    NOTICE OF INTENTION TO CIRCULATE A RECALL PETITIONTo the Honorable Virginia Marquez, Council Member - Ward 1 of the Common Council ofthe City of San Bernardino: Pursuant to theCalifornia Constitution, the Charter oftheCity ofSanBernardino includingArticle VII, Sec. 122thereof, and California election laws, theundersigned registeredqualifiedvoter of the CityofSanBernardinoand its Ward 1, in the StateofCalifornia,does hereby give notice that I am a proponent ofa recall petition and intend toseekyour recall and removal fromthe officeof Council MemberforWard 1of the CityofSanBernardino, California, and to demand election of a successor in that office.

    The grounds for the recall are as follows: CouncilMemberMarquez was elected to officeinNovember of2009 and has since that time has failed to protect the health, safety, and welfareof the residents of the City ofSan Bernardino and demonstrated dereliction to the duties of herelected office by making fiscally irresponsible votes and by supporting fiscally irresponsibleprogram leading to the misuse of the City's General Fund. Council Member Marquez's actionsand failures to act, have propelled the City of San Bernardino into financial crisis, and have ledto the filing for protection under Chapter 9 of the federal bankruptcy laws by the City. The Cityof San Bernardino is currently the object ofnation-wide ridicule as a result of the mishandling ofthe bankruptcy and its proceedings.

    Further, Council MemberMarquez has violated the public trust by repeatedly failing toreach consensus with the other members of the San Bernardino City Council on basic issues ofCity finances, and ignored advice of the City's Executive Staff for the previous two yearsregarding financial concerns. Her actions have led to massive reductions in City services andpolice and fire personnel, causing an increase in crime rates, businesses leaving the City, andcontributed to overall blight within the City.Signed this day ofApril 2013The printed name, residence address, and signature of the proponent are as follows:Name Address SignatureChristian Fernando Flores. If ananswer is filed, a copyof itmustbe served ononeof theproponents, personally or by certifiedmail, within the sameseven(7) dayperiod, andif it is to bepublished, at the sametime shall filewith theCity Clerk a statement declaring his/her intent thatthe answer be published.
