What Does It Mean When Your Title Says “Joint Tenants”?

When two buyers purchase a home together, they can register the title as joint tenants or as tenants in common.

Most home buyers don’t know the difference.

The term “tenant” has a lot of folks thinking it has something to do with renters.

But your title will designate the owners as either joint tenants or tenants in common.

So…...What’s the difference?With joint tenancy, each person on title

is the owner of the entire property.The main benefi t of joint tenancy is the

“right of survivorship”. When one joint tenant passes away, his

or her interest in the property diminishes and the surviving joint tenant ends up being the sole owner of the land.

This eliminates the need for this part of the estate to go through probate and makes things simple.

Tenants in common is a different situation.

Each individual on title is the owner of a half or some other portion that belongs just to them. They are able to include their share in their own will or sell it.

This arrangement is a bit more complicated, often used with second marriages.

There is absolutely no right of survivorship in a tenancy in common.

A tenant in common may deal with their share in the property as they wish without authorization of the other titleholder.
