Occupational Safety and Health Administration

The United States Occupational Safety and Health Administration (OSHA) is an agency of the United States Department of Labor. It was created by Congress under the Occupational Safety and Health Act, signed by President Richard M. Nixon, on December 29, 1970.

Extends to most nongovernmental workplaces where there are employees.

State and local government workers are excluded from Federal coverage, however, states operating their own workplace safety and health programs under plans approved by the US Department of Labor are required to extend their coverage to state and local government employees.

Citation 1 Item 1a Type of Violation: Serious29 CFR 1910.134(c)(1) In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respirator protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include the program the following provisions of this section as applicable

Weatherization Agency – Employees spraying Touch’n Seal A Component and B Component insulation in the attic were required to wear a 3M full face, negative pressure respirator for protection against vapors. A written respiratory protection program had not been developed.

provide a medical evaluation to determine the employee’s ability to use a respirator before the employee is fit tested or required to wear the respirator.

Serious 29 CFR 1910.134(f)(2) The employer did not

ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator

hazardous materials such as two part Touch’n Seal containing MDI, Glazing Sealant containing ethyl and methyltriacetoxysilane, Minwax Wood Finish and Dap Gutter and Lap Sealant containing mineral spirits. The methods to detect the presence of hazardous chemicals were not explained.

Citation 1 Item 2c Type of Violation: Serious 29 CFR 1910.1200(h)(3)(ii) Employees were handling

hazardous materials such as two part Touch’n Seal containing MDI, Glazing Sealant containing ethyl and methyltriacetoxysilane, Minwax Wood Finish and Dap Gutter and Lap Sealant containing mineral spirits. The physical and health hazards of the chemical were not explained.
