Below is the Staggered Motion Docket for the Fourth Circuit Court for Friday, August 27, 2021.

Please remember that attorneys and/or litigants who are suffering from the Covid-19 virus, have recently been exposed to the virus, are experiencing

symptoms of the virus, or running a temperature should not appear in court.

While in the building, maintain social distance from other individuals of at least 3 feet at all times. FACEMASKS ARE REQUIRED.

Both Third and Fourth Circuit Court are experimenting with ways to hopefully expeditiously deal with our Motion Docket and minimize the

number of people in the courthouse at any one time. PLEASE NOTE THAT THE COURTS’ MOTION PROCEDURES DIFFER. If you have

Fourth Circuit Court will be addressing its motions as follows:

1. Absent extraordinary circumstances and advance approval by the Court, ALL motions shall be heard in-person.

2. Motions for default judgment and all other “1st Call” Motions will be taken up first, promptly at 9:00 a.m. All attorneys, litigants, witnesses

and court reporters are directed to be present and ready to proceed at 9:00am. Court staff will call your motion in the hall and the attorneys and litigants

shall be allowed to enter the courtroom at that time, not to exceed 20 people at a time. Any witnesses are requested to remain in the hall until they are

called to testify.

3. The next set of cases will take place beginning at 10:00 a.m. until all cases are concluded. All attorneys, litigants, witnesses and court reporters

are directed to be present and ready to proceed at 10:00am. Court staff will call your motion in the hall and the attorneys and litigants shall be allowed

to enter the courtroom at that time, not to exceed 20 people at a time. Any witnesses are requested to remain in the hall until they are called to testify.

4. The next set of cases will take place beginning at 11:00 (or as soon as the cases from the 10:00 docket are concluded, whichever comes last)

until all cases are concluded. All attorneys, litigants, witnesses and court reporters are directed to be present and ready to proceed at 11:00am. Court

staff will call your motion in the hall and the attorneys and litigants shall be allowed to enter the courtroom at that time, not to exceed 20 people at a

time. Any witnesses are requested to remain in the hall until they are called to testify.

In the event an interpreter is necessary, the use of the State Trial Court interpreter, an interpreter approved by the Administrative Office of the Court

or approved by the AOC guidelines, is required for motion hearings and it is incumbent on the party requiring the interpreter to secure the same.

As always, attorneys and self-represented litigants are encouraged to communicate prior to the motion docket in an effort to reach in agreement on

any pending motion. This is VERY important. PLEASE be mindful about trying to resolve your motions BEFORE appearing in court.
