25. TheUKlegislativeprovisionsforherbalmedicinesaretobefoundintheMedicinesAct1968,Section12,paragraphs1&2,andSection56,paragraphs1&2.Traditionalmedicinescontainingnon-herbalingredientsarenotyetincludedintheseprovisions.

26. Section12(1)specifiesexemptionforherbalmedicinesfromlicensingprovidedthattheyaresuppliedsubsequenttoprivatepersonalconsultation.Section12(2)exemptsherbalmedicinesprovidedthattheyareproducedaccordingtostandardtraditional,non-industrial

methods.Italsospecifiesthatnowrittenclaimsmaybemadefortheuseoftheremedy.27. Section 56 reiterates and expandsupon theprovisions of 12(1). In addition, Statutory Instrument 21301977 lists several herbs "in

respectofwhichtheexemptionsconferredbysection56(2)donothaveeffect".Thisremovedtheherbssoidentifiedfromgeneralsaleand specified that they may only be prescribed on consultation, or supplied under the supervision of a pharmacist. This list alsospecifiesmaximumpermitteddosesanddailydosesforthoseherbs.

28. Theobviousshortcomingsoftheseprovisionsarethecurrentexclusionofnon-herbalingredientsandthatthereisnodefinitionofwhoorwhatapractitioneris.TheimminentrevisionofSection12(1),alongsidethestatutoryregulationoftheCAMprofessions,isexpectedtoredresstheseshortcomings.
