    NO.FPC.5/2010/154, Dated Dispur, the 11th May, 2010.

    The Govt. of India vide their letter No.1-32/2006-U II/UI(i) dated 31-12-2008 and letter

    number 1-32/2006-U.11/U.1(ii), Dated 31-12-2008 allowed the U.G.C. pay scale to the teachers in the

    Central Universities and Degree Colleges and the AICTE pay scale to teachers of the Engineering

    Colleges and other Technical Institutions w.e.f. 1-1-2006. Further the UGC vide their letter number F.3-

    1/2009(PS) Dtd.23/9/2009 issued the Regulations to revise UGC pay scales. In pursuance of Govt.

    decision and in exercise of powers conferred by the proviso to Art 309 of the Constitution of India the

    Governor of Assam is pleased to extend the benefit of the revised UGC/AICTE pay scale to the

    Teachers in Universities/Colleges and others as below :-

    1.F. REVISED PAY SCALE:-

    (i) The posts of Accompanists, Coaches, Tutors and Demonstrators if any, the pay and grade

    pay shall be fixed in the appropriate pay bands relative to their existing pay in each University / College

    corresponding to such fixation in respect of Central Government employee as approved by Central

    Government on the basis of recommendations of 6th Central Pay Commission.

    (ii) The benefit of above revised UGC/AICTE pay scale be extended only subject to the

    fulfillment of conditions related to number of posts, mode of filling up of these posts, minimums number

    of years of service required for any given posts and the conditions related to eligibility in respect of

    educational qualification and teaching/research experience as laid down by Govt. of India in its pay

    revision scheme dated 31-12-2008 and conditions laid down by UGC/AICTE regulations and if any by

    University concerned.

    (iii) The higher grade pay for those particular posts mentioned in the scheme of pay revision

    Dated 31-12-2008 notified by Govt. of India, shall be allowed subjected to the fulfillment of such

    conditions as mentioned in the scheme of pay revision.

    (iv) The benefit of above revised UGC/AICTE pay scale be extended only to those

    Universities and Colleges that adopt the UGC/AICTE regulations related to creation and filling up of

    teaching posts in pyramidal order, appointments on Contract basis, minimum numbers of teaching days

    and weeks, minimum work load, adoption of service agreement for new appointee and code of

    professional ethics by way of incorporating these in acts or statutes, wherever applicable, within three

    months from the date of adopting the revised UGC / AICTE pay scales.

    (v) The State Universities will also follow similar procedure as the Central Universities in

    creating teaching and non-teaching posts, including adherence to UGC prescribed ratio of teaching to

    non-teaching staff and teacher-student ratio. Higher Education department will initiate necessary steps in

    this regard.

    (vi) The Higher Education and Technical Education department will put in place a

    mechanism within one month at the respective Directorate level to ensure that only those teaching staffs,

    that are eligible under the scheme, get the revised UGC / AICTE pay scales.

    (vii) (a) The Higher Education and Technical Education Departments will evolve an effective

    mechanism in respect of Colleges, both General and Technical and Polytechnics within three months to

    ensure the compliance of the regulations related to minimum teaching days / weeks and minimum work

    load, if necessary, by adopting the electronic cards or such other means for recording these parameters.

    (b) The Universities will also formulate an appropriate and effective in house

    mechanism to ensure compliance of the regulations related to minimum teaching days/weeks and

    minimum work load.

    2. INCREMENTS:-

    (i) Each annual increment shall be equivalent to 3% of the sum total of pay in the relevant Pay Band

    and A.G.P. as applicable for the stage in the Pay Band.

    (ii) The number of additional increment(s) on placement at each higher stage of AGP shall be as per

    the existing scheme of increment on promotion from lower Pay Scale to Higher Pay Scale; however, in

    view of the considerable raise in effective pay between the two Pay Bands, there shall be no additional

    increment on movement from the Pay Band of Rs. 15600-39100 to the Pay Band of Rs. 37400-67000.

    (iii) However for advance increment at the rate of 3% of the sum total of pay in the relevant Pay

    Band and the AGP as applicable (non-compoundable). Education Deptt. will issue a separate

    notification in consultation with Finance Department to ensure uniformity among Universities/Colleges

    and Technical Institutions.

    3. PAY FIXATION FORMULA :-

    (i) The pay in the pay band/pay scale will be determined notionally by multiplying the existing

    basic pay as on 1-1-06 by a factor of 1.86 and rounding off the resultant figure to the next multiple of

    10.

    (ii) If the minimum of the revised pay band/pay scale is more than the amount arrived at as per (i)

    above, the pay shall be fixed at the minimum of the revised pay band/pay scale;

    Provided further that:-

    (a) Where, in the fixation of pay, the pay of Teachers etc.drawing pay at two or more

    consecutive stages, in an existing scale gets bunched, that is to say, gets fixed in the revised pay

    structure at the same stage in the pay band, then, for every two stages so bunched, benefit of one

    increment shall be given, so as to avoid bunching more than two stages in the revised running pay bands.

    For this purpose, the increment will be calculated on the pay in the pay band. Grade pay would not be

    taken into account for the purpose of granting increments to alleviate bunching.

    (b) If by stepping up of the pay as above the pay of Teachers etc. gets fixed at a stage in the revised pay

    band/pay scale (where applicable) which is higher than the stage in the revised pay band at which the

    pay of a Government servant who was drawing pay at the next higher stage or stages in the same

    existing scale is fixed, the pay of the latter shall also be stepped up only to the extent by which it falls

    short of that of the former.

    (c) The pay in the pay band will be determined in the above manner. In addition to the pay in the

    pay band, grade pay corresponding to the existing scale will be payable.

    (iii) For fixation of pay in the revised UGC/AICTE pay scale, the authenticated fitment Table of

    Ministry of Human Resource Development as forwarded by the letter No.F.3-1/2009-U.I, Dated

    4-6-2009 for the existing incumbent in position as on 1-1-2006 shall be applicable.

    4. ALLOWANCES etc.:-

    (i) The Dearness Allowance as applicable to State Government Employee which is at par with the

    rates followed by Central Government shall be applicable.

    (ii) House Rent Allowance, Leave Travel Concession, Special Compensatory Allowance, Medical

    Allowance etc. will be admissible w.e.f. 1-5-2010 as applicable for the State Government employees.

    (iii) Only the allowances and grants as admissible to the State Government employees will be

    admissible to the University/College Teachers and other staff covered under these UGC/AICTE pay

    scales.

    5. SUPERANNUATION and PENSION:-

    (i) Superannuation age of the teachers of the General/Technical Colleges and Polytechnics in the

    State shall continue to be unchanged.

    (ii) The Higher Education Department will examine the issue relating to superannuation age of Vice

    Chancellor and Teachers of State Universities with all its ramifications and move an appropriate

    proposal.

    (iii) The State Universities should switchover immediately to the new Defined Contributory Pension

    Scheme as introduced by the State Govt. for their employees joining service on or after 1-2-2005.

    6 EFFECT OF RFEVISED PAY SCALE AND ALLOWANCES

    AND PAYMENT OF ARREARS:-

    (i) The benefit of revised pay structure under UGC/AICTE scheme as per this notification shall be

    effective from 1-4-2009 but the revised pay shall be notionally fixed as on 1-1-2006. The arrears only in

    respect of pay and Dearness Allowance at the revised rate shall be paid w.e.f. 1-4-2009 to 30-4-2010 in

    one installment and shall be credited into the Bank Account

    (ii) The arrears for the period from 1-4-2009 to 30-4-2010 (i.e. for thirteen months) will be paid in

    cash in one installment by crediting the same in the bank account of the Teachers concerned.

    (iii) Education Department of Government of Assam will move Government of India for releasing

    their 80 % share of the arrear amount for the period from 01.01.2006 to 31.03.2010.

    7. Higher Education Department and Technical Education Department may issue necessary

    notification as required to implement the revised UGC/AICTE pay scales as per this notification.
