Dear Zoning Board,
We are currently seeking a zoning variance of our rear yard from 20' -0" to 12' -6". (Section 7, Table 3.) which would modify the existing requirements by 7' -6".
The 20'rear yard setback line prohibits us from building a new garage and driveway that will solve our flooding issues in this setback.
Our house sits on a reverse comer lot that is facing the longer comer street yard. Therefore, our rear yard setback is on the west side of our lot. We wish to construct a new garage in this area that will encroach in the existing rear yard.
We understand and accept all conditions of Section 4.4e.l but feel that this variance should be granted based on the following: .
This strict application of the terms of the zoning ordinance will result in an undue hardship to my residence and belongings. We have an unique circumstance. Our current garage door is sunken down approximately 40" from the street level. In the past several years when there is a heavy rain, water runs down my sloped driveway and into my garage underneath the door. In July 2011 we experienced water in our garage up to 20" that damaged a lot of our belongings. We have consulted with plumbers and engineers on how best to solve this problem. We explored a new drainage system in our driveway but because none of the trades would guarantee it would not flood again we decided to not do it. For us, the only viable solution is to fill up our sloped driveway and replace it up to the current grade level. This will stop all our current flooding issues. The solution however, will eliminate our existing garage so we are seeking to build a new garage in order to make up for the one we lost. It would be 26' wide to accommodate a new concrete driveway that would not cover the existing drain clean-outs and catch basin.

This variance will not alter the essential character of the locality. My wife and I feel very strongly that this project will solve the flooding issue and enhance the exterior of our home and lot that will help beautify our community. The new garage being located on Michael John Drive side will also help with filling in the empty space on the west side of the lot. We feel this variance helps solve issues for us and the whole community.
