CONDITIONS OF PROBATION

You must comply with the following conditions:• Not violate any criminal law of any unit of government.

• Not leave the State of Michigan without the consent of this court.

• Make a truthful report to the probation officer monthly, or as often as the probation officer may require, either in person or in writing, as required by the probation officer.

• Notify the probation officer immediately of any change of address or employment status.

• Comply with all other conditions listed on page 2 of your Order of Probation.

VIOLATION OF CRIMINAL LAW OF ANY UNIT OF GOVERNMENT

You must report any contact with law enforcement within 24 hours of the event.

Reporting the contact includes calling or emailing your Probation Officer and providing:

• Date of offense

• Where the offense occurred

• Police Agency and incident report number

• Detailed account of the incident

TRAVEL REQUESTS

What do I have to do to travel out of state? You must always have the permission from your probation officer

prior to traveling out of state.

You must be in compliance with probation in order to get permission to travel out of state.

You must request permission to travel at least one week prior to allow your probation officer time to review your travel request and complete a Request to Leave the State form which will be reviewed by your probation officer for approval.

Travel forms must be in your possession at all times while out of state.

Traveling without permission is considered a violation of probation.

REPORTING

You are required to make a truthful report to your probation officer monthly,

or as often as the probation officer may require, either in person or by phone,

as required by the probation officer.

• In Person Reporting – you are required to report to your probation officer promptly on the date and time scheduled. The probation office is located on the 2nd floor of the court house.

• If you are meeting with a probation officer at the Ishpeming Location this office is located in the Marquette County Service Center Building at 215 W. Hematite Dr. (across from Ishpeming Police Department).

• By Phone Reporting – you are required to call your probation officer directly and promptly on the date and time scheduled.

SUPPORTIVE DOCUMENTATION/VERIFICATION

• You are responsible for providing proof of participation and completion of all court-ordered conditions.

• You will be required to submit said verification along with EACH monthly report via email, mail or faxed to the Probation Department.

• You must sign a release of information with your provider so they can release any HIPPA information.

Examples of supportive documentation

include, but is not limited to:

• Victims impact Panel

• AA/NA/twelve step attendance

• Programming status reports

• Counseling/Therapy status reports

• Community service verification

• Employment verification

• School attendance /grades

FINES & COSTS

In accordance with Michigan Court Rule 1.110, all financial assessments such as the fine, court costs, and statutory assessments, must be paid at the time of sentencing, except when the court allows otherwise for good cause shown.

Refer to item #6 on the front page of your Order of Probation that lists the total fines and costs due to the court. You will also find your payment arrangment/plan listed if fines have not been paid in full.

Please note if fines were paid in full the total balance reflects only what was ordered on the day of sentencing and not your current balance.

RULES FOR TESTING

• You must have Photo ID to test and your test will be monitored.

• The cost of the drug screen will be added to your court fines and costs.

• Allow yourself at least thirty minutes to complete your test.

• Do not eat, drink or have anything in your mouth for at least 15 minutes prior to testing.

• Do not drink excessive water, tea, or other fluids on the day of your test. Your sample will be tested for dilution and rejected as a tamper if you are abnormally hydrated.

• If you deny use, you may have the sample sent to the lab for an additional expense. The cost is $44 which is to be paid in cash to Great Lakes Recovery Center.

• Do not bring friends, family or any other person to testing.

• NO CHILDREN ARE ALLOWED AT TESTING SITES

POSITIVE DRUG SCREENS

• If you feel you have tested positive and it is a result from a prescription medication, you must provide the valid prescription to probation within 48 hours of the positive screen

• If the prescription is consistent with the positive drug test, no violation will occur; however, if it is not consistent, the prescription is not current or the positive result is not within the therapeutic dosages levels, it would be a violation and you would be subject to possible sanctions and/or violation process.

• For safety and security purposes, please do NOT bring in any prescription bottles with medication(s) to the probation office. You must provide the written prescription as instructed.

• All clients maintain the right to contest a positive result and have it sent out to a certified lab for confirmation for an additional cost

INTOXICATING SUBSTANCES

• While on probation you cannot use/consume any intoxicating substances including but not limited to; alcohol, marijuana, controlled substances, or any substance that alters consciousness or behavior.

• If the Judge of record has granted permission to use medical marijuana you must provide a copy of your valid medical marijuana card, front and back to your probation officer. You cannot use marijuana until this documentation has been received and approved by the Judge.

COMMUNITY SERVICE

Community Service must be done at a Non-Profit Agency.

The court does not select the agency for you, or the scheduled date/time. You are responsible for setting up and completing the community service by the ordered due date.

Verification of completion must be provided in writing on the Community Service Restitution form, which includes number of hours completed and the supervisors name and contact number.

You may request a Community Service Work Site list from your probation officer or a copy can also be found on our web page. Any sites not on the list must be approved by your probation officer.

• If your Order of Probation includes a “no contact” and/or “no go to” order you must not have or attempt to have any contact with the person or place listed; directly or indirectly. Any contact is a violation of probation. If that person tries to contact you, do not agree to make contact, tell your probation officer immediately. This also includes contact via social media, telecommunications, 3rd party, and in person contact.

• If your Order of Probation includes “no abusive, assaultive or threatening behavior of any kind” this condition applies to the victim and everyone else.

• If your Order of Probation includes “Do not purchase or possess any weapons, ammunition or firearms” you are responsible for ensuring you are compliant with this order and that all these items have been removed from your residence and/or personal property.

VIOLATIONS

• Failure to comply with this order may result in a revocation of probation and or incarceration.

• Violations will be addressed on a case by case basis by your Probation Officer.

• Violations could result in a Violation of Probation hearing scheduled before the Judge or may result in an immediate bench warrant. You may also be detained for up to 72 hours without the need of a warrant, if there is reasonable cause to believe you have violated the terms of probation.

Notice of Potential Eligibility for Early Discharge from Probation

1. You have been placed on probation and you may be eligible for an early discharge from that probation provided that all terms of your probation have been met and you have completed at least ½

of your probation term.

2. Pursuant to MCL 771.2(3), once you have completed at least ½ of your term of probation and all required programming, the probation department may notify the court that you may be eligible for

early discharge from probation. If the probation department does not notify the court of your eligibility, and you have not violated your probation in the past 3 months, you may notify the court of

your eligibility by submitting court form MC 512. This form can be located on courts.michigan.gov or can be obtained from your agent or the Court

j. 750.411i Stalking A Minor –Aggravated
