1 Duty of care

Youmusttakeallreasonablestepstopreventorreducelossof,ordamageto,propertyinsuredbythispolicyandtomaintainthepropertyinagoodconditionandinagoodstateofrepair.

2 Other insurances

Atthetimeofanyloss,damageorliabilityresultinginaclaimunderthispolicy,ifyouhaveanyotherinsurancecoveringthesameloss,damageorliability,wewillonlyberesponsibleforourproportionoftheclaim.

3 More than one property

Ifthispolicyinsuresmorethanonepropertyasshownonyourschedule,thepolicylimitsandexclusionsapplyseparatelytoeachpropertyinthesamewayasifeachpropertyhadbeeninsuredbyaseparatepolicy.

4 Notifying us of a change

Pleasetellusassoonaspossibleifthereareanychangestotheinformationsetoutinthemostrecentscheduleissuedtoyou.Thisincludesanychangetothepersonstobeinsuredunderthepolicy,theaddressofthepropertytobeinsuredandtheamountsorlimitsyouritemsareinsuredfor.

5 Changes to premium

Ifyoumakeachangeinthepolicycoverandthisresultsinachargeorarefundofthepremiumfortheperioduptotherenewaldateofthepolicy,thensuchchargeorrefundwillonlybemadebyusifexceeding£50.Wedonotmakeanadministrationchargeforprocessingchangesyourequire.

6 Cancelling the policy

Ifyoudomakeaclaimorthereisanincidentwhichmaygiverisetoaclaimthenyoumustpaytheannualpremiuminfull.

2. Your right to cancel after the cooling-off period Ifyoudonotcancelthepolicywithinthe14-daycooling-offperiodmentionedabove,thepolicyisinforce

3. Our right to cancel

a. Non-paymentofpremium

i. Ifyoudonotpayyourpremiumbyinstalments Unlessotherwiseagreedwithus,wewillnotprovidecoverunderthispolicyunlessyoupaythe

premiumbythedateitisdue.Ifyoudonotpaythepremiumbythisdate,wewillsendnoticeoftheoutstandingpremiumtoyouandgiveyouafurtherperiodofatleast14daysfromthedateitbecamedueinwhichtopaytheoutstandingamount.Ifpaymentisstillnotreceivedinthetimescalewehaveadvisedthepolicyiscancelledfromtheoutset.

ii. Ifyoupayyourpremiumbyinstalments Unlessotherwiseagreedwithus,wewillnotprovidecoverunderthispolicyunlessyoupaythefirst

instalmentofpremiumwhenrequested.Ifthefirstinstalmentofpremiumisnotreceived,thepolicyiscancelledfromtheoutset.

Ifyoupaythefirstinstalmentofpremiumbutdefaultonanysubsequentinstalments,wemaycancelthepolicywitheffectfromthedatethefirstoutstandinginstalmentwasduebynotifyingyouinwriting.

Ifyourinstalmentplanisprovidedbyus,wewillsendnoticeofanyoutstandinginstalmenttoyouandadvisethedatewhenwewillre-presentourpaymentrequesttothebank.Thiswillnotbelessthan14daysfromthedateonwhichourpaymentrequestwasoriginallypresented.

Wewillnotcancelthepolicyforfailuretopaythepremiumoranyinstalmentofpremiumifsuchfailureisduetoerroronourpartoronthepartofyourbroker,bankorbuildingsociety.

b. Othercancellationrights

Inadditiontoourrightsunder:i. non-paymentofpremiumabove;andii. Generalcondition10Fraudulentclaims;andiii. Generalcondition13Sanctions;

wehavetherighttocancelyourpolicyatanytimebygivingyouatleast14days’noticeinwriting,sentbyspecialdeliverytoyourlastknownaddress,wherewehaveavalidreasonfordoingso.Ourcancellationletterwillsetoutthereasonwhywearecancellingyourpolicy.Validreasonsforcancellingyourpolicymayincludebutarenotlimitedto:

1. circumstanceswhichareoutsideourreasonablecontrol,forexample:a. wherethelawrequiresthatwecancelyourpolicy;b. wherethecontinuationofyourpolicywouldresultinusbreachinganyapplicablelawor

regulationthatappliestoyourpolicy.2. youreceivingacriminalconvictionwhichresultsinacustodialsentence.

Ifwecancelyourpolicyforavalidreasoninaccordancewithourrightsunderb.aboveandyoudonotpayyourpremiumbyinstalments,wewillrefundthepartofyourpremiumwhichrelatestotheperiodremainingunderyourpolicywhichhasbeencancelledbyus.

Ifyouhavemadeaclaimunderyourpolicy,wewillnotrefundanypartofyourpremiumandyouwillberequiredtopayusanyunpaidpremium.

7 Making a claim

1. Ifanyeventwhichmayresultinaclaimunderthispolicyoccurs,youmusttellusassoonasisreasonablypossibleandwithinsevendaysintheeventofriot.

Otheractiontotakethendependsonthetypeofclaim. Accidental loss outside the home, theft, vandalism, or malicious acts Tellthepoliceassoonasreasonablypossibleandobtainacrimereferencenumberfortheft,vandalismor

maliciousacts. Legal liability for injury or damage Immediatelysendusanywrit,summons,orotherlegaldocument. Youmustnotnegotiate,admitordenyanyclaimwithoutourwrittenpermission. Legal expenses TellDASLegalExpensesInsuranceCompanyLtdassoonaspossible. Travel Youmustplaceyourselfunderthecareandfollowtheadviceofaqualifiedmedicalpractitionerintheeventof

bodilyinjuryorsicknesswhichmaybethesubjectofaclaimunderthispolicy. Youmustgiveusreasonablenoticebeforetheintermentorcremationortheholdingofanyinquest,enquiryor

proceedingconcerningthedeathordisappearanceofaninsuredperson.2. a. Tohelpprogressyourclaimwemayrequireyoutoprovideoriginalpurchasereceipts,invoices,bankor

creditcardstatements,instructionbooklets,photographs,utilitybills,pre-purchasesurveysorplansanddeedsofyourproperty.Wemayalsorequireyourconsenttoobtaininformationaboutyourlossfromthepoliceorotherrelevantlawenforcementagency.

b. Tohelpassistindealingwithyourclaimwemayrequireyoutoobtainestimatesforthereplacementorrepairofdamagedproperty.

Wewillonlyaskforinformationrelevanttoyourclaimandwewillpayforanyreasonableexpensesyouincurinprovidinguswiththeaboveinformationaspartofyourclaim.c. Followingnotificationofyourclaimanypropertydamagedbeyondrepairmustberetainedforatleast30

days(oranyotherperiodweagree)andbemadeavailableforourinspection.

8 Rights and responsibilities

Wemayenteryourpropertywheredamagehasoccurredtodealwithyourclaim,temporarilytakeforsafekeepinganyofthepropertyinsuredandtodealwithanysalvage.However,youmustnotabandonanypropertytous.Wemaytakeoveranddealwith,inyourname,thedefenceorsettlementofanyclaim.

Wemaytakeproceedingsinyourname,butatourexpense,torecovertheamountofanypaymentwehavemadeunderthispolicy.Youmustgiveusalltheinformationwemayneedtomaketheserecoveries.

9 Rights of third parties

ApersonorcompanywhoisnotpartytothispolicyhasnorightundertheContract(RightofThirdParties)Act1999toenforceanytermofthispolicy,butthisdoesnotaffectanyrightorremedyofathirdpartywhichexistsorisavailableapartfromthatAct.

10 Fraudulent claims

Ifaclaimmadebyyouoranyoneactingonyourbehalf,oranyotherpersonclaimingtoobtainbenefitunderthispolicy,isfraudulentorexaggerated,whetherultimatelymaterialornot,orifanydamageiscausedbyyourwilfulactorwithyourknowledgewemayatouroption:1. repudiatetheclaim;2. recoveranypaymentsalreadymadebyusinrespectoftheclaim;3. cancelthepolicyfromthedateofthefraudulentactandretainthepremiumduefortheunexpiredperiodof

insurancefromthedateofcancellationuptotherenewaldate.Ifwecancelthepolicywewillnotifyyouinwriting,byspecialdeliverytoyourlastknownaddress.

11 Misrepresentation

Itisyourdutytotakereasonablecarenottomakeamisrepresentationtousifweaskyouaquestioninconnectionwithyourinsuranceorweaskyoutoconfirmoramenddetails.

Ifyoufailinthisdutyitmayhaveadverseconsequencesonyourpolicyincluding,intheworstcasescenario,refusingallclaims,cancellingthepolicyfromthebeginningandretainingallpremiumspaid.

12 Sanctions

Weshallnotprovideanycoverunderthispolicyorbeliabletopayanyclaimorprovideanybenefittotheextentthattheprovisionofsuchcover,paymentofsuchclaimorprovisionofsuchbenefitwouldexposeustoanysanction,prohibitionorrestrictionunderUnitedNationsresolutionsorthetradeoreconomicsanctions,lawsorregulationsoftheEuropeanUnion,UnitedKingdomorUnitedStatesofAmerica.

Ifanysuchsanction,prohibitionorrestrictiontakeseffectduringtheperiodofinsuranceyouorwemaycancelthatpartofthispolicywhichisaffectedwithimmediateeffectbygivingsuchnoticeinwriting.

Insuchcircumstancesweshallreturnaproportionatepremiumfortheunexpiredperiodofcoverprovidednoclaimshavebeenpaidorareoutstanding.

13 Assignment

Youshallnotassignanyoftherightsorbenefitsunderthispolicyoranysectionofthispolicywithoutourpriorwrittenconsent.

Wewillnotbeboundtoacceptorbeaffectedbyanynoticeoftrust,charge,lienorpurportedassignmentorotherdealingwithorrelatingtothispolicyoranysectionofthispolicy.

14 Building works

Youmustprovideuswithfulldetailsofanyconversions,renovations,extensionsorotherstructuralworktothebuildingsiftheestimatedcostexceeds£125,000intotalinanyoneperiodofinsurance.Oncenotified,wehavetheoptiontochangetheconditionsofthispolicy.

Ifyoufailtonotifyandprovideuswithfulldetailsatleast30daysbeforetheworkisduetostart,wemaynotpayforanylosscausedbyorrelatingtothebuildingworksunderyourpolicy.

1 Radioactive contamination

Wewillnotcoverloss,damage,liabilityorexpensedirectlyorindirectlycausedbyorcontributedtobyorarisingfrom:- ionisingradiationfrom,orcontaminationby,radioactivityfromanynuclearfuelorfromanynuclearwasteor

fromthecombustionofnuclearfuel;- theradioactive,toxic,explosiveorotherhazardousorcontaminatingpropertiesofanynuclearinstallation,

reactororothernuclearassemblyornuclearcomponentofanyofthese;- anyweaponordeviceemployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactive

forceormatter;- theradioactive,toxic,explosiveorotherhazardousorcontaminatingpropertiesofanyradioactivematter.This

doesnotextendtoradioactiveisotopes(otherthannuclearfuelornuclearwaste)whensuchisotopesareinthebuildingsandarebeingprepared,storedorusedinthenormalcourseofyouroperationsforthecommercial,agricultural,medical,scientificorothersimilarpeacefulpurposesforwhichtheywereintended.

2 War risks

Wewillnotpayforloss,damageorliabilitydirectlyorindirectlyoccasionedby,happeningthroughorinconsequenceofwar,invasion,actsofforeignenemies,hostilities(whetherwarisdeclaredornot)civilwar,rebellion,revolution,insurrection,militaryorusurpedpower.

3 Terrorism

PartA-PropertyApplicabletotheBuildings,Contents,Art,antiquesandpersonalvaluablesandHomeemergencysectionsofthepolicy.Regardlessofanycontributorycausethisinsurancedoesnotcoveranyloss,damageorexpensedirectlyorindirectlycausedby,resultingfromorinconnectionwith:

1. ContaminationorthethreatofContamination;2. anyactiontakenincontrolling,preventingorinanywayrelatingtoContaminationorthethreatof

Contamination;duetoanyactofterrorism.

Forthepurposesofthisexclusion,Contaminationmeansbiological,chemicalornuclearpollution,contaminationorforce.

Ifweallegethatbyreasonofthisexclusionanydirectorindirectloss,damageorexpenseisnotcoveredbythisinsurancetheburdenofprovingthecontraryshallbeuponyou.

PartB-ThirdpartyliabilityApplicabletoanysectionorpartofasectioninsuringlegalliabilitytothirdparties.Thisinsurancedoesnotprovideanindemnityinrespectofanyliabilitytothirdpartiesoranyliabilityincurredbyyoufordamages,costsorexpensesdirectlyorindirectlycausedbyresultingfromorinconnectionwithanyactofterrorism.Thispolicyalsoexcludesanysuchthirdpartyliabilityoranyliabilityincurredbyyoudirectlyorindirectlycausedby,resultingfromorinconnectionwithanyactiontakenincontrolling,preventing,suppressingorinanywayrelatingtoanyactofterrorism.Ifweallegethatbyreasonofthisexclusionanydirectorindirectloss,damageorexpenseisnotcoveredbythisinsurancetheburdenofprovingthecontraryshallbeuponyou.

4 Uninsurable risks

Wewillnotcoverthefollowing:- Thecostofmaintainingbuildingsorcontents;- Damagethathappenedbeforecoverunderthispolicystarted;- Damagecauseddeliberatelybyyouoranyoneactingonyourbehalf.Thisdoesnotapplytotheftby

domestic staffofanyinsuredpropertyunderthispolicy;- Damagecausedbywearandtear,atmosphericorclimaticconditions(otherthanstormorflood)frost,rot,

fungus,inherentvice,latentdefect,insects,verminoranygradualcause;- Damagecausedbyfaultyworkmanship,materials,specificationordesign;- Damagecausedbycleaning,dyeing,repair,orrestoration(otherthanasprovidedbytheRestorationand

repaircoveroftheArt,antiquesandpersonalvaluablessection);- Mechanicalorelectricalbreakdown;- Propertybeingconfiscatedordetainedbyanygovernment,publicorpoliceauthority;- Coastalorrivererosion;- Damagecausedbychewing,scratching,tearing,denting,vomitingorfoulingbyyourpetswherethetotal

amountofallsuchclaimsduringtheperiodofinsuranceexceeds£5,000;- Damagecausedbyorconsistingofyounotreceivinggoodsorservicesyouhavepaidfor.

5 Pollution or contamination

Wewillnotcoveranyclaimorexpenseofanykindcauseddirectlyorindirectlybypollutionorcontaminationotherthancausedbyasudden,identifiable,unintendedandunexpectedincidentwhichtakesplaceinitsentiretyataspecificmomentintimeandplaceduringtheperiodofinsurance.

Allpollutionorcontamination,whicharisesoutofoneincident,shallbedeemedtohaveoccurredatthetimesuchincidenttakesplace.

6 Date recognition

(ThisexclusiondoesnotapplytotheLegalexpensesorTravelsectionswhereaseparateexclusionapplies)

Wewillnotcoverdamagetoany:- computerorotherelectricalequipmentcontainingamicrochiporintegratedcircuitoranycomponentpart

insuredbyus;and- computerrecords,programs,discs,softwareortheinformationcontainedonthem;whichiscaused,atanytime,byafailureofanypropertyinsuredbyustorecognise,accept,processorrespondtoanydateasitstruecalendardateorafailuretocontinuetofunctioncorrectlybeyondthatdate.

Wewillpayuptothesuminsuredshownforbuildingsasdetailedintheschedule.

Providedtheworkiscarriedoutwithoutdelaywewillpaythecostforyoutoeitherrepairorrebuildasnewthedamagedpartofthebuildingsusingreinstatement techniques and materials.However,ifyouandweagreethatitisnotreasonabletorepairthebuildings usingreinstatement techniques and materials,wewillpayyouanamountwhichwebothagreeisfair.

Fortenant's improvementswewilldecidewhethertoreplaceorrepairthedamagedparts.

Ifthebuildingsarenotinagoodstateofrepairatthetimeoftheloss,wewillreducetheamountwewillpaytotakeintoaccountwearandtear.

Underthissectionwewillalsopaythefollowingcosts:1. architects',surveyors’,engineers’andotherprofessionals'reasonableandnecessaryfees;2. thecostofdemolishingthebuildings,supportingthebuildings,removingdebrisandmakingthesitesafe;3. thecostofkeepingtolocalauthorityorotherlegalconditionsmadeafterthedamage.

Reinstatement of sum insuredUnlessweadviseotherwisewithin30daysofyoureportinganydamagetous,weagreetoreinstateyoursumsinsuredfromthedateuponwhichrepairorreplacementhasbeencompleted.Thisisprovidedyoucarryoutourrequirementstopreventfurtherdamage.

Extended replacement costIfyouhavehadavaluationbyoursurveyor,orbyanindependentprofessionalvaluerwhichwehaveacceptedinwriting,andyouhavesetyoursumsinsuredaccordingly,wewillpaythefullcostofrepairingorrebuildingthebuildingsevenifthisamountisgreaterthanthesuminsuredshowninyourschedule.Thiscoverwillonlybeprovidedifyoutellusaboutanyrefurbishmentsorextensionsyouhavemadetothebuildingssincethevaluationwasconductedandyouamendthesuminsuredtoaccountforthis.

Ifyoulosethekeystoyourhomeortoanysafeoralarminyourhome,orthekeysarestolen,wewillpayforreasonableandnecessarycostsofgainingaccesstoyourhomeandrepairingorreplacingthekeysorlocks.Thereisnoexcessforthiscover.Wewillonlypayaclaimunderonesectionofthispolicyforeachclaim.

11 Security upgrade

Wewillpaysubjecttoourprioragreementforthecostofupgradingyourhome'salarmandphysicalprotectionsfollowingathreattoyouorathreatmadeinthecourseofanaggravatedburglary,acriminalassaultoracarjackingoccurringwithinthegeographical limits.

Subjecttoanoverallmaximumpaymentforsecurityupgradesunderallsectionsofthispolicyof£15,000.

12 Trespassing and fly tipping

Wewillpayforcostsandexpensesincurredbyyouinremovinganythingillegallyormaliciouslydepositedatyourhome oritsgrounds,butwewillnotpayforpollutionorcontaminationofanyproperty,land,waterorair.Thiscoverwillnotapplyifyourhomeisunoccupied.

Themostwewillpayforallclaimsis£15,000intotalinanyoneperiodofinsurance.

13 Loss prevention

Ifweagreeyourclaimfordamagecausedbyescapeofwater,fire,floodorstormwewillalsopaytowardsthecostofimprovementsintendedtomitigateorpreventafutureoccurrenceofthesamedamage.Wewillonlydothisiftheclaimweagreetopayforthedamageismorethan£10,000.

Ifyourhomeisnotinsuredelsewhere,thepersonbuyingyourhomewillhavethebenefitoftheinsuranceunderthissectionfortheperiodfromexchangeofcontracts(orifinScotlandthewrittenofferandacceptance)untilthesaleiscompleted.

Inadditiontothegeneralexclusionsonpages20to22,thefollowingextraexclusionsapplytothissection:1. Damagecausedbystormorfloodtogates,fencesorhedgesand/orthecostofremovinganytree,branch,

2. Protectingdata

You mustmakesurethatyou takeprecautionsfordisposingofanddestroyinghome systems inordertoprotectdata.

3. Controllingdefence

Wecan,butdonothaveto,takecontrolofinvestigating,settlingordefendinganyclaimmadeagainstyou.Wewouldtakethisactioninyour name.Ifnecessary,wewillappointanadjuster,solicitororanyotherappropriatepersontodealwiththeclaim.Wemayappointyour solicitor,butonlyonafeebasissimilartothatofourownsolicitor,andonlyforworkdonewithourpermissioninwriting.Wewillonlydefendclaimsifwethinkthatthereisareasonablechanceofbeingsuccessful,andaftertakingthecostsofthedefenceintoaccount.

4. Reasonablecare

Youmust:a. makesurethatyour home systems areusedandmaintainedasrecommendedbythemanufacturer orsupplier;andb. takeallreasonablestepsandprecautionstopreventorreducedamage orotherlosscoveredbyyour

Environmental legislationmeansanylegislationenactedwithintheUnitedKingdomgoverningthe:1. preventionandcontrolofpollutionandcontamination;2. protectionoftheenvironment.

Regulatory authoritymeansanystatutoryauthority,regulatororlegalbodywhichhasauthorityunderenvironmental legislationtolegallyrequireororderremediationortoconductremediationitselfandtorecoverthecostsofdoingsofromothers.

Wewillpaycosts and expensesupto£50,000todefendyourlegalrightsinadisputearisingfromyour ownershipofanitemofartandantiqueswhereanotherpartyclaimsyoudonotholdgoodtitletoit.

Providedthat:1. youhavemadethepurchaseoftheitemwithintheUnitedKingdomfromaUnitedKingdom-basedseller

duringtheperiod of insurance;and2. youmadereasonableenquiriesabouttheitem’sprovenancebeforeyouboughtit,andyoupurchaseditin

goodfaith.

What is not covered

Anyclaimrelatingtothefollowing:1. AnyclaimwhereyouhavefailedtonotifyDASoftheinsuredincidentwithinareasonabletimeofithappening

andwherethisfailureadverselyaffectsthereasonable prospectsofaclaimorDASconsidertheirpositionhasbeenprejudiced.

2. Costs and expensesincurredbeforethewrittenacceptanceofaclaimbyDAS.3. Fines,penalties,compensationordamagesthatacourtorotherauthorityordersyoutopay.4. AnylegalactionyoutakethatDASortherepresentativehavenotagreedto,orwhereyoudoanythingthat

hindersDASortherepresentative.5. Anyclaimrelatingtowrittenorverbalremarkswhichdamageyourreputation.6. Anyclaimwhereyouarenotrepresentedbyalawfirm,barristerortaxexpert.7. Costs and expensesarisingfromorrelatingtoaJudicialReview,coroner’sinquestorfatalaccidentinquiry.

Conditions

1. a. Onreceivingaclaim,iflegalrepresentationisnecessary,DASwillappointapreferred law firmasyourrepresentativetodealwithyourclaim.Theywilltrytosettleyourclaimbynegotiationwithouthavingtogotocourt.

b. Iftheappointedpreferred law firmcannotnegotiatesettlementofyourclaimanditisnecessarytogotocourtandlegalproceedingsareissuedorthereisaconflictofinterest,thenyoumaychoosealawfirmtoactastherepresentative.

c. Ifyouchoosealawfirmasyourrepresentativewhoisnotapreferred law firm,DASwillgiveyourchoiceoflawfirmtheopportunitytoactonthesametermsasapreferred law firm.However,iftheyrefusetoactonthisbasis,themostwewillpayistheamountwewouldhavepaidiftheyhadagreedtotheDAS Standard Terms of Appointment.Theamountwewillpayalawfirm(whereactingastherepresentative)iscurrently£100perhour.Thisamountmayvaryfromtimetotime.

d. Therepresentativemustco-operatewithDASatalltimesandmustkeepDASup-to-datewiththeprogressoftheclaim.

2. a. Youmustco-operatefullywithDASandtherepresentative.b. YoumustgivetherepresentativeanyinstructionsthatDASaskyouto.

3. a. YoumusttellDASifanyoneofferstosettleaclaim,youmustnotnegotiateoragreetoasettlementwithoutthewrittenconsentofDAS.

b. Ifyoudonotacceptareasonableoffertosettleaclaim,wemayrefusetopayfurtherlegalcosts.

c. Wemaydecidetopayyouthereasonablevalueofyourclaim,insteadofstartingorcontinuinglegalaction.InthesecircumstancesyoumustallowDAStotakeoverandpursueorsettleanyclaiminyourname.YoumustallowDAStopursueatourownexpenseandforourownbenefit,anyclaimforcompensationagainstanyotherpersonandyoumustgiveDASalltheinformationandhelptheyneedtodothis.

4. a. Youmustinstructtherepresentativetohavecosts and expensestaxed,assessedoraudited,ifDASaskforthis.

b. Youmusttakeeverysteptorecovercosts and expensesandcourtattendanceandjuryserviceexpensesthatwehavetopay,andmustpayusanycosts and expensesthatarerecovered.

5. Iftherepresentativerefusestocontinueactingforyouwithgoodreason,orifyoudismisstherepresentativewithoutgoodreason,thecoverweprovidewillendimmediatelyunlessDASagreetoappointanotherrepresentative.

6. IfyousettleorwithdrawaclaimwithouttheagreementofDAS,ordonotgivesuitableinstructionstotherepresentative,wecanwithdrawcoverandwillbeentitledtoreclaimfromyouanycosts and expenseswehavepaid.

7. DASmayrequireyoutoget,atyourownexpense,anopinionfromanexpertthatDASconsiderappropriate,onthemeritsoftheclaimorproceedings,oronalegalprinciple.TheexpertmustbeapprovedinadvancebyDASandthecostagreedinwritingbetweenyouandDAS.Subjecttothis,wewillpaythecostofgettingtheopinioniftheexpert’sopinionindicatesthatitismorelikelythannotthatyouwillrecoverdamages(orobtainanyotherlegalremedythatDAShaveagreedto)ormakeasuccessfuldefence.

8. Youmust:a. keeptothetermsandconditionsofthissection;b. takereasonablestepstoavoidandpreventclaims;c. takereasonablestepstoavoidincurringunnecessarycosts;d. sendeverythingDASaskforinwriting;ande. reporttoDASfullandfactualdetailsofanyclaimassoonaspossibleandgiveDASanyinformationthey

need.

9. Anyoneclaimingunderthissectionmusthavetheagreementoftheperson(s)namedasinsuredinthescheduletoclaim.

10. ThissectionisgovernedbythelawthatappliesinthepartoftheUnitedKingdom,ChannelIslandsorIsleofManwhereyounormallylive.OtherwisethelawofEnglandandWalesapplies.

AllActsofParliamentmentionedinthissectionofthepolicyincludeequivalentlawsinScotland,NorthernIreland,theIsleofManandtheChannelIslandsasthecasemaybe.

Wewillindemnifyyouinrespectoflossof:

1. charity money;2. materialproperty;belongingtoacharityandforwhichyouarelegallyresponsibleoccurringduringtheperiodofinsuranceandsustainedinconsequenceofanydishonest,fraudulent,criminalormaliciousactcommittedbyatrustee,otherthanyou,ofacharitywiththeintenttoobtainimproperpersonalgainforthemselvesorforanyotherparty.

Coverexcludesanydishonest,fraudulent,criminalormaliciousactoromissioncommittedbyanypersonafterthediscoverybyyouofreasonablecauseforsuspicionofsuchactoromissioninrelationtothatperson.

Annual salary meansthetotalgrossbasicannualsalary(excludingovertime,commissionorbonuspayments)payabletotheinsured personatthedatebodily injuryissustained.

Iftheinsured personispaidweeklytheannualsalarywillbecalculatedbytakingtheaveragegrossbasicweeklysalaryoftheinsured personforthe13weekspriortosustainingbodily injuryandmultiplyingthisamountby52.

Bodily injury meansaccidental bodilyinjuryresultingdirectlyandindependentlyofanyothercausewithin104weeksindisablementordeath.

Deferment periodmeanstheinitialperiodfollowingbodily injuryduringwhichthetemporarytotal disablement benefitisnotpayable.

Insured person(s) meansthepeoplenamedasinsuredinthescheduleandtheirfamilywhonormallylivewiththem.

Loss of hearingmeanspermanenttotalandirrecoverablelossofhearinginoneorbothears.

Loss of limb(s) meanslossbypermanentphysicalseveranceatorabovetheankleorofthefourfingersatorabovethemetacarpophalangealjoints(wherethefingersjointhepalmofthehand)orpermanenttotalandirrecoverablelossofuseofacompleteleg,foot,armorhand.

Psychiatry and psychotherapy meansthetreatmentofamentaldisordercarriedoutbyapsychiatristorclinicalpsychologist.

Quadriplegiameansthepermanenttotalandirrecoverableparalysisofbotharmsbelowtheshoulderandbothlegs.

Temporary total disablementmeanstotaldisablementfromengaginginorgivingattentiontotheirusualoccupationforaperiodnotexceeding52weeksinallfromthecommencementofsuchdisablement.

How we will pay your claim

3 Assault

Ifduringtheperiod of insuranceaninsured personsustainsbodily injuryasadirectresultofanysuddenandunprovokedassaultwewillpaytheinsured personuptothelimitassetoutbelow.

in-patienttreatment.

2. Paralysis Ifwe acceptaclaimforbodily injury underthissection andwithin24calendarmonthsthisisthesoleand

independentcauseoftheinsured person sufferingparalysis we willpay:a. anadditional20%ofthebenefitspayableunderpermanent total disablementinrespectof

quadriplegia; b. anadditional10%ofthebenefitspayableunderpermanent total disablementinrespectof

paraplegia.

Wewillnotpayforbodily injury: 1. arisingfrom:

a. anyconsequenceofsuicideordeliberateself-injury;b. anypsychologicalorpsychiatricconditionotherthanPostTraumaticStressDisorder;c. anysicknessordiseasenotresultingfromabodily injury;d. anyrepetitivestressinjuryorsyndromeoranygraduallyoperatingcause.

2. arisingfromanyinsured persontakingpartinpractisingortrainingforanyofthefollowingexcludedactivities:a. flying(exceptasapassenger);b. huntingonhorseback,polo,showjumpingorsteeplechasing;c. driving,ridingorsailinginanykindofrace;d. playinginanysportprofessionally;e. serviceinanyofthearmedforces.

3. directlyorindirectlycausedorcontributedtobyanactof terrorisminvolvingtheuseorreleaseorthethreatthereofofanynuclearweaponordeviceorchemicalorbiologicalagentregardlessofanycontributorycause.

4. arisingfromtraveltoadestinationtowhichtheForeignandCommonwealthOffice(FCO)hasadvisedagainstallorallbutessentialtravelbeforethejourneycommences.

4 Psychiatric services

Ifduringtheperiod of insuranceaninsured personsustainsbodily injuryasadirectresultofanysuddenandunprovokedassault,orisawitnesstoanysuddenandunprovokedassaultofanyotherinsured person,orisawitnesstoanysuddenandunprovokedassaultatthehomewhichwithin12monthsofandmedicallydiagnosedbyamedical practitionerasaresultoftheincidentresultsinanyformofmentaldisorderwewillpaytheinsured personforpsychiatry and psychotherapyprovidedbyaregisteredpsychiatristorclinicalpsychotherapist.

Wewillpay:1. upto£350foraninitialconsultationanddiagnosisfollowingreferralfromtheinsured personsGeneral

MedicalPractitionerorothermedicaldoctor;2. upto£1,650foradditionalconsultations;3. amaximumperinsured personof£2,000perincident;4. amaximumof£10,000payableinrespectofmultipleinsured personsforthesameincident;5. amaximumof£30,000intheaggregateperperiod of insurance.

5 Other medical expenses

Ifduringtheperiod of insuranceaninsured personsustainsbodily injuryasadirectresultofanysuddenandunprovokedassaultbutwherenoclaimisbeingmadeunderanyothercoverunderthissectionforbodily injury,wewillpaytheinsured personforanyreasonablyincurredmedical expenses.

Themostwewillpayis:1. upto£2,000perincident;2. amaximumof£10,000payableinrespectofmultipleinsured personsforthesameincident;3. amaximumof£30,000intheaggregateperperiod of insurance.

6 Sponsorship cover

Ifduringtheperiod of insuranceaninsured personsustainsbodily injurywhichresultsintheinsured personbeingunabletoparticipateinascheduledsponsoredeventwewillpaythelostsponsorshiptotheinsured person'scharityforwhichtheeventwasintendedtobenefit.

Themostwewillpayis£500anyoneclaimand£1,000inanyoneperiod of insurance.

Wewillnotpayunderthiscoverfor:1. anyclaimarisingdirectlyorindirectlyfromapre-existingcondition;2. anyclaimarisingfrombodily injurynotsubstantiatedbyawrittenreportfromthetreatingmedical

practitionerconfirmingtheinsured person'sinabilitytoattendthescheduledevent;3. anymoniesnotreturnedtothesponsoroftheinsured person.

7 Hole-in-one cover

Ifduringtheperiod of insuranceaninsured personachievesagolfinghole-in-oneinanorganisedclubeventorcompetitionwe willpayadonationtotheinsured person'snominatedcharity.

Themostwewillpayis£500anyoneclaimand£1,000inanyoneperiod of insurance.

Providedthat:1. anyhole-in-onemustbewitnessedandconfirmedinwritingbyacluborcompetitionofficial;2. thehole-in-onemustbebasedonthepubliclyadvertiseddistanceandnormalstrokeparofanyparticularhole.

Wewillnotpayunderthiscoverfor:1. Anyinsured personwhoisregisteredasaprofessionalgolfer;2. AnycoursethatisadvertisedasaPitchandPutt,PuttingGreenorCrazyGolforsimilar.

8 Lost keys

Theonlyavailablesetofkeystoyourhomearelost,stolenordamagedandunusableandyoucannotreplacethem,orcannotgainnormalaccess.

Nocoverappliesinrespectofthefollowing.

ProvidedthattheInsured personchecksinattheinternationalcoachterminal,railterminal,portorairportaccordingtotheofficialitinerarysuppliedandobtainswrittenconfirmationfromthecarriers(ortheirhandlingagents)ofthenumberofhoursdelayindepartureofthecoach,train,seavesseloraircraftinwhichtheInsured personwasbookedtotravelandthereasonforsuchdelay.

4 Missed departure

WewillpaytheInsured personupto£1,000inrespectofreasonableadditionalandotherwiseirrecoverabletravelandaccommodationexpenseswhichtheInsured personnecessarilyandreasonablyincursduringtheoperative time of covertopurchaseaticketforanalternativejourneytoreachhis/heroverseasdestinationorreturnfromhis/heroverseasdestinationtotheUnited KingdomortheChannelIslandsasaconsequenceof:

5 Hospitalisation

WewillpaytheInsured person£50foreachfullperiodof24hoursduringtheoperative time of cover thathe/shespendsinhospitalprovidedthatwehaveacceptedliabilityunderCover1–Medicalandotherexpensessubjecttoamaximumoverallbenefitof£1,000.

Providedthatyouprovidetheclaims handlerwithin30daysofreturningfromthejourneywiththeappropriatemedicalschedule.

6 Hijack and kidnap benefit

WewillpaytotheInsured person£500foreachfullperiodof24hoursduringtheoperative time of coverthathe/sheisunlawfullydetainedagainsthis/herwill(whetherhijacked,kidnappedorotherwise)byanypersonorpersonsnotknowntohim/herprovidedthatsuchdetentionbeginsduringtheperiod of insurancesubjecttoamaximumoverallbenefitof£5,000.

Providedthatyouprovidetheclaims handlerwithin30daysofreturningfromthejourneywiththeappropriatepolicereport/writtenevidence.

7 Personal accident

WewillpaytotheInsured person£50,000ifduringtheoperative time of covertheInsured personsustainsaccidentalbodilyinjurybyviolentexternalandvisiblemeans(includingunavoidableexposuretothenaturalelements)whichindependentlyofanyothercauseresultswithin12monthsfromthedateofsuchbodilyinjuryinthedeath,loss of limb,loss of sightinoneorbotheyesorpermanent total disablement oftheInsured person.

Weshallnotpaymorethanonebenefitinconnectionwiththesameaccident.

ForanyInsured personundertheageof16yearsatthetimeofbodilyinjuryintheeventofdeaththemostwe willpayis£7,500.

8 Loss of passport

Wewillpayupto£1,000intotalforthereplacementcostofpassportplusreasonableadditionalaccommodationandtravelexpensesincurredonlybytheInsured personasaresultofthelossofhis/herpassportoccurringwhilstoutsidetheUnited KingdomortheChannelIslandsduringtheoperative time of cover.

Providedthatthenon-arrivaloftheInsured person’sbaggageisreportedimmediatelytothecarrierandawrittenreport(orinthecaseofanairlineaPropertyIrregularityReport)obtainedfromthem.Allreceiptsforitemspurchasedmustbesenttotheclaims handler.

10 Catastrophe

Wewillpayupto£1,000forequivalentadditionalandotherwiseirrecoverableaccommodationexpensesincurredbytheInsured personasaresultofbeingforcedtomovefromtheaccommodationbookedinadvanceforthejourneyfollowinganemergencyoragovernment,provincialgovernment,municipalorlocaldeclarationofsuchemergencyoccurringduringtheoperative time of cover.

11 Winter sports

Ski equipment hire chargesWewillpay£50perdaysubjecttoalimitof£750totheInsured personinrespectoftheequivalentandnecessarychargesfortheemergencyhireofski equipmentifduringtheoperative time of covertheInsured personisdeprivedoftheski equipmenttakenonthejourneyforeighthoursormorefromthetimeofarrivalatthebookeddestinationontheoutwardlegofthejourneyduetodelayormisdirectionbythecarrier(e.g.airline).

2 Our rights in the event of a claim
