The forms also request the applicant to certify to various items on page 2 of the form. These certifications as well as theunderlying data is your responsibility to review for correctness as you are responsible for the data being submitted to yourlender as outlined in the original engagement letter between you and DHG.
On December 27, 2020, the Consolidated Appropriations Act ("CAA") was signed into law. This law now allows a PPP borrowerto be retroactively and prospectively eligible to potentially claim an Employee Retention Credit ("ERC") in addition to taking outa PPP loan simultaneously. However, any wages used for PPP forgiveness are ineligible to also be claimed for the ERC. We haveenclosed information that gives a high level overview of the ERC for the 2020 and 2021 eligible time periods. If you would like toengage DHG to perform computations/consultations relating to the ERC, please contact me and I will place you in contact with amember of our ERC team.
The following pages represent the output of our forgiveness model and will assist your business in completing either the SBAForgiveness Application Form 3508 or Form 3508EZ. Records Retention Requirement: The Borrower must retain all such documentation in its files for six years after the date the loan is forgiven or repaid in full, and permit authorized representatives of SBA, including representatives of its Office of Inspector General, to access such files upon request. The Borrower must provide documentation independently to a lender to satisfy relevant Federal, State, local or other statutory or regulatory requirements or in connection with an SBA loan review or audit
The selected time period must be the same time period selected for purposes of completing PPP Schedule A, line 11. Documents may include payroll tax filings reported, or that will be reported, to the IRS (typically, Form 941) and state quarterly business and individual employee wage reporting and unemployment insurance tax filings reported, or that will be reported, to the relevant state. Documents submitted may cover periods longer than the specific time period.
For categories a-c, documentation verifying existence of the obligations/services prior to February 15, 2020 and, for all categories, eligible payments from the Covered Period.
