Presenter: Manager Business Services, Liam Carroll Approved: General Manager Corporate Services, Diana Leeder PURPOSE The purpose of this report is to provide details on how Council will progress each of the short term actions identified as its primary responsibility following the CBD Summit on 6 October 2016. LINK TO STRATEGIC PLAN The issues addressed in this Report are in accordance with the following Goals/Strategies of the City of Darwin 2012 – 2016 as outlined in the ‘Evolving Darwin Towards 2020 Strategic Plan’:- Goal 5 Effective and Responsible Governance Outcome 5.3 Good governance Key Strategies 5.3.4 Encourage community participation by engaging, communicating and working

in partnership with the community KEY ISSUES The Lord Mayor hosted the Darwin CBD Summit on 6 October 2016 which was

attended by over 40 delegates representing the key stakeholder organisations within the CBD.

The objective of the Summit was to collectively identify short, medium, and long term strategies to help ensure the viability, safety and liveability of the CBD into the future.

A Working Group to progress the short term strategies was convened on 26 October 2016 with a number of actions allocated to various members.

A further Darwin CBD Summit is scheduled for 9 March 2017.

BACKGROUND Council resolved at its Ordinary meeting held 13 December 2016 as follows: DECISION NO 21\5099 CBD Summit Working Group - Update Report No. 16A0132 LC:jg (13/12/16) Common No. 3360177 B. THAT a further report be presented to Council in January 2017, detailing

how Council will progress each of the short term actions identified as its primary responsibility within this report.

DISCUSSION

Creating a cooperative atmosphere to enable the creation of a vibrant City

6.1.1

Re-establish the Northern Australia Capital City Committee to enable a comprehensive target development of the City.

Meeting with the Lord Mayor and Chief Minister held on 13 December 2016.

Advice from the Chief Minister that the committee will be re-established. City of Darwin CEO and NTG Chief of Staff held a meeting on 20 December 2016 to progress the format. NTG advice is NTG Architect is to be included.

6.1.6

Lobby Government to discontinue the fragmentation of administrative offices from the City.

Work with the Property Council to develop a position paper to lobby the NT Government.

This matter will be referred to the Northern Australia Capital City Committee.

The follow up Summit is scheduled for 9 March 2017, invitations to be send in February.

Consider an activation fund to be sourced out of parking fees.

Subject to a further report to Council in 2017 to form a policy position.

Report to be presented to Council’s budget workshop scheduled for 8 February 2017 and form part of the budget deliberations.

Activation and renewal – bring people back into the City

6.4.8 Determine strategic locations for mood and fairy lights to enliven the City.

DARWIN ENTERTAINMENT CENTRE - AIR CONDITIONER UPDATE

PURPOSE

The purpose of this report is to provide an update on the budget and programming of the Darwin Entertainment Centre air conditioning replacement project.

KEY ISSUES

The air-conditioning plant for the Darwin Entertainment Centre (DEC)experienced a critical failure in 2015, resulting in the loss of one of three chillers.

A temporary replacement system was hired for the 2015/16 wet season and anew chiller was installed in the hotels main air-conditioning plant, early 2016.

Council has allocated $4 million into the 2016/17 capital works program for a newair-conditioning system, separate from the Hilton Hotel.

An independent cost estimate (Sept 2016) for air-conditioning replacement is$6.1 million inclusive of contingencies, project management and design costs.

This cost estimate has been investigated by the project team and third parties. The condition of existing elements of the air-conditioning system reduces the

feasibility of completing a de-scoped or staged upgrade.

Air Conditioner Update, be received and noted. B. THAT Council endorse the allocation of $6.1 million, spread over two financial

years, for the scope of works for replacement of the Darwin Entertainment Centre air-conditioning systems outlined in Report Number 16TS0191 NL:hd entitled Darwin Entertainment Centre - Air Conditioner Update.

C. THAT replacement of the Darwin Entertainment Centre air-conditioning systems be funded via:

(i) general funds (as per the 2016/17 municipal plan) of $2,236,000 (ii) external loan funds of $3,864,000

D. That Council seek ministerial approval to borrow up to $4 million for the

replacement of the Darwin Entertainment Centre air-conditioning systems.

E. That Council approach the Northern Territory Government for financial assistance for the upgrade of the Darwin Entertainment Centre air conditioning plant.

F. THAT the decision be moved into Open. BACKGROUND At the 1st Ordinary Council Meeting held 11 October 2016, Council requested a report based on the following decision: DECISION NO.21\4910 (11/10/2016) Darwin Entertainment Centre - Air Conditioner Update Report No. 16TS0178 ND:tz (11/10/16) Common No. 2638206 B. THAT further investigation of costs and timeframes for the replacement of the Darwin Entertainment Centre air conditioning system project be undertaken prior to going out to tender and the outcomes reported back to Council. The Darwin Entertainment Centre’s (DEC) main playhouse theatre runs on two separate air conditioning plants which then have other associated complexities. The playhouse theatre and ancillary areas runs on a system owned, operated and maintained by the adjoining Hilton Hotel. The air conditioning system is over thirty years old and has reached the end of its useful life. The smaller studio theatre plant is more than twenty years old and has also reached the end of its useful life.

PAGE: 3 REPORT NUMBER: 16TS0191 NL:hd SUBJECT: DARWIN ENTERTAINMENT CENTRE - AIR CONDITIONER UPDATE The existing arrangement of the provision of chilled water from the Hilton Hotel for air conditioning at the DEC is not considered to be as efficient or effective as could be achieved. The DEC regularly suffers from an inefficient service. Separation of the systems and installing a single stand-alone system to service both theatres and ancillary spaces at the DEC is considered the most suitable solution for the long term. City of Darwin has allocated $4 million in the 2016/17 capital works program for the replacement of the air conditioning plant at the DEC. The original cost estimate of $4 million was based on a concept design only. A subsequent cost estimate – completed in September 2016 – details a revised overall project budget at $6.1 million. DISCUSSION An investigation has been completed into the costs and timeframe outlined in a third party cost estimate (Sept 2016) pertaining to the DEC air-conditioning replacement. This process scrutinised each element of the project separately in an attempt to examine cost saving opportunities and potential staging of activities. Existing Chilled Water Pipe System During conception and design of a new air-conditioning system for the DEC, consideration has been afforded to using the existing chilled water pipework, largely due to cost of replacement of this element alone which is approximately 13% or $780,000 of the total project cost. Notwithstanding the significant expense of the pipework, the investigation completed for this report identified the following:

During preliminary site visits and consultation, the pipework has been identified to have “deteriorated considerably”.

The DEC operators and City of Darwin representatives have responded to and repaired several leaks in the last five years highlighting internal corrosion.

For improved efficiency, the layout of air-conditioning equipment in the new design would require the removal (in some cases) and modification of existing pipework, reducing the viability of reuse.

Where contractors would be required to join into existing pipework, there is a “significant risk” that variations to scope are uncovered as a result of remedial work required to existing equipment.

Although the cost of pipework replacement is estimated at $780,000, the project team wishes to highlight to Council that this is not the value which can be saved through reusing the pipework. Considering the complexity of the new design and interfaces between new and old equipment, the saving is estimated at $200,000. Due to the factors identified above, it is the recommendation of the project team that the existing piping is not reused.

PAGE: 4 REPORT NUMBER: 16TS0191 NL:hd SUBJECT: DARWIN ENTERTAINMENT CENTRE - AIR CONDITIONER UPDATE Chiller Plant; Water-Cooled & Air-Cooled The two most feasible options for such air-conditioning works are water-cooled or air-cooled chillers for the production of chilled water. During the initial project conceptual pricing ($4 million) and subsequent detailed cost estimate ($6.1 million), the air-cooled option was not reviewed. The table below details a comparison between the two options based on applicable conditions of the DEC:

† Assumptions made in determination: Consultation with Australian Institute of Refrigeration, Air Conditioning and Heating (AIRAH) guidelines indicates that air-conditioning usage in Darwin typically comprises up to 60% of total energy use per building. Recommendations made to the project team highlight (through case studies) that water-cooled equipment is 10% more energy efficient than air-cooled equipment of the same capacity.

Per the table above, the expected operational life of the water-cooled equipment is twice that of the alternative. Investigations detail the cost to replace the air-cooled equipment (after 12-15 years) at $590,000; additional to the upfront cost of $4.9m. As was prescribed in the original project brief, consideration has been given to the production of noise by the equipment. The final design accounts for this through the proposal of an outdoor enclosed plant room. It is highly likely that the properties immediately adjacent to the DEC will be redeveloped during the period of time which any new air-conditioning upgrade will be operating. A primary concern held by the project team regarding air-cooled equipment is with the management of noise created by these systems. Air-cooled chillers by nature need to be in a highly ventilated area to ensure optimum performance which it is anticipated would result in noise pollution to adjacent residents/developments. Given the unique geometry of the spaces requiring cooling and the building itself with respect to plant positioning, it is the project team’s recommendation that water-cooled equipment is most suitable for this application.

PAGE: 5 REPORT NUMBER: 16TS0191 NL:hd SUBJECT: DARWIN ENTERTAINMENT CENTRE - AIR CONDITIONER UPDATE Air-Conditioning System Efficiencies and Requirements The design capacity of the proposed air-condition system is based on the peak load scenarios which will be acting on the system. Rather than a standard ‘hours of operation’ design approach, the proposed air-conditioning solution is based more particularly on a combination of the rate of occupancy and geometric requirements of the building. There are elements of the existing air-conditioning system which are not compliant with Australian Standard. One example is the failure to distribute the required amount of outside air into the DEC, particularly during performances when occupancy is high. As occupancy increases within the building, the existing air-conditioning system must operate at maximum capacity just to cool and re-circulate the air already within the building. The new air-conditioning design accommodates the rapidly changing rates of occupancy within the building, adjusting appropriately the levels of outside air in accordance with levels of CO2 detected by the system. Simultaneously, the proposed system controls the humidity of the incoming air supply to maintain the occupants’ comfort. There is currently no humidity control within the DEC. The previous system which is outdated, was decommissioned following ongoing issues with reliability. The new design controls the delivery of air-conditioning to isolated areas within the DEC. Autonomous monitoring of the CO2 levels at these locations allows for the introduction of outside air specifically into the areas of the building which are occupied including the main playhouse, studio theatre, gallery theatre and ground and first level foyers. The existing system does not have the capacity to monitor the cooling requirements of separate spaces. In periods of intermittent downtime where it is not practical to completely shut down the air-conditioning, the designed building management system can switch to a higher, more efficient ambient temperature whilst maintaining humidity control. Duct Work During project design and planning, significant effort has gone into the programming of construction activities and potential for staging certain elements at a later date. During design investigations, an audit was performed into the state of the existing ductwork within the DEC. Outcomes indicated that the physical integrity of the ductwork is fair and that maintenance will be required sometime in the future to remove accumulated dirt and mould. It has been communicated to the project team that the cleaning treatment to the ductwork would be approximately $250,000 in additional cost to the $6.1 million estimate. It is recommended by the project team that this treatment could be postponed beyond this period of proposed upgrade works, although treatment will most likely be required within five years.

The merit of reusing original components has been shown to be unfeasible. The project team has concluded from this investigation that the most appropriate air-conditioning treatment, given the geometry of the building and how it is occupied, would be a new water-cooled chilled water system. Project Timeframe Based on the recommendations of this report, the tender period and tender assessments would be completed by the end of March 2017. Construction at the DEC would commence in June 2017 with a focus on achieving a large portion of the works during the wet season months when the DEC is occupied less frequently. Commissioning works would be completed by April 2018. BUDGET AND RESOURCE IMPLICATIONS The project team wishes to note that all costs referenced herein are exclusive of GST. Currently, City of Darwin’s 2016/17 budget makes provision for the project to be funded from both general funds and loan funds as below:

It is recommended that this be funded via external loan. The long term financial plan has factored in repayments for the already approved amount at $220,031 per annum for ten years, in addition to the continuing repayments of $454,847 for the existing 20 year loan for the pound and extension and upgrade works at the centre in 2007. Revising the amount to be borrowed to $3,864,000 and extending the period to twenty years would result in annual repayments increasing by $73,992 to $294,023 on the current low interest rates (the calculations utilise the 2016/17 Municipal Plan assumptions of 4.5% interest expense PA) . Loan repayments would commence in 2018/19 (as a result of loan raising in say June of 2018 once the capital cost outcome is reasonably settled/clear). Until Council is able to replace the existing arrangements with a standalone system independent to the Hilton Hotel, Council incurs monthly maintenance costs and capital contribution costs. In the interest of determining the feasibility of the proposed air-conditioning works, the entire building replacement costs have been investigated. Through referencing the ‘Rawlinson Australian Construction Handbook’, the construction of a replacement entertainment centre in Darwin for 1,500 occupants is $31 million. RISK/LEGAL/LEGISLATIVE IMPLICATIONS The operational arrangements with the Hilton Hotel remain unchanged with the City of Darwin and DEC continuing to incur costs for the provision of chilled water and a proportion of repairs, maintenance and capital expenditure. The lack of flexibility of this arrangement has been an ongoing concern to both the DEC and the Hilton Hotel. The agreement under which all parties operate is a continuing one based on good will as the signed agreement expired some years ago. As the DEC facility ages further, maintenance requirements will become more frequent and costly. City of Darwin’s reputation and financial position is exposed significantly to both the current reliance on the Hilton Hotel’s maintenance regime and the age/condition of the existing plant. Although the recent replacement of one of the hotel’s chillers has improved the outcomes for the Centre, it is a temporary solution as a full house in the main theatre at this time of the year results in discomfort to the audience from the temperature not reducing sufficiently.

If the decision is reached to upgrade the air-conditioning system in part rather than entirely, there is a risk that failure of remaining elements may result in sub-standard provision of air-conditioning earlier than expected. This could occur while the public and stakeholder expectation is that the air-conditioning ought to be operating without fault having just been upgraded.

The replacement system cannot be purchased off the shelf and requires considerable lead time for its manufacture so any delay in a decision to approve the project exacerbates the risk of major failure.

In accordance with Section 123 of the Local Government Act Council requires ministerial approval to borrow funds.

ENVIRONMENTAL IMPLICATIONS

Since the commencement of this project, each party involved has been tasked with the provision of an energy efficient, reliable and sustainable air-conditioning upgrade. The options provided herein are designed to minimise environmental impact, with particular respect to noise pollution and energy consumption, while addressing the high level of demand for efficient air-conditioning during peak occupancy.

BACKGROUND City of Darwin Policy No. 082 - Alcohol in Council Controlled Spaces and Places details the community and cultural elements that applicants are required to meet when seeking permission for use of alcohol in Council’s spaces and places. Special Liquor Licence applications for new events such as the ‘I Love the 90’s Tour’ at the Amphitheatre are required to be presented to Council for consideration, prior to going before the Director-General, Licensing NT. DISCUSSION City of Darwin has received a Special Liquor Licence Application from Summer Junkies Pty Ltd for a one-off music event ‘I Love the 90’s Concert Tour’, as part of a national tour. The event organiser is requesting the event be held at the Gardens Amphitheatre, Sunday 11 June 2017, 4.00pm – 11.30pm. Monday 12 June 2017 is the Queen’s Birthday long weekend. The proposed event has an estimated attendance of 2500-3000 people and is identified as an all ages event. The music concert is part of a 2017 Australian/New Zealand Tour. The proposed event intends to showcase international live acts including Salt-N-Pepa, Coolio, Vanilla Ice and various MCs and DJs. Tickets are currently on sale. The Tour organiser has provided an Event Management Plan outlining the events schedule, emergency plan, site layout, security controls and responsible service of alcohol policy. Council Officers have reviewed this plan and liaised with the event organiser to ensure strict responsible service of alcohol practices will be in place. Council is the owner / controller of the proposed venue, the Gardens Amphitheatre, and as such Council approval is required before the Director-General of Licencing NT will consider the application for the Special Liquor Licence. It is the recommendation of this report that Council approve the application for a Special Liquor Licence from Summer Junkies.

Municipal Plan Summary The Municipal Plan Summary follows a similar format to the statement of cash flows, but is based on working capital rather than cash. The actual transfers to and from cash backed reserves are now considered to be up to date. Elected Members can refer to the quarterly budget reviews for more detailed information on reserves. Revised Budget The revised budget column in the Overall Income Statement and Municipal Plan Summary (Attachment A) includes projects/programs carried forward from 2015/16 into 2016/17 for completion and the adopted variations as per the 1st quarter budget review 2016/17. Investments Report Details all cash and investments held by institution and provide information on interest rate returns, maturities and policy compliance. Accounts Receivable Report Details rate receipt collection, outstanding general debtors and performance on rates recovery compared to the previous year. Explanation of Columns: "Full Original  Budget" and "Full Amended Budget"  are full year.   YTD Actual is year to date.  YTD v FAB is the % of actualsachieved against the full year original budget.  

Outlines income and operating expenses.  Excludes capital expenditure and instead recognises depreciation expense.  The net operating  surplus or deficit for the reporting period is a measure of Council's financial performance.  This figure is determined by deducting total operating expenses including depreciation from total operating revenue.

Operating income:   Rates are recognised at the beginning of the year hence 100% achieved.   Operational grant income is  exceeding target YTD with receipt of Federal Assistance early release of 1st & 2nd qtr grant monies;  in addition receipt of Library  grant, Funbus &  Faces in Spaces grant monies.  

Operating expenses:  Overall expenditure appears reasonable for this 6th month of the financial year.  Employee Costs which are slightly below target due to staff vacancies and timing of leave entitlements.  The "savings" is utilised for agency/temp contractor  costs.  Borrowing costs: 1st repayment of external loan has now occured and is on track. Depreciation and Amortisation:  It is anticipated that actual depreciation will exceed original budget as the budget did not allow for factors  such as  the revaluation of buildings at 30/6/16. This will be addressed in the 2nd quarter budget variation. This will not affect Council budgeted cash flow/working capital position.

Municipal Plan Summary

Outlines:  This statement outlines Councils  entire budget in accordance with the published municipal plan.  It shows the effect on General Funds (original budget ‐ break even/nil).  It groups items into operating, investing and financing and has a very close relationship to cash flows , which is why it is presented in the same international format.  It eliminates the depreciation calculation and discloses totals for asset sales and purchases as well as loan raising and repayments.  Finally it discloses the transfers to & from cash backed reserves. 

Net funds provided by operating activities:  These will reduce throughout the year to equate more closely to budget as the rates struck are expended.

Sale of Plant & Equipment:  This appears to be progressing as expected.

Purchase of Infrastructure, property etc.  This is 25% spent compared to 50% of year elapsed. Maybe indicative of carryforward of any incomplete projects into 2017/18.

Transfers from (‐to) reserves.  This discloses the transfers to & from cash backed reserves.  Details of the Reserve Report willbe provided in the 2nd Quarter Budget Variation.

Manager Finance:  There are no overall concerns in relation to the budgets.

other events KEY ISSUES The construction program is progressing well, though significant wet weather

periods have impacted on the works schedule. Parap Pool user groups have been accommodated through extended operating

hours at Council’s Casuarina and Nightcliff Pools. Regular updates regarding project progress are provided through Council’s social

media platforms. Discussions continue regarding planning for a national swimming fixture at the

D. THAT Council, pursuant to Section 32(2)(d) of the Local Government Act 2008,

hereby delegates to the Chief Executive Officer, the power to finalise and enter into a contract for the redevelopment of the Parap Pool with Sunbuild Pty Ltd as described in report Number 16TS0152 NK:jd entitled Parap Pool Redevelopment - Award of Tender Contract.

C. THAT Council note that the new amenities facility and the following

community elements are estimated to cost $5 million;

a. Children’s water play area (wet activity) b. Children’s playground (dry activity area) c. Shaded facilities to prepare and share food (community space) d. Aquatic activity for children and youth (leisure water) e. Outdoor shaded area for community and group exercise

D. THAT Council not proceed with the new amenities facility and community

elements unless the Northern Territory Government commits to substantially funding these components of the project.

DISCUSSION This report documents progress of the Parap Pool redevelopment project since the previous advice to Council in November 2016. Significant rain events either side of the Christmas – New Year break have impacted on the programmed concrete pours and base preparation works. Notwithstanding this inclement weather, construction has progressed to a point where the site is now shielded from further rain.

25m pool; concrete pool base poured; 25m pool; concrete pool walls commenced; 50m pool; drainage gravel layer installed; 50m pool; concrete pool base commenced; Shade structure; concrete footings commenced; Building A – administration, amenities; building foundation levelled.

To date, the project team have agreed on a total ‘adjustment of time’ of 18 working days. This adjustment shifts the date for practical completion to 18/10/2017 from the original date of 27/09/2017. There is no consequence to cost of construction resulting from this adjustment. Four project variations have been assessed by the project team. These variations have been managed within the project budget and have no consequence to cost of construction. The head contractor – Sunbuild – has now occupied the site for four months. To date, Sunbuild can attribute 100% of its expenditure to local content. City of Darwin officers undertook extensive consultation with stakeholders to ensure there was minimal disruption following the closure of the Parap Pool for redevelopment. The attendance figures for the financial year 2nd quarter (October to December 2016) indicate only a very small decrease of 4% compared to the same period in the previous year. This suggests that the majority of patrons who normally use Parap Pool have been accommodated at Council’s other venues through the increase of operating hours and lane allocation arrangements. Discussions continue regarding planning for a national fixture in 2018 at the newly redeveloped Parap Pool. A meeting was held in December 2016 between City of Darwin officers, the CEO Major Events NT and the President, Swimming NT. Swimming Australia will be requesting expressions of interest from State and Territory swimming peaks early in 2017 and the Northern Territory, in partnership with City of Darwin and the Northern Territory Government will develop a number of options to be hosted in the Parap Pool for 2018 and future years. PAGE: 5 REPORT NUMBER: 17C0006 AM:kl SUBJECT: PARAP POOL REDEVELOPMENT PROGRESS REPORT POLICY IMPLICATIONS City of Darwin Policy No. 046 – Recreation and Healthy Lifestyle, provides a framework for the design, development and management of facilities that support pursuits to encourage healthy lifestyles and community connectedness. BUDGET AND RESOURCE IMPLICATIONS The total project budget for the Parap Pool Redevelopment project is $14,960,000 (GST Exclusive). In mid-2015, Council secured grant funding of $4.48 M from the Commonwealth Department of Infrastructure and Regional Development which Council matched. The Northern Territory Government contributed an amount of $5 M during 2016 toward the project. Decision making points for the project have been identified to ensure critical milestones are presented to Council in a timely manner for resolution in order to comply with the conditions of the Australian Government funding agreement. ENVIRONMENTAL IMPLICATIONS The design for the redevelopment will take into consideration environmental measures, subject to budget availability. This will include measures for temperature control of the two water tanks, solar power, energy and water efficient devices and pool shade. These measures will assist in modifying environmental conditions for the comfort of all users and forms part of FINA compliance requirements. The Master Plan features the retention of the established Beauty Leaf trees and sensitive landscaping throughout both the internal and external areas of the facility. $1.5M toward the upgrade of the Darwin Velodrome as part of the 2015/2016 Northern Territory Government budget.

Council endorsed the scope of works consisting of re-surfacing and re-banking of the track, drainage and landscaping works as required, and the addition of lighting, the latter item subject to budget availability. The scope of works was established following extensive consultation with all stakeholders.

In November 2016 an expression of interest process for Design and Documentation of the Velodrome was commenced with final assessment of EOI’s being completed in January 2017.

PAGE: 3 REPORT NUMBER: 17C0005 AM:kl SUBJECT: VELODROME UPGRADE PROGRESS REPORT DISCUSSION The Northern Territory Government announced an allocation of $1.5 M toward the upgrade of the Darwin Velodrome as part of the 2015/2016 Northern Territory Government budget. The Darwin Velodrome is situated on Lot 1676, Town of Nightcliff. The City of Darwin obtained freehold title of the land from the Northern Territory Government in 1990. An active competitive cycling club has been part of the Darwin sporting and recreational landscape since the 1950s. The existing Velodrome was constructed circa 1970 and the bitumen track was resurfaced in 1994 and 2000 with financial assistance from the Northern Territory Government. Additional amenities such as lighting, a safety guard rail and temporary buildings and storage were added to the facility over the course of the past thirty years. The facility is used by cycling organisations, predominantly the Darwin Cycling Club for programs and training and is accessible to the community in general. Following Council’s decision at the 2nd Ordinary Meeting in March 2016, negotiations continued with the Northern Territory Government regarding funding agreement content. The former Department of Sport and Recreation agreed the project brief described in the funding agreement will include all elements as contained in the scope of works, however, lighting improvements will only be included if budget permits. Additionally, the Northern Territory Government agreed for an agency representative to participate in regular project meetings and any exclusion from the scope of works will be agreed to in consultation with all parties and the cycling community. A project delivery timetable for the project was also agreed to ensure the project can be appropriately managed and administered within existing resources and not impact on the City of Darwin’s ability to deliver its scheduled capital works program. A timetable for the project has also been agreed to as follows: May – June 2016 Contract Finalisation & Exchange July - August 2016 Project Start-up – Project Team & Brief Finalisation September 2016 Stakeholder Consultation, Finalise Scope of Works December – February 2017 Detailed Design January – February 2017 Development Application Process (if required) April – May 2017 Award Contract June 2017 Commence Construction December 2017 Project Completion and Final Reporting In November 2016 the City of Darwin commenced the expression of interest process for the Design and Documentation of the Velodrome. Three submissions were received and assessed in accordance with City of Darwin procedure CM04 Tender Assessment.

The detailed design and documentation, including the preparation and submission of a development application if required, is scheduled for 12 weeks to allow a construction tender to be issued in April 2017. CONSULTATION PROCESS In preparing this report, the following City of Darwin officers were consulted: Manager, Capital Works Capital Works Coordinator Manager, Recreation, Customer Service and Events POLICY IMPLICATIONS Council Policy No. 046 – Recreation and Healthy Lifestyle provides a framework to encouraging active behaviour and the equitable, safe and inclusive use of Council’s active and passive recreation facilities. BUDGET AND RESOURCE IMPLICATIONS As part of the 2015/2016 NTG budget announcements an amount of $1.5 M (plus GST) was allocated to the upgrade of the Darwin Velodrome. The project budget is inclusive of the design documentation. Cardno NT Pty Ptd was awarded the design and documentation at a cost of $100,909 ex. GST. RISK/LEGAL/LEGISLATIVE IMPLICATIONS Nil ENVIRONMENTAL IMPLICATIONS The revised footprint of the Velodrome will impact on existing trees, requiring the removal of some specimens. The retention of as many established trees as practicable will be a requirement of the final design to ensure the amenity of the area and the provision of natural shade is maintained.

BACKGROUND City of Darwin responded to 19 Development Applications exhibited between 3 December 2016 and 18 January 2017. City of Darwin received and responded to two applications requesting Crown Land, between 3 December 2016 and 18 January 2017. Development Applications Discussion Of the 19 Telecommunications and Development Applications, City of Darwin officers recommended supporting 17 (either subject to normal or specific conditions) and requested a deferral on two applications. Subclause 2 provides that lots should have; “sufficient area and appropriate dimensions to provide for the proposed density of developments including dwellings, vehicle access, parking and ancillary buildings”. The proposed subdivision plans provide indicative building envelopes, however details of existing and future infrastructure including but not

limited to; street lights, street trees and indented on-street car parking bays (as existing in both Fuhrmann and Letch Streets), vehicle access and stormwater etc. are not included with the application. These details are required to be included for City of Darwin to assess whether the subdivision: • can be accommodated within the existing infrastructure; • can accommodate the proposed infrastructure whilst providing

sufficient services, on-street car parking and access to future dwelling development; and

• is capable of achieving viable dwelling development on the proposed lots in accordance with the minimum requirements of the Northern Territory Planning Scheme (the Scheme) and the Service Authorities.

b). Zone SD23:

Specific Use –Darwin Zone 23 (SD23), established specifically to aid the subdivision and the development of Muirhead through philosophies unique to the greenfield site.

Subclause 2 encourages:

• “lot patterns which are best suited to catch prevailing breezes”. Whilst

the lot patterns are generally consistent with already developed lots, the location of the building envelopes for the proposed MD (Multiple Dwelling) lots being 12, 13, 14, 15 and 16 aren’t consistent with the envelopes beyond those lots.

It is therefore not clear if the introduction of staggered envelopes will impact any future developments ability to catch prevailing breezes and reduce the reliance on air conditioning; and

• “breezeway separations between buildings and the inclusion of side yard spaces”. The rectangular design of the MD lots being 12, 13, 14, 15 and 16 with a single front access would either presumably force multiple dwelling development that is of a battle-axe or a side by side townhouse design. Such development design would presumably offer minimal side yard spaces, which; promote prevailing breezes, provide an adequate extension of the dwelling, are permeable to the sky, allow for deep soil planting and are private and functional.

It is therefore requested that the applicant be required to provide indicative dwelling layouts to ensure the requirements of Zone SD23 Subclause 2 can be met.

The purpose of Subclause 4 is to “ensure residential subdivisions contain lots of a size, configuration and orientation suitable for residential purposes” that achieves an overall lot design which:

• Have a “minimum frontage of 18m”, however:

− proposed lot 2 has a proposed frontage of 16.9m and therefore seeks a variation. Reducing the frontage limits the opportunity for development to successfully incorporate the required infrastructure, double garage and an active street frontage; and

− the rectangular design of the proposed MD lots 12, 13, 14, 15 and 16 have a single front access of either 18m or 19.3m wide. The functional layout of the building(s) on these lots are not identified and therefore it is unclear whether a battle-axe design may be requested. Council does not support multiple crossovers on these lots.

It is requested that the subdivision design be amended to ensure compliance with Subclause 4 of Zone SD23.

c). Clause 11.2.3, Lot Size and Configuration in Residential Subdivisions:

Whilst Clause 11.2.3 of the Scheme may not specifically apply to the proposed subdivision given that Zone SD23 provides subdivision design criteria; there are considerations that should be included to “ensure residential subdivisions contain lots of a size, configuration and orientation suitable for residential purposes”. Subclause 2 provides that; “battle-axe lots are only to be provided as part of a subdivision that has taken place through clause 11.1.4” of the Scheme. Again, given the rectangular design of the MD lots being 12, 13, 14, 15 and 16 with a single front access, it would presumably force multiple dwelling development that is of a battle-axe design or a side by side townhouse design. To reiterate, Council does not support multiple crossovers on these lots.

d). Clause 11.2.4, Lots less than 600m2 for Single Dwellings:

Subclause 2 provides that an; “application to subdivide land to provide lots subject to this clause must include plans and diagrams to demonstrate that proposed lots, building envelopes, private open space,

vehicle access, on-site parking and habitable rooms facing the street will be provided to meet performance criteria and respond to parking and infrastructure in the adjacent public road”. Again, whilst Clause 11.2.4 of the Scheme may not specifically apply to the proposed subdivision given that Zone SD23 provides subdivision design criteria; there are considerations that should be included to ensure “regard for vehicle access, on-site parking and street infrastructure” has taken place and that the subdivision can allow for successful dwelling development that is in accordance with the minimum requirements of the Scheme and the Service Authorities. Council therefore requests that the applicant be required to demonstrate compliance with the requirements of Clause 11.2.4.

e). Clause 6.5.4, Vehicle access and On-site Parking for Single dwellings on

Lots less than 600m2 but not less than 300m2:

Clause 6.5.4 of the Scheme has been introduced post the development of Zone SD23. The purpose of Clause 6.5.4 is to ensure; “that vehicle access driveways and on-site parking spaces for single dwellings on lots less than 600m2 and not less than 300m2 do not unduly reduce the amenity of a public road or the availability of kerbside parking in the public road”. Subclause 2 provides that; “the on-site parking and its vehicle access from the public road shall be located to ensure that the lot’s street frontage has a minimum continuous length of 6.5 metres without on-site parking or vehicle access within that length”. Council questions the ability for lots 1, 2, 8, 9, 10, 11, 17 and 18 to achieve compliance with this requirement, taking into consideration the location of the existing indented on-street car parking within both Fuhrmann and Letch Streets. As discussed above (in response to Clause 11.2.4) it is requested that the applicant be required to demonstrate compliance with the requirements of Clause 11.2.4 whilst addressing the requirements of Clause 6.5.4.

Further to the above, the City of Darwin wishes to reiterate its position in relation to tandem car parking design and note that Council would not support any proposal for tandem parking arrangements if proposed, which may be a design outcome in response to the narrow lot design.

In summary, City of Darwin considers it appropriate to seek a deferral to ensure that; future dwelling development can meet the above requirements and subsequent provisions of the Northern Territory Planning Scheme and the infrastructure requirements of the Service Authorities and in doing so, ensure the best (and most viable) outcome is delivered in favour of all.

Once Council further understands how any changes to existing infrastructure (to be handed to the City of Darwin in the long-term) and the layout of the multiple dwelling lots will be able to accommodate development and proposed infrastructure; Council will provide the required City of Darwin specific conditions related to the subject application. via new intersections to Pruen and Makagon Roads. It appears from the staging plan that alternative access points will be constructed to the east of the site in the later stages of development. It is unclear from the staging plan when alternative access points will be constructed to the north of the site, although it also appears to be in the later stages when access from Stuart Highway will be properly connected through to the remainder of the development. Pruen Road, Makagon Road and the wider road network in this area service an existing industrial estate, with the existing infrastructure not being to a standard suitable as the only access point to a new mixed used residential estate. To facilitate the increase in traffic and mixing of residential and industrial traffic, at a minimum the following upgrades will be required:

• Increased lighting • Changes to line-marking • Upgrades to the arterial road intersections with Pruen, Strath and

Marlow Roads (although it is noted that the arterial roads, including Berrimah road and the Stuart Highway are Northern Territory Government controlled).

• Footpaths • Road Signage • Road safety measures • Road widths • Landscaping • Stormwater drainage infrastructure

c). These and any other upgrades to City of Darwin infrastructure required

to facilitate the proposed development are to be supported by suitable studies and are to be approved, designed and constructed to the City of Darwin’s standards.

As this subdivision interacts with City of Darwin road infrastructure, at a minimum the following additional information is required:

• The hierarchy classification should be in line with the City of Darwin’s hierarchy defined in the Subdivision & Development Guidelines. This should be with consideration to the ultimate development, not just Stage 1.

• A Sidra analysis of the new roads with Pruen and Makagon Roads. This should be an analysis of Stage 1 and the ultimate development.

• In accordance with the City of Darwin Subdivision & Development Guidelines, the developer is required to construct

appropriate intersections on Pruen and Makagon Roads with the new roads, which should be to the ultimate configuration.

• Details of all proposed upgrades to Pruen and Makagon Roads.

Traffic, parking and safety around schools d). The Berrimah Farm Area Plan includes two school sites, both of which

are adjacent City of Darwin road infrastructure. There will need to be appropriate infrastructure built on and around these sites, including parking, crossings, kiss and goes, and bus pick up areas.

Pruen Road intersection

e). The proposed new intersection with Pruen Road is within close proximity of a bend and this limits sightlines of vehicles exiting the new development. A safety audit of the intersection and its proximity to the bend should be undertaken.

Crossovers

f). Plans provided in the application note driveways and crossovers to Darwin City Council requirements. The land is not, at this stage, within the City of Darwin municipality.

Stormwater

g). Any changes, additional stormwater discharge or connections to City of Darwin stormwater infrastructure are to be to the design and satisfaction of the City of Darwin. Existing stormwater from upstream catchments discharging to the subject site are to be catered for within the drainage design. Footpaths

h). The subdivision includes an internal footpath network and the Planning Principles require the cyclist and pedestrian network to provide a safe connection with the northern side of Stuart Highway. There is now also a new shared pathway located within the Tiger Brennan Drive road corridor that has the potential to offer future residents, workers and visitors to the area with an excellent connection to a broader shared path network that connects directly to the Darwin city centre as well as providing an extended recreational riding route.

i). The application also includes a cycle/pedestrian road hierarchy plan that nominates 1.2 and 2.5 metre wide paths. It is noted that some of the paths located adjacent the future school sites and activity centre are not 2.5 metres wide. These are likely to be high pedestrian and cyclist traffic areas and consideration should be given to providing 2.5 metre wide footpaths in these and other high usage areas.

ii). The City of Darwin requests that should a development permit be issued, that the following be provided as a condition precedent:

a). A dilapidation report covering infrastructure within the road

reserve to the satisfaction of the General Manager Infrastructure, City of Darwin at no cost to Council.

b). Prior to the endorsement of plans and prior to the commencement

of works (including site preparation), approval by Council is required for any element that is designed to be constructed or installed on or over City of Darwin road reserve.

c). Traffic

The City of Darwin requires a comprehensive Traffic Impact Assessment Report, to be prepared by a suitably qualified traffic engineer in accordance with the Austroads Document Guide to Traffic Management Part 12: Traffic Impacts of Developments, in the report structure provided as Appendix C of that document, with particular attention to vehicular, pedestrian, cyclist and public transport issues and opportunities.

The Traffic Impact Assessment report is to also include swept paths for

waste collection vehicles entering and exiting the site. The report should identify any necessary upgrades to the surrounding street network as a result of the implications of the development. The developer will be required to institute all required upgrade measures resulting from the traffic assessment at no cost to the City of Darwin.

d). The City of Darwin requests that the Authority require a schematic plan demonstrating all stormwater to be collected on the site and discharged underground to the City of Darwin’s stormwater drainage system. The applicant’s plans fail to demonstrate how on-site stormwater will be collected and discharged underground to the City of Darwin’s drainage network.

1). The plan shall include details of site levels and the City of Darwin’s

stormwater drain connection point/s. The plan shall also indicate how stormwater will be collected on the site and connected underground to the City of Darwin’s system.

2). The City of Darwin requires a stormwater drainage plan to confirm

that it is technically feasible to collect stormwater on the site and dispose of it into the City of Darwin’s stormwater drainage system. It is also necessary to ensure that no stormwater will sheet-flow into the road reserve or onto adjoining properties.

e). Site Construction

The City of Darwin requests that an Environmental and Construction Management Plan (ECMP) be required. The ECMP should specifically address the following: • waste management, • traffic control, • haulage routes, • storm water drainage, • use of City of Darwin land, and • how this land will be managed during the construction phase;

to the satisfaction of the General Manager Infrastructure, City of Darwin.

Note: Sediment control measures are to be established and maintained, to prevent silt and sediment escaping the site or producing erosion. Building rubbish or debris must not be placed, or be permitted to be placed, on any adjoining public reserve, footway, road or private land, without first obtaining a works approval from the City of Darwin.

iii). Should the above issues be adequately addressed, the City of Darwin

offers the following comments:

The City of Darwin comments on issues for which it is the sole responsible authority, under the Local Government Act and associated By-Laws:-

a). Street Trees, Verge Plantings and Footpaths

Any proposed or existing planting associated with the development that impacts upon City of Darwin infrastructure is to be approved by the City of Darwin prior to planting or removal.

b). Protection of Street Trees

All street trees shall be protected at all times during construction. Any tree on the footpath, which is damaged or removed during construction, shall be replaced, to the satisfaction of the General Manager Infrastructure, City of Darwin. A Tree Protection Zone (TPZ) shall be constructed for all existing trees to be retained within the development, in accordance with Australian Standards - AS 4970-2009 Protection of Trees on Development Sites. Copies of AS 4970-2009 Protection of Trees on Development Sites can be obtained from the Australian Standards web site.

Should this application be approved, the following conditions pursuant to the Planning Act and the City of Darwin’s responsibilities under the Local Government Act are also recommended for inclusion in the Development Permit issued by the Development Consent Authority. • Designs and specifications for landscaping of the road verges adjacent to the

property shall be submitted for approval by the General Manager Infrastructure, City of Darwin and all approved works shall be constructed at the applicant’s expense, to the requirements of the City of Darwin.

• The location, design and specifications for proposed and affected crossovers

shall be provided at the applicant’s expense, to the satisfaction of the General Manager Infrastructure, City of Darwin.

• Kerb crossovers and driveways to the site shall be provided and disused

crossovers removed, public footpath and cycleways shall be provided, stormwater shall be collected and discharged into the City of Darwin’s drainage network, and reinstatement works carried out, all of which is to be provided at the applicant’s expense and to the requirements and satisfaction of the General Manager Infrastructure, City of Darwin.

• Sight lines shall be provided at crossovers to public streets, to the satisfaction

of the General Manager Infrastructure, City of Darwin. No fence or tree exceeding 0.6 metres in height shall be planted in front of the sight line.

• Car parking spaces and internal driveways shall meet the requirements of the

relevant Australian Standard and be line-marked and sealed with an impervious material.

• The total number of required disabled car parking bays shall be met on site. • All developments on/or adjacent to any easements on-site, in favour of the City

of Darwin shall be carried out to the requirements and satisfaction of the General Manager Infrastructure, City of Darwin.

• Any proposed signage for the site shall be subject to a separate assessment in

accordance with City of Darwin Policy Number 42 – Outdoor Advertising Signs Code.

• Any proposed works on/over City of Darwin property shall be subject to

separate application to the City of Darwin and shall be carried out to the requirements and satisfaction of the General Manager Infrastructure, City of Darwin.

• Any proposed stormwater connections to the City of Darwin stormwater system or proposed works on/over City of Darwin property shall be subject to separate

variation to the minimum requirements of the Scheme. • Design - the treatment of the proposed south-east and

north-west elevations at tier 1 should be enhanced to contribute to the amenity of the surrounding area.

• Landscaping • Services/Facilities - such as end of trip facilities and

public toilets.

The Development Consent Authority consented to the application and issued a Development Permit with further Conditions Precedent including: • amended plans modified to show bicycle storage

As this application is for four wall and three fence advertising signs, Council is required to consider and make a determination on the submitted sign application. Location of premises and sign Casuarina All Sports Club is seeking Council’s consent to install a free-standing sign which incorporates an animated sign panel. The advertising sign is to advertise and promote their business and events within the club. The proposed advertising signage concept is provided at Attachment A. The premises are located within Zone C (Commercial). The free-standing sign’s total height is 6.5m and at its widest point, it is 3.1m wide. The square meter size of free-standing signs is not assessed, and as the sign is less than 7m in height, other than the animated sign panel, the free-standing sign complies with the Signs Code. It is proposed that the free-standing sign be illuminated from dusk to dawn and that the animated sign operate from 7.00am to 11.00pm daily and dim automatically, relative to the ambient light. Messages on the panel will be displayed in full and the interval for messages will not be less than 30 seconds. There are no residential properties in the immediate area, with Casuarina Village to the north, Casuarina Shopping Centre to the south and Holy Spirit Catholic Primary School across the road.

(269) TROWER ROAD, CASUARINA City of Darwin Policy No.042 - Outdoor Advertising Signs Code The Signs Code defines an Animated Sign as: “Animated sign means an advertising sign that is designed to move, flash, change its message, intensity or pattern, or which contains moving parts, whether or not any part of the sign is also illuminated.” Section 8 Specific Provisions – Temporary Signs (Notwithstanding that this application is for a permanent animated sign, section 8.3 still applies to this application because this is the only section of the Signs Code that deals with animated signs) details the following in regard to animated signs: “8.3 Animated Signs

Flashing lights in an animated sign are prohibited if they are likely to cause a distraction to drivers.

Chasing lights, where lights follow in a repetitious pattern, may be permitted within commercial zones, but are prohibited if they are likely to cause a distraction or nuisance to drivers, the general public or residents.

Bright lights are prohibited if they are likely to cause a distraction to drivers and may be confused with traffic control devices. Bright lights will not be permitted within, or adjacent to, residential zones.”

As the LED Screen is proposed to have advertising that is designed to change the message and illuminated, the sign is considered an animated sign. Animated signs do not fall within the complying signs category of the Signs Code, and are prohibited in all Zones apart from Commercial and Industrial Zones. The proposed sign is located in Zone C (Commercial) and is therefore considered discretionary. Conclusion

It is recommended that Council approve this sign application as the proposed animated advertising sign is not adjacent to any residences and is not expected to affect the amenity of the area. CONSULTATION PROCESS In preparing this report, the following City of Darwin officers were consulted:

chasing characters or symbols.” ENVIRONMENTAL IMPLICATIONS The proposed advertising sign is not expected to have significant environmental implications for the City of Darwin.
