CONFERENCE PROCEEDINGS: First National Conference On Online Dispute Resolution

Mechanism On April 21, 2018 at Civil Service Officers Institute, Chanakyapuri, New Delhi:

Construction Industry Arbitration Council has organised the First National Conference on Online Dispute Resolution Mechanism on April 21, 2018 at Civil Service Officers Institute, Chanakyapuri, New Delhi to promote wider awareness and acceptance of Online Dispute Resolution Mechanism through propagation of its systems with the support of Niti Aayog, Department of Legal Affairs (Ministry of Law& Justice), Department of Commerce (Ministry of Commerce & Industry), All India Council for Technical Education, Government of India and UNCITRAL Regional Centre for Asia and the Pacific, UNCITRAL National Coordination Committee, India (UNCCI) and the Engineering Council of India. The one day Conference had total 5 sessions as detailed below:

1. Inaugural Session 2. Session I UNCITRAL NOTES “Presentation on ODR Technical Notes” 3. Session II Present Scenario & initiatives on ODR Mechanism 4. Session III Panel Discussion and Case Studies 5. Session IV Concluding Session Summing up & way forward.

Welcome address was by Dr Uddesh Kohli, Chairman, CIAC. Mr P K Malhotra, Former Law Secretary & Chairman, Steering Committee of the Conference gave background and overview of the Conference.

The Conference was inaugurated by the Hon’ble Vice President of India, Mr M. Venkaiah Naidu, he said that Online Dispute Resolution Mechanism is a laudable initiative to fast-track dispute resolution and it shall go a long way in resolving disputes. He also said that Online Dispute Resolution mechanism is the need of the hour keeping the increase of e-commerce and e-businesses in view. He welcomed the measures taken by Ministry of Law and Justice to introduce Online Dispute Resolution through mediation, arbitration and conciliation.

He informed that CIAC has been closely associated with UN Commission on international trade and law. He further said that domestic and international trade and commerce has spurred competition provide more opportunities and imputed risks. The commercial arbitration in India is witnessing a steady transition and it should become more simpler.

The session ended with Vote of thanks by Dr. P. R. Swarup, Member Secretary, CIAC.

CONFERENCE PROCEEDINGS: The first session UNCITRAL NOTES “Presentation on ODR Technical

Notes” was Chaired by Mr P K Malhotra, former law secretary and Chairman Steering Committee. Chairman distributed the certificates to the participants of Drone Training Program.

The first session UNCITRAL NOTES “Presentation on ODR Technical Notes” was Chaired by Mr P K Malhotra, former law secretary and Chairman Steering Committee. Chairman distributed the certificates to the participants of Drone Training Program.

Session started with UNCITRAL presentation followed by Question & Answer session. The queries by participants were answered by Mr Shreyas Jayasimha & Mr Ashok Sharma, Director, CIIarb. The session was quite interactive. It was followed by

demonstration of ODR Portal by Mr Hemakumar and presentation by Dr R S Rathore on Arbitral Systems Specialist & Mr S Ratnavel on Internship Initiatives of ACCE.

The Second Session Present Scenario & initiatives on ODR Mechanism was Chaired by Mr Gourab Banerji, Former Additional Solicitor General of India and Speakers include Prof Pradeep Kulshrestha, Dean, School of Law, Sharda University, Prof. B T Kaul, Chairperson, Delhi Judicial Academy & Mr Ratan K Singh, Chairman, Indian Society of Construction Law.

The Session highlighted the present initiatives on ODR and speakers explained the role ODR in future. They have appreciated the role of CIAC in promoting ODR mechanism in India.

The third session Panel Discussion & Case Studies was Chaired by Mr Sanjay Jain, Former Additional Solicitor General of India and presentations by Mr Akhilesh Srivastava, CGM, NHAI, Mr R S Amar, CEPC, RBI, Mr Pranjal S, CEO, ODR Ways and case studies by Mr. Neeraj Aarora, Advocate on Record, Supreme Court of India, Cyber Lawyer & International Arbitrator.

Presentations were appreciated by the audience and case studies gave insight into the role of ODR in dispute resolution and its implications and applications in our country. Students were very curious about the mechanism to be adopted, role of portal etc.

The concluding session was Chaired by Mr. P K Malhotra and summary statement was presented by Er. O P Gupta, VSM, Registrar, CIAC and way forward was suggested by Dr P R Swarup, Member Secretary, CIAC. The Conference ended on a positive note and new avenue for employment in the form Arbitral Systems Specialists has evolved.

The secretariat is preparing the recommendations and they will be submitted to the Ministry of Law & Justice for onward implementation. A series of Arbitral Systems Specialists training programs are being planned along with Webinars with various colleges to provide alternate employment opportunities for engineering, management and law students in the country.

CIDC – Activities: Odisha State level competition for India Skills -2018:

Government of Odisha through Odisha Skill Development Authority (OSDA) has successfully hosted “Odisha Skills-2018”, a state level competition for India Skills-2018 on April 29-30, 2018.

The event was organized to recognize the skills and provide an opportunity

to the youth to showcase their talent; compete with the best and meet the aspirations.

Odisha skills is the state level chapter of India skill competition organized by National skill Development Corporation (NSDC) and the Ministry of Skill Development and Entrepreneurship, Govt. of India. Odisha skills is the first of its kind state level skills competition organized by Govt. of Odisha. The opening ceremony of Odisha skills 2018 was hosted in Cuttack on April 28, 2018 at Jawaharlal Nehru indoor stadium and inaugurated by the Chief Minister of Odisha Shri Naveen Patnaik in front of a full house audience. The two day competition was organized at IDCO Exhibition ground in Bhubaneswar on April 29-30, 2018.The event hosted people from all spheres of the skill system. Moreover youths from schools and technical institutes visited and witnessed the competition. The competition had a participation of nearly 7000 participants from across Odisha competing in 6 sectors and 26 skills.

Odisha skill 2018 event showcased as one of the major event of the state promoting skills and making it aspirational amongst the youth.

The closing ceremony was attended by Mr. Dharmendra Pradhan, Minister of Skill Development and Entrepreneurship, Govt. of India.

Role of CIDC in Odisha Skill 2018

CIDC has also made its small but important contribution for this event. One of CIDC’s partner institutes, C V Raman college of Engineering, Bhubaneswar invited CIDC for imparting training to its students participating in this competition. In its preliminary analysis, it was found that the students studying in Diploma engineering have very low practical skill about their trades (Civil). The staff (P.K.Chattopadhyay and Sh. Manas Bishoyi) detailed at CVRCE was assigned to the job to conduct the training within a very short period. The planning and scheduling of training programme, formulation of Course syllabus and training methodology were done by the CIDC staff posted at CVRC. Mr. Shabab Akhtar & Mr. Anurag kumar deputed from CIDC Faridabad training Centre imparted the training for 10 days in the first phase from 21.03.2018 to 31.03.2018. 11 students got qualified in the preliminary 1 for preliminary 2 out of 13. Again 5 students got qualified in the preliminary 2 competition. In the second phase 5 students got training from 18.04.2018 to 28.04.2018 to appear the state skill competition. In the State skill competition held during April 29-30, 2018; two students out of five were able to get gold and silver medal in the wall and floor tiling skill competition.

Namely.

1. Lochan Kumar Mahato secured first position and got Gold medal. 2. Ashis kumar Digal secured second position and got Silver medal.

It is not out of place to mention that Mr. Manas Bishoyi was also invited by OSDA as a Jury for Plumbing and Heating competition.

CIDC – Activities: Project update – CSR Training Sponsored by Airports Authority of India

(AAI):

Airports Authority of India (AAI) collaborated with Construction Industry Development Council (CIDC) the leading Human Resource Developer and training provider for the project, “Employment Oriented Training and Skill Development Programme for SC/ST/OBC/Women, Unemployed Youth & EWS of society for 2000 candidates”. Starting in end of 2016, the project has

been completed successfully.

The program was aimed at providing job oriented skill development and training to the marginalized and economically weaker sections of the society across India. The training was provided to the beneficiaries in various CIDC centres across India.

Out of the 2048 candidates all candidates have successfully completed their training and are gainfully employed, 1005 have availed direct employment with leading construction companies across India and 98 have

opted for self-employment or chosen other avenues.

The training centres were located in Ranchi, Gopalpur, Odisha, Rairangpur, Daltonganj, Dumka, Chaibasa, Ghaziabad, Dhaulana, Amethi, Faridabad, Gorakhpur, Bharatpur, Sidhauli, Rewsa, Chapaguri, Agartala, Bheemli, Ongole, Vizianagaram, Dilsukhnagar, Srikakulam leading to successful delivery of training courses resulting in increased creation of employment opportunities for marginalized sections and meeting of skilling India goals.

To facilitate job opportunities for self- employed and those who would wish to opt for direct employment at a later stage, CIDC is also working closely with project organizations to include the compulsory clause on deployment of Tested & Certified construction workers on their sites. While CPWD, MES, many state PWDs, have already incorporated such a clause, there is growing awareness amongst private entities to adopt this best practice.

The trainees who have completed their training while thanking Airports Authority of India for the support and resource based sponsorship for various construction trades also underlined the importance of the training in shaping their careers.

The AAI project and other similar initiatives are a step in the direction of providing gainful employment to the weaker sections of the society and helping generate livelihoods and helping provide a boost to rural economies.

Based on the success of the program, AAI has decided to replicate the model once again for 2000 more candidates in 2018-19. The training for the new batched has started and as on date 306 candidates have been enrolled in various construction trades at different CIDC centres.

CIDC – Activities: Project update – CSR Training sponsored by Oil and Natural Gas Corporation

Limited: Training for 458 candidates has been successfully completed under the project “Onsite Training, Testing and Certification of Construction Workers” at various construction site in Jharkhand.

The overall beneficiaries of this exercise were 458 workers from Dhurwa, Dumka, Chaibasa, Bokaro, Hazaribagh (Jharkhand) regions. Besides trade knowledge, emphasis was laid on Health, Safety and Environment issues and workers were sensitized on these aspects. The complete support and cooperation from ONGC Head office and Jharkhand teams was commendable and allowed team CIDC to complete the project in time. Testing and Certification of onsite construction workers is a welcome move which translates

into increased employability for construction workers, value added employment generation, and deployment of a skilled workforce leading to enhancement of quality, safety and productivity on various construction projects.

The certificate at some of the campsite were distributed to the beneficiaries by ONGC team.

Vishwakarma Tritiya (VKT) Dhaulana:

Director (VT) Shri Rajeev Jain addressed the new trainees during the training orientation program on 08th April 201., He told the trainee this programe is sponsored by Airport Authority of India under its CSR initiatives, and Construction Industry Development Council (CIDC) is a training providing agency. CIDC take up and promotes activities for the development of the construction Industry. This project is aimed to provide employment opportunities through livelihood promotion in backward and remote areas as well as help the marginalized section gain meaningful employment leading to their social and economic upliftment. He advised and motivated the trainees to do their theory and practical class daily so that they can achieve their goal in a very short span of time. He also advised regarding the importance of time and never give up creative activities in your life.

District Employment officer Mrs. Vandana Singh and her team visited VKT Dhaulana (Hapur), on 25th April 2018. Her team was welcomed by our Center In charge Shri Gyan Prakash Sharma and VKT Staff members. She formally inaugurated CIDC VKT Training program sponsored by Airport Authority of India.

CIDC – Activities: Mrs Vandana Singh addressed students about the benefits of skills in life ,how the skills are helpful in getting more employement oppurtunity .

She visited practical yard of general works supervisor,trainer of general works supervisor told her about different kind of bonds.

Gorakhpur Training Centre Organizing Rojgaar Mela: Job Fair organized by Construction Industry Development Council, Gorakhpur in employment exchange office, Basti, Uttar Pradesh on 27th April, 2018. The aim of organizing job fair was to educate and give awareness the un-employed youth about CIDC training and placement to Increase the outreach/accessibility and to provide employment services directly to the unemployed youth. Handbill having the details of training and placement was also distributed by CIDC staff. Shri Nanak Chand, Training Officer and Shri Sabhajeet Dubey, Trainer, CIDC leaded the program and made one to one interaction to all employment seeking students and informed them about CIDC skill development training and job availability in the construction industry. Around 100 participants participated in this job fair and 49 got registered.

Sarv Shiksha Abhiyaan in Gorakhpur:

To create educational awareness and to inform the society about the Right to free and Compulsory Education,

Educational Awareness Program was organized by CIDC, Gorakhpur with Primary school, Harsewakpur,

Gorakhpur on 18th April, 2018 under Sarva Shiksha Abhiyan. The rally was flagged off by Ms Alpana Pandey,

Head Master, Harsewakpur, Gorakhpur. The rally having hundreds of primary school students, teachers and

CIDC trainees and staffs covered nearly six kilometer area across homes of utmost poor and deprived class.

During rally, primary students and trainees of CIDC raised slogan on educational awareness. Students were

quite enthusiastic about the entire event and the entire group toured the village with placards in hands to

spread awareness regarding the benefits of education for everyone

.
