IMPRIMIS, it is ordained. That everyPerfon who fhall hereafter be made free ofthe faid Miftery and Commonalty, fhall be-

YOU fhall Jwear, That you fhall he true andloyal to our Sovereign Lord King George,

and faithful and true in all lawful Things, untothe Corporation and Company of the Surgeons ofLondon, whereof you are now made free j andaccordingly he obedient to the Majler and Gover-nors thereof; and, as much as in you lieth, main-tain Amity and Unity therein, and obey, ohferve,and perform all the lawful Rules, Statutes, andOrdinances thereof j and he propertionahly contri-butary to the heft of your Power, to all lawful or

reafonable Charges, Contributions, and Payments,

belonging or neceffarily apperta'uiing to you to hear,as other Brethren of the fame Company do. Andalfo you fhall obey all Manner of lawful Summonsor Warnings done or to he made by the Clerk,Beadle, or other Officer of the faid Company there-unto ajjigned, in the Name of the Majler or Go-vernors, having no lawful or reafonable Excufeor Impediment to the contrary: All thefe Articlesyou fhall truly, fully,

11. Item, it is ordained. That whoever here-after fhall be chofen Principal Mailer or Gover-nor, or Warden or Governor, or Afliftant, or

Clerk, or Beadle of this Company, fhall every

J'O U jhall Jwear, That during the ‘Time of yourOffice of Principal Mailer or Governor, you

jhall diligently obferve, keep, and maintain, theProfit and Common Weal of the Corporation andCompany of the Art and Science of Surgeons ofLondon, in all Points lawful, according to yourheft Skill and Power ; and Jhall obferve, keep,maintain, and execute, and cauje to he obferved,kept, maintained, and executed,

111. Item, it is ordained. That all Electionslhali for the future be determined by Ballot;and that the Candidates in all Eledions of Of-

fleers fhall be reduced to Two, unlefs a Majorityot the Members then prefent fhall upon the tirffcBalloting appear in favour of any One Candi-date, in which Cafe fuch Candidate fhall be im-mediately declared duly defied. When there isa Vacancy in the Court of Affiftants, either byDeath or otherwife, fuch Vacancy fhall be de-clared at the Firft Court of Affiftants whichfhall be holden after the fame fhall happen, andanother AJfifiant fhall be defied out of theMembers of the laid Company at the next Courtafter fuch Vacancy declared: And if the Prin-cipal Mafier or Governor, or either of the TwoWardens for the Time being, or any of theExaminers , fhall happen to die, or be amoved,the Vacancy happening thereby fhall in likeManner be declared at the next Court of Affift-ants which fhall be holden after fuch Vacancyfhall happen ; and fuch Vacancy fhall be filledup at the next Court of Affiftants which fhallbe held after the fame fhall be fo declared. Andthe new Principal Mafier or Governor, or eitherof fuch Two Wardens, fhall continue refpedive-ly in fuch Office or Offices for the Remainderof the Year, until the next annual Eledlion-dayv And when any Officer of this Companyfhall happen to die, or be amoved, the Prin-cipal Mafier or Governor fliall call a Court ofAffiftants to eledl a new One; which Courtihail not be held till after the Expiration of

Twelve Days after fuch Death or Removal;but the fame Ihall be held before the Expirationof Twenty-one Days from the Deceafe or Re*-movai of fuch Officer, upon Pain of forfeitingthe Sum of Twenty Pounds.

IV. Item, it is ordained. That whenever anyMember of this Company Hiall be fummoned toappear at any Court or Alfembly of the Mafter,Governors, and JJfiftants, or at any Court or Af-fembly of the Examiners , Notice thereof Ihall begiven either to him perfonally or left in Writingat his ufual Place of Abode ; and if, after fuchSummons, the Member fo fummoned Ihali refufeor negledt to make his perfonal Appearance, ac-cording to the Tenor thereof, unlefs there befome juft and reafonable Caufe to the contrary',to be judged of by the Court or Alfembly towhich he Ihall be fummoned, he Ihall for theFirft Default forfeit and pay the Sum of PdveShillings, and for the Second Ten Shillings, andfor every Default after the Second Summons, theSum of Twenty Shillings of lawful Money ofGreat Britain •> and if any fuch Perfon Ihall, afterfuch Appearance, depart, before the Caufe offuch his Summons be determined, without theConfent or Leave of the laid Court, then everyfuch Perfon Ihall forfeit and pay for every fuchhis Contempt, to the Ufe of the Company,the Sum of Forty Shillings of like lawfulMoney.

V, Item, it is ordained. That when any Courtof Affiftants fhall be called, there fhall be left at-the Place of Abode of every One of the Affiftantswho fhall inhabit or dwell within the Cities otLondon or JVeJiminJler, or within One Mile there-of, by the Beadle or proper Officer, a particularSummons, in which lhail be expreffed the Pur-pofe for which fuch Court is to be called wheretohe fhall be fo fumrrioned j and every One of theAffiji'dnts refiding out of London or JVeJiminJler, atany Diltance exceeding One Mile and not exceed-ing Seven Miles, fhali be fummoned by a Penny-pod: Letter: And no fuch Court fhall be holdenwithout the perfonal Prefence of Two of the LidGov errors and Nine of the Afpjlants at the leaf 5And no Order of any Court .fhali be binding orobligatory till the fame has been confirmed byfeme fucceeding Court of Affiftants. And further.That no Member of the Court fhall depart there-from, without having firft obtained the Leave ofthe Principal Majier, or of the prefiding Governoror Warden, or the Majority of the Court who fhallbe then prefent, on pain of forfeiting One PoundOne Shilling of lawful Money of Great Britain ;

neither fhall the Principal Majier or Governor, orother Perfon who prefides at the Court whereinthe Bufmefs mentioned in the Summons is to betranfadled, leave the Chair without the Confentof the Majority of the AJfiJiants then prefent,until the Bufmefs of their' Meeting be fully de-

tcrmined, on pain of a Motion from the Courtof Examiners and Affiftants: And if any Diffe-rence of Opinion lhall happen at any fuch Court,touching any Motion or Queftion made or pro-pofed, the fame ill all be determined by ballot-ing, if defined by any Two AJftftnnts prefent:And, in cafe of ah Equality of Voices or Votes,the Principal Mafter or Governor, if prefent, orin his Abfence whoever lhall prefide at fuchCourt, lhall have the calling or decifive Voiceor Vote. VI. Item, in order to encourage a punctualAttendance according to the Summons, it is or-dained, That every Aftiftant who lhall be prefentin the Room where any Court of AliiHants isappointed to be holden before St. Paul’s Clockhas llruck the Hour mentioned in fuch Sumrmons, lhall receive Half a Crcwn, out of theMoney which properly belongs to the Court ofAffillants.

VII. Item, it is ordained, That if any Memberof the Court of Affiftants negleds to attend at anyCourt for the Space of Six Months, after havingbeen duly fummoned to attend, without givinga fufficient Reafon or Reafons for fuch his Ab-fence, to be judged of by the faid Court, hefhall ‘be liable to be amoved fcom his faid Of-fice of an Affiftant, and of an Examiner (if hehappens to be One); And if any Member of

either of the Court of Afliftants or Examinersremove above Seven Miles from London,

he fhall be amoved from both the faid Courts.

VIII. Item, it is ordained. That no Perfonpradtifing as an Apothecary, or following anyother Trade or Occupation befides the Profef-fion or Bufmefs of a Surgeon, fhall be capableof being chofen into the Court of Afliftants or,if he ftiould be One of the Court of Afliftants,be eligible to the Office of Mafier or Examiner.

IX. Item, it is ordained, That there fliall bein the faid Company Ten Examiners-, who fhallbe from time to time fucceffiveiy chofen by theCourt of Afliftants; and fhall conflft of thePrincipal Mafier or Governor and the Two War-dens or Governors for the Time being, and of Sevenother Members of the Court of Afliftants; whofhall continue in fuch Office fo long as they fhallwell behave themfelves therein and fhall becalled Lhe Court of Examiners and fliall havePower to examine any Perfon whofoever, eitherbrought before them, or offering himfelf to beexamined, touching his Skill or Knowledge inthe Art and Science of Surgery; and to cer-tify the fame accordingly; and to affix the Com-mon Seal to the grand Diploma which they fliallgrant to any Perfon examined by them; pro-vided fuch Examination hath been in the Pre-fence of Two Governors and Three Examiners,

or of One Governor and Five Examiners at theleaft, and not otherwife.

X. Item, it is ordained. That whenever anyCourt of Examiners fhall be called, every Oneof the faid Examiners who fhall inhabit or dwellwithin the Cities of London and TVeJiminJier, orOne Mile thereof, fhall be particularly fum-moned by the Beadle or other proper Officer;and if he refides at a greater Diftance from Lon-don or JVeftminJier, not exceeding Seven Miles,by a Penny-pod Letter: And no fuch Courtfhall ever be holden without the perfonal Pre-fence of Two of the laid Mafters or Governorsand Three of the faid Examiners, or One Cover-nor and Five of the faid Examiners at the leaft:And that no Examiner fhall certify the Sufficiencyof any Perfon in the Art of Surgery, unlefsfuch Perfon hath been examined in the Prefenceof fuch Two Governors and Three Examiners, orOne Governor and Five Examiners, on pain ofthe Examiner fo certifying being difmiffed fromhis Place of an Examiner and forfeiting TwentyPounds: And that no Examiner prefent at anyfuch Court of Examiners fhall during the Con-tinuance of fuch Court depart therefrom, with-out having firft obtained the Leave of the Chiefor Principal Mafter or Governors, or of the Ma-jority of the Court who fhall be then prefent,on pain of forfeiting Twenty Shillings of lawful

Money of Great Britain : And if any Examinerfhall on any Account or Pretence receive anyPee or Prefent from any Perfon to be examined,either at, before, or after the Time of fuch Ex-amination, he fhall be expelled and amoved bothfrom his Office of an Examiner and AJfijlant.

XL Item, it is ordained. That no Perfonwhatfoever fhall be prelent at any Court of Exa-miners, but whom the Examiners themfelves ffiall

and that each Examiner who fhall beprefent in the Room wherein the faid'Court isappointed to be holdeny before St. Paul's Clockhas ftruck the Hour 'appointed in the Summonsfor the Meeting of fuch Court, and ffiall con-tinue there during the Examination of any Perfonor Perfons who ffiall receive the grand Diploma

ffiall have Half a Guinea out of the Moneypaid for every fuch Diploma ; and the Remainderto go into the common Stock of the Company;and in cafe no Perfon ffiall happen to be exa-mined for the grand Diploma, ffiall receive Halfa Crown, out of the Money which properly be-longs to the Court of Affiftants.

XII. Item, it is ordained. That every Mem-ber, either of the Court of Affiftants or Exa-miners, who ffiall behave himfeif uncivilly orindecently to any of the Governors or other AJfijl-antS) at cither of the faid Courts, or ffiall, by

Writing or otherwife, exprefs any Diftatisfadlionat any Order, Refolution, or Determination ofeither of the faid Courts, after the Subjedt-matter of their Meeting has been determined bya Majority of either of the faid Courts, fuch Mif-behaviour in either of the foregoing Inftances,to be judged of by the Court of Affiftants, {hallbe ipjo fatlo expelled both the faid Courts.

XIII. Item, it is ordained. That if his prefentMajefty, or his Succeffors, fliall be pleafed here-after to appoint a Principal Serjeant whois not a Member of this Company, fuch PrincipalSerjeant Surgeon fhall, at the Firft Court after hisAppointment, be prefented with the grand Dt-ploma, without an Examination; and fhall like-wife be chofen an AJJifiant and Examiner on theFirft Vacancies which fhall refpedlively happen,and Principal Mafier at the Eledlion next enfuinghis Admlffion into the Court ofExaminers : Andif fuch Principal Serjeant Surgeon, at the Timeof fuch his Appointment, fhall happen to be aMember of this Company, but not of the Courtof Afliftants or Examiners, he fhall in like Man-ner be chofen into the refpedlive Courts, on theFirft Vacancies happening therein j and fhalllikewife be chofen Principal Majier at the Elec-tion next enfuing his Admiftion into the Courtof Examiners.

XIV. Item, it is ordained, That every Mem-ber of the Company, who fhall be elected Prin-cipal Majier or Governor

,or Warden, or Governor,

and fhall refufe to take upon him the fame Office,or to take fuch Oath as is afore ordained for thePerformance thereof, not having a reafonableExcufe for his Refufal (to be allowed by theCourt of Affiflants) fhall be expelled and amovedboth from the Courts of Affiflants and Exa-miners ; and the Court of Affiflants fhall be atLiberty to proceed to a new Election of anotherin his Room 5 and no fuch Governors or Wardensfhall, after the Expiration of his or their Office,intermeddle as Governor or Warden ; but fhallupon the Firfl fthurjday in July, being the Dayon which his and their Office expires, or withina Fortnight after in every Year, deliver in hisAccounts, and pay the fucceeding Governors theBalance thereof, upon pain of Twenty Poundsfor every Default, not having a reafonable Ex-cufe, to be allowed by the Court of Affiflants,as aforefaid.

XV. Item, becaufe the late A6l of Parliamentand feveral of the By-laws herein contained haveat many of the Courts diredted by them tobe holden, made the Prefence of Two of theGovernors indifpenfably necefifary, and confe-quently, becaufe their Abfence may greatly protra6l the Bufmefs of this Company, wherebygreat Detriment may arife not only to the feveral

Members thereof, but likewife to the public ingeneral, for whole Utility this Corporation was

constituted, it is ordained. XVI. Item, it is ordained. That if anyMember of the Court of Affiftants Shall becomea Bankrupt or Infolvent, he Shall be removedfrom his faid Office, and likewife from being an

Examiner (if he fhall happen to be One) ; and infuch Cafe the Fine of Twenty-one Pounds, whichhe paid upon his Admiffion into the faid Courtof Affiftants, fhall be repaid him, if the CourtShall think fit and reafonable.

That the Courtof Affiftants fhall out of the Members of thisCompany, bn the Firft SShurfday in the Month of'July in every Year, chufe Two Majiers, TwoWardens, and Two Stewards ofAnatomy, withoutany Regard to Seniority 3 to be changed fuccef-fively. Two at a Time, every Year 3 the par-ticular Duty and Bufinefs of which refpedtiveOffice, fhall from time to time be determined andregulated by the Court of Affiftants, and theExpences and Charges thereof, be borne and de-frayed by the Company: And if any Memberfo chofen and appointed, after due Notice offuch Election to either of the faid refpebtiveOffices, refufe to accept and take the fame uponhim, without juft and reafonable Caufe, to beallowed of by the Court of Affiftants, or if heaccepts the fame, and fnall afterwards negled toattend unto and execute the Duty of fuch Office,to be regulated and determined as aforefaid, hefhall in either of the above Cafes, forfeit and paythe Sum of Twenty-one Pounds of lawfulMoney: And if any fuch Majter, Warden, or

N. B. By a Refolution of a Court of Affiftantsholden the 23d of July, 1766 (Mr. Crane, Mailer)It was refolved, that the then Method of givingAnatomical Lectures did by no Means anfwer thePurpofes intended: And that a Member of theCompany, of known Abilities, fhould for the fu-ture be appointed, under the Character of Pro-feffor of Anatomy , to give a complete Courfs ofLectures annually, inftead of the two Mailers ofAnatomy appointed to be annually chofen by theforegoing By-Law. And by a Refolution of an-other Court of Affiftants, holden on the 26th ofthe fame Month, the Fine to be excufed fervingthe Anatomical Offices, was reduced from TwentyOne Pounds to Five Guineas.

XIX. Item, it is ordained. That the Court ofAffiftants fhall have Power to appoint One or more

XX. Item, it is ordained, That if the faid MaJ-ter or Governors, or any or either of- them, fhallby him or themfelves, without the Confent and ,

Order of a Court of Affifcants, tranfafl any Biffi-nefs which properly belongs to the faid Court,whereby the Company fhall and may fuftain orfuffer any Lofs or Damage, fuch Lofs or Damagefhall be made good by the Party or Parties fooffending; who fhall iikewife be amoved fromtheir refpeblive Offices of Mafier or Governor ; andthe Court of Affiflants fhall proceed to a newElection.

XXL Item, it is ordained, That no Memberof this Company, fhall at any Time transfer orbetake himfelf to or procure hirnfelf to be admit-ted or entered a Freeman or Member in any otherCorporation or Company of this City, withouthaving firft obtained an Order, in Writing, tefti-fying the Confent and Allowance of the Court of

XXII. Item, it is ordained, That if any Mem-ber of the Company fhall wittingly or willingly,without the Confent in Writing of a Court of Af-fillants, cancel, blot, deface, or put out, or caufcto be cancelled, blotted, defaced, or put out, anyPldure, Monument, Memorial, RemembranceBook, or Record, belonging to the faid Company;fuch Member fhall forfeit the Sum ofFifty Pounds.

XXIII. Item, it is ordained. That if anyMember of this Company, who fhall pradife Sur-gery, or any part thereof, fhall ufe any indirectMeans to take a Patient out of the Care or Chargeof any other Surgeon, Member of this Company,(which indired Means is to be determined by theCourt of Affiftants) or fhall ufe, publifh, or utterany Words in Detradion of the Art or Knowledgeof fuch Surgeon, relating to his Profeflion, inwhofe Hands or Cure the faid Patient then was,fuch Perfon fhall, in either of the faid Cafes, for-feit and lofe his Freedom of this Company, orotherwife forfeit and pay fuch a Sum (not exceed-ing Fifty Pounds) as the Court of Afllflants ofthis Company fhall think fit.

XXIV. Item, it is ordained. That every Per-fon having a Right to the Freedom of this Com-

pany by Servitude, fhall pay for the Freedom andgrand Diploma, the Sum of Twenty-one PoundsTwo Shillings and Six Pence, of lawful Money vand every Perfon who has no Right by Servitude,and fhall apply to this Company for his Freedomthereof, fhall pay Two Guineas for the fame, andTwo Guineas for the binding Fee, over and abovethe Sum of Twenty-one Pounds Two Shillingsand Sixpence, making in all for his Freedom andgrand Dipkma the Sum of Twenty-five PoundsSix Shillings and Six Pence, But if any Perfonfo applying for his Freedom, who has no Rightthereto by Servitude, or any Perfon who is intitlcdto his Freedom by Servitude at the Time of hisbeing admitted into the Freedom of the faid Com-pany, propofes torefideand praflife Surgery at

any Place or Town Seven Miles or more diftantfrom the Cities of London and Wejtminfier, andgives Security to the Company, to be approved ofby Two of the faid Governors, that he will con-tinue fo to do, he fhall in fuch Cafe, be intitled to,and fhall have the Freedom and grand Diploma,

paying for the fame no more than One Half ofthe feveral Sums herein before-mentioned.

And every Freeman ofthis Company, or foreign Brother, fhall, withinOne Month next after his Entertainment of anyPerfon in order to be his Apprentice, prefentfuchPerfon before the Governors , or any Two ofthem,.at a Court to be by them held, and there bind.fuch Perfon to him before the faid Governors, byIndenture, upon pain offorfeiting Twenty Poundsoflawful Money. And the Clerk of the faid Com-pany lhall not bind any Perfon who has not beenprefented and examined, upon pain of forfeitingthe Sum of Ten Pounds of lawful Money, andbeing liable to be amoved from his faid Office.And no Apprentice lhall be turned over from OneMailer to another, but at a Court, in the Prefenceof the Mafter and Wardens, or One of them ; andOne Guinea and no more lhall be paid for the fame.

XXVII. Item, it is ordained. That the Sea-Surgeons Chelts and Inllruments, whenever of-fered for Examination, lhall always for the futurebe examined by the Mafter and Upper Warden : Butifeither of them neglects or refufes attending forthat Purpofe, the Second Governor or Warden lhallbe intitled to fuch Examination ; and that the Cer-tificates of the Sea-Surgeons, having left theirJournals, lhall for the future be figned by the Prin-cipal Mafter ox Governor, or fuch of the other Go-

XXVIII. Item, it is ordained, That the Clerk'sSalary fhali not exceed Sixty Pounds per Annum ;

and no Gratuity Iball be above forty Pounds ; Andthat the Beadle's Salary fhali not exceed TwentyPounds per Annum; and no Gratuity above TenPounds, unlefs with the Confent of a Majority ofthe whole Company who fhali attend at &hy Court.

XXIX. Item, it is ordained, That for the fu-ture, ail public Dinners of the Companyfhali behad at fuch Time and Place only, as the Mafter andGovernors, or any Two of them, fhaliappoint j andthat theExpence fhali be defrayed byvoluntary Sub-fcriptions: And that at every fuch public Enter-tainment the Clerk fhali call over the Names of allthe Members of the Company, according to theirStanding in the Company, and f\ich of the faidMembers who fhali be prefent fhali anfwer to theirNames, and take their Seats at Table according tofuch Seniority, and onRcfufal fhali forfeit the Sumof Twenty Shillings.

XXX. Item, it is ordained. That the Governorsfor the Time being, or fome or One of them, fhalireceive to the life of the Company, all Fines, For-feitures, Annuities, Rents, andSums of Money dueand payable to the Company; and fhali likewife

XXXI. Item, it is ordained. That every Mem-ber of this Company fhall yearly, on Midjummer-day, or within Fourteen Days then next enfuing,pay the Sum of Ten Shillings of lawful Money ofGreat Britain, and every foreign Brother the Sumof Twenty Shillings of lawful Money, for and inthe Name of the Quarterage of the faid Company,at fuch Place and unto fuch Perfon or Perfons, asthe Governors, or any Two of them, fhall from timeto time affign and appoint, the Firft of which Pay-ments fhall be made on Midjummer-day now nextenfuing, or withinFourteen Days then next follow-ing, and to continue for fo long Time only, as theCourt of Afhftantsfhall think fit, which faid Courtfhall, if they think fit, have Power of increafingthe faid Yearly Sums to the Sum of Forty Shillingsto be paid in Manner aforefaid, provided the Ma-jority of a general Court of the whole Companyconfent thereto, until the Theatre and other newintended Buildings, for the Ufe of the faid Compa-ny, are ereded, finifhed, and paid for (the Moneyfo to be raifed being intended to be applied for thecredingand finifhing fuchBuildings, and difeharg-jng the Intereft of the Money borrowed for thatEurpofe) : And after fuch Buildings are intirelycompleted and paid for, fuch yearly Sums, or fuchQuarterage only, if any, fhall be paid, as fhall be
