21 of the Rights of
Important provisions in the Rights of Persons with Disabilities Act, 2016.
3.(1) The appropriate Government shall ensure that the persons with
disabilities enjoy the right to equality, life with dignity, and respect for his
or her integrity equality with other.
20.(1) No Government establishment shall discriminate against any
person with a disability in any matter relating to employment.
20.(2) Every Government establishment shall provide reasonable
accommodation and appropriate barrier-free and Conducive
environment to employees with disability.
6(1) The appropriate Government shall take measures to protect
persons with disabilities from being subjected to torture, Cruel, inhuman
or degrading treatment.
6(2) No person with a disability shall be a subject of any research
without, prior permission of Delhi State Committee for Research on
Disability
92. Whoever. (a) intentionally insults or intimidates with intent to humiliate a person
with disability in any place within public view:
(b) assaults or Uses force to anyY person with disability with intent to
dishonour him or outrage the moadesty of a women with disability:
(c) having the actual charge or control over a person with disability
voluntarily or knowingly denies food or fluids to him or her;
(d) being in a posifion to dominate the will of a child or women with
disability and uses that position to exploit her sexually:

e) voluntarily injuries, damages or interferes with the use of any limb or
sense or any supporting device of a person with disability: shall be
punishable with imprisonment for a term which shall not be less than six
months but which may extend to five years and with fine.
Important provisions in the Mental Healthcare Act, 2017
23(1) A person with mental illness shall have the right to contidentiality
in respect of his mental health, mental healthcare, treatment and
physical healthcare.
24(1) No photograph or any other information relating to a person with
mental illness undergoing treatment at a mental health establishment
shall be released to the media without the consent of the person with
mental llness.
LBSH Equal Opportunity Policy Details
A. Facility and amenity to be provided to the Persons with Disabilities
(PWD) to enable them to effectively discharge their duties at LBS
Hospital.
Physical and digital infrastructure (buildings. furniture. facilities
and services in the building) adhering to the accessibility
standards to be mentioned here
As required by the RPDA 2016. LBSH will offer reasonable
adjustments for eligible employees with disabilities wherever
possible. Accommodations would be made; a) to provide equal
opportunity in the applicafion and selection process. b) to
enable an employee with disability to execute the essential
functions of a job, and c) to allow disabled employees to enjoy
non-disabledthe same advantages and privileges as

employees. Obtaining or altering equipment or gadgets,
modifying assessment and training materials, modifying work
Schedules, and reassignment fo a vacant position are all
examples of reasonable adjustments. All records relating to an
employee's request for reasonable accommodations would be
kept in ihe employee's confidential file, which would be kept
separate from the employee's official personnel file.
. Employee with disabilities are given Transport Allowance at double
the normal rate + DA thereon, as per Ministry of Finance,
Department of Expenditure, OMnO.2013/2017-e.iib DATED
12.07.2018.
2. Income Tax Exemption for the employee with disabilities as per
Govt. rule
3. Grant of Children Education Allowance for children of governmeni
employees with disabilities payable at double the normal rates of
CEA prescribed.
4. Special Allowance for child care for women with disabilities and
Education Allowance for disabled chilcren of Govi. Employee.
B. List of posBs identified suitable for persons with disabilities in Lal
Bahadur Shastri Hospital
(1) There is no direct recruitment of A,B, C and D category of
posts in Lal Bahadur Shastri Hospital, except for the Junior
Resident, Senior Resident. which are engaged as per
residency scheme.
Junior Resident and Senior Residenls are appoinled category wise
which also includes persons with disability on Ihe basis of available
vacancies as well as considering order daled 16.01.2018 of State
Commissioner for Persons with Disabilities, GNCTD endorsed by Dy.
Secretary(HR-Med) vide letter dated 08.03.2018.
(The notification for appointments are published at the official
website with its copy pasted/affixed on the Notice Board of LBSH.
C. The manner of selection of Persons with Disabilities for various
posts, post-recruitment and pre-promotion training, preference in
fransfer and posting, special leave, preference in allotment of
residential accommodation if any, and other facilities for PwD in
Lal Bahadur Shastri Hospital.
Recruitment
Resident Doctors are engaged ihrough Walk-In-Interview and/or
Screening Tests.
1. 4%reservation in recruitment for recruitment of person with
Disabiliies against the identified post of benchmark disability.
Such employee with disability will receive an induction iraining
session alongside the rest of ihe staff.
2 Age relaxation of 10 years as per applicable instructions of GOI
time to time.
Fee exemption for candidates with disabilifies. 3
Post Recruitment and Pre-Promotion Induction Iraining Lal Bahadur Shastri Hospital only induct Resident Doctors, which
are engaged against tenure posts. There is no promotion in the
Residency Scheme.
Preference in transfer and posting. As far as possible, the persons with disabilities may be exempted
from the rotation transfer policy/transfer at hospilal level and
allowed to continue in the same job, where they would have
achieved the optimum performance Further, choice of

preference in place of posting aft the lime of transfer may be
given to the persons with disability subjec lo Ihe administrative
constraints. Instructions issued by the Department of Personnel
and Training, Government of India, from time to time will be
followed.
Leave/Special Leave. a) The guidelines issued in this regard from GOl as well as Stale
Government will be followed. Special Disabilily Leave admissible
to the officials vide DoP&T OM NO.2011/1/2008-Est. Dated
19.11.2008 and 10 days Special Casual Leave admissible to the
officials vide DoP&T OM No.28016/02/2007-Estt(A) dated
14.11.2007. for participating in Conference
Seminars/Training/Workshop relateed to disability and
development to be specified by Ministry of Social Justice &
Empowerment shall be implemented
b) Subject to availability. this Hospital shall provide accessible
accommoda tion to the persons with disabilities near their place
of posting and they will be preferred for allotment of ground floor
accommodation. Existing housing accommodations will be
renovated subject to feasibility to make them accessible to
person with disabilities.
Preference in allotment of residential accommodation. Subject to availobility. Lal Bahadur Shastri Hospital shall provide
accessible accommodalion lo Ihe persons with disabilities in the
staff quarters availble al the campus and Ihey will be pretered
for allofment of ground floor accommodation. Existing housing accommodations will be renovated subject lo feasibility to make
hem accessible to persons wilh disabilities (by the Estate Officers)
D. Provisions for assistive devices, barier free accessibility and other
provisions for persons with disabilities.
. Separate counter are available for people with disabilities at
fhe required places like pharmacy area, OPD registration
area.
2. Registration on priority basis.
3. Doctors examine the disabled patients on priority basis.
4. Secuity guards are also available for assistance. Time to time
instructions are given to the guards during the briefing to assist
PwD.
5. Attendants/Nursing Orderlies who are PwD are given duty at
accessible place preferable to ground floor, like Ground floor
OPDs.
6. Adequate number of ramps are available in hospital.
7. Adequate number of wheel chairs in hospital. Wheel chairs
are parked in emergency block.
8. Separate toilets for Persons with disability are available at
different wards. Further Public work department of LBS
Hospital is being approached io construct PwD friendly toilets
in emergency block, OPD area, pharmacy area and old
building wards are.[Annexure-B).
9. Required help is being provided through Dealing Assistant
(UDID) in form filling and issuance of railway concession formn.
in the registration for PwD certificate. OPDs and Emergency. 10.The parking space near ward building IS earmarked
dedicatedly for Persons with Disabilities.
11.Other facilities and amenities are to be provided to the
persons with disabilities (PwD) to enable them to discharge
their duties in the establishment, are propOsed and planned
as per latest guidelines of Govi. ot India in thIS regard as
under ( Direction tiles are placed from the Admin Block to
emergency ward, OPD block and Ward block for
physichally handicapped people.
Double side railing are provided in the corridor of
OPD/ramp Each and every connecting corridor and stiair case are fo
be provided with double type hand railing for grabbing
purpose for PwD.
12. The work related to above provision is to be progress through
fime to time communication with Public Work Department.
E. Appointment of liaison officer by the establishment to look after
the recruitment of persons with disabilities and provisions of
facilities and amenities for such employees.

The above policy covers applicants with disabilities for posts in the
LBSH, full time. part time employees, interns/trainees, Contractual
employees, including temporary employees. I| also covers those
employees who acquire disability during their work tenure. This
policy also applies lO all aspecis of employment, be it
recruitrnent, iraining, working conditions. salaries Iransters
employee benefits and career advancement. Review ot Policy
shall be undertaken at regular intervals.
