His actions affected the ability of supervisors to accurately investigate, document, and photo'graph the scene, willie the vehicle and/or any evidence was available. Officer Fantauzzi advised he was distracted by r~a:ohing over to plug the power e6rd in for his .police laptop MDT while the vehicle was in motion and allowed. the vehicle to drift off'.Cnurse.

Recommendation:

A three shift suspension without pay.

Summary:

On two separate occasions since July 2007, Officer Fantauzzi has been late for roll call. The first documented offense took place July 29, 2007 and the second was on today's date, August 21, 2007. In both instances he overslept.

Recommendation:

On July 29,2007, Officer Fantauzzi was given a Notice of Counseling. In accordance with progressive discipline as described in Article 11 of the union contract, this subsequent violation would warrant a written reprimand.
