a motor vehicle stops, ticket it!" I've been asked time and again, is there any way to
fight a parking ticket and win. My answer is yes. Here's how.
Don't throw away, crumple up, or do any other nasty things to your parking ticket.
Required Elements –The NYC driving public’s best
friend
The face of your parking ticket contains valuable information, and may provide you with
a “Get out of jail free” card. For example, you win if the face of your NY parking ticket
contains the wrong:

These bite size bits of information are called “Required Elements.” If any of these required elements are omitted, misdescribed, or illegible you win upon application;
regardless of whether your committed the alleged parking crime.

Code 20: General No Parking. "No parking where parking
is prohibited by sign, street marking or traffic control
device"
PLEA:
Not guilty, if you stopped temporarily to drop-off or pick-up a passenger, or
drop-off or pick-up property to or from the curb. You need to furnish an affidavit
from your passenger setting forth her reason for being dropped-off or picket-up
at the location, address of building, and describe her destination inside the
building. Documentary evidence, such as a grocery receipt, pharmacy receipt,
note from your physician, or other such evidence makes your case much
stronger
Not guilty, if you are a commercial vehicle making a service call or delivery, and
you win if you can furnish an affidavit describing the details of your delivery, with
a work order or receipt corroborating the information in your affidavit.

Code 40: “No person shall stand or park a vehicle other
than an authorized bus in its assigned bus stop when any
such stop has been officially designated and appropriately
posted except that the operator of a vehicle may
temporarily stand therein for the purpose of expeditiously
receiving and discharging passengers provided such
standing does not interfere with any bus about to enter or
leave such zone:”
PLEA: Not guilty, if you can prove you stopped temporarily to pick-up or discharge a
passenger
Here are some tips:
Please keep in mind this is a difficult parking ticket to beat
You must have a certification from your witness to even think of fighting this
ticket
You need to explain and document where you passenger was going or coming
from
An independent witness in addition to your passenger strengthens your case
The more facts you present the better.

drop or pick-up and go

Code 46: "Standing or parking on the roadway side of a
vehicle stopped, standing or parked at the curb; in other
words, 'double parking...'"
PLEA: Not guilty, if you are a commercial vehicle double parking:
At such locations and during such hours that stopping, standing and parking is
not prohibited and your are;
Expeditiously making pickups, deliveries or service calls, provided that;
There are no unoccupied parking spaces or designated loading zone on
either side of the street within 100 feet.
"Expeditiously" means taking 30 minutes or less to complete your pick-up, delivery or
service call.
However, double parking is always prohibited in Midtown Manhattan
between 7 a.m. and 7 p.m. daily, except on Sunday. Midtown Manhattan is
the area from 14th Street to 60th Street, between First Avenue and Eight
Avenue, inclusive.
If you are a NON-COMMERCIAL vehicle
Conventional wisdom says you cannot double park any time, any place,
anywhere in NYC; the big but is:
o I believe “stop, drop or pick-up and go” is a defense to a parking ticket for
double parking (as do some other experts)

o Discretion may be the better part of valor on a double parking ticket until
the City Council straightens this mess out and creates some uniformity in
the enforcement of double parking tickets by passing a law making “stop,
drop-off or pick-up, and go” a defense to double parking
