JIM Cutter ConstruCtIon wIns ethICs AwArd
On Oct. 27, Jim Cutter, owner of Jim Cutter Construction in Cold Spring, was awarded a 2011 Torch Award for Marketplace Ethics by the Greater Cincinnati Better Business Bureau (BBB), which also serves northern Kentucky. “The Torch Award encompasses the spirit and tradition of the BBB unlike anything else,” said BBB president Jocile Ehrlich. “It recognizes and honors businesses and organizations that fully
commit to ethical practices in all aspects of their business dealings.” Cutter, who is HBAK’s vice president/treasurer and a member of HBA of
Northern Kentucky, received the award during a gala at Cincinnati’s Duke Jim Cutter Construction wins ethics award Energy Convention Center. “Too often, the news is about the scandals or problems with businesses and nonprofits,” said Ehrlich. “Our Torch Awards not only recognize good organizations, but let our community know that good organizations committed to doing the right thing are the norm.” The Torch Awards for Marketplace Ethics is a program of the Center for Ethics at the BBB.
hoMe buILders APPLAud ConGress For restorInG hIGher FhA LIMItsThe National Association of Home Builders (NAHB) applauds Congress for reinstating for another two years the higher conforming loan limits for the Federal Housing Administration (FHA), noting that this is an important step to help mend the struggling housing market. “We commend congressional leaders in both parties and each chamber of Congress for taking this action to boost overall mortgage liquidity in the marketplace, create jobs, and provide home owners and home buyers with safe and affordable financing,” said NAHB Chairman Bob Nielsen, a home builder from Reno, Nev. “Restoring the higher FHA loan limits will help to stabilize home values, provide constancy while private investors re-enter the market, and enable millions of creditworthy consumers to get home loans with the best mortgage rates and lowest fees and down payment requirements,” he added.

My name is Anthony McFarland and I am currently enrolled in the Carpentry Program here at Home Builders Northern Kentucky. My employers, G.L. Staley Construction, gave me the opportunity to attend this 2 year program to help train my skills on the worksite. I really appreciate the confidence that Gerald Staley and the Carpentry teaching staff have in me. My goal is to excel in this program and work hard to become an even bigger asset to the company.
My name is John Haake. I graduated from Dayton High School and live in Dayton Kentucky. I chose to go into the Electrical field because my brother-in-law is a very successful electrician. I decided it would be a great trade for me as well. I am in the first of my four years here at the Enzweiler Trade Program and I have already learned so much here!

Midwest Training Services (also known as Success Enterprise) has been in the lead paint training business for going on 10 years. We are based out of Nunica MI
and started in 1973 as a general construction comapny. Over the last 30 plus years we have been building homes that range from $90,000 to $590,000. With the decline in the housing market that began around 1998, at least here in MI, we began to work for the many HUD funded programs, the low income/no income housing. As you know, when you are working with government funds you have to have additional training, in this case lead abatement.
So in 1999 we became the 141st state certified lead abatement contractor and have been performing lead abatement work all over the state of MI ever since. In 2002 we began conducting lead based paint inspections and risk assessments and in 2003 we began teaching the lead related course with Michigan accreditation. Over the past few years and the many new rules that have been passed from by EPA, we have received accreditattion from the EPA to be a nationwide trainer.
We have been actively presenting the RRP class since Oct 2009 in MI, OH, WI, IL, IN, KY, TN PENN, SC, FL (FL and SC are good places to work in the winter months!) The Principal Instructor is myself, Joe Fehler, I currently hold a Michigan residential builders license (1995), MI lead abatement supervisor license (1998), lead paint inspector and risk assessor license (2001). One of the big things I bring to the table that many other training providers do not is, I’ve done the work, which means I can present the info in a way that the student will be able to apply it to the field, I can tell what is easy to do and ehat is not so easy to do.

Northern Kentucky EMS is a non profit organization and Laura Randall has been the director of NKEMS since 1980. Our primary emphasis had been on EMS training
and is now health and safety training, along with Automated External Defibrillation (AED) implementation for schools, churches and businesses. We are a training center for the American Heart Association and American Safety & Health Institute.

“What’s in it for us?”A lot of times, we find ourselves asking that question when it comes to considering sponsorship of an HBA event. On September 15, 2011, Forge Lumber had the honor of hosting one
of three “Mix and Mingle” events sponsored by the HBA’s Sales and Marketing Council. I was asked to share some thoughts about that experience and what it meant to our company. First of all, let me say that we viewed this as an opportunity to thank our regular customers, the folks who buy our materials and labor, the companies who pay our bills on an ongoing basis. But, we also considered this as a golden opportunity to invite potential customers to see firsthand what we at Forge have to offer professional builders, remodelers and commercial contractors. Finally, it was a chance to meet some of the folks who are actively involved in the HBA and serving on its Boards and committees.
We zeroed in on a theme of “Oktoberfest” for our drinks and hors d’oeuvres. Being the time of year and being that folks in this region generally respond favorably to the German type of food and beverage fare, we thought that would be a perfect way to entice folks to come by. We contacted a caterer and told him what we were up to and he came through with a great menu. We got hold of a beer aficionado who came over and served some different brews and discussed his favorite topic with whoever wanted to know some detail about brewing or the beer we were serving. We arranged for our shop employees to come into work late that day so that they could be here and we could have shop tours while there was something actually going on. We moved around a few things so people would have a place to eat, drink and converse. We cleaned up everything and prepared for the guests to arrive.
Overall, we were pleased with the turnout. The weather cooperated and it was a pleasant evening. Folks whom we had not done business with before came by and toured our facility. Many of our regular customers stopped by and enjoyed
some sausage and kraut and a cold beverage. In a nutshell, it was a great way to increase exposure for Forge Lumber in the market. We got to display our building materials, showcase some of our manufactured products and highlight some of the installed projects we have completed recently.
Don’t feel like you have to hire a caterer and a beer specialist to host a “Mix and Mingle” for your company. You can keep it simple with coolers full of beverages, chips, pretzels and a cheese tray or two. It’s more about the opportunity for you to highlight what your company has to offer to the building community. Clean up the parking lot, dust off the shelves, put on a big smile and invite folks in to see what you are about.
You know, I have been involved with the HBA since 1986. I can tell you firsthand that you get out of it in direct proportion to what you put into it. In these difficult and challenging times for our industry and the economy, it is more important than ever that we have a strong Association and good leaders fighting for our future. Give some serious consideration to getting involved in some small way. I think you will be glad you did. If you and I don’t care enough to do something positive for the building industry, who will?

As any construction professional can attest, anything can go wrong on a construction project. Therefore, it is important that construction professionals and homeowners know
what recourse is available to them when something does go wrong. Let’s suppose that a Contractor wants to sue an Architect for deficient design of a house. The Architect’s deficient design resulted in additional costs to the Contractor when building the house, but there was no damage to any other property or any personal injuries as a result. Generally, the Contractor will not have a contract with
the Architect, and its only recourse will be suing in negligence or other tort remedies. The economic loss doctrine limits tort remedies such as negligence. The economic loss
doctrine provides that if the deficient design or other error only results in damage to the actual construction project, then the claimant has no remedies in tort. Its only recourse is contract remedies. However, if the deficient design causes damage to other property or to persons, then the claimant may sue for negligence or other torts.
Prior to this year, Kentucky case law only tip-toed around the economic loss doctrine. In June of 2011, the Kentucky Supreme Court took a stand, expressly adopting the economic loss doctrine in Giddings & Lewis, Inc. v. Industrial Risk Insurers. In this case, Giddings & Lewis sold a Diffuser Cell System to the purchaser, who used the product to cut and shape metal parts. After working properly for seven years, the product malfunctioned, hurling large chunks of metal across the purchaser’s plant. Fortunately, there was little to no damage to people or other property. The damages to the product itself, on the other hand, amounted to $2.7 million. The purchaser filed a claim with its insurer, who compensated the purchaser for its loss. The insurer subsequently sued Giddings & Lewis to recover the damages suffered by the purchaser. Because the statute of limitations had run on the product’s warranty and contract claims, the insurer’s only recourse was in tort law.
The insurer sued Giddings & Lewis under negligence, strict liability, negligent misrepresentation, and fraud by omission theories. In response, the Kentucky Supreme Court embraced a broad economic loss doctrine, rejecting two possible exceptions to the doctrine. Accordingly, the Court held that the insurer could not recover from Giddings based on these tort claims because the damages were limited to the product itself.
Although Giddings & Lewis involved the manufacture of a product, rather than the construction of a house, it still provides valuable advice to construction professionals and homeowners alike. While some state courts have made an exception for residential construction cases, many courts throughout the states have applied the same economic loss doctrine to construction projects and manufactured products. Kentucky’s stance on residential construction projects remains to be seen. In the meantime, be aware that Kentucky’s newly adopted economic loss doctrine could divest construction claimants of certain tort remedies. Now more than ever, each project participant should ensure that it is covered by a contract with strong contractual remedies and warranties.

Since 2002, Lafarge Gypsum has operated a state-of-the-art plant producing drywall and joint compound in Silver Grove, Kentucky. For the past two years, Lafarge has partnered with the Evening Trades Program to provide tours of their plant for all
of our classes.Students are given a two hour tour of the facility, which uses 99% recycled content by
weight, in the production of drywall. The plant uses synthetic gypsum (calcium sulfate) to produce the drywall. This synthetic gypsum is a by-product of the desulfurization process to improve air emissions at the Moscow and North Bend power plants. This by-product would normally be removed and disposed of in a landfill, but Lafarge has turned that by-product into something valuable and useful, as well as not harmful to the environment!
Besides being seeing motor control centers, properties of drywall products and industrial HVAC equipment, the students get to see a plant that has embraced a Green philosophy of sustainability. Lafarge is listed in the “100 Global Most Sustainable Corporations in the world” and has received the CCL honor awarded by the Wildlife Habitat Council.

Tour of Remodeled Homes: The Tour was held on October 1st and 2nd with a total of 19 entries in Cincinnati and Northern Kentucky and was a huge success! I hope you had a chance to attend the TORH and see the wonderful projects that were entered. Attendance at the show was great and many of the consumers attending were interested in remodeling their homes. The Remodelers in the TORH are already busy following up on leads from the show. Home & Remodeling Showcase: The H & R Showcase will be held February 10 – 12, 2012 at the Northern Kentucky Convention Center. Next year’s show will also feature our Designer’s Challenge where designers are given a blank space to design a room.
