Brite was appointed Warning Order Attorney to notify Unknown Heirs, Assignees, Beneficiaries, Legatees and Devisees of Melinda Rouse, if any, and Unknown Heirs, Assignees, Beneficiaries, Legatees and Devisees of Bobby Allen and any unknown persons who may have an interest in the property which is the subject matter of this motion and is described as follows: Located near Custer in Breckinridge County, Kentucky, and being more particularly described as
follows, to-wit:
Beginning at a steel stake located and the Northerly line of Ira and Polly Hancock lot; thence runningwith their line in a more or less Southwesterly direction 170 feet, more or less, to another steel stake,same also being along the Hancock's rear property line; thence in an Easterly direction along HelenDyer's line 116 ft., more or less, to another steel stake; located in the rear line of Mattie Allen; thencealong Mattie Allen's rear property line 175 feet, more or less, to another steel stake, also being a cornerto Willard Bennett; thence along Willard Bennett's line in a Southerly direction 85 feet, more or less tothe point of beginning, as per description furnished draftor of this instrument on this date.
Being the same property conveyed to Ira Hancock and Polly Hancock, his wife, from Mattie Allen,widow of Oscar Allen, deceased, unmarried, by deed dated June 13, 1979, and recorded in Deed Book201 at page 59 in the Breckinridge County Clerk's Office. Ira Hancock died and pursuant to thesurvivorship provision in said deed, Polly T. Hancock became the owner.
Being a part of the property included in the deed to Sidney Probus and Ruth Nell Probus byCommissioner's Deed dated May 16, 2001, and recorded in Commissioner's Deed Book 10 at page500 in the Breckinridge County Clerk's Office. Thereafter, Sidney Probus died. Thereafter, Ruth NellProbus died November 12, 2016, and pursuant to her Affidavit of Descent recorded in Deed Book 419at page 425 in the Breckinridge County Clerk's Office, Timothy C. Probus and Melinda Rouse becamethe heirs at law of Ruth Nell Probus.
Oscar Allen and Mattie Allen, his wife, were conveyed a three acre tract of property from Carl Davisand Altha Davis, his wife, by deed dated November 9, 1966, and recorded in Deed Book 112 at page365 in the Breckinridge County Clerk's Office. Copy Attached. Plaintiffs Exhibit 1.
EXCEPTION IOn August 12, 1967, Oscar Allen and Mattie Allen executed a deed to Willard Bennett and his wife,conveying from the parent tract 1.4 acres, more or less. Said deed is recorded in Deed Book 113 atpage 121 in the Breckinridge County Clerk's Office. Copy Attached. Plaintiffs Exhibit 2.
EXCEPTION IIOn March 7, 1969, Mattie Allen, widow of Oscar Allen executed a deed to G. H. Huffines, conveyingfrom the parent tract X acre, more or less. Said deed is recorded in Deed Book 115 at page 401 in theBreckinridge County Clerk's Office. Copy Attached. Plaintiff's Exhibit 3.
EXCEPTION IIIOn September 16, 1972, Mattie Allen, widow of Oscar Allen, executed a deed to Ira Hancock and PollyHancock, his wife, conveying a tract of property from the parent tract (no acreage given). Said deed isrecorded in Deed Book 127 at page 525 in the Breckinridge County Clerk's Office. Copy Attached.Plaintiff's Exhibit 4.
Thereafter, Mattie Allen, widow of Oscar Allen, unmarried, executed a deed conveying part of theparent tract to Ira Hancock and Polly Hancock, his wife, by deed dated June 13, 1979; however, saiddeed was not recorded until July 20, 1990, in Deed Book 201 at page 59 in the Breckinridge CountyClerk's Office. Copy Attached. Plaintiffs Exhibit 5.
On January 4, 1989, Mattie Allen, widow of Oscar Allen, executed a deed to Bobby Allen conveyingthe parent tract of three acres subject to the three exceptions stated in the deed. The deed to BobbyAllen is recorded in Deed Book 192 at page 335. The property conveyed to Ira Hancock and PollyHancock, his wife, by deed dated June 13, 1979, and recorded in Deed Book 201 at page 59 in theBreckinridge County Clerk's Office should have been listed as an exception in the deed to Bobby Allen, but was not. Copy Attached. Plaintiffs Exhibit 6.
Thereafter, Bobby Allen died, and his mother, Ruby Harris, became the owner of said property byinheritance. Bobby Allen mortgaged said property to Meade County Bank before his death and themortgage became delinquent, and the property was sold at Master Commissioner sale on May 16,2001, at which time Sidney Probus and Ruth Nell Probus purchased the property. Copy Attached.Plaintiff's Exhibit 7.
Sidney Probus died and Ruth Nell Probus became the owner of said property by the survivorshipprovision in the deed. Ruth Nell Probus died November 12, 2016, at which time her son, Timothy C.Probus, was appointed Administrator of her estate.
