NOTICE

At the Environmental Advisory Committee meeting held 18 August 2015, Mrs Diana Hertzler of Mundaring asked questions which were taken on notice. Below is a summary of the questions and the responses provided in a letter to Mrs Hertzler from the Co-ordinator Environment and Sustainability.

Question 1

Is the EAC considered a stakeholder in the projects/programs of Infrastructure Services, i.e. does the EAC receive notification of projects in the planning stages and are environmental impact assessments performed?

Response 1 The EAC’s Terms of Reference is to provide Council with advice and information

regarding environmental matters within the Community. The EAC does not provide advice on Council operations or programs unless Council requests it to.

Question 2

Will the Strategy delineate how conflicts are to be resolved between the delivery of infrastructure services and environmental conservation?

Response 2 The Draft Roadside Conservation Strategy’s vision is to protect the

environmental values of the Shire of Mundaring’s roadside vegetation. Shire

staff, within Infrastructure Services and Environmental Services, currently discuss operations which have the ability to affect roadside vegetation.

Question 3

What will have priority? Providing “improved” infrastructure services that are surplus to the fire hazard safety requirements of ratepayers, or environmental conservation?

Response 3 The EAC is not in a position to provide an answer to this question given its terms

of reference. Question 4

Will public consultation with ratepayers as stakeholders be done prior to decisions being made that may impact their local environment, lifestyle and property values?

Response 4 As per above, the EAC does not become involved in Council operational matters. Question 5

Will the strategy address potential damages from and risk of the proposed 39 road works identified in Infrastructure Service’s Emergency Access improvement Program and the associated potential increase in traffic hazards that may threaten roadside flora and fauna as we have wanted for Lacey Road?

Response 5 The Draft Roadside Conservation Strategy includes data surveyed with

assistance from the Roadside Conservation Committee on the conservation status of roadsides in the Shire. The Strategy addresses threats to roadsides and actions to consider the impact those threats have on roadsides.

Question 6

In line with the aims of the EAC, may I request that the roadside verge of Lacey Road be protected? And that this would include protection of the root zones of the existing vegetation, including the trees? This area of protection would extend on either side along the length of the road beyond the previously identified strip of Priority 1 Conservation Area.

Response 6 The EAC is an advisory group and does not carry out on ground works however

is working to complete the Draft Roadside Conservation Strategy to advise Council on the best methods of roadside vegetation conservation.

SUMMARY: . At the ordinary meeting of Council held 8 September 2015 Council reviewed its committee’s structure to ensure continued relevance, establish a uniform approach and ensure compliance with statutory obligations. As a result 5 committees were re-established as Advisory Groups or Representative Meetings. These groups have changed their names from Committees of Council to Working or Advisory Groups. These Groups are now able to perform their functions without the formality of appointment of members, formal agenda and minutes Council deferred its decision on any action in regards to the Environmental Advisory Committee (EAC) to enable further consultation with committee members. This report recommends that the Environmental Advisory Committee becomes the Environmental Advisory Group and amends its Terms of Reference accordingly. BACKGROUND: Committees and advisory groups should only be created to assist Council in carrying out its role more effectively. This should result in more informed decision-making, better policy and law-making, better financial and risk management and the provision of better services and facilities.

The reviewed committees structure has now been implemented following the local government elections on 17 October 2015.During the special Council meeting on 21 October 2015 Council appointed elected members to all its committees, advisory groups and representatives meetings.

STATUTORY / LEGAL IMPLICATIONS: The establishment, type and membership of committees are governed by sections 5.8 to 5.18 of the Local Government Act 1995 (the Act).

POLICY IMPLICATIONS: Nil FINANCIAL IMPLICATIONS: The restructure may result in administrative and governance savings derived from the reduction in committees. Savings may include advertising, stationery, staff time, catering etc. STRATEGIC IMPLICATIONS: Shire of Mundaring 2013 – 2023 Strategic Community Plan: Strategic Theme: Respected Civic Leadership: Strong civic leadership and trusted governance. SUSTAINABILITY IMPLICATIONS: Nil RISK IMPLICATIONS: Nil CONSULTATION: EAC members considered a report about the name change and review of Terms of Reference during the August 2015 EAC meeting and deferred its decision in order to have more time to consider the matter. The Manager Finance and Governance will be available at the EAC meeting to further discuss this issue. COMMENT: During its meeting on 8 September 2015 Council adopted the review of its committees. In that report a recommendation for the EAC was made as follows: Environmental Advisory Committee A committee of Council established to advise Council on environmental issues within the Shire, to create environmental awareness in the community, to conduct environmental activities involving the community and gain community opinion. Membership: one elected member and community representatives. Recommended action: this committee can achieve the same purpose by making it a working group. Council can still request representation by one or more nominated elected members and will still receive agendas and records of proceedings. Any advice to Council resulting from the group’s meetings can still be incorporated in staff reports to Council. Being relieved of the statutory compliance burden will greatly assist the working group, so that they can concentrate on their purpose of working with the community on environmental issues.

Committee members have been consulted about the proposed change: most requested more time be allowed to make an informed decision, while some members preferred to remain a committee. Proposed new name: Environmental Advisory Group. An alternative motion by Cr Fox was presented to Council, and was adopted unanimously, which requested

That Council: Defers a decision on any action in regards to the Environmental Advisory Committee until further consultation with committee members has occurred.

Reason for the change: Councillors have requested that further discussions with the Environmental Advisory Committee members be held before changing the committee to an advisory group. As an advisory group members would be able to perform their functions without the need for strict compliance with the Act. This would mean that: • Members other than elected members do not need to be formally appointed

by Council. They can be appointed by the group in accordance with its Terms of Reference.

• Changes to the Terms of Reference of the groups don’t require Council approval, but can be made through a majority vote of the group.

• There is no requirement to disclose financial and other interests. • Any recommendations from the meetings will still be reported to Council and can be included for consideration in budget deliberations. • Staff will still provide administrative support to the group and facilitate

meetings. • Council can nominate a representative to the group if it so wishes. Should the EAC stay as a formal Advisory Committee, then the following would still be required: • Regular review of its Terms of Reference with members of the EAC and

adoption by Council resolution; • Individual members (not organisations) must to nominate and be formally

appointed by Council following public advertising; • Council may nominate an elected member to the committee; • Any future changes to the membership require approval by Council resolution

(s. 5.10); • Any changes to the Terms of Reference require approval by Council

resolution; • All members are subject to the Disclosure of Financial Interests provisions of

the Act ;

• The CEO is to convene an ordinary committee meeting by giving each member of the committee at least 72 hours’ notice of the date, time and place of the meeting and an agenda for the meeting by facsimile, letter or electronic mail (Standing Orders Local Law cl. 1.2.5);

• A quorum of at least 50% of the number of offices (whether vacant or not) of member of the committee is required (Local Government Act 1995 s. 5.19);

• Formal committees of Council are subject to the Shire of Mundaring Standing Orders Local Law (being repealed and replaced by the Shire of Mundaring Meeting Procedures Local Law in the near future);

• All recommendations from the meetings need to be submitted to Council through a report to Council;

• Local Government Act 1995 agenda and minute requirements apply; • The membership of the Committee continues until the person resigns, the

committee is disbanded or the next ordinary election day, whichever happens first (s. 5.11). After each election Council must appoint or reappoint members to the committee.

Whilst the future of the EAC’s name and structure is ultimately Council’s decision members of the EAC are invited to provide feedback to Council whether they wish to stay as a formal committee of council or become an Advisory or Working Group. The Terms of Reference are also provided for EAC members to review and submit comments back to the Shire’s Governance Staff. Should any changes to the Terms of Reference be recommended and the EAC remains an Advisory Committee, then these changes need to be endorsed by Council. Should the EAC change to an Advisory or Working Group, then any changes to the Terms of Reference can be made through majority voting of the members.

VOTING REQUIREMENT: Simple Majority RECOMMENDATION That the Environmental Advisory Committee: 1. Is disestablished as a formal committee of Council; 2. Becomes the Environmental Advisory Group; 3. Requests Council to appoint an elected member to the Group; 4. Requests the Chief Executive Officer to provide appropriate administrative

support to the Group; and 5. Amends its Terms of Reference to reflect the above changes.

ATTACHMENT 4 COMMUNITY EDUCATION STRATEGY

November 2015 Background: The community education strategy is developed by the Environmental Advisory Committee (EAC) through a workshop process. The Strategy consolidates existing environmental education and communication activities and identifies new activities in accordance with the EAC’s Terms of Reference. The Community Education Strategy links strongly with the Shire’s Strategic community Plan and will assist in fulfilling its vision Connecting community and environment. Objectives: 1. To educate, raise awareness and inform the community of the Shire’s Policies

and Strategies as well as the Mundaring Environment. 2. To encourage community participation and involvement in environmental

activities. 3. To consult and gain feedback from the community and environmental issues. No. Activity Progress/Implementation 1 Environmental Art

ENVIRONMENTAL SERVICES ACTIVITY REPORT: SHIRE OF MUNDARING APRIL TO JUNE 2015 REFERENCE: EMRC PURPOSE OF REPORT To provide the Shire of Mundaring with a quarterly progress report for all activities and actions achieved by the EMRC Environmental Services. SOURCE OF REPORT Director Regional Services Manager Environmental Services BACKGROUND The EMRC Environmental Services business unit reports on key activities on an ongoing basis. The EMRC 2022 – 10 Year Strategic Plan provides the framework for reporting under the objectives “to contribute towards improved regional air, water and land quality and regional biodiversity conservation” and “to address climate change issues within the region”. The projects relevant to Environmental Services primary activities include:

• Eastern Hills Catchment Management Program (EHCMP);

• Water Campaign™;

• Achieving Carbon Emissions Reduction Program (ACER);

• Community Energy Efficiency Program (CEEP);

• Future Proofing Project (Regional Climate Change Adaptation Action Plan);

• Swan and Helena Rivers Management Framework;

• Sustainability and Environmental Education Program;

• Provide environmental consultancy services; and

• Regional environmental advice and advocacy.

REPORT Activities of the Environmental Services business unit focus on a number of key strategies and projects that are agreed as regional priorities by member Councils as part of the annual consultation and budget development processes and through consultation with the Regional Environmental Advisory Group (REAG). All of the Environmental Services strategies emanate from the EMRC’s 10 Year Strategic Plan and all activities and projects are listed in the Regional Environment Strategy 2011-2016 and annual Business Unit Plan which becomes the source document for guiding the work of the business unit throughout the year.

The following report represents the Environmental Services business unit progress report for the period January to March 2015. Action: Implement Regional Environmental Strategy The Regional Environment Strategy continues to be implemented. Consultation with member Councils and key stakeholders on a new Regional Environment Strategy for 2016 to 2020 is proposed to commence in the second half of 2015. Action: Develop and Implement the Sustainability and Environmental Education

Program Sustainable Schools WA (SSWA, formerly AuSSI-WA) Alliance meetings were attended in April and June 2015, with the meeting in April being held at the City of Bayswater. These meetings were held to identify opportunities for engagement with SSWA Alliance partner school programs; to discuss the establishment of a Regional Network Group for teachers within the City of Bayswater; and to promote the program. Four schools communicated interest in the SEE schools program following an expression of interest letter sent to all schools within the Shire of Mundaring inviting participation. The SSWA North Metro (Mundaring) Regional Network Group meeting was attended on 12 May 2015 at Sawyers Valley Primary School to meet with representatives from three of the four schools to discuss options for engagement with the program. Following this, one school, Mundaring Primary School, has completed the Schools Sustainability Benchmarking Survey. The Sustainability and Environmental Education Program Schools Report outlining progress to date and recommending the way forward for local government involvement in schools was developed. A staff sustainability competition called Mythbusting May was run as part of the Shire of Mundaring’s program to raise awareness amongst Shire staff about sustainability myths and facts and to encourage participation and competition between Directorates. An evaluation report was completed highlighting the success of the competition and providing recommendations for future staff sustainability programs. A Certificate was presented to the winning Directorate in June 2015.

Action: Co-ordinate and Implement Eastern Hills Catchment Management Program (EHCMP) Interest in alternative weed management practices was evident from the success of the Working with Weeds seminar held in May 2015 in partnership with The Weed’s Network operating out of Monash University. Representatives from local governments, Department of Agriculture and Food, State NRM Office, the community and commercial weed management contractors attended the event. Presenters from Perth, Melbourne and Holland provided information on alternative weed management practices. A steam

weed machine has been purchased by the EMRC with grant funding from the Swan River Trust. It will be used as an alternative to chemicals in the management of weeds. A number of local governments and community groups have demonstrated interest in the operation of the steam weed machine. Water quality monitoring is continuing at sites nominated by the Catchment Groups. Hydrocarbon pads will be utilised as a tool to identify the entry point of hydrocarbons into the Swan River. A sampling analysis plan is being prepared for this project. A water quality monitoring project at Bellevue light industrial area, funded by the Swan River Trust, will commence in August. This project aims to identify source points of pollutants entering the Swan River from the light industrial area. The theme for the next Combined Catchment Group meeting in August is “Revitalisation of Catchment Groups”. Members of Catchment and Friends of Groups will workshop ideas to increase volunteer retention and recruitment. A grant application has been completed for Healthy Wildlife Healthy Lives – A One Health Project which is being reviewed before submission to Lotterywest. The 18 month project will address the transfer of diseases from humans and domestic animals to native animals. The project is a partnership with Murdoch University. Action: Co-ordinate Activities for Marri Canker Research Project Treatment trials for marri canker were completed in June in the Shire of Mundaring. The Green Army team applied five different treatment methods to 100 trees infected by marri canker. The trees will be monitored utilising the Marri App. Murdoch University will collect and analyse data from observations of tree health for inclusion in their research project. Action: Co-ordinate and Implement Community Led Project (Swan River Trust) Assistance was provided to Catchment Groups to prepare Swan River Trust Alcoa Landcare Program (SALP) grant applications. Weed removal, monitoring and mapping has been undertaken in the Shires of Kalamunda, Mundaring and City of Swan as part of community group SALP grants. Assistance was provided to Catchment Groups to revegetate sites with 3,000 plants. Consultation was undertaken with the Whadjuck working group on the Katharine Street River Gang SALP grant application and for the Lower Lesmurdie Falls project. Action: Undertake Eastern Hills Catchment Management Program (EHCMP)

marketing and promotional activities The EHCMP program and community group achievements were promoted at the Kalamunda Plants to Resident’s day. Macroinvertebrate surveys and a catchment scale model activity were delivered to a Scouts group in Mundaring. Community group projects, achievements, planting day activities and future projects were promoted through the Greenpage Newsletter, EMRC and Perth Region NRM websites. Green Army activities have been promoted in local newspapers such as the Southern Gazette, Belmont, Midland Kalamunda Reporter and the Chidlow Chatters newsletter.

Action: Develop and Implement Youth Programs (NRM) The Bush Skills 4 Youth program commenced with two workshops, titled All About Leaf Litter. A total of 40 school children attended. The highlight of the workshop was the use of iScopeStands, which transform iPads, tablets and smart phones into microscopes. The use of this technology offers more insight into soil invertebrate activity. Action: Implement the Dam Restoration Project

The Dam Restoration Project is being reviewed for resubmission to the State NRM Office and for submission with the Australian Research Council. Expressions of interest from over 50 landholders in Perth’s Eastern Region were received providing dam sites for inclusion in the project. Action: Co-ordinate activities for the Green Army Program The Green Army team assisted Murdoch University by applying treatments to infected marri trees as part of the Marri Canker Research Project. They have also worked on brush log construction and installation along the Swan River foreshore, seed collection, planting, erosion control and creekline restoration in the Shires of Kalamunda and Mundaring and City of Swan. Water quality monitoring and macroinvertebrate sampling were undertaken in the City of Belmont and Shires of Kalamunda and Mundaring. Discussions are underway with BJL (Service Provider) regarding arrangements for the graduation event for round one Green Army teams. Round two will commence in the City of Bayswater in August 2015. Unfortunately the round three application for the Green Army was unsuccessful. Project development is underway with member Councils in preparation for Green Army round four which is due to open in July with implementation in 2016. Action: Co-ordinate and Implement Water Campaign for the Shire of Mundaring Corporate and community water consumption data for the Shire of Mundaring has been analysed and results presented in the Water Conservation and Water Quality Review and Recommendations report along with the status progress and list of actions implemented. The report was reviewed by the Shire and finalised. The Water Corporation has indicated that works following the audits as part of the Free Non-Residential Waterwise Retrofit Program, funded by the Water Corporation, have been further delayed. Consultants who will be carrying out the works have started contacting participating Councils. Action: Participation in the Cooperative Research Centre (CRC) for Water Sensitive Cities The CRC for Water Sensitive Cities Mid-year Review briefing for Perth given by CEO Tony Wong was held in May 2015. The 2015 Mid-year Review combined with a briefing of the development of the next stage of the CRC for Water Sensitive Cities research engagement program to present the substantial highlights and achievements from the previous year’s activities, as well as sharing some important information regarding the

development of the next stage of the CRC research and adoption activities. A Regional Advisory Panel meeting was held in June 2015. The main topics of discussion were the process for developing the tranche two projects and how to effectively engage appropriate stakeholders. Strategy: 1.5.4 Identify, Investigate and Develop New Environmental and Sustainability Opportunities Action 1.5.4.1 Co-ordinate EMRC’s Community Energy Efficiency Program

(CEEP) The Milestone 9 Report was accepted by the Department of Industry and Science in June 2015. This final milestone included the launch, promotion and signage activities for Shire of Mundaring, review and reporting activities for City of Bayswater and Shire of Mundaring, as well as the Final Report for the Re-energising Perth’s Eastern Region project. Over the life of the $1.46 million project, $635,197 was received in co-funding from the Australian Government. The EMRC, Town of Bassendean, City of Bayswater and Shire of Mundaring collaborated to undertake much needed energy efficiency upgrades and retrofits at four community facilities. The Re-energising Perth’s Eastern Region project is complete with the audit reports confirming that:

• Energy consumption has actually reduced by 40.7 per cent across the four facilities;

• Energy use has reduced by around 829,790 kilowatt-hours;

• This is the equivalent of the annual consumption of 134 average Perth households;

• Greenhouse gas emissions have reduced by 562 tonnes CO2-e; and

• Energy cost savings alone are around $133,450 for the participating councils. Overall, the Re-energising Perth’s Eastern Region project was very successful and substantively met all of its objectives as well as the objectives of the Community Energy Efficiency Program. The benefits for Perth’s Eastern Region include:

• Improved energy efficiency;

• Reduced energy and maintenance costs;

• Reduced greenhouse gas emissions;

• Improved amenity for the community including: safer lighting; improved visibility and reading comfort; improved air movement, quality, temperature and comfort; improved pool water circulation, temperature and comfort; improved health outcomes; reduced downtime for maintenance; and

• Demonstrated, proven energy efficiency technologies.

Conversations continued in relation to the Planet Footprint software and the potential transition of the Emissions Reporting Platform from Greensense. Greensense have requested that member Councils withdrawing from the Emissions Reporting Platform provide formal notification in writing to them of this decision. Information regarding this requirement will be provided to member Councils. Action: Co-ordinate and Implement the ACER Program for the Shire of Mundaring An Achievements Report has not been finalised due to the issues with the Shire of Mundaring’s Emissions Reporting Platform data. Relevant Shire staff have been contacted to locate information and to develop a Data Management Guideline that will assist with future data gathering and integrity. A review of the Home Energy Audit Kits and Power Mates placed in the Mundaring and Greenmount Libraries was conducted to check working condition and for the purpose of collating and reporting community feedback. The Power Mates were also re-calibrated to include new Synergy tariffs. Action: Implement the Regional Climate Change Adaptation Action Plan 2013-

2016 The Future Proofing Perth's Eastern Region - Key Achievements 2014/2015 Report outlines the key achievements for the year including recommendations for 2015/2016. A CEOAC Information Bulletin was developed to update EMRC Council on the potential impacts of the Australian Government’s Direct Action Plan and Cleaner Environment Plan on local government and the region in June 2015 (Ref: D2015/07246). Planning Institute of Australia - National Climate Change Working Group Support continues to be provided to the Planning Institute of Australia (PIA) in relation to the establishment and implementation of their professional development program through the National Climate Change Working Group. The aim of the professional development team is to design national level education programs aimed at planners and developers in relation to climate change and its impacts. A webinar was held on 23 June 2015 hosted by the Climate Council in conjunction with PIA with 135 participants. Professor Will Steffen presented in relation to the Climate Council's report: Counting the Costs: Climate Change and Coastal Flooding which found that $226 billion of infrastructure and homes are at risk from coastal flooding across Australia. Professor Steffen provided a comprehensive update on the economic risks from coastal flooding. There is the potential that coastal flooding could have impacts on the Swan River upstream and flood risk mapping is being developed as part of the Understanding and Managing Flood Risk in Perth’s Eastern Region project being undertaken in partnership with the Department of Water, State Emergency Management

A review of the Local Climate Change Adaptation Action Plans (LCCAAPs) for the Town of Bassendean, Cities of Bayswater and Belmont and Shires of Kalamunda and Mundaring was finalised. These reports review actions that have been undertaken within the LCCAAP and provide a gap analysis for future areas of opportunity. Development Plan The Swan and Helena Rivers Management Framework Review Report was finalised and endorsed at the February Council meeting. Swan and Helena Rivers Management Framework stakeholders have been forwarded a copy of the final report. Work is continuing to establish a strategic steering group to assist with coordination of the Swan and Helena Rivers Management Framework. Action: Identify and respond to funding and advocacy opportunities relating to

the Swan and Helena Rivers Management Framework The Understanding and Managing Flood Risk in Perth’s Eastern Region project has commenced with funding from the Natural Disaster Resilience Program. Memoranda of Understanding have been executed between the project funding partners – Department of Water and Cities of Swan, Belmont and Bayswater. The Department of Water has completed stage one of the project involving flood data collection and collation. A request for tender process has commenced to engage a consultant to undertake a catchment hydrology assessment as part of the flood study for the Swan and Helena rivers. Hundreds of local primary school students have created stunning creative designs depicting what they can do to help restore a healthy environment after a bushfire. These are currently on display at the Mundaring Arts Centre for the Mundaring Environmental Art Project until 27 September. The Mundaring Arts Centre is proud to announce the wonderful artistic creations by over 450 local primary school students are currently on display at the Mundaring Arts Centre until Sun 27 September. This annual project is a partnership between the Mundaring Shire’s Environmental Advisory Committee, the Mundaring Community Bank Branch Bendigo Bank, the Mundaring Arts Centre, local schools and Department of Culture and the Arts. Students from Mundaring, St Anthony’s Greenmount, Glen Forrest, Sacred Heart, Sawyers Valley, Midvale, Pickering Brook, Gidgegannup, Treetops Montessori, Mundaring Christian College, Middle Swan, Mount Helena and Chidlow Primary Schools have taken part in the annual Mundaring Environmental Art Award Project and submitted their works expressing their positive messages about the importance of nurturing and protecting the earth. This year’s theme, Bushfire Recovery Evolving in the Presence of Fire invited students to explore the effect of bushfire on native flora and fauna to provide solutions for recovery and future environmental practice. Lower primary students reflected on what they could do to create healthy habitats for assisting native flora and fauna to recover after a bushfire. Upper primary students investigated the idea of regeneration and depicted their ideas for re-establishing healthy environments after a bushfire. Each class approached the topic differently with some schools undertaking cultural visits, eco tours and research into topics such as; shelter, habitat and food requirements; manmade habitats (nesting boxes); minimising erosion; weed control; methods to improve water quality and fire resistant replanting. Out of the entries, a record 15 winners have been chosen to paint their designs as large scale banners for the town centre. A further 34 highly commended students were selected and these students will receive a special prize bag. The public is invited to visit the exhibition from 11 – 27 September, enjoy the wonderful variety of works on show and vote for your favourite artwork. The student with the most votes will receive the People’s Choice Award at the banner launch ceremony in the Nichol Street Rose Gardens in November.
