notes from the SUPERVISOR’S OFFICE

November is the month that really brings the full

change of seasons to us, and it is a month where

things are very busy for people here in Guilderland.

The Guilderland Highway Department is fully

involved these days in the Town’s annual leaf

collection program. Our leaf vacuum trucks are

circulating throughout the neighborhoods where

they are able to operate, picking up leaves on the

scheduled dates for the neighborhoods, plus making

additional swings through diff erent areas as their

schedule allows. Highway Department crews will be

picking up bagged leaves in neighborhoods where

the vacuum trucks cannot operate. Your street’s

pick-up dates were printed in the Town newsletter

mailed to all our residents in September. If you

didn’t note the pickup dates when you received

the newsletter, you can check on the Town website,

www.townofguilderland.org.

Please be sure that leaves are placed in the street

adjacent to your curb line to avoid damage to Town

equipment, and show concern for your neighbors

and our Town work crews by not piling leaves in a

way that restricts visibility. Also, branches and brush

set out for pickup needs to be cut into pieces no more

than 4 feet long and tied into bundles that a single

worker can readily pick up for collection. If you have

any questions, please call the Highway Department

at 861-5108.

I have presented the 2012 Town Supervisor’s Draft

Budget to the members of the Guilderland Town

Board, which will vote on it at its meeting on

Thursday, November 10. The continuation of diffi cult

times in the national and regional economy, along

with New York State’s imposition of a cap on the

property tax levy, have caused the Town to scrutinize

costs very carefully in every area, and to scrupulously

avoid being overly optimistic in projecting revenues.

This approach has resulted in a draft budget that

leaves the Town tax rate unchanged at 26 cents per

thousand dollars of assessed valuation again in 2012.

In order to accomplish this, Town employees and

elected offi cials will once again receive no raises in

2012, and several positions have been converted

from full-year to seasonal status, but there are no

changes proposed in the range or the level of services

provided for our residents.

Each year, I

like to take the

opportunity to

encourage residents

to keep up on Town

aff airs by watching

Town government

meetings on

Channel 17 on

the local cable

television networks.

Town Board

meetings take place

on the fi rst and third Tuesdays of each month, and

are broadcast live on Channel 17. These meetings are

rebroadcast at 1:00 and 7:30 P.M. on the following

Friday, and at 7:00 P.M. on the following Saturday.

The Zoning Board of Appeals meets on the fi rst and

third Wednesday of the month. These meetings

are broadcast live, then replayed at 1:00 P.M. the

following Thursday and at 7:00 P.M. the following

Saturday. The Planning Board meets on the second

and fourth Wednesday of the month, with live

broadcasts of its meetings, as well as replays the

following Thursday at 1:00 P.M. and the following

Saturday at 7:00 P.M. Altamont’s Village Board meets

at 7:00 P.M. on the fi rst Tuesday of the month, and

its meetings are taped for rebroadcast at 11:00 A.M.

and 5:00 P.M. on the Thursday and Saturday after the

meetings.

With Thanksgiving occurring in November, I think that

this time of year is a time when all of us in Guilderland

can take time to refl ect on all that we have to be

thankful for in a community like our own. I would like

to take this opportunity to extend my wishes for a

happy Thanksgiving to all of Guilderland’s residents

and their families.

November in the chamber world is consumed with a health insurance

ac vity called OPEN ENROLLMENT. We get new plans, new rates, and chamber members who wants to make changes to this me can do so. We have very good news from our insurance carrier, CDPHP, that while some rates are increasing a teeny bit, others are actually going down in price! We had a busy month in October doing grand opening ribbon cu ngs, and do have a few more, including TCBY on 11/11/11! TCBY low fat frozen yogurt is not a new thing, but it is located right next to Five Guys on Western Ave and is healthy in a very health conscious me. This ribbon cu ng is open to the public, school is off that day, and there will be free 3 oz TCBY, face pain ng, balloons and more from Friday Nov 11 through Sun Nov. 13. We also have heard rumors that we are ge ng a deli at the old Wendy’s, a Super Cuts at the 20 Mall (Hamilton Square) and s ll rumors that Recovery Room is coming there too!

The chamber has some great networking events- at Central Steak on Nov. 9, a women’s business luncheon with Dr Mark Hillman at the Pine Bush Discovery Center on Nov. 16, a Friday Business Breakfast open to anyone about websites and internet marke ng on Dec 2, and a bus trip to New York City Dec 3, also open to anyone.

Guilderland, NY - It is no secret that the Guilderland

real estate market has changed dramatically

over the past several years. Currently there are

approximately 282 existing single family homes for

sale in Guilderland ranging in price from $89,900 to

$1,600,000 with a median list of price of $352,450.

Approximately 198 existing homes closed during

2011 as of the end of October, with a median sale

price of $224,149. On average about 20 homes sold

each month in Guilderland in 2011. Based on this

absorption rate and the current inventory we have

over a year supply of homes currently on the market.

The days of putting a sign in the ground and having

multiple off ers in 24 hours ended for the most part,

in 2006. Today, a real estate agent needs to be a

COMMUNITY CAREGIVERS TO HONOR ALBANY COUNTY DISTRICT ATTORNEY

A Harvest Happening is the theme of the 17th annual gala to benefi t Community Caregivers, which will be held at Albany Country Club on Saturday, November 19.

The annual gala is one of two major events to raise funds for Community Caregivers. This year’s event will honor three men who are community leaders in their own right.

District Attorney David Soares and Pastor Charlie Muller will receive the Community Caregivers Public Service Award.

Charles Touhey will receive the Joseph A. Bosco Community Service Award.

DA Soares was elected Albany County District Attorney in 2001 and re-elected in 2008. During his two terms in offi ce,

Mr. Soares has redefi ned the role of the District Attorney to emphasize public integrity and crime prevention. He also has shifted the criminal enterprise prosecution paradigm by taking action against the leaders of organizations instead of low-level off enders.

Some of his initiatives include: Seniors and Law Enforcement Together (S.A.L.T.), addressing crimes committed against senior citizens, and to help prevent crimes of opportunity against one of our most vulnerable populations.

The Community Accountability Board, which empowers community members to take responsibility for the quality of life in their neighborhoods.Pastor Charlie Muller is best known in the Capital Region for starting the fi rst ever Gun Buy Back Program in Albany. To date the program has taken over 350 handguns from the streets of Albany and Schenectady. A recent study in 2010 showed that there was not one homicide in the city of Albany during the year with a handgun.

Pastor Charlie established the Victory Christian Church in Albany and recently opened a second church located in Colonie.

His passion is clearly for needy children, building and opening the fi rst Children’s Only Feeding Center in Albany. To date there have been over 400,000 meals served to at-risk inner-city children.

In 2010, he received the Boys & Girls Club Community Impact Award.

Charlie Touhey has been a main stay in Capital Region for many years. He has extensive experience in the private sector with an emphasis on real estate and housing. He currently is Managing Partner of The Latham Four Partnership and oversees one million square feet of offi ces and distribution facilities in New York and Florida. He has also developed several residential subdivisions using such innovations as modular housing. In addition, he is also Vice President of Orange Motor Company, as well as the President of The Spare Room, Inc. a mini-storage facility with over 3,000 units.

At the present time Mr. Touhey is supervising construction of 50 new owner-occupied two family homes in Arbor Hill. He is a member of the College of Saint Rose Board of Trustees and a Board member of the Albany Center for Economic Success, a small business incubator, which assists women and minority entrepreneurs in starting up new enterprises.

ADVANCE MEDICAL DIRECTIVESThe law recognizes that we have a fundamental right to consent

to or refuse medical treatment. But what happens when we

are unable to communicate our wishes with respect to medical

treatment?

The law provides that we can execute certain documents in

advance that can facilitate the process. We will discuss two of

them, health care proxies and living wills, in this article.

Q. What is a health care proxy?

A. A health care proxy is a document that appoints someone to

be your health care agent. A health care agent can make medical

decisions on your behalf.

Q. When does the health care proxy become eff ective?

A. A health care proxy becomes eff ective only after a doctor

determines that you are unable to communicate your wishes

yourself, e.g. if you are unconscious or in a coma.

Q. What decisions might the agent be called upon to make?

A. Some of the decisions your agent may be required to make

include what medications to take or refuse or what procedures or

surgeries to undergo.

Q. Can the health care agent make a decision that is against my

own wishes?

A. If you have previously communicated to your health care

provider your wishes with respect to certain medications or

procedures, your health care agent cannot overrule your decision

once you lose your ability to communicate.

Q. Does the health care proxy make the health care agent

responsible for my medical bills?

A. No. You remain responsible for payment of medical services

provided to you, whether you personally consented to them or

your health care agent consented on your behalf.

Q. Can my health care agent override my decision to be an

organ donor?

A. No. Your health care agent cannot cancel your decision to be an

organ donor if you have fi lled out an organ donor form.

Q. Can my health care agent make decisions regarding end-of-

life choices?

A. Your health care agent can make decisions with respect to end

of life care only if you can show that you have communicated

your intentions to the agent. A separate document called a Living

Will can accomplish that.

Q. What is a Living Will?

A. A Living Will is a document that serves as evidence of your

wishes with respect to end-of-life care.

Q. What are some of the issues a Living Will addresses?

A. A Living Will can express your wishes with respect to life-

prolonging procedures and end-of-life treatment when it has

been determined that you are in a persistent vegetative state or

have no hope of recovery.

Q. What are some of the issues I can address in advance?

A. You can use your Living Will to express your desire to withdraw

or withhold life-sustaining treatment, such as artifi cial respiration,

artifi cial hydration and artifi cial nutrition when you have no

hope of recovery. You can also indicate a desire to be taken off

medications, even antibiotics, if there is no hope for your recovery.

Q. What about pain management?

A. You can use your Living Will to express a desire for maximum

pain relief, even if that were to hasten your death.

Q. Can I ever change my Health Care Proxy or Living Will?

A. A health care proxy and living will can be changed at anytime,

so if you change your mind about certain procedures or wish to

change your health care agent, you are free to do so.

Q. Who has the ability to complete a Health Care Proxy and

make a Living Will?

A. Anyone 18 years or older can make a Living Will or complete

a Health Care Proxy. To be eff ective, the documents need to be

executed and witnessed in conformance with New York State law.

Balance

While driving to school with my son and his friend the

other day, we were discussing an upcoming football

game. As you may or may not know, I am a huge fan of

football. That is, when my son(s) are playing. I have been

working on my self control as a spectator – I tend to get a little

excited to say the least – but this article is about balance so I’ll

leave adult self control for another time.

We were talking about how great it feels to win and how

terrible it feels to lose. I told them that it all balances out.

Everything in our universe is in balance. It is necessary for

someone to lose if someone wins. We discussed the far

eastern philosophy of yin and yang, positive and negative,

light and dark, and the list goes on as long as you would like to

take it. Everyone understands money, so I used the example

of wealth on a global scale. Compared to the average person

in our community, there are people with such fi nancial wealth

that it staggers the mind. There are also people in such

poverty that we cannot imagine. It all balances. The concept

of communism forces the balance to average out so everyone is just kind of happy; like a tie football game

that is unresolved. In our society, and most countries globally, we need the winners to give us something

to strive for and to keep us working and hoping and challenging ourselves. We also need to be winners

sometimes to feel successful.

What I tried to tell the boys was that you can’t have joy without sadness, you can’t have a win without a

loss, and you can’t have love without hate. It just doesn’t work out. Without the yin to go with the yang the

technique is incomplete. Without the football loss we cannot experience the football win. Without a concept

of hate, we cannot know love. With nothing to compare to, everything would just feel kind of okay, like a tie

game.

You may fi nd all of this saddening, but actually it serves to make sense of the world and why things are the

way they are. The concept of necessary balance regarding economics, physics, or competition can provide a

sense of comfort through understanding the way things work. This realization has helped me remain calmer

at games, for a game in football represents so much more than just a game; it is full of life lessons. Just like

Taekwondo. Find your lesson and your balance in the things you do.

Old Songs, Inc. presents “FOUR SEASONS, FOUR YEARS”, The Civil War: A Musical Journeyon November 18 and 19, 2011 at 8:00pm at 37 S. Main St.,Voorheesville, NY.

Four Seasons, Four Years is a new and exclusive production

featuring eleven singers and musicians performing a selection

of songs extant in America between 1850 and 1865. These

will include both popular songs of the period as well as songs

composed in response to the Civil War itself and events leading

up to it. The songs are interspersed with historical narrative

specifi c to New York State and the New York Volunteer Regiments.

Tickets are $25 and may be purchased online at www.oldsongs.

org. Reservations and tickets may also be purchased by calling

Old Songs, Inc. at 518-765-2815. A preview performance will be

held on Thursday, Nov. 17 at 7:00 pm for which tickets may also

be reserved.

The cast of singers and musicians include Greg Artzner, Dan

Berggren, Stephen Fry, Betsy Fry, Reggie Harris, Terry Leonino,

John Roberts, Bill Spence, Toby Stover, Susan Trump and George

Wilson. All known in their own right as fi ne working musicians,

they have joined forces to present this unique show in observance

of the 150th anniversary of the Civil War.

The songs of this period include Negro spirituals, shape-

note hymns, marching songs, sentimental songs and songs

and parodies written by 19th century writers such as Stephen

Foster, George F. Root, the Hutchinson Family and Henry C. Work.

The cast performs in individual and ensemble performances

bringing these songs alive with great gusto, emotional impact

and exceptional musicianship.

The production has been produced, written and directed by

Old Songs, Inc. Executive Director Andy Spence in collaboration

with the musicians.

These events are made possible by the New York State Council

on the Arts with the support of Governor Andrew Cuomo and

the New York State Legislature.
