OFFICE ORDERWHEREAS Mr Sayed Ansar Ali, S/o Sayed Mansur Ali, At/P.O-Brahmabarada, P.S-Dharmasala, District-Jajpur, Driver, Commissionerate of CT & GST (Odisha); At-Cuttack erstwhile O/o the Commissioner of Commercial Taxes (Odisha), Cuttack was absent from duty with eff ect from 25.02.2008 without any prior intimation or permission of the competent Authority.AND WHEREAS, draft charges were framed against Mr.Ali vide this offi ce Memorandum no: 13649/CT, Date: 30.08.2008 for unauthorized absent from Govt. Duty that amounted to negligence and dereliction of Government duty.AND WHEREAS, all opportunities as per the provision of OCS (CCA Rule, 1962) had been given to Mr.All by the Enquiring Offi cer to defend. But he did not avail any of the opportunities.AND WHEREAS, the Enquiry Offi cer in his report observed that “He is an absentee from Government duties for more than 5 years who had been remaining absent from Government duty since 25.02.2008. The law deems all absentees beyond 5 years as fi t case of removal from service subject to provisions of OCS (CCA Rule 1962)”.AND WHEREAS, Rule 72(2) of Odisha Service Code speaks that “ where a Government servant does not resume duty after remaining on leave for a continuous period of a fi ve years, or where a Government servant after the expiry of his leave remains absent from duty otherwise than on foreign service or on account of suspension, for any period which together with the period of the leave granted to him exceeds fi ve years, he shall unless Government in view of the exceptional circumstances of the case otherwise determine, be removed from service after following the procedure laid down in the Odisha Civil Services (Classifi cation, Control and Appeal) Rules, 1962.AND WHEREAS it was decided to impose punishment on Mr Ansar Ali in pursuant to Rule 72(2) of Odisha Service Code as per the Rule-15 of the OCS(CCA) Rules, 1962 Mr Ali was called upon vide this offi ce letter no : 14029/CT; date: 16.09.2017 to appear before the appointing authority on any state govt. working days within 15 days to show cause as to why major punishment shall not be awarded to him. But he did not appear-before the appointing authority.AND WHEREAS it was ascertained from the postal acknowledgement the said show cause notice had been received by some Sayena Parween on 19.09.2017 and since Mr Ali did not appear before the appointing authority, another chance was given to him to submit his explanation by appearing before the appointing authority on any state govt working days within 15 days to show cause as to why major punishment shall not be awarded to him vide this offi ce letter no; 7454/CT&GST; date: 16.05.2018. But he did not appear before the appointing authority. Since he is absconded the show cause notice was published in the leading Odia daily i.e Dharitri and Sambad on 03.01.2019. But Mr. Ali did not respond.AND WHEREAS Mr.Ali has failed to respond to the notice published in the above Odia dailies within the stipulated time frame, the following major penalty is hereby imposed on Mr. Sayed Ansar Ali, Driver of this offi ce U/r 13 of the OCS (CCA) rules, 1962 and Rule 72(2) of Odiaha Service Code.“Mr. Sayed Ansar Ali Is removed from the Government service which shall not be a disqualifi cation of future employment from the date of Issue of this order.This is issued wilh the approval of the Commissioner of CT&GST; Odisha.
