WHpReas t is expedient o prevent any action directed against theconfidentiality, ntegrity and availability of electronicsystem,networksand dataaswell as hemisuseof sirchsystem,networksand databy providing for thepunishmentof suchactionsand o provide mechanism or investigation,prosecutionand rial ofoffencesand for mattersconnected herewith or ancillary theretoq

Now.'rseee,roeE, n exercise of the powers conferred by clause (1) of
Article 89of theConstitution of the Islamic Republicof Pakistanand n exerciseof
all powersenabling n that behalf, thekesident is pleased o make andpromulgate
the ollowing Ordinance:-
1. Short title, extent application and commencement.-(1) This
Ordinancemay be called the Preventionof Electronic Crimes Ordinance,2007.
(2) It extends o the wholeof Pakistan,
(3) It shall apply to every person who commits an offence under this
Ordinance rrespectiveof his nationalityor citizenshipwhatsoeveror in any place
outside or inside Pakistan,having detrimental effect on the security of Pakistanor
its nationals or nationalharmony or any Foperty or any electronicsystemor data
locatedin Pakistan or any electronic systemor data capable of being connected'
sent o, usedby or with any electronicsystem n Pakistan.
(4) It shall come into force dt once,
. 2. Detinitions.- (l) In thisOrdinance, nless here s anything epugnant
in the subjector context,-
(a) "access"meansgaining access o any electronic systemor dataheld
in an electronicsystemor by causing heelectronicsystem o perform
any function o achieve hatobjective;
(b) ..Authority?,means the Pakistan Telecommunication Authority
establishedunder section 3 of the PakistanTelecommunication'
(Re-organization)Act 1996 XVII of 1996);
(c) "code" means hecode of criminal Procedure,1898(Act V of I 898);
(d) "Constitution" meansConstitutionof the slamicRepublic.ofPakistan;
(e) "data'r meansrepresentationsof information or of concepts that are
being preparedor havebeenprepared n a form suitable or use n an
electronicsystem ncludingbut not limited to computerprogram' ext'
images,sound,video and nformation within a database r electronic
sYStem;
(O "decision of theAuthority" meansdecisiongiven, determinationmade

(g) "Electronic CertificationAccreditationCouncil" means he council
established under section 18of the Electronic Transaction Ordinance
2002(LIof20o2);
(h) "electronic" includes but not limited to electrical, digital, analogue,
magnetic,optical, biochemical,electrochemical,electromechanical,
electromagnetic,adioelectricor wireless echnology;
(D "electronic device" meansany hardwarewhich performsone or more
. specific unctionsandoperates n any orm or combinationof electrical
energy.
() "electronic mail message"meansany datageneratedby an electronic
system or a uniqueelectronic mail address;
(k) "electronicmail address"meansa destination, ommonlyexpressed
as a string of characters, onsistingof
auniqueuser or group nameor
mailbox,iommonly referred o as he ocal part, and areference o an
internet or intranetdomain,commonly referred o as hedomainpart,
whetheror not displayed to which an electronicmail message anbe
sentor delivered or originatedfrom and includes an electronic mail- addresswhich may be permanent,dynamic or disposable;
(1) "electronic system" meansany electronic device or a group of
interconnectedor relateddevices,one or moreof which, pursuant o a
program or manual or any external instruction, performs automatic
processingof information or data andmay also nclude a permanent,removableor any otherelectronicstoragemedium;
(m) ..encrypteddata" means data which has been transformed or
scrambled from its plain version Qr text to an unreadable or
incomprehensibleormat and s recoverableby anassociateddecryption
or decodingtechnique, egardlessof the techniqueutilized for such
transformation or scrambling and rrespectiveof the medium in which
such dataoccursor can be found for the purposesof protecting such
data:

(o) n'Interpol"means nternationalCriminal police Organisation;
(p) n'offence"includes,-
(i) an offences punishableunderthis Ordinance;
(ii) anoffencepunishable nder he awsmentioned n the schedule:or
(iiD any other offence punishableunder any other law for the timebeing in force if committed through or by using any compurer,electronic slstem; electronic meansor electronic device as ameanor tool;
(q) "plain version" meansoriginal databefore t hasbeen ransformedorscrambled o an unreadable r incomprehensibleormat or after t hasbeen ecoveredby usingany decryptionor decoding echnique;
(r) "rules" means ules madeunder this Ordinance:
(s) "Schedule" means he Schedule o this Ordinance;
(t) "sensitiveelectronicsystem"meansanelectroriicsystemuseddirectlyin connectionwith or necessaryor,-
(r) the securify,defenceor international elationsof pakistan:
(ii) the existenceor identity of a confidential sourceof informationrelating to theenforcementof criminal law;
(iii) the provision of servicesdirectly related to communications
infrastrucfure,banking and financial services, public utilities,courts,public transportation, ublic key infrastructure,paymentsystems nfrastfuctureor e-commerce nfrastnrcture ;
(iv) the protectionof public safety including systemsrelatedtoessentialemergencyservicessuehas police, civil defenceandmedical services
(v) the purpose declaredas such by the FederurGovernment in
accordancewith the prescribedprocedure; or
(vi) containing any data or database rotectedassuch,by any otherlaw.

(u) "serviceprovider" includesbut not limited to,-
(i) a personacting as a serviceprovider in relation to sending,
receiving,storing orprocessingof electronicCommunicationor
the provision of other services n relation to electronic
communication hrough anyelectronicsystem;

, (ii) a person who owns,possesses,perates,managesor controls a
public switchednetworkor provides elecommunication ervices;

electronic ommunication erviceor usersof such service;
(v) "subscribernformationo'meansany nformationcontainedn any orm
that is held by a serviceprovider, relating to subscriber's services
other than traffic data andby which can be established,-
(i) the ype of communicationserviceused, he echnicalprovisions
(ii) the subscriber's dentity, postal, geographicelectronic mail
aldress, elephoneandotheraccess umber,billing andpaymentinformation, available on the basis of the service agr€ementor
arrangement;or
( i i | any other information on the si te of the instal lat ion of
communicationequipment,availableon the basisof the service
agreementor iurangement;
(w) "traffic data" meansany data elating o a cortmunication by means
of an elechonicsystem,generated y an electronicsystem hatformed
a part n thechainof communication,ndicating hecommunication's
origin, destination,oute, ime,date,size,duration,or typeof underlying
serviee:
'"Tribunal"means he nformation andCommunicationTechnologies
Tribunal constituted ndersection3l; and
"unauthorized access"meansaccessof any kind by any person to
any electronicsystemor dataheld n an electronicsystemor electronic
device,without authorityor in excessof authority, f he is not himselfentitled to control access f the kind in question o theelectronic system
or electronic device, or data dnd he does not have consent to such
access rom any person,so entitled.

CHAPTER-II
OFFENCES AND PUNISHMENTS
3. Criminal access.-Whoever ntentionallygainsunauthorized ccessto thewholeor anypartof an electronic ystem r electronicdevicewith or withoutinfringingsecurltymeasures,hallbepunishedwith imprisonment f eitherdescriptionfor a term which may extend o two years,or with fine not exceeding hree hundredthousand upees,or with both. . ,
4. Criminal data access.-Whoever intentionally causesany electronicsystem or electronic device to perform any function for the purposeof gaining
unauthorized ccesso any dataheld n anyelectronic ystemor electronicdeviceor on obtainingsuchunauthorized ccess hallbe punishedwith imprisonmentofeitherdescription for a term which may extend o threeyears,or with fine or withboth.
5. Data damage.-Whoever with intent to illegal gainor causeharm tothepublicor anyperson, amages ny data s shallbepunishedwith imprisonmentof either description for a term which may extend to three years,or with fine, orwithboth.

6. System damage.-Whoever with intentto causedamageto hepublic
or any person nterfereswith or intemrptsor obstructs hefunctioning, reliability or
usefulness f an electronicsystern r electronicdeviceby inputting, ransmitting,damaging, deleting, altering, tempering,deteriorating or suppressingany data or
servicesor halting electronicsystemor chokingthe networksshallbepunishedwithimprisonmentof either description or a term which may extend to threeyears,orwith fine, or with both.

8. Electronic forgery.-Whoever for wrongful gain nterfereswith data,electronicsystemor electronicdevice,with intent to causedamageor injury to thepublic or to any person,or to makeany llegal claim or title or to causeany person opart with property or to enter nto any expressor implied contract,or with intent to
commit fraud by any nput,alteration, eletion,or suppression f data, esulting n
unauthentic atawith the ntent hat t be considered r actedupon or legalpurposes
as if it were authentic,regardlessof.the fact that the data is directly readableand
intelligible or not shallbepunishedwiih imprisonmentof eitherdescription or a termwhich may,extend o seven ears,or with fine or with both.
,/9. Misuse of electronic system or electronic device.-(l) Whoever
produces,possesses, elts,procutes, transports, mports, distributes or otherwise
makesavailablean electronicsystemor electronicdevice, ncluding a computerprogram,designedor adaptedprimarily for the purposeof committing any of the
offences establishedunder this Ordinance or a password,accesscodenor similar
databy which the whole or any part of an electronicsystemor electronicdevice s
capableof being accesbed r its functionality compromisedor reverseengineered,with the intent that it be used for the purposeof committing any of the offences
establishednder hisOrdinance,s said o commit offenceof misuseof electronicsystemor electronicdevices:
Provided hatthe provisionsof this sectionshall not apply to the authorizedtesting or protectionof an electronic system or any lawful purpose.
(2) Whoever commits he offencedescribedn sub-section l) shall bepunishablewith imprisonment of eitherdescription or a term which may extend o
threeyears,or with fine. or with both.
10. Unauthorized access o code.-Whoever disclosesor obtains anypassword,accessas o code, systemdesignor anyothermeansof gaining access o
any electronic system or datawith
intent to obtain wrongful gain, do reverse
engineeringor causewrongful loss o any personor for any other unlawful purpose
shallbe punishedwith imprisonmentof eitherdescription or a term which may
extend to threeyears,or with, or with both.
ll. Misuse of encryption.=Whoever for thepurposeof commissionof
an offenceor concealment f incriminatingevidence, nowingly andwillfully encryptsany incriminating communicationor datacontained n electronicsystem elating to
that crime or incriminating evidence,commits theoffence of misuseof encryptionshall be punishebwith imprisonmentof either description for a term which mayextend o five years,or with fine, or with both.

12. Malicious code.-(l) whoever willfully writes, offers, makesavailable,distributesor transmitsmalicious codethrough an electronic systemorelectronicdevice,with intent o cause arm o anyelectronic
ystemor resulting nthe comrption, desffuction,alteration,suppression,heft or lossof datacommits theoffenceof maliciouscode:
Providedthat the provision of this sectionshall not apply to the authorizedtesting, researchand developmentor protection of an etectronic system for anylawful purpose.

Explanation-For the purposeof this section he expression 'malicious
code" includes but not limited to a coJnputerprogram or a hidden function in aprogramthatdamagesdataor compromises heelectronicsystem'sperformanceoruses he electronicsystem esources ithout properauthorization,with or withoutattaching ts copy to afile and s capableof spreadingoverelectronicsystemwith orwithouthuman nterventionncludingvirus,wormorTrojan horse.
(2) whoever commits the offencespecified n sub-section l) shall bepunishedwith imprisonment of eitherdescription or a term which may extendtofive years,or with fine or with both.
13. Cyber stalking.-(l) whoever with intent o coerce, ntimidate.orharass nypersonusescomputer, omputernetwork, nternet,networksite,electronicmail or any othersimilarmeans f communicationo._
communicateobscene, ulgar, profane, ewdl lascivious, or indecentlanguage. ictureor image;
makeany suggestion rproposalofan obscene ature:
threatenany illegal or immoral act;
take or distribute picturesor photographsof any person*ittrout trisconsent r knowledge;
displayordistribute nformation n amanner hatsubstantiallyncreasesthe risk of harmor violence o any other person,commits the offenceof cyber stalking.
(2) Whoever commits the offence specified in sub-section(t) shall bepunishablewith imprisonment f eitherdescriptionor a termwhich,mayextend osevenydarsor with fine not exceeding hreehundred housand upeei, or with both:

14. Spamming.-( 1) Whoever ransmitsharmful, fraudulent,misleading,illegalor unsolicitedelectronicmessagesn bulk to anypersonwifhout theexpresspermissionof therecipient,or causes nyelectronicsystem o show anysuchmessageor involves n fatsified online useraccount egistrationor falsified domain nameregistration or commercial purposecommits theoffenceof spamming.
(2) Whoevercommits heoffenceof spammingasdescribedn sub-section
(l) shallbe punishablewith fine not exceedingifty thousandupees f he commitsthis offenceof spamming or the first time and or everysubsequent ommissionofoffence of spamminghe shall be punishedwith imprisonment of three monthsorwith fine , or with both.
' 15. Spoofing.-Whoever establishesa website, or sends an electronicmessage ith acounterfeit ource ntendedo be believedby therecipientor visitoror its electronic system o be an authentic sourcewith intent to gain unauthorized
accessor obtain valuable information which later can be used for any unlawful
purposescommits the offenceof spoofing.
(2) Whoevercommits the offenceof spoofingspecified n sub-section I )shall be punishedwith imprisonmentof eitherdescriptioh'fora rerm which mayextend o threeyears,.orwith fine,or with both.
16. Unauthorized interception.-( I ) Whoeverwithout lawful authorityinterceptsby technicalmeans, ransmissions f data o, from or within an electronic
systemncludingelectromagnetic missions rom an electronicsystemcarryingsuchdata commits the offenceof unauthorizednterception.
(2) Whoevercommits heoffenceof unauthorizednterception escribed
in sub-section1) shallbe punishedwith imprisonmentof eitherdescription or aterm which mayextend o five years,or with fine not exceeding ive hundred housand
rupees, r with both.
17. Cyber tdrrorism.-( I ) Any person,groupor organizationwho, withterroristic intent utilizes, accesses r causes o be accessed computer or computernetwork or electronic systemor electronicdeviceor by any available means,andtherebyknowingly engagesn or attempts o engage n a terroristic act commits theoffence of cyber terrorism.

Explanation.l.- For thepurposesof this section he expression terroristic
intent" means o act with the purpose o alarm, frighten, disrupt, harm, damage;or
carry out an actof violence againstanysegmentof thepopulation,the Government
or entity associated herewith.
Explanation2..^For thepurposes f thissection heexpressionterroristic
act" ncludes. ut s not imited o,-
(a) altering by addition, deletion,orchangeorattemptingto alter ntbrmation
that may result n the mminent njury, sickness, rdeath o anysegment
of thepopulation;
(b) transmission r attemptedransmissionf aharmfulprogramwith thepurpose f substantially isrupting r disablinganycomputernetwork
operatedby the Govemmentor anypublic entity;
(c) aiding thecommissionof orattemptingto aid'thecommissionof an act
of violence againstthe sovereigntyof Pakistan,whether or not the
commi*sion of suchact of violence s actuallycompleted;or
(d) stealingor copying,or attempting o stealor copy,or secureclassified
information or datanecessary o manufactureany form of chemical,
biologicalor nuclearweapon,or anyotherweaponof massdestruction.
(2) Whoevercommits the offence9f cyberterrorism andcausesdeathof
anypersonshall be punishablewith deathor imprisonment for life, and with fine and
in anyothercaseheshallbepunishablewith imprisonmentof either description or
a term which may extend o tenyears,or with firie not less hanten million rupees'
or with both.
18. Enhanced punishment for of fences involv ing sensi t ive
electronic systems.-(1) Whoever causCs riminal access o any sensitive
electronicsystem n thecourseof the commissionof anyof theoffencesestablished
under his Ordinance hall, n addition o thepunishment rescribedor thatoffence,
bepunishedwith imprisonmentof either description or a teim which may extend o
ten years,or with fine not exceedingonemillion rupees,or with both.
(Z) For the purposesof any prosecutionunder this section, it shall be
presumed,until contrary is proved, that the accusedhad the requisite knowledge
-that t was a sensitiveeiectronicsystem.
19. Of abets, aids or attempts to commits offence.-(l) Any person
who knowingly andwillfully abets hecommissionof or who aids ocommit or does

any actpreparatory o or in furtheranceof the commissionof any offence under hisgrdinanceshall be guilty of that offence and shall be liable on.conviction o the
punishmentprovided for the offence.
(2) Any personwho attempts o commit an offence underthis Ordinance
shall be punished for a term which may extendto one-half of the longestterm of
imprisonment providedfor that offence.
Explanation -For aiding or abetting an offence to be committed under'thissection, t is immaterialwhether he offencehasbeencommittedor not.
20. Other offences.-Whoever commits any offence, other than those
expressly rovidedunder his Ordinance,with thehelp of compgter,electronic ystem,electronic device or any other electronic meansshallbe punished, n addition to the
punishment rovided or thatoffence,with imprisonment f eitherdescription or a
term which maydxtend o two years,or with finenot exceedingwo hundred housand
rupees. r with both.
2I. Offences by corporate body.- A corporatebody shallbeheld liable
for an offence under his Ordinance f theoffence scommitted on its instructionsor
for its benefit. The corporatebodyshall
bepunished with fine not less than one
hundredthousandrupeesor the amount involved in the offence whichever is the
higher:
Provided hatsuchpunishment hallnotabsolvehecriminal iability of the
naturalpersonwho has committed the offence.
Explanation-For thepurposes f this sectioncorporatebody, ncludesa
body of persons ncorporatedunderany law such as trust, waqf, an association,a
statutorybody or a company.
CHAPTER-III ,
PROSECUTION AND TRIAL OF OFF'ENCES
22. Offences to-be compoundable and non-cognizable.-All offences
under his Ordinanceshallbecornpoundable, on-cognizable ndbailableexcept he
offencespunishablewith imprisonment or sevenyearsor more.
23. Prosecution and trial of offences.-(l) The Tribunal shall take
cognizanceof and try any offence underthis Ordinance.

(2) In all matterswith respect o which noprocedurehasbeenprovided nthisOrdinanceorthe rulesmade hereunder,heprovisionsof theCodeshall,mutatismutandis,apply.foi the trial.
(3) Al l proceedings efore he Tribunal shall be deer-nedo be judicial
proceedingswithin the meaningsof sections193 and 228 of the PakistanPenalCode 1860(XLV of 1860)and he Tribunalshall be deemed o be a Court for thepurposesof sections480 and 482 of the Code.
24. Order for payment of compensation.-The Tribunal may, onawardingpunishmentof imprisonmentorfine orboth forcommissionof any offence,make an order for payment of any compensation o the victim for any damage
caused o his electronic system or data by commissionof the offence and thecompensationso awardedshall be recoverableas arrearsof and revenue:
Provided hat the compensation wardedby the Tribunal shallnot prejudice
any right to a civil remedy for the recovery of damagesbeyond the amount ofcompensationawarded.
CHAPTER IV
ESTABLISHMENT OF INVESTIGATt'ON AND PROSECUTIONAGENCIES
25. Estabtishment of investigation agencies and prosecution.- TheFederalGovernmentshall establishaspecialized nvestigationandprosecutioncellwithin Federal nvestigationAgency o investigateandprosecute heoffencesunderthis Ordinance
Provided hat till such ime anyagencys so established,he nvestigation
andprosecutionof an offenceshallbe conducted n accordancewith theprovisigns
of theCode:
Provided further that any police officer investigatiirgan offence under this
Ordinancemay seekassistance f any special nvestigationagenty for any technical
in put,collectionandpreservation fevidence.
, 26. Powers of officer.-(l) Subject to obtairting search warrant an
investigationofficer shall be entitled o,-
(a) have access o and nspect he operationof any electronicsystem,.
(b) useor cause o be usedany suchelectronic system o searchany data

(2) The policeofficer may,subjecto the proviso, equirea serviceproviderto submit subscribernformationrelatingto suchservices n respectbf a personunder nvestigationn thatserviceprovider'spossessionr controlnecessaryor theinvestigationf theoffence:
Provided he nvestigating fficer shallgetprior permissiono investigateany service provider from the licensing authority where prior permission of thelicensing authority is require{under any law to investigate the licensed serviceprovider.
(3) Any person who obstructs the lawful exerciseof the powers undersub-sections1) or (2) shall be liable to punishmentwith imprisonmentof eitherdescrip-tionor a term which may extend o oneyear,or with fine not exceedingonehundred housandupees, r with both.
27. Real-time collection of traffic data.- (l) The FederalGovernmentmay require a licensed serviceprovider, within its existing or required technical
capability, o collect or record through the applicationof technicalmeansor to co-operateand assistany law enforcementor intelligenceagency n the collection orrecordingof trafficdataordata,inreal-time,associated ith specified ommunicarionstransmitted y meansof an electronicsystem.

(2) The Federal Government may also require the service provider to
keepconfidential he actof the execution f anypowerprovided or in thissection
and any information relating to it.
28. Retention of traffic data.-(l) A serviceprovider shall, within its
existing or requiredtechnical capability,retain ts traffic dataminimum for a period
of ninety daysandprovide thatdata o the investigatingagencyor the investigating
officer when required. The Federal Government may extend the period to retairu
suchdateas and when deemsappropriate:
(2) The serviceprovidersshall retain he traffic dataundersub-section
(1) by fulfilling all therequirements f dataretention nd ts originality asprovided
under sections5 and 6 of the Electronic TransactionOrdinance20OZ LI of 2002).
(3) Any personwho contraveneshe provisionsof this sectionshall be
punishedwith imprisonmentor a term of six monthsor with fine or with both.
29. TFans-border access.-For the purposeof investigationthe Federal
Governrnent r the nvestigation gencymay,without hepermission f any oreign
Governmentor international agencyaccess ublicly availableelectronic systemor
datanotwithstanding he geographically ocation of suchelectronicsystemor data,
or accessor receive, through an electronicsystem,data located n foreign countryor territory if it obtains the lawful and voluntary consentof the personwho has he
lawful authority o disclose t:
Provided that such access s not prohibited under the law of the foreign
Governmentor the nternationalagency:
Provided urther that the nvestigatingagencyshall nform in writing to the
Ministry of Foreign Affairs of Governmentof Pakistanand other relevantagencies
as he casemay be about he nvestigation onducted nder his section.
CHAPTER-V
INTERNATIONAL COOPERATION
30. International co-operation.-(1) The FederalGovernment may
cooperatewith any foreign Government,. nterpol or any other nternational agency
with whom it has or establishesreciprocal arrangements for the purposes of
investigationsor proceedingsconcerningoffences elated o electronic systemand
data,or for the collection of evidence n electronicform of anoffence or obtaining
expeditiouspreservdtion nddisclosure f traffic dataor databy meansof a electronic
systemor real-timecollectionof traffic dataassociated ith specifiedcommunications
or interceptionof data.

, (2) The FederalGovernmentmay, without prior request, orward to such
foreignGovernment,Interpolorotherinternationalagency, ny nformationobtained
from its own investigationsf it considershat the disclosureof such nformation
mightassisthe otherGovernment r agency n initiating or carryingout nvestigationsor proceedings oncerningany offence.
(3) The FederalGovernmentmay require he oreign Govemment,Interpol
or other nternational agency o keep he nformationprovided confidential or use t
subject o someconditions.
(4) The investigating agency shall, subject to approval of the Federal
Govemment,be responsibleor sendingandansweringequestsor mutual assistance,
the executionof suchrequestsor their transmissiono the authoritiescompetent ortheir execution.
(5) The FederalGovernmentmay refuse o accede o any requestmade
by such oreignGovernment, nterpol or internationalagency f therequestconcerns
an offence which is likely to prejudice ts sovereignty, ecurity,public orderor other
essentialnterests.
'(6)The FederalGovernment may postponeaction on a request f such
action wouldprejudice nvestigationsor proceedings onductedby its investigation
agency.
CHAPTER-VI
INFORMATION AND COMMT]NICATION TECHNOLOGIES
TRIBUNAL
31. Information and Communication Technologies T!ibunal.-(1).
As soon as possible after the commencementof this Ordinance, the Federal
Covernmdnt hall,by notification n theofficialGazette, onstitute he Information
andCommunicationTechnologiesTribunal hoseprincipalseat hallbe at Islamabad.
(2) The Tribunal may hold its sittingsat suchplaceor placesas heFederal
Governmentmay decide
(3) The Tribunal shall consistof achairmanandasmany membersas he
FederalGovernmentmay determinebut not more thansevenmembers.
(4) The Chairmanmay constituteBenchesof the Tribunal and unless
otherwisedirectedby him a Bench shallconsistof not less hantwo members.A
BenchshallexerciseSuchpowersanddischarge uch unctionsasmay beprescribed.
There shall be establishedat least one Bench n eachprovince.

32. Qualifications for appointment.{1) A personshallnot bequalifiedfor appointmentas Chairmanunlesshe s,or hasbeen,or isqualifiedfor appointmentasa udge of the High Court.
(2) A person shall not be qualified for appointment as a Memberunlesshe-
has for two yearsserved aqa District and Sessions udge;
has or a period of not less han ten yearsbeenan advocateof a HighCourt;or
has specialknowledgeof legislationandprofessional xperience fnot ess han enyearsn the ield of telecommunication nd nformation
technologies.
33. Salary and allowances, and other terms and conditions of
services.- The salary allowances,privileges, and the other terms and conditions
of sbrviceof theChairman andmerpberof theTribunal shallbe suchas he FederalGovernmentmay, by notification in official Gazette, etermine.
34. Resignation and remoyal.- (1) The Chairman or a member of the
Tribunal may,by writing u4derhis handaddressedo theFederalGovernment. esign
his office:
Provided hat the Chairmanor amembershall,unlesshe s permittedby the
FederalGovernment o relinquishhisofficesooner, ontinue o holdoffrceuntil the
expiry of threemonths from the dateof receiptof suchresignationor until apersonduly appointedashis successor ntersupon his office whichever s earlier.
(2) The Chairman or a memberof theTribunal shall not be removed rom
his office before theexpiry of term specified n section33, by ttreFederalGovernment
except as.may be prescribed.
(3) The FeileralGovernmentmay,by rules,regulate heprocedure or the
investigation of misconductor physicalor mental ncapacity of the Chairmanand a
memberof the Tribunal.
35. Saving Tfibunal's proceedings.-No act or proceedings of the
Tribunal shall be called in question. n any manner on the ground merely of any
defect in the constitution of theTribunal.

36. Employees of the Thibunal.-(l) The Federal Government shall
providetheTribunal with suchemployeesAs he Government naydeemappropriate
in consultationwith the Chairman of theTribunal.
(2) The employeesof theTribunalshallperformtheirdutiesundergeneral
superintendence f the Chairmanof the Tribunal.
(3) The salmies, llowances ndotherconditions f serviceof theemployees
of the ICT Tribunal shall be such asmay beprescribedby the Federal Government.
37. Right to legal representation.-The parties in appeal may either
appear n person or authorize one or more legal practitioners, and in case of a
corporatebody any ofits officers, to present he casebefore theTribunal.
38. Amicrrs curiae.{l) The Tribunal may, f it so reqpires,be assisted
ih technical aspects n any case by an amicus curiae having knowledge and
experiencen information communication echnologies,inanceand economics.
(2) The FederalGovernmentshall maintaina list of amicus curiaatiaving
relevantqualifications andexperience.
(3) The Tribunal in consultationwith the Federal Government shalldetermine he remunerationof the amicuscuriae and the Tribunal may decidethe
party or parties to pay such remuner.stion, eeping in view the circumstancesof
each case.
39. Procedurrcand powers of T[ibunal.-(l) Subject to the provision
of this Ordinanceand the rules made hereunder,he Tribunal,-
may, where it deemsnecessary, pply the proceduresas provided in
the Codeor, as he casemay be, n theCodeof Civil hocedure, 1908(Act V of 1908);
in the exerciseof its civil jurisdiction, shallhavepowers vested n the
civil court undertheCodeof Civil Procedure,1908;and
in the exerciseof its criminal jurisdiction, shall have he samepowers
as are vested n the Court of Sessionunder the Code.
, 40. Appeal to Tlibunals.-{l} Any person aggrieved by any of thefollowing orders may,'within fifteen days 'from the date of suchorder, prefer an
appeal o the Tribundl, namely :.-

(2) An appealagainstan order of the Tribunal under section40 or anorder of sentenceexceeding en yearsshall be heardby the Division Benchof theHigh Court.
M. Civil court not to have urisdiction.-No court shall have urisdictionto entertain any suit or proceeding in respect of any matter which the Tribunalconstituted under this Ordinance is empoweredby or under this Ordinance todetermineand no injunction shall begrantedby anycourt or other authority in respectofany action takenor to be taken n pursuance f anypower conferredby or underthisOrdinance.
45. Thansitory prnceedings.l l ) Until the establishmerrt f the Tribunalall cases,proceedingsandappeals, ubjectmatterof which is within the drisdiction
. of Tribunal , shall continue to beheardand.decidedby the competentforum existingunderany law for the tirne being in force.
(2) On the constitutionof the Tribunal all cases,proceedingsand appealsshall stand ransferred o andheardand disposedof by the Tribunal.
(3) On.transferof cases,proceedingsand appealsunder sub-section 2),theTribunal shall proceed rom the stage heproceedingshad reached mmediatelyprior to the transferandshall not be bound to recall any witnessor againrecordanyevidence hat nray havebeenrecalled.
CHAPTER_VII
MISCELLANEOUS
46. Ordinance to override other laws.-The provisions of thisOrdinance shall have effect notwithstanding anything o
fhecontrary
contained nany other law for the time being in force.
47. Power to amend Schedule.-The Federal Government many, bynotification in the official Gazette,amendhe Sihedule so as addany entry.theretoor modify or omit any entry therein.
48. Powers to rnake rules.-(l) The FederalGovernmentmay , bynotification in the offrcial Gazette,make ulesfor carryingout purposesof the Tribunal.
49' Removal of difliculties.-If any difficulty arises n giving effect rotheprovisionsof thisordinance, the FederalGovernmentmay,by orderpublished ntheofficial Gazette,make uchprovisionsnot nconsistentwith theprovisionsof thiiOrdinanceas riray appear o be necessaryor removing the difficulty.
