II Ukrainian Grain Congress: everything is in our hands!
In the beginning of October 2010 there was held the fi rst Ukrainian Grain Congress, and the task of organizers was to defi ne the basic long-term tendencies of development of the world and Ukrainian grain market. The year passed, during the time the Ukrainian grain market faced the fundamental changes, and it was time to talk about them in October 2011.
Recently the grain market of Ukraine is associated with two main subjects: slowdown of the rates of exports and moratorium cancellation for agricultural land selling. Due to the fact, Ukraine is strategically important supplier of agricultural commodities with good potential of grain production, not only Ukrainian market operators watch the development of situation, but also the world public, which is no wonder, due to the estimation of a lot of specialists, Ukraine is the strategically important supplier of agricultural commodities with really great potential of grain production.
It is natural that problems with grain exports infl uence not only at the business activity of traders, but also do not allow creating of the active trading within the territory of the country. Thus, agrarians harvested one of the record grain crops, but Ukraine does not have any possibility to use the export potential in full.
While talking about the land market it is necessary to confess that there are more questions in the stated sphere than answers, and meanwhile the market participants try to understand how the game rules change with the beginning of work of the land market.
However the Ukrainian market has one feature – to work despite the problems. Representatives of the Ukrainian enterprises stated that meanwhile they solved the certain problems, other replace them. It is reasonably to state that working in the present realities you should always think about the future.
In order to resume all above stated, the Ukrainian Grain Association and APK-Inform Agency decided to organize and held the II Ukrainian Grain Congress which was held in Kiev on October 17-18, 2011. It is necessary to note that despite the diffi cult situation on the market, nearly 200 delegates from 125 companies participated in the event.
The sponsorship assistance was provided by the companies: Hermes Trading and UkrAgroCom, Gavilon, Louis Dreyfus Ukraine Ltd, Alfred S.Toepfer, Nouble Grop, Souffl e Group. Bunge was the sponsor of the session “Mechanisms of the fi nancing of agrarian production. World experience and Ukrainian fundamentals”. Astarta Kiev provided the fi nancial support for the
roundtable holding devoted to “Mechanisms for the eff ective interaction between government and private business in the grain market”. The organizers express the essential thanks to the Heads of the stated enterprises, who in rather diffi cult market conditions found time and funds to provide the event with the support. It is imperatively to understand that the stated Congress is not the only project in order to observe formalities, but the sponsorship support of the leading Ukrainian and world companies allows the organizers not to consider their work was useless.
Besides, the organizers would like to express the certain thanks to the FAO, EBRD, Agroinvest Project, Ukrainian Agrarian Confederation, the American Chamber of Commerce and Industry, and American-Ukrainian Business Council for providing the support in holding of the event, and also for the interest of the profi led organizations in the Ukrainian market development, even despite rather strange vectors of its development. While analyzing news line of the Ukrainian information area, it is diffi cult not to note that sometimes the international organizations can reach the offi cials, who defi ne the legislative and juridical grain market development, faster than those who work on such market. However it is nice that representatives of such

organizations defi ne the purpose for themselves not only to carry the personal opinion to the Government of the country, but make the Government to listen to the Ukrainian businessmen.
It is necessary to note that the conference work was devoted for 3 sessions, where the participants discussed the world market development, Ukrainian land market and mechanisms of fi nancing of the agrarian production in Ukraine and in the world. Also with the Congress work (October 18) there was the roundtable of the Ministry of Agrarian Policy and Food of Ukraine and the European Bank for Reconstruction and Development “Mechanisms for the eff ective interaction between government and private business in the grain market”. We will consider in details the key opinions which were stated within the conference work.
Era of expensive food, the potential of Black Sea grains and sharpening of the competition
According to Eugenia Serova, Senior Advisor of the FAO International Investment Center, the current period is possible to describe as transitional from the era of cheap food to the expensive one. According to the expert, the prices increase is not the feature of the current period of time, but long-term trend which is forecasted by the world specialists.
The major features of the stated period are the limited number of land and water resources, which slows down the market development. Also the expert noted that in the short-future we should not expect the agricultural crops yield increase. According to her, world production has come to the lowest point of crop yield. However the climatic conditions changing can impact on the process for the range of the countries. Thus, the average temperatures increase for the countries like Ukraine and Russia may positively aff ect the agricultural crops production.
At the same time, the food prices increase is able to activate the investment attraction the the industry of agriculture.
Meanwhile, in the conditions of the prices increase the essential attention is paid to the price and quality ratio. The bright example of the dynamic entering the world market is possible to consider the beginning of the season in Russia, when after the long-term embargo for the grain exports the traders started to supply grain at the low prices.
This was confi rmed by one of the leading experts of the Russian market. Andrei Sizov, Executive Director of the Analytical Center SovEcon, noted that the current season in Russia started with the records export of the grain. But he forecasted that it is necessary to expect the season exports decrease in November. In total Russian grain exports may total 22-23 mln tonnes in the current season.
A.Sizov also underlined that competition in the Black Sea region strongly increases. In particular Kazakhstan is going to export 10 mln tonnes of grains. The expert noted that competition sharpening may cause further prices decrease.
Alexei Gavrilov, President of the Grain and Feed Trade Association (GAFTA),
also stated about increase of the impact of the Black Sea region grains on the world market.
According to him, the major sales markets of the grain are the countries of the North Africa and Middle East. At the same time while talking on the middle-term forecasts, A.Gavrilov noted that the countries of the Black Sea region will produce more grain, than the countries of Africa and Middle East consume annually. That is why it is already necessary to look for new sales markets, in particular about Asia, which may become the potential sales market.

Anastasia Ivasenko, Analyst of APK-Inform Agency noted that the forecasted volume of general grain production in combination with carry-over stocks, estimated at the level of 4.5 mln tonnes provides general grain supply in 2011/12 MY at the level of 55.9 mln tonnes. According to A.Ivasenko such supply volume provides grain domestic demand and the export potential realization. According to analyst, in 2011/12 MY Ukraine is able to supply on the world markets 24.5 mln tonnes of grain, twice more than the export forecast for the previous season and is a record for Ukraine.
While discussing the current problems of the market, a lot of market participants stated good level of grain crop in Ukraine. However a lot of them were worried due to the duties on grain exports, which were imposed in order to fulfi ll the budget of the country.
When and what the land market of Ukraine to be?
Activation of the land market work for Ukraine is the certain uncertainty. It is stated that the moratorium on the agricultural lands selling will be canceled till the end of 2011, but it is still non clear what norms of work under the new conditions will be accepted. It is necessary to note that within the congress work, Sergei Tereschyuk, Deputy Chairman of the Committee of the Verkhovna Rada of Ukraine on the issues of agrarian policy and land relations, stated that the Law on introduction of land market in Ukraine can be signed by the end of the current year. At the same time he added that the Draft Law needs to be improved. The certain corrections may be introduced during consideration of the Law.
Thus, the committee of Verkhovna Rada of Ukraine will insist that the owners of land can be only physical persons, who will use land only for agricultural production. Also, according to him they discuss the issue on the maximum land area, which one person may own. S.Tereschyuk stated that they consider the issue on the cancellation of the decision on the priority right of land purchasing by the state. According to him, fi rst of all it is necessary to cancel moratorium for land selling, and only then to introduce land market.
Besides, it is necessary to take into account the market structure, which was formed in Ukraine. In particular, it is necessary to work out new legislative for agricultural holdings.
At the same time, Tamara Sulukhia, Coordinator of sustainable development in Ukraine, Belarus and Moldova, of the World Bank, who participated in the Congress stated that it is too early to cancel the moratorium due to a lot of unsolved problems existing in the sphere. In particular, the cadastral system is not ready yet and its work is imperfect. By the way, the expert noted that the owner of the private lands in Ukraine are barely informed on the principles of work of the registration systems. According to T. Sulukhia the stated situation can cause the potential profi t defi ciency.
Besides, the initiative of the Government restricting land selling to the foreign citizens may cause the negative impact on the investment attractiveness of
agriculture of the country.It is also worth to note that the expectations of the market participants
were various. A lot of Ukrainian specialists stated that own land areas can be a bank pledge for attraction of granting of a credit.
Meanwhile, Leonid Kozachenko, President of the Ukrainian Agrarian Confederation noted that if the Law on the free market of land comes into force, developing companies forecast increase of capitalization of large-scale holding companies by 1.5 times.

At the same time, Andrei Sizov making the example of functioning of the land market in the Russian Federation, noted that land is not liquid pledge due to its dynamics and tendencies of its development are still unclear for investors despite the presence of free market of land in the Russian Federation.
Within frames of the discussion Eugenia Serova stated the opinion that moratorium cancellation on the selling of land will cause the serious risks by creating the essential administrative barriers.
Brazilian experience: all in hands of market participants
We should also say a few words about the discussion on the mechanisms for attracting investments to the agricultural production within frames of the third session of the Congress. Participants of the discussion paid special attention to the Brazilian system of fi nancing of grain production. Marcelo Fernandes Guimaraes, Economic Analysis Department Coordinator of the Ministry of Agriculture and Food of the Federative Republic of Brazil, focused attention that the country managed to achieve rather tremendous progress in attracting investments in agriculture. In particular, the expert noted that private business coped with the problem of fi nancing by over 70%. M.Guimaraes marked that agrarians in Brazil actively use grain certifi cates of pledge, which allows to agricultural producers to attract funds precisely at the time, when they are really needed. The expert also noted that the problems and realities of the Ukrainian market (except of the moratorium on selling of agricultural lands) are quite familiar to the Brazilian market, though they were relevant 20 years ago...
Roundtable discussion: investment attractiveness of Ukraine, results of the constructive dialogue, and what the Ukrainian authorities have to hear
Opinions of market participantsEnd of 2010/11 MY and beginning of 2011/12 MY became really very diffi cult for Ukrainian agricultural companies. In
particular, the main problems were caused by the regulatory policy of the Government, which replaced the export quotas on grains with export duties. According to announcements of the offi cials, fi rst of all these measures were designed to supplement the state budget. Not only traders, but also representatives of all segments of the grain market, felt the eff ects of such actions of the Government. The roundtable discussion was the excellent opportunity to hear fi rst hand about the problems that such regulatory policy brought to the market participants.
It should be noted that speeches of all representatives of agricultural business concentrated on the need for creation of clear and consistent legislative base, and registration of long-term consequences for making of government decisions and, of course, realization of the constant and fruitful dialogue with those who, in fact, work on the market from day to day.
Thus, Aleksiy Vadaturskiy, General Director of the company NIBULON, in his speech noted that there are some companies in Ukraine, to which public authorities have the increased level of interest. In particular, he noted that the state quality inspections exceed own authority rights and often require a complete set of documents on grain qualitative indicators from agricultural companies, when it is transported, which includes even those documents that are not required for realizing of grain export operations.
According to A.Vadaturskiy, the separate problem is that the attention of the Ministry of Agrarian Policy and Food is not intended to controlling of imports of seeds, but when exporting grains, buyers are interested in the certifi cate of the presence of GMOs in the products. At the same time, the expert said that nearly 13 laboratories in Ukraine give such certifi cate. A.Vadaturskiy noted that a number of companies have problems with obtaining and keeping of the certifi cate of conformity for elevators. Also, the General Director of NIBULON focused attention on pressure from the tax authorities to identify the legality of realized transactions.
The specialist stressed that in the existing realities grain exporters are very dependent on the regulatory authorities. And

fruitful dialogue of the business with the Government positively aff ects at work of the market. A.Vadaturskiy called normalizing of the situation around export supplies of Ukrainian wheat with high content of corn bug as an example.
Irina Prysyazhnyuk, General Director of “Alfred C. Toepfer International (Ukraine)”, also agreed that the dialogue between business and the Government should exist. The specialist pointed out that export companies experienced diffi culties after imposition of the export quotas by the Government, they also had to learn to survive in the terms of new Tax Codex and imposition of the export duties. Also, I.Prysyazhnyuk emphasized that she does not have confi dence in the fact that in 2012 the legislative base will remain unchanged. In particular, the Congress participants started discussing the VAT refund. In the opinion of I.Prysyazhnyuk, the VAT is a very important factor in work of traders, so it is very important to have certainty in the issue. All these factors complicated work of traders. I.Prysyazhnyuk noted that in order to ensure the normal functioning of the market, the regulatory base may not be ideal, but in any case it should be predictable, transparent and stable.
Viktor Ivanchyk, General Director of Astarta-Kiev, continued the theme of problems in the industry, and noted that except of the already mentioned problems, in fact, the complete absence of active export supplied already led to the situation that Ukrainian rail stock is actively used by Russian companies. According to him, rail stock is eluted from transportation arteries of the country, without which even the domestic market will have hard work, the expert commented on the situation prevailing on the domestic market after imposition of the export duties. V.Ivanchyk also noted that the government support in terms of development of foreign export routes, signing of international contracts and agreements with the FAO of the UN for solving of the world hunger problem, is quite essential for the market. The support is signifi cantly important in the terms of the present forecast of substantial increase of grain production. That is why, in the opinion of the expert, it is very important to date to systematically increase the export volumes, develop new selling markets, in order to be able to export nearly 50 mln tonnes of grains in 10-year period.
V.Ivanchyk also noted that it is very important to increase investments in grain production. At the same time, he noted that Ukrainian companies (both large-scale and not very) have diffi culties obtaining the necessary fi nancing in Ukrainian banks only. That is why, according to the businessman, it is very important to improve the investment climate in cooperation with international organizations such as the European Bank for Reconstruction and Development and the World Bank.

Opinions of experts
We should say that the opinion concerning the necessity for constructive dialogue between the business and the Government was supported by representatives of international organizations. The experts also agreed that the government regulation should be minimized, in order to allow to the grain market of Ukraine to develop in the terms of productive competition.
In particular, Gilles Mettetal, Director for Agribusiness of the European Bank for Reconstruction and Development, in his speech said when problems of the market are clear to the Government, market participants can avoid serious diffi culties. The expert noted that the adequate actions of the Government prevented signifi cant worsening of the investment climate of the country, when the authorities cancelled quotas on grain exports, and the monopoly in the market segment was abolished.
At the same time, according to J.Mettetal, there are several issues that should be solved in order to improve the market conditions for increasing of investment infl ows into the industry. In particular, the expert noted that it is important to accept the clear land legislation to ensure that land areas can be the pledge in attracting of additional funding.
Within frames of the discussion, Jorge Zukoski, President of the American Chamber of Commerce in Ukraine, expressed his view of how the dialogue
between business and the Government in the country develops. In his speech, the expert drew attention to the fact that despite rather diffi cult working conditions for the market in 2010/11 MY (action of the export quotas and duties), nevertheless the market faced positive trends. In particular, J.Zukoski noted about readiness of the Government of Ukrainian to cooperate with representatives of agricultural business and professional societies. The agreement about timely manner (in 2 months) of informing of the market participants about the planned closure of export trading, and refusal to establish any limitations for realizing of export supplies in the terms of operation of the free markets, was called as one of such achievements. Also, the expert paid special attention to the schemes of subsiding of the industry. In particular, he noted that in the world practice the mechanism of VAT refund is not used as fi nancial support for the industry. Thus, he expressed the opinion that it would be better to remove the VAT from the whole marketing chain, replacing it with direct subsidies.
Vladimir Klimenko, President of the Ukrainian Grain Association, also harshly criticized policy of the Government. He noted that the Government did not even conceal the true purpose of imposition of the duties and cancellation of the VAT refund - the need for replenishment of the state budget. At the same time, these measures were not imposed in other manufacturing industries. According to V.Klimenko, the complete absence of the agricultural lobby became the main reason for the situation development. At the same time, such actions of the Government aff ected not only activities of traders, but also agricultural producers. The specialist also stressed that the Government began considering the views of market participants only after beginning of the protest actions nearby the Parliament.

Dmitry Prikhodko, Economist of the Investment Centre of FAO, named a number of issues, which are needed to be solved for more transparent work of the market, in addition to the global needs of the grain market. Thus, the expert noted that Ukraine should focus on defining of the clear requirements for food safety. In particular, in addition to the physical availability of grains in the country, it is necessary to ensure availability of grain products to the population. Also, in order to receive more detailed forecasts and planning of the further work, it is necessary to create the united forecast balance sheet, which will serve as the base for the market.
Sergei Kvasha, Director of the Department of agrarian market development of the Ministry of Agrarian Policy and Food of Ukraine, made public the position of the Ministry, and noted that the problems faced by the market in the current season, became the define challenge for the Ministry. Together with market participants, the organization took steps for filling the revenue side of the budget of the country beginning from intervention of the Government in the process of export trading (quotas) to imposition of the export duties. S.Kvasha noted that these problems are quite understandable, but the consequences of such state policy to be felt through all market segments. Also, the representative of the Ministry of Agrarian Policy noted that the strategic objective for the department is to create the specialized body which would take into account social, economic and political needs. S.Kvasha also marked the importance of creating of the required conditions for business development, availability of food commodities on the market and provision of
the quality. The Government representative also noted that the grain market in Ukraine is not enough attractive for investments, due to rather volatile grain harvest volumes in the country.
In conclusion, it should be noted that within frames of the discussion of problems of the industry representatives of the companies and specialized organizations, as a rule, completed own speeches by expressing the hope that the situation will change, and they will get the opportunity to fully engage in the business rather than deal with the problems created by the Government.
Moreover, there are certain prerequisites for such optimistic expectations. In particular, on October 10, 2011, the Ministry of Agrarian Policy and Food of Ukraine and grain exporters signed the memorandum to ensure controlling over the critical volumes of grain exports in 2011/12 MY. The memorandum provides maintaining of the dialogue between agricultural business and the Government with regard to coordination of the required grain export volumes. The reached agreement on notifi cation about closure of export trading in two months before the entry into force of the limitations may be called as one of the key points of the document.
Summing up the conference results, we want to say separate “thank you” to all participants, who found the opportunity to come together to discuss the prospects of the industry in such diffi cult market conditions. In this regard, we would like to recall the words of Vladimir Klimenko, President of the Ukrainian Grain Association, that only dialogue can break the deadlock of problem solving, only consolidated statements can reach out to the government offi cials and convey to them the opinion of participants of one of the leading manufacturing segments of the Ukrainian economy. Moreover, while discussing and solving the current problems at such meetings, market participants have the unique opportunity to determine the prospects for further development of the grain market.
It is diffi cult to judge whether there are matches in the life, or anything that happens - logically and consistently, but the very next day after the Congress ending, Viktor Yanukovych, President of Ukraine, signed the law canceling the export duties on wheat and maize, which was such important for the market of grains. Perhaps it is true that the problem solution begins with its understanding and discussion...
