Jeremy & Susan Mapp are retiring from farming and are relinquishing the tenancy with their family having been the longest serving tenants on Apley Estate to date. Having previously farmed Charolais cattle and run a flock of quality breeding ewes at Catstree House Farm, they have concentrated on their arable enterprise in recent years. Nock Deighton Agricultural LLP are delighted to be instructed to conduct their sale on farm and any prospective purchasers must note the first class condition of all the machinery and equipment. The three John Deere tractors are particularly worthy of mention and are some of the best tractors we have offered for sale for many years.

Viewing
Viewing will be strictly on the morning of the sale or by prior arrangement with the auctioneers.
Buyers Registration
Purchasers previously unknown to Nock Deighton Agricultural LLP must register at the sales office prior to commencement of the sale.
Payment
Strictly on the sale day prior to removal of any items. Those wishing to pay by cheque who are unknown to the auctioneers will be asked not to remove purchases until cheques have cleared. Cash is acceptable.
VAT
VAT will be charged at 20% where applicable.

GENERAL CONDITIONS OF SALE
1. These conditions together with those set out in the foreword appearing in this catalogue are the only Terms and Conditions to which Messrs Nock Deighton Agricultural LLP (The Auctioneers) as Agents for the Vendor will sell goods to the Purchaser (The Bidder) and all other conditions whether expressed or implied at common Law or by Statues as are capable of lawful exclusions are hereby excluded.
2. The Auctioneers may at their discretion or upon the instructions of the Vendor;
a) Alter or withdraw all or any lots referred to in this catalogue up to the moment at which the hammer falls in relation to such lot(s). Any lot in the sale marked with a lot number followed by an ‘X’ denotes that the description of that particular lot is different from the original catalogues. As such the addition of an ‘X‘ will cancel the original entry within the catalogue and any description will be absolutely as given out the Auctioneer at the time of the sale.
b) Where a reserve has been placed on any lot, withdraw that lot in the event that the highest bid does not meet the reserve. c) Where two or more consecutive lots are similar in quality and description offer the second and subsequent lot(s) (or any such lot) to
the Bidder purchasing the first lot at the same price. d) The Auctioneers may accept written or verbal instructions from any person unable to attend the sale, but any instructions accepted
shall be the sole risk of the prospective purchaser who will be deemed to have inspected the lot(s). The Auctioneers accept no responsibility in connection with the commissioning of their staff to bid on the lot(s) or for the failure of any telecommunications relating to the bids made.
3. Each lot shall be sold to the highest Bidder and in the event of any dispute arising between the Bidders, such dispute shall be resolved in such a manner as the Auctioneers may in their absolute discretion determine.
4. Bidding shall be regulated by the Auctioneers in such a manner as they see fit and they may without giving reason refuse to accept the bidding of any person.
5. The Bidder is on risk once the hammer falls and is strongly advised to effect insurance at once upon the fall of the hammer the Bidder shall assume all risks in and relating to such lots. The Bidder is advised to effect in respect of all such risks arising thereafter any insurance he may consider necessary. The duty of the Auctioneers and/or the Vendor to deliver lots shall be deemed performed upon the fall of the hammer or even if a lot (or part thereof) is subsequently lost.
6. The Auctioneers have used their best endeavours to ensure that the descriptions of each lot appearing in the catalogue are accurate but the bidder relies on such descriptions at his own risk. The bidder is advised to inspect any lots for which he intends to bid to verify the accuracy of the description contained in the catalogue. No lots in this catalogue are sold as new and likewise no lots in this catalogue are sold with any warranty whatsoever. No person in the employment of the Auctioneers has any authority to make or give any representation of warranty whatever in relation to any lot. The auctioneers on his own behalf and on behalf of the vendor, hereby excludes all liabilities for any loss or damage or injury sustained by the Bidder, as a result or in connection with a defect in any lot purchased, a miss-‐description thereof comprised in the catalogue, the failure thereof to fulfill the functions of which they were intended by the Bidder or any damage or loss occasioned thereof prior to the same being removed from the Vendor’s premises but after the passing of risk therein pursuant to Clause 6 hereof.
7. The Auctioneers do not warrant the Vendor’s title to any lot and the latter will be sold with such title as the Vendor has. The Vendor
warrants that either all the items sold are not subject to any form of Hire Purchase or Lease or that the has obtained written permission to sell such items and in the event of such permission not being obtained he will return to the Purchaser the bid Price in full.
8. The Price at which the Bidder purchases each lot will be exclusive of VAT. Where a bidder intends any lot to be exported outside the united kingdom a refund of VAT (subject to whatever regulations made from time to time may be in force) will be available upon the production by the bidder of such proof of the intending export as the Auctioneers may require.
9. No person shall advance a sum less than shall be named by the Auctioneers and no bids shall be retracted. No lot shall be removed until paid for, or without a written pass issued by the Auctioneers. No person shall be allowed to retract his bidding but shall give the Auctioneers either at the sale office or at the fall of the hammer his full name, address and telephone number.
10. If any Purchasers shall fail to comply with the above Conditions of and Foreword appearing in this catalogue, the lots shall be resold at the Auctioneers discretion and the deficiency (including any associated additional costs, if any) made good by the defaulter and be recoverable as and for liquidated damages.
11. The Auctioneers shall not be liable for any expense, loss, claim or proceedings in respect of any loss or damage whatsoever to any property real or personnel (including any lots) whether incurred before, during or after the sale. Nor shall the Auctioneers be liable for any expense, loss, claim or proceedings in respect of any personnel injury to or death of any person arising out of or in the course of or caused by the sale. All persons attend the sale entirely at their own risk.
12. HEALTH AND SAFETY AT WORK ETC. ACT 1974. It is expressly brought to the Bidders attention that, at the time of the sale, any item of plant, machinery or equipment contained with the lot(s) may not necessarily comply with the Health and Safety etc Act 1974 or any other Acts or Regulations thereunder governing the use of that plant, machinery or equipment in a working environment and the successful purchasers hereby agree to ensure that the use of such plant, machinery and equipment does not contravene such Act or Regulation thereunder applicable thereto.
13. ALL ROAD TRAFFIC ACTS. Purchasers are reminded that some vehicles or trailers sold at this sale may not be immediately roadworthy, or may be of such a design as will not without alterations, comply with the provisions of the Acts or Regulations issued thereunder. It is an offence to use on a road a vehicle or trailer, which does not comply with these provisions and purchasers, accordingly shall undertake to comply with the Acts and Regulations relating to such vehicles or vehicle or trailer.
