As the agency first released drafts of the proposed rule it became apparent that the agency was attempting to expand its jurisdiction to the extreme in order to control more land and more activities

involving the use of land. As the rule was reaching its final draft NAHB, the partners within our federation, and hundreds of other groups submitted over a million comments regarding this onerous intrusion into controlling our lives. The only success we were able to achieve was to remove subsurface seeps and shallow underground drainage from the rule.

What the final rule does is to include “tributaries” and waters with a “bed, bank, and ordinary high water marks”. These two items were being used in some interpretations by the Army Corps of Engineers (COE) in application for projects that disturbed land. This is not good news immediately for our industry. As I write this to you I sit in Ronald Reagan National Airport as I return from NAHB’s Spring Board of Directors meetings in Washington DC. We have spent three days discussing how we got here and what is going to be done to address the issue.

In short, as Tom Wood, NAHB Chairman from Blue Springs Missouri stated it today at the culmination of our meetings, “we’re going to sue them...sick ‘em Rizzo”; referencing NAHB’s General Counsel. Looking back we had originally thought that the EPA may handle this rule like they handled their proposed Nationwide Stormwater Retention Standard. After the 2010 elections the EPA rescinded that rule. After the last November elections we contacted NAHB legislative staff. The bad news was that President Obama was personally pushing this rule and that because of that the EPA was not going to back down. And...they didn’t.

What will this mean in the short term? It will be more expensive to develop and build. The process will become that much longer and less and less in our industry will be able to make a living in development and building; not just residential building but ALL building. Not to take this laying down we have worked to get a bill worked through the House of Representatives and have established a companion bill in the Senate. The house bill is H.R. 1732. Please call on Senators McConnell and Paul to support this bill. They have a good history of supporting our causes. However, it is far more important for you to reach out to your friends outside of our state and ask them to call their Senators to support our cause.

We are working on a veto proof Senate majority to push this disaster back and we need all of your help. That is what we can do now. To help solve these issues in the long run we need a significant change in the White House in 2016. Whatever your political affiliation it needs to be said that more has been done to harm our industry in the last few years than has been done over the last many decades. In late May the US Environmental Protection Agency (EPA) finalized its rule making defining the waters of the U.S.. After decades of urging by the National Association of Home Builders and dozens of other trade associations the EPA took upon the task of defining their jurisdiction of particular waters. Up until the rule was finalized application of very ambiguous interpretations of what constituted a jurisdictional water created applications that were at times unknown for developers and others that disturbed earth in their business.

In late January this year, Tammy Gorby became the Administrative Coordinator. Tammy’s smile and pleasant voice welcomes members and visitors to the HBANKY office. Tammy provides office support including reception duties, conference

center reservations, association building committee meeting reservations and arrangements, HBA building maintenance, Southern and Eastern Counties Council and the association calendar. Tammy came to HBANKY with a diverse background. Tammy brings to the HBA experience as a real estate agent. She also is knowledgeable in the hospitality industry. These talents are an asset to the HBA and bring an additional flair to the staff.

Tammy recently celebrated the high school graduation of her twin children - Sarah and Ian. Her love of dogs is shared with Nikki and Riley, her dogs. In her spare time, Tammy volunteers with SAAP, Stray Animal Adoption Program. She also fosters dogs. As a matter of fact, Tammy had fostered Riley before adopting her.

On June 6th during the National Association of Home Builders’ (NAHB) Spring Board of Directors meeting Brian Jones was named a Life Director of NAHB. Brian is a longtime member of our HBA and has been active with his State Association and NAHB. To attain

Life Director status one must be a voting director of NAHB for ten years. Each of those ten years a director must attend two NAHB Board of Directors meetings each year. Brian continues to serve his industry as he is our current Associate President; an office he has served in once before. He has chaired several of our HBA’s committees and task forces as well as done the same at our State Association. Brian is President/CEO of CK Ash Insurance in Florence. He serves his community and industry on several boards around Northern Kentucky and around the state. We congratulate Brian for this fine accomplishment and look forward to his continued commitment to our industry. We thank you!

The 2015 Cavalcade of Homes, sponsored by Drees Homes, scattered site show held the first three weekends in May was

a true celebration of Northern Kentucky’s new home inventory. Northern Kentucky is bursting with possibilities to grow. Outdated and overloaded sewer systems have been a stumbling block, however, for developers in the region. In

Boone County, the Richwood Pump Station affects the Triple Crown area where more than 100 home sites were turned down for approval because the area had reached sewer capacity. “That pump station also affects commercial projects and one sizable industrial parcel that our economic development corporation has been working to bring 1,000 jobs to the region,” HBANKY Executive Vice President Brian Miller explained. According to Miller, reservations of sewer capacity in Hebron had been shut down for more than a year and are closer to coming on due to funding for an engineering study of the project.

HBANKY Building Community Rallies Together for GrowthHBANKY builders and developers voiced their concerns in unison in recent months as SD1 conducted its 2016 budget approval process. They spoke loud and clear about the problems associated with aging infrastructure that causes sewer overflows in older neighborhoods and the growth issues that face Northern Kentucky. Bringing new businesses and investors to the area was impossible without addressing these problems.

After months of speculation of whether SD1 was going to raise rates for current customers, the board decided to instead reduce cash reserves and cancel proposed projects to provide the $4 million for new growth projects. The board agreed to move forward with a sewer main project that would redirect flow from the Richwood Pump Station to another plant in the western part of Boone County. While the SD1 Board of Directors instructed the staff to accept reservations of capacity in both areas the Judges Executive of Kenton and Campbell disagreed; sparking a contentious issue that will take time to resolve itself. Their stance is that since engineering was complete for the Richwood Pump Station and not Hebron that construction could begin almost immediately. In Hebron it would take up to six months to complete engineering and begin funding construction.

HBANKY disagrees with the Judges Executive on this issue, Since SD1 has become extremely political it is important to “lock in” the utility

to funding the construction in the future. If reservations were to be granted now developers could begin what may be over a year long process to install streets and infrastructure. This would align construction funding at SD1 with developers bringing new homes, and new ratepayers, to market.

The budget went into effect July 1, giving the green light to some key housing and commercial projects that are anticipated to bring jobs and fuel economic growth for the region. “All in all this is a big win for all in the construction industry,” Miller said. Future SD1 customers are anticipated, which will bring in more money to the district that will enable SD1 to fix existing infrastructure problems.

HBANKY President Jason Yeager, Ashley Construction, commented on the decision and applauded the efforts of association members for helping give the industry a strong voice. “Advocacy is the unspoken part of our association. We have a passionate group of members who go to bat for our industry. If anyone is looking at why they should become a member, this is one of the reasons. Without these efforts, you would find a much flatter local economy,” he explained. According to Yeager, growth begins with providing homes for communities to attract industry and jobs that will employ current residents and bring in new ones. “It’s a simple formula in our minds, but we’re not bullheaded. The HBA respects the fact that growth isn’t the only issue. There are multi-faceted systems that the SD1 board has to manage. They have a tough job, supporting our current system, then expanding it. It’s a difficult balance to strike, especially when different opinions are involved,” he said.

Increased Sewer Capacities in Richwood Give Green Light to Projects That Have Been on Hold – Funding for Hebron Engineering One Step Closer | In June, the Sanitation District No. 1 (SD1) approved its 2016 budget, which includes approximately $4 million in funding for increased sewer capacity in Boone County, specifically the Richwood Pump Station and an engineering study in the Hebron areas. Growth in both communities has been stymied due to lack of capacity issues, leaving developers who have been ready to invest in the community shaking their heads in frustration.

Yeager emphasized the importance of advocacy within the association. “We’re constantly addressing each and every issue that comes to our table. Brian (Miller) shares the same passion we do. As President, I’ve been able to watch how the association operates in full force. It’s not about winning or losing, but it’s about staying involved. These kinds of decisions affect all of us. It’s great news and it’s a step in the right direction,” he said. Yeager emphasized that while he respects the balance that the SD1 board has to strike and the responsibility to manage the current systems in place, he believes growth should be a bigger part of the solution.

Mike Conklin, Drees Homes, described the synergy going into the SD1 board meeting. “The building community really came together. We filled the room. I left the meeting feeling better than I thought I would. I was glad the Hebron issue was resolved at the board meeting and am equally concerned that it is being held up by the Judges Executive. I’m grateful they recognized that growth is happening, and for us at Drees it makes an immediate impact,” he said. Conklin explained the company has two sections in the Thornwilde subdivision ready to go, so fixing Hebron is a difference-maker for them. In addition, the Richwood decision enables them to move forward with working with Triple Crown developers Jim and Tony Berling of Berling Engineering Co. in building 100 patio homes in the development. According to Conklin, some of lots will be ready by early fall. “This really showed a partnership between the builder community and SD1 where the system worked. We showed up in force, we stated our position; the board listened and voted for a growth initiative in Northern Kentucky. That’s a win-win. For so many years, we were at odds with each other. I’m grateful the process worked. We have more work to do to save Hebron but the winner in this is the economy and the citizens of Northern Kentucky,” Conklin added.

Land Development Council President John Toebben, Toebben Builders, believes the recent decision is a step, but one that’s overdue. “We’re nearly at the crest of a slope that, if more money is not allocated toward new development, we will turn away more businesses who ultimately want to employ our children,” he emphasized. “In Hebron, for example, they’ve got brand new schools, a new state highway, new water and gas lines, but no sewers. When the iron was hot and we wanted to develop there, we

couldn’t build in that community. The minute you don’t have the utilities in place, that’s the beginning of a travesty. We have to ensure those needs are met,” he elaborated. Toebben emphasized the need to act sooner than later to enable growth and for development to support a viable community.

Shad Sletto, EGC Construction, said his company has clients in both the Richwood and Hebron areas that haven’t been able to move forward with projects. He commented on the impact that representatives of the residential and commercial building industry made in bringing the challenges that have impacted growth to light. “I felt like the builders that work in NKY had a heavy presence. The vast majority of them were present, demonstrating that they want to invest in their own backyard,” he said. Sletto pointed out that developers have been paying tap-in fees that have helped support sewer services for years and he was quick to correct the misconception that increasing the service subsidizes new construction. Instead, he said, it’s the other way around. “It’s important to note that by increasing service, the new tap-in fees will help fund the growth of SD1. New construction can help pay for maintenance of existing systems. Those fees subsidize the capacity of the new plants,” he said.

In communities where history is celebrated and roots are deep, no one wants the infrastructure to be as old as what’s on the museum shelves. Northern Kentucky’s heritage is part of its charm, but aging sewer lines are not a source of pride. Ralph Dusing, Bluegrass Commercial Group, was at the SD1 meeting in support of the association and the industry and praised the region’s efforts to bring in more industry, but emphasized the need to repair existing facilities. “There’s a lot going on – at least six or eight projects just in Covington. There’s a lot of positive stuff going on above ground, but there’s not much attention being placed on what’s going on under the ground,” he emphasized. From a commercial perspective, Dusing represents interests primarily in Covington, where he said money is desperately needed to upgrade and fix the sanitary sewers system.

With the door opened for opportunities to grow, the region is one step closer to doing what it needs to provide a backdrop for attracting more jobs and fueling growth. For some, it’s considered a baby step, but for others it’s enough to start moving forward immediately.

Women Build is a Habitat for Humanity program that empowers women to build homes, lives, hope and communities and creates new connections and lifelong bonds

Building will start around Mother’s Day 2016 and be completed by December 2016 – everyone is invited to attend Kick-Off ceremonies at the beginning of our builds and the Dedication celebrations once the homes are complete

We are building three homes this year, side-by-side, located at 2465, 2475, 2489 Wilson Avenue in Colerain Township, Hamilton County (home model pictured below)

According to the latest NAHB/Wells Fargo Housing Opportunity Index, 66.5% of new and existing homes sold between January and the end of March were affordable to

families earning the U.S. median income of $65,800.“Now is a great time for consumers to buy homes,” said NAHB

Chairman Tom Woods, a home builder from Blue Springs, Mo. “Both first-time and move-up buyers can take advantage of these favorable market conditions and start building their American Dream.”

The national median home price declined from $215,000 in the fourth quarter to $210,000 in the first quarter. Meanwhile, average mortgage interest fell from 4.29 percent to 4.03 percent in the same period.

First-time home buyers also can find help qualifying for a mortgage with low-downpayment programs offered by Fannie Mae and Freddie Mac that are geared primarily toward the first-time home buyer market. These lenders now offer mortgages with 3% downpayments, allowing more creditworthy borrowers who lack the funds for a large downpayment to obtain a home mortgage.

As housing affordability continues to improve, more consumers can discover the benefits of homeownership, including the fact that it is a primary source of net worth for many Americans, and is an important step in accumulating personal financial assets over the long term.

The financial benefits of homeownership begin in the first year for most home owners, through the ability to deduct mortgage interest and property taxes paid off their taxable income. This can result in savings of thousands of dollars every year, especially in the early years of the mortgage when interest makes up the largest portion of the monthly payment.

In addition to the financial benefits to families, homeownership also strengthens communities. Home building increases the property tax base that supports local schools and communities.

“Homeownership builds stronger communities, provides a solid foundation for family and personal achievement and improves the quality of life for millions of people,” said Woods.
