A Call to ActionAs the National Apartment Association Capital Conference comes to a close, it is important to reflect on the importance of having a voice in the Legislation that affects Nevada Businesses and our Industry.

To help shape the future of our industry to benefit both our Industry and our Residents, it is important we have an active role in the Legislation process from the beginning. The Nevada State Apartment Association, Legislative committee does just that. Through the eyes and ears of our Lobbyist, this committee keeps track of all bills created, submitted to committee for review, and up for a vote that affect business in Nevada and the multi-family industry.

In the last few years, the NVSAA has placed a heightened focus on developing an influence and position in the legislative process. We have met with, endorsed and contributed to many Nevada legislative campaigns funds. In February of 2014, the Legislative Committee, with the guidance of the Board of Directors, completed and distributed a NVSAA Legislative Policy Manual.

The NVSAA Legislative Committee asks for your support. As part of a non-profit organization, we look to our members to fund the initiatives needed to ensure our industry is not financially impacted or restricted due to legislation. We have established many events throughout the year to raise funds for our Legislative Action Fund. You may contribute to the NVSAA LAF fund at any by contacting the NVSAA Office directly. Your support helps us to have an influential seat at the table when it comes to issues affecting our industry.

Recently, the Nevada State Apartment Association (NVSAA) completed its first version of its Legislative Policy Manual. This important document helps us educate our State’s Legislators, industry partners and even the public on critical issues which not only affect us but our tenants too.

The Nevada multi-family housing industry is one of the largest and most influential industries in the state according to published economic studies. It is estimated that the multi-family housing industry has contributed 12 billion dollars to Nevada’s economy and supports roughly 300,000 industry-related Nevada jobs. The industry is comprised of and affects not only property owners, management companies and the employees who oversee individual multi-family housing properties, but also the renters who reside in these properties, and the multitude of vendors (small and large business owners) who exist to provide services thereto. Because the multi-family housing industry is so expansive and intertwined with

other supporting industries, it is routinely affected by a wide variety of state legislative changes.

At present, the NVSAA has over 500 individual multi-family housing property members throughout the state of Nevada. Furthermore, the NVSAA is additionally affiliated with 44 independent rental owners, 72 active property management firms, and 110 vendor members who provide services to its members in Nevada. It is estimated that there are approximately 218,000 individual apartment dwellings in the State of Nevada; the NVSAA — through its various memberships — is directly affiliated with more than 87,000 of these apartment dwellings. Respectively, the NVSAA is now affiliated with almost 40% of all Nevada apartment dwellings.

Apartment Association is a conglomeration of more than 170 state and local affiliates throughout the country, representing 63,000 members and over 7 million apartment homes. The National Apartment Association shares the NVSAA’s commitment serve the interests of multi-family housing owners, managers, developers and suppliers and to maintain a high level of professionalism in the multifamily housing industry to better serve the rental housing needs of the public.

Policy and Political EngagementLegislatively, the NVSAA is committed to serving our members on all local and statewide issues that impact our industry. We strive to monitor all industry-related local and state legislative changes, inform our members as to the potential impact of such changes, and attempt to educate our legislators as to our industry and the effect of their decisions. With the assistance of the National Apartment Association, professional liaisons, retained lobbyists and our Legislative Committee — and in utilizing the NVSAA’s Policies pertaining to Endorsement and Contribution — we strive to enhance the economic climate of our state, promote our members’ rights, and maintain a viable and productive multifamily housing industry in Nevada. Additionally, we also ensure our residents best interests are fair and in accordance of national policies, like HUD policies.

Understanding the Importance of Multifamily in NevadaA new class of renter has emerged in Nevada. Housing in Nevada is at a changing point. Shifting demographics have collided with new economic realities, challenging traditional concepts of home. Tomorrow’s households not only want something different from a suburban single-family home, but also need flexible housing options to adapt to the ever-changing job market. These trends add up to fewer homeowners and more renters.

Yet, housing policy today hardly ref lects these transforming fundamentals. Nationally, housing policy’s failure to recognize the growing demand for rental housing not only threatens the apartment sector’s ability to meet the nation’s acute housing needs but also hinders new job creation integral to economic recovery. We urge policy makers to adopt policies that respect people’s right to choose housing that best meets their financial and lifestyle needs and values apartment living to the same degree as homeownership.

Apartments Provide More than Just ShelterApartments represent fiscally responsible development. By tapping into existing infrastructure, apartments reduce the cost of providing public services such as water, sewer and roads. More than $100 billion in infrastructure costs could be saved nationally with more compact forms of development such as apartments.

Apartments are more environmentally friendly and sustainable than other housing types.

Because of their high-density nature, apartment dwellers generate 30 percent to 40 percent fewer vehicle trips than single-family households, making apartments an important tool for climate change efforts.

Apartments help develop economically healthy communities by providing jobs and housing for much-needed workers. Harvard

University researchers found that average house values were thehighest in working communities with the most multifamily units.

What Does This All Mean and Where Do We Stand On Policies?Now that we have helped you (hopefully) uncover some of our industry’s basics and WHY the multifamily landscape is so important to Nevada (and the nation), let’s address just some of our policy stances and why we as an industry support and / or oppose certain topics. While there are several policies we look at as industry we will only be looking at a few. Standing Policy PositionsNRS 118, NRS 118A, & NRS40Landlord-tenant relationships contemplated in the multi-family housing industry are governed predominantly in the State of Nevada by Chapters 118, 118A and 40 of the Nevada Revised Statutes (NRS). These statutes represent the codified framework governing prohibitions against discrimination (NRS 118), obligations of the parties in a landlord-tenant relationship (NRS 118A), and procedural mechanisms for obtaining possession of real property through eviction. The NVSAA maintains the position that the current statutes identified above are fair and equitable for both landlords and tenants alike.

The NVSAA believes the current versions of NRS 118, 118A, and 40 impart fair and consistent obligations on both landlords and tenants, and provide appropriate penalties and avenues for redress should a party deviate from the standards contained therein. Accordingly, NVSAA desires to maintain the current statutory scheme and preserve the status quo.

The NVSAA Supports:• The continued fair treatment of landlords and tenants under

Nevada law.• The preservation of the current statutory scheme maintained in

NRS 118, 118A, and 40.• The consistent application of these statutes by all members of

the Nevada judiciary.

The NVSAA Opposes:• Modifications to the current statutory scheme that change the

obligations of the parties in a landlord-tenant relationship (i.e. increased eviction periods or additional notice requirements for initiation of eviction).

• Attempts at circumventing or supplementing the current statutory scheme through delegation of authority to administrative agencies and/or the implementation of additional administrative regulations.

• Inconsistent interpretation and application of these statutes by members of the Nevada judiciary.

Fair Housing and Equal OpportunityThe Nevada multi-family housing industry operates under a variety of state and federal laws which prohibit discrimination in both employment and housing. The NVSAA supports these laws and is strongly committed to seeing that its members abide by same in both spirit and in letter, and that the highest of ethical standards are always followed. The NVSAA maintains — and strives to instill in its members — that prospective and current residents and employees shall not be discriminated against based on the following: Race, ancestry, or ethnicity; Religious beliefs; Gender or sex; Sexual orientation; Marital status; familial status; Source of income; or Disability.

The NVSAA maintains that proper application of state and federal laws shall have the effect of dissuading discrimination and removing barriers in both housing and employment; such action will enhance the economic climate of our state and allow our industry to grow in Nevada.

The NVSAA Supports:• The current versions of state and federal laws prohibiting

discrimination in both housing and employment and the proper application and enforcement of same.

The NVSAA Opposes: • Inconsistent interpretation and application of the current

versions of state and federal laws prohibiting discrimination in both housing and employment.

Affordable HousingThe continued affordability of housing in the State of Nevada is of great importance as it ensures the long-term viability of the multi-family housing industry and promotes its growth. Accordingly, all levels of state government should address affordable housing needs through the use of broad and comprehensive strategies, including, but not limited to, responsible alternative and innovative funding programs, increased housing production and diversity of housing types, streamlined regulatory processes, and reduced market interventions on the part of government. Moreover, governmental regulations and procedures that arbitrarily increase the costs of housing should be removed, including mandatory inclusionary zoning without proper incentives.

The NVSAA Supports:• Affordable housing through the use of a competitive market

operating in a climate that Rl!!l encourages and accommodates housing options for all income levels.

• Affordable housing supported by broad funding supplements where market forces cannot supply housing without added incentives or subsidy.

• Legislation that removes barriers to affordable housing.

The NVSAA Opposes: • Legislation that increases barriers to affordable housing, or

increases the costs to apartment residents indirectly, thereby rendering housing less affordable.

• Adoption of mandatory inclusionary zoning programs or policies.

Smoke-Free Housing ChoiceIn 2006, Nevada voters passed the Nevada Clean Indoor Air Act which effectively banned smoking in most indoor places of employment. This act was amended in 2011 by Nevada lawmakers to strengthen the ban and further protect non-smoking persons from exposure to environmental tobacco smoke. While the NVSAA supports the Nevada Indoor Clean Air Act and its intended goals, it maintains that landlords and managers of multi-family housing properties should be free to set their own smoking and non-smoking policies for the individual properties that they own and manage.

The NVSAA maintains that all persons (smokers and non-smokers alike) have a right to choose housing which fits their respective needs - and that suitable housing should exist for all. Legislation mandating smoke-free multi-family residential housing would deprive persons of the above rights and the ability to find housing suitable for their needs.

Through the use of lease agreements, landlords and managers already adequately regulate many types of conduct within multi-family housing properties so as to protect residents and the property in general.

Examples of these regulations include noise reduction and quiet hours, facility usage restrictions, permitted pets on property, and guest stays. Contractual restrictions on smoking are no different than these regulations; should a landlord or manager decide to restrict smoking on property - based on market forces or at their own discretion - the terms of the lease agreement provide a suitable basis for enforcement of same (and suitable remedies in the event of noncompliance).

Ultimately, the decision to designate dwellings and common areas of multi-family housing properties should be left to the respective owners and managers of same; furthermore, that decision should be influenced and dictated by market forces as opposed to additional legislation mandating a particular result.

The NVSAA Supports:• The owner of a multi-family housing property should be free in

its own discretion to determine whether to designate or regulate all or portions of the property as smoke-free.

• The use of market forces as the primary tool for determining whether a multi-family property should be designated in whole or in part as smoke-free.

• The owner’s use of the lease agreement as a tool for regulating smoking on or about the multi-family property.

• Holding smokers accountable for interior damages caused to a residential dwelling as a result of smoking within; holding smokers accountable for any nuisance or intrusion into the quiet enjoyment of others caused by their actions.

The NVSAA Opposes:• Legislation which removes the owner’s right to determine — in

its own discretion — whether to designate a property or portions thereof as smoke-free.

Crime Free PropertiesThe NVSAA supports the protection of all residents of multi-family housing properties from crime and maintains that that all residents are entitled to the peaceful enjoyment of their dwellings, without fear of violent crime, drug activity, and gang violence.

To accomplish same, the NVSAA strongly advocates that multi-family housing properties work closely with local law enforcement to develop

a partnership to combat on-property crime. Moreover, the NVSAA strongly advocates that multi-family housing properties create and implement crime free provisions into their lease agreements and to undertake certification of the property with local law enforcement as a designated “crime free” property. Properties that carry this designation are better situated to combat crime (with the assistance of local law enforcement) and to take judicial measures to evict and hold responsible the perpetrators of such crimes so as to remove them from our communities.

The NVSAA Supports:• The certification and designation of multi-family housing

properties as “crime free” through local law enforcement agency programs.

• The collaboration of multi-family housing properties with local law enforcement to prevent crimes and dissuade perpetrators from engaging in same.

• Attempts by landlords and managers to evict perpetrators of crimes so as to remove them from the community, and to hold perpetrators of crimes responsible for damages incurred as provided for in NRS 118A.

The NVSAA Opposes:• Legislative measures that that fail to hold the perpetrator of

crimes responsible and/or cause his/her existence to not be reported to law enforcement; the NVSAA opposes legislative measures that directly or indirectly allow perpetrators of crime to remain in our communities so as to potentially repeat their original offense or additional offenses.

RecyclingThe NVSAA supports measures that better protect our environment, conserve our natural resources, and reduce landfill volumes. The implementation of single stream recycling programs will further these measures in Nevada — to wit, many NVSAA members are already voluntarily participating in such existing programs. To the extent that these programs become mandatory in Nevada, the NVSAA supports same provided that the costs and liabilities to multi-family property owners are properly balanced.

Of primary concern to owners of multi-family housing is the cost of any mandated recycling programs. The NVSAA recommends that property owners and municipalities work together to implement successful recycling programs that are tailored to accomplish the recycling goals of each property in a cost-effective manner. Simply stated, these programs should consider a property’s unit size, volume

of recyclables, type of recyclables, and resident participation — and the cost of such programs should be based accordingly. Not unlike other utility costs which become the responsibility of residents at initiation of tenancy, it is believed that residents will share in bearing the associated costs and fees of any implemented recycling program; for this reason, it is imperative that recycling program costs remain as cost- effective as possible.

Of secondary concern to owners of multi-family housing are the potential liabilities associated with mandating recycling programs. Generally speaking, residents are not overly motivated to recycle (except for those that are environmentally focused), and the general concern is that the property owner will bear liability for a residents’ failure to abide by any and all imposed recycling rules and regulations (i.e.. failing to separate recyclables). To combat this concern, the NVSAA supports the use of single stream recycling so as to negate the need to separate recyclables; the NVSAA also opposes any implementation of fines or assessments against the property or its owner which punishes the property or owner for the improper actions of residents.

The final concern raised by owners of multi-family housing is the mandating of a “one-size fits all” approach to multi-family housing

recycling. Simply stated, each multi-family housing property is different, and a cookie cutter approach to implement recycling measures will not succeed - or as feared, will result in significant cost and liability to the property owner to achieve compliance. No two multi-family housing properties have identical buildings sizes, designs, trash disposal systems, parking arrangements, large vehicle access, and space allocation; naturally, a recycling program mandating specific sized receptacles in a specific location may result in significant compliance cost, variances and permit fees, and may simply be outright impossible.

The NVSAA Supports:• Cost-effective single stream recycling programs tailored to meet

the needs of individual properties and their respective residents.

The NVSAA Opposes:• Mandated recycling programs (single stream or other) which

are not cost-effective, suitably tailored, and which result in significant compliance cost or impediment.

On March 11th, when the Nevada State Apartment Association was on Capitol Hill, the Senate Banking Committee Chairman Tim Johnson (D-SD) and Ranking Member Mike Crapo (R-ID) announced that they have reached an agreement on a housing finance reform proposal. Last fall, the Senate Banking Committee hosted an in-depth series of hearings exploring essential elements necessary for reform and over the past few months they have been negotiating and drafting the reform proposal. The bipartisan agreement includes measures from Committee Members on both sides of the aisle, the Administration and stakeholders. Chairman Johnson and Ranking Member Crapo are putting finishing touches on draft legislative text that they plan to release publicly in the coming days, and they plan to hold a markup in the coming weeks.

“There is near unanimous agreement that our current housing finance system is not sustainable in the long-term and reform is necessary to help strengthen and stabilize the economy. This

bipartisan effort will provide the market the certainty it needs, while preserving fair and affordable housing throughout the country,” said Chairman Johnson. “Ranking Member Crapo has been a great partner to work with from the start, and I appreciate all of the important contributions Members of the Committee made to this effort. Specifically, I want the thank Senators Warner and Corker for providing us a strong framework to build on. I look forward to moving this effort through committee once Members have had a chance to review our forthcoming legislation.”

“This agreement moves us closer to ending the five-year status quo and beginning the wind down of Fannie and Freddie while protecting taxpayers with strong private capital, building the components for a stable secondary market and avoiding repeating the mistakes of the past,” Crapo said. “Government control of Fannie and Freddie with no private capital to protect taxpayers against losses is unacceptable. of Senators deserve a tremendous amount of credit for making the hard decisions that will move us toward a stronger housing system that provides a balance between providing broad access to mortgages while protecting taxpayers from losses.”

Chairman Johnson and Ranking Member Crapo agree that the status quo in which Fannie Mae and Freddie Mac remain in conservatorship is not a viable option for our nation’s housing finance system. To move forward, the following principles need to be reflected in any housing finance reform legislation: • Protect taxpayers from bearing the cost of a housing downturn. • Promote stable, liquid, and efficient mortgage markets for single-

family and multifamily housing. • Ensure that affordable, 30-year, fixed-rate, prepayable mortgages

continue to be available, and that affordability remains an important consideration.

• Provide equal access for lenders of all sizes to the secondary market.

• Facilitate broad availability of mortgage credit for all eligible borrowers in all areas and for single family and multifamily housing types.

Details of the Agreement on Housing Finance Reform

Outlined below are some of the details of the agreement that Chairman Johnson and Ranking Member Crapo have reached that will form the basis of a bipartisan housing finance reform text: • Start with S.1217 as the base text and generally maintain its

overall architecture. • Wind down and eliminate Fannie Mae and Freddie Mac. • Promote a smooth and stable transition from the old system to

the new system by providing specific benchmarks and timelines to guide Federal Mortgage Insurance Corporation (FMIC) and market participants.

• Transfer appropriate functions to the modernized, streamlined and accountable FMIC, modeled in part after the FDIC including its regulatory authority.

• Mandate 10 percent private capital, up front, and create a mortgage insurance fund for the system to protect taxpayers against future bailouts.

• Create a member-owned securitization platform that will issue a single, standardized FMIC-wrapped security, and permit private label securities to be issued in a manner that encourages standardization and improved market liquidity.

• Establish a mutual cooperative jointly owned by small lenders to ensure institutions of all sizes have direct access to the secondary market so community banks and credit unions are not at the mercy of their larger competitors when Fannie Mae and Freddie Mac are dissolved. The small lender mutual cooperative would provide a cash window for individual eligible loans, and small lenders could retain servicing rights.

• Provide clear rules of the road for servicers that choose to participate in the FMIC system.

• Maintain a vibrant multifamily market by building upon successful risk-sharing mechanisms and products and providing access to a broad range of markets.

• Require strong underwriting standards that mirror the definition of “qualified mortgage”, and set down payment requirement at 5 percent (with a short phase-in) except for first-time homebuyers at 3.5 percent.

• Facilitate the broad availability of credit for eligible single-family and multifamily borrowers, monitor consumer and market access to credit, and provide market based incentives and transparency to serve underserved areas.

• Eliminate affordable housing goals and establish transparent and accountable housing-related funds that would focus on ensuring there is sufficient decent housing available. The funds are NOT paid for with tax dollars, but through a small FMIC user fee (10 basis points) that only those who choose to use the system pay.

• Allow current conforming loan limits to be maintained so that mortgage credit continues to be available in high cost areas.

• Maintain broad liquidity in the To-Be-Announced (TBA) market and direct FMIC to take into account the impact of new products on the TBA market.
