Pete Furuseth, City Attorney presented the following: Hawkeye has requested the City execute a subordination agreement, in order to obtain financing. The City is in first position with the performance lien and this agreement would put us in second position. Mayor Klug asked about the outstanding property taxes. Pete Furuseth answered this would have to be stipulated, to be paid through the financing.

Commissioner Cymbaluk expressed his concerns that these individuals have not paid their taxes on other properties they own and why would the City allow a subordination agreement. John Sessions addressed the Commission by stating the last few years have been difficult for Hawkeye Village; however, we have provided City Attorney Jordon Evert assurances that the first draw from the loan will go almost entirely to pay the property taxes, approximately $450,000. The development agreement attached to this land was intended to ensure the developers would instruct the improvements necessary for the various land uses, in this case, single-family housing. We intend on building streets and all the infrastructure. We have currently $250,000 invested in Bison Drive and the backbone infrastructure for Hawkeye Village to include the residential area and we are asking for your cooperation. We are ready to begin, as we have building permits and approved engineering on lot construction. Commissioner Cymbaluk stated he appreciates the effort, however, the city should not have issued building permits on a property that has back taxes owing and when you purchased this you took on the risk as a developer, so why should the City agree to be moved into second position. History shows you have not paid your real estate taxes, why should we believe this will change, moving forward. John Sessions answered the assurance you have is we have agreed to use the first draw on the loan to pay the back taxes and it is your choice to make, but if you want people you know building houses in Williston this is the way you can help. Commissioner Cymbaluk made a motion to deny the request as presented. Mayor Klug asked if there was support for this motion, hearing none, this motion is dead. Commissioner Bekkedahl indicated there was a meeting recently of the Housing Commission, as housing is a huge issue in the community now. I understand the comments about the history, however, this is one of the few developers that continue to come to Williston and attempt to make something happen in our private sector, even with their ups and downs. This is another area that we can have outside capital come into our community and assist with the housing issue. As far as the subordination goes, this is a small price to pay, as other builders are not stepping up to do anything. Commissioner Piesik stated this is an area she visits daily, they are currently working, they are doing something, and this is a nice area and feels this is a good idea and feels like we need to support this. John Sessions wanted to clarify that the Subordination Agreement needs to be recorded then the draw will be distributed, then the property taxes will be paid.

1) 2019 Annual Report David Peterson Chief of Police presented the following: Chief Peterson presented a summary of the report, that was provided in the Commission packet. Commissioner Bekkedahl asked if there was any category that Chief Peterson wanted to point out. Chief Peterson pointed out the number of drug arrests are up from last year, this is a positive trend. Commissioner Bekkedahl asked about the level of cooperation from other entries. Chief Peterson answered these partnerships need to be fostered and we continue to build those relationships and they are strong.

Mayor Klug wanted to point out on page 18, Crime Prevention and asked Chief Peterson to explain a few of these programs and what the Department is doing for Crime Prevention. Chief Peterson stated the D.A.R.E. program is one taken very seriously, by getting into the schools at that level and being proactive. Chief Peterson named a few others, along with some additional details. Commissioner Piesik stated she feels it is a really great thing, when you see children waiving at Police Officers, rather than thinking they are the bad guys and the general feeling this community seems to have toward the Police is nice to see and feels the Police Department has done a good job making the community feel safe and it is appreciated. Commissioner Bekkedahl agreed and thanked Chief Peterson. H. Development Services Mark Schneider, Director of Development Services presented the following:

1) City Hall 1st Floor Renovation Change Order 001 FCI has submitted a change order for five items that were unforeseen during the City Hall renovation project. The items are all existing conditions and need to be repaired or added because of the existing building condition. The total amount for the change order is $40,813. The original contingency amount was $53,397. Through various savings FCI has found, the total contingency fund has been increased to $95,741. Currently, $51,887 of the contingency fund has been used with approved changes and roughly $29,560 of additional charges coming forward, leaving a balance of $14,294 left in the contingency fund. This change order would give FCI an additional cushion of the change order amount, so we are not awaiting City Commission approval before proceeding on future items, therefore allowing FCI to complete the project on schedule early July 2020. If FCI does not use the remaining contingency, these dollars come back to the City at the end of the project. We recommend approval of this change order. Commissioner Bekkedahl asked for confirmation this money in the contingency fund will be refunded to the City if not used. Mark Schneider answered yes. 2) Final Plat, Williston Square Subdivision Phase 1a Kent Jarcik City Planner presented the following: This application is for the Williston Square Subdivision Phase 1a final plat including 34.76 acres. The preliminary plat, C-2: (WS) General Commercial Overlay Zone, and Williston Square Design Guidelines were approved by the City Commission at their February 25th, 2020 regular meeting. The final plat was reviewed by the Planning and Zoning Commission on March 2nd, 2020 and recommended for approval. Final plat: The environmental avoidance areas were removed with the preliminary plat based on direction from the FAA for the preference of deed restrictions or other instruments be used. The FAA is now reconsidering their previous direction and is directing going back to showing environmental avoidance areas on the plat. The environmental avoidance areas will be added prior to recordation. As was presented with the preliminary plat, the phase 1a plat will be merged with the overall Williston Square plat and will be recorded as one plat instead of two separate plats. A resolution #20-025, prepared by the City Attorney’s office to authorize this action is attached. Some final redline items will need to be corrected prior to recording. The Planning and Zoning Commission recommends approval. Commissioner Brostuen asked if the environmental avoidance areas will ever be able to be removed from the plat. Anthony Dudas, Airport Director, answered that they will not be able to be removed, as they are undevelopable areas. Mayor Klug asked how large these areas are. Kent Jarcik answered he does not know exactly and someone from the audience commented approximately five acres total. Dave Tuan, City Administrator indicated they are all north of the golf course. Shawn Wenko Executive Director of Economic Development presented the following: Brock Romine resigned from the STAR Fund board. This left an open board seat. The STAR Fund Board voted to have James Bervig with 1st International Bank and Trust fill the vacant seat. Motion by Bekkedahl, Seconded by Piesik to make a motion to approve the STAR Fund Board Nomination of James Bervig as presented AYE: Brostuen, Bekkedahl, Piesik, Cymbaluk and Klug
