Chad Harris started his career in the moving

industry in 1986 as a packer and mover. Chad

became an assistant dispatcher, dispatcher, op-

erations manager, relocation salesman and a

general manager over his 33-year career. Chad

has spent the last thirteen years devoted to the

commercial relocation business. His goal is to assist

the client in having a great moving experience.

Chad does this by providing his clients with the knowledge

Dear Chapter 36,

It’s so good to be back in Texas, and as you might imagine, I have a lot to

tell about my experience in Nicaragua. The beautiful people and land-

scape were unforgettable, as was their dire need for what we take for

granted….infrastructure! If the schedule allows, I hope to share my bridge

building experience with you at a luncheon in the upcoming months.

If you were like me and missed the Chapter 36 Golf Tournament and Spring

Seminar, I hear we really missed out on a great event! Please join me in

thanking Chapter Vice President Kristen Bennett and her team for the many

volunteer hours it took to deliver a phenomenal golf tournament and semi-

nar. The turnout was great and it was another record breaking year for

fundraising. Big thumbs up to our chapter members and sponsors!

Each year the nomination committee makes a recommendation to the

general membership for the next slate of Chapter Board positions. So on be-

half of Chapter 36, I want to thank the Nominations Committee comprised

of Marcus Boyd, Margaret Lein and Matt Lance for carrying out their duties

and recommending qualified candidates for the upcoming election to be

held at the general membership meeting on Tuesday, May 8th. The recom-

mended slate of officers are: Director 1 Year - Marcus Boyd, Director 2 Year -

Kim Hiebert, President - Kristen Bennett, Vice President - Lora Gunter, Treasur-

er -Dalton Vann, Secretary - Jennifer Hall, Professional Development Com-

Lopez. As a reminder any chapter member is welcome to run from the floor

for any position on the board.

The Chapter recently made a decision to allow RFP and job opening an-

nouncements, which are industry relevant to our Chapter members, into the

newsletter and on the website at no cost. If you desire to make such an an-

nouncement please send an email with a brief description and other perti-

nent information to TJ Smith (Webmaster), Andy Cox (Newsletter) and Kim

Hiebert (President) and we will get it in the next available publication. Keep

in mind there is no newsletter in July or August. The website can be updated

at any time.

Speaking of Website it is with great anticipation and pleasure I announce to

you that our website will be under major renovation this summer. We will be

changing our website vendor to Star Chapter and TJ Smith, Chapter 36

Webmaster, will be the architect. The change has been needed for a long

time, and thankfully one of our members is willing to volunteer their time and

energy to see it through. If you have input for what you envision the website

to offer, please contact TJ. Google ―Star Chapter‖ if you want to learn

about all of the possibilities this new web layout will offer our chapter.

I look forward to seeing everyone again at our next luncheon!

President: Kristen Bennett, SR/WA, R/W - RAC

Kristen Bennett is the President of Blackbird Right of Way

LLC. Prior to founding Blackbird, she served as Senior Man-

ager, Director of Relocation Services for Sendero Acquisi-

tions, LP for 8 years. Kristen also spent 3 years with Enter-

prise Products Partners, L.P. as a Right of Way Agent and

Title Analyst. She is currently serving as the Vice Chair of

the Relocation Community of Practice and the Vice Presi-

dent of Chapter 36. In 2016, Kristen was the Chapter 36

Young Professional of the Year. She is a CLIMB Certified Instructor for courses

501, 502, 503, 504 and 505. Kristen has also presented relocation sessions at

the IRWA annual conference.

Kristen earned her SR/WA designation in 2018 and her R/W-Relocation Assis-

tance Certification in 2013. She earned a Bachelor of Music degree from

Texas Tech University and a Master of Music degree from the prestigious

Jacob’s School of Music at Indiana University. Before joining the right-of-

way profession, Kristen was a professional opera singer. She has performed

at Carnegie Hall and Lincoln Center.

Kristen lives in Azle, Texas and enjoys spending time with her husband, John

Bennett, and their two daughters, Ellie and Mimi.

Vice President: Lora Gunter, SR/WA, J.D.

Lora Gunter, SR/WA is the Project Delivery Director for the

Right of Way Division of the Texas Department of Transpor-

tation. In her role, she oversees the department’s statewide

right of way acquisition portfolio. She implements the poli-

cies and procedures for right of way project delivery activi-

ties. She must ensure that those policies and procedures

adhere to the legal parameters set forth in the Federal Uni-

form Act, Texas statutes, and the Texas Administrative

Code, as well as both state and federal Constitutions. She manages a legal

staff that assists her Project Delivery staff in operating in a compliant man-

ner. Lora also manages the Acquisition Management section, which is a

supporting arm of Project Delivery. That section handles relocation issues,

appraisal guidance, local public agency matters and is responsible for emi-

nent domain minute orders.

Lora’s right-of-way career began at the Texas Attorney General’s Office,

where she represented TxDOT in eminent domain matters across the state.

She has ample experience in the eminent domain process, engaging in nu-

merous administrative hearings, jury trials, and appellate cases. She has also

worked as a Right-of-Way attorney for the department and handled various

matters involving property acquisition and real property disposition.

Additionally, she engaged in legal work concerning the compliance and

interpretation of federal and state laws, rules and regulations (including the

Uniform Act). Lora has also worked in the private sector representing large

public utility companies in condemnation proceedings and other right-of-

way issues. Most recently, Lora worked in TxDOT’s Fort Worth District oversee-

ing the right-of-way, utilities, and survey sections of the District.

Treasurer: Dalton Vann, MAI, RWA, R/W-AC

Dalton Vann, MAI, RWA, R/W-AC began his real es-

tate appraisal career in residential valuation in 2005.

After receiving his Master of Real Estate degree from

Texas A&M, he began commercial appraisal and

work in right-of-way in 2007 with Integra Realty Re-

sources - DFW. Dalton is currently a senior vice presi-

dent with JLL Valuation and Advisory Services and provides valuation

services across Texas. Mr. Vann holds the MAI designation from the

Appraisal Institute and the Right-of-Way Appraisal Certification and

RWA designation from the IRWA. He has appraised a wide variety of

property and provided expert witness testimony for roadway, pipe-

line, power transmission line and municipal projects. Dalton is active

within Chapter 36, having served as Secretary, Newsletter Editor, Edu-

cation Committee Member, and Education Chair, along with numer-

ous volunteer positions over the years including serving on the nomi-

nations committee, scholarship committee, and Spring Seminar. Dal-

ton was the Chapter 36 Young Professional of the year in 2015. He

has also served as the education chair for the Central Texas Chapter

of the Appraisal Institute. Dalton is also a CLIMB-certified IRWA instruc-

tor.

Secretary: Jennifer Hall, SR/WA, R/W-NAC

Jennifer Hall, SR/WA, R/W-NAC is currently the Di-

rector of Right-of-Way for TNP, Inc. The honor of

Employer of the Year 2017 was given to TNP, Inc.

She has sixteen years of experience and in-depth

knowledge of right-of-way and easement negotia-

tions, property evaluations, relocation assistance,

title curative, eminent domain coordination, and

contract management.

Jennifer is active within Chapter 36, having served as Membership

Committee Member, Historian, and 2 years as Programs Committee

Member. Since joining Chapter 36 in 2005 Jennifer has actively taken

courses to obtain her R/W-NAC and SR/WA designations. She has

also supported the Chapter and Region by volunteering at various

events. Currently, Jennifer is working to become certified as an IRWA

instructor and has become CLIMB certified.

PDC Chair: Sarah Riebe, R/W-NAC

Sarah Riebe is a Project Manager/ROW Agent for Pinnacle

Management Consulting Group, Inc. Ms. Riebe is the Project

Manager for Parker County Transportation projects for Freese

and Nichols, and also provides clients with condemnation

support services. Additionally, Sarah provides right-of-way

agent services for the Texas Department of Transportation.

Prior to joining the Pinnacle team, Ms. Riebe served as the

Senior Managing Director of Title and Acquisition Services for

Sendero Acquisitions, LP.

Additionally, Sarah is experienced in pipeline easement acquisitions, construc-

tion damages, routing, title curative duties, and closings, including as a consult-

ant for a 29-mile pipeline project for Enterprise Products Partners, L.P. Previously,

Sarah served as the Project Manager for the City of Denton Municipal Electric

Transmission Line Rebuild Projects, and has acquired rights-of-way on numerous

projects for TxDOT and TxDOT’s SPD. Sarah also serves as a Special Commission-

er in condemnation cases in Parker County. Prior to Right-of-Way, Ms. Riebe

was licensed by the Texas Department of Insurance as an Escrow Officer, and

worked directly with realtors, lending institutions, and builders, for over 12 years.

PDC 3 Year: Denise Lopez, SR/WA, R/W-RAC

Denise Lopez is a Real Estate Representative for the City of

Arlington. Denise has been in the right-of-way industry for

almost 10 years and has a background of over 23-years ex-

perience in the Real Estate field. Prior to working in right-of-

way for a municipality, Denise was a real estate agent sell-

ing and listing residential real estate. Five years later she be-

came a real estate broker and managed newly licensed

realtors under her independently-owned real estate com-

pany, Property Zone Realty, LLC. Denise had the opportuni-

ty to become a part-time instructor for Kaplan Real Estate Education and

did not hesitate to step in front of the classroom as an instructor and teach

mandatory continuing education courses including legal and ethics. As a

Texas Real Estate Certified Instructor she also taught licensed agents the

―ins and outs‖ of TREC contracts.

Denise earned a Bachelor of Science degree in Business from Tarleton State

University. She has completed the IRWA CLIMB Instructor Development Pro-

gram certifying her to teach several IRWA courses. Denise is active within

Chapter 36 having served as Programs Co-Chair and Membership Chair,

she i also Course Coordinator Certified with IRWA.

Denise enjoys running and vacations with her husband and three sons. Den-

ise, a proud Aggie mom, has also volunteered on the scholarship commit-

tee for the Fort Worth/Tarrant County Aggie Moms’ Club.

PDC 2 Year: Jace Whatley, MAI

Jace Whatley is a real estate appraiser with Pyles

Whatley Corporation, in Dallas, Texas. He graduated

from the University of Texas at Austin in 2008, and has

been with Pyles Whatley for eight years. Mr. Whatley

recently earned the MAI designation from the Ap-

praisal Institute. He has been involved in a variety of

right-of-way projects including roads, electric transmission lines, utility

easements, and gas easements. Jace volunteered for Chapter 36 as

the program chair for three years from 2012 to 2014 and 2015/2016,

and also served as the historian from 2014 to 2016. Jace is currently

on the PDC committee serving as a 3-year member. Jace and his

lovely wife live in Dallas, and they enjoy spending time at the lake

and walking their dog.

Director 2-year: Kim Hiebert, SR/WA, R/W-RAC, R/W-

NAC

Kim Hiebert, SR/WA, R/W-RAC, R/W-NAC, is a Real Es-

tate Program Manager for HDR Engineering, Inc. fo-

cused on Project Management and Business Devel-

opment in Texas. She has eighteen years of experi-

ence in the ROW industry and has in-depth

knowledge and experience in project management

and coordination services for private and public sector ROW pro-

jects. Her skills include management, right-of-way acquisition, resi-

dential and business relocation, eminent domain, title curative, utility

adjustments, and delivering projects in compliance with the Uniform

Act. Kim is a graduate of Texas A&M University and holds a Texas Real

Estate Commission Broker’s license. She has been a member of IRWA

for seventeen years and has held an SR/WA for eleven years. She has

actively volunteered for the Chapter over the years, serving three

years on the Professional Development Committee, one year as

Treasurer, one year as Vice President, and is the current President of

the Chapter. Kim is very committed to community service and is cur-

rently serving her fourth term on the Aledo City Council as Mayor Pro

Tem and also serves on the City’s Economic Development Board.

Director 1-Year: Marcus Boyd, SR/WA, R/W–RAC,

R/W-NAC, R/W-URAC

Marcus Boyd is a Vice President for Pinnacle Con-

sulting Management Group, Inc. Pinnacle is a

professional right of way, land acquisition, reloca-

tion assistance and survey company. Marcus has

been in the Right of Way business since 2005,

earned his R/W- Relocation Assistance Certifica-

tion in 2009, and the SR/WA designation in 2011. He has business mar-

keting and management degrees from Texas Tech University and is a

licensed Texas Real Estate Broker.

Marcus has recently served the North Texas Chapter 36 International

Right of Way Association as Chapter 2-Year Director, President, Vice

President, Secretary, Membership Chairperson and Professional De-

velopment Committee Chairperson. Marcus enjoys spending time

with his wife, his son, and his two daughters.

Please attend the Luncheon on May 8 at the Texas Star Confer-

ence Center to participate in the election of Chapter 36 Offic-

Hello YP’s:

Thanks to everyone who came out to ―The Rustic‖ for our March/

April event. We had another great turnout. It’s always good to

catch up with everyone and enjoy some good company and

music. We had some good discussions about our next Lunch

Question: After an Eminent Domain Special Commissioners

hearing, what are your options and how do you go

about appealing and getting a trial?

Answer: You have two options. 1) accept the findings of

the Special Commissioners and the award; or 2)

object to the findings of the Special Commission-

ers. By doing the latter you will convert the eminent

domain case from an administrative proceeding

into a normal pending cause of action. This will on-

ly happen if objections are filed by the Condemnor

or the Condemnee. Hubenak v. San Jacinto Gas

Transmission Co., 141 S.W.3d 172, 179 (Tex. 2004).

The Texas Property Code provides:

A party to a condemnation proceeding may

object to the findings of the special commis-

sioners by filing a written statement of the ob-

jections and their grounds with the court that

has jurisdiction of the proceeding. The state-

ment must be filed on or before the first Mon-

day following the 20th day after the day the

commissioners file their findings with the court.

TEX. PROP. CODE ANN. § 21.018(a) (West 2014).

Objections to the special commissioners' award need not

utilize particular words but must be filed with the court and must

identify the substance of the party's complaint by stating the

―grounds‖ for its objections. See TEX. PROP. CODE ANN. § 21.018

(a); Pappas Rests., Inc. v. State, No. 01-15-00001-CV, 2016 WL

3900720, at *7 (Tex. App.—Houston [1st Dist.] 2016, no pet.).

However, language in a motion to withdraw the award funds

that attempts to satisfy the requisites of section 21.018(a), does

not constitute a written statement of objections. Oak Lawn

Apartments, Ltd. v. State, 02-16-00287-CV, 2018 WL 359956, at *4

(Tex. App.—Fort Worth 2018, no pet. reh'g denied).

If no party to the condemnation proceeding files timely

objections to the special commissioner's findings, then the court

having jurisdiction shall adopt the commissioners' findings as the

judgment of the court. See In re Energy Transfer Fuel, LP, 250

S.W.3d 178, 180–181 (Tex. App.—Tyler 2008, orig. proceed-

ing); TEX. PROP. CODE ANN. § 21.061 (West 2014). Absent objec-

tions from either party, the trial court's function is ministerial; it

lacks jurisdiction to do anything except render judgment based

upon the commissioners' award. Muhammad v. Plains Pipeline,

L.P., 12-16-00189-CV, 2017 WL 2665180, at *2 (Tex. App.—Tyler

2017, no pet.); See also Rose v. State, 497 S.W.2d 444, 445 (Tex.

1973).

In the absence of timely-filed objections, the trial court's

judgment on the commissioners' findings and award is not ap-

pealable. See Musquiz v. Harris County Flood Control Dist., 31

S.W.3d 664, 667 (Tex. App.—Houston [1st Dist.] 2000, no pet.)

(citing Pearson v. State, 315 S.W.2d 935, 938 (Tex. 1958).

STEVE BAGGETT MEMORIAL GOLF TOURNMENT

AND SPRING SEMINAR

The 2018 Spring Seminar and Steve Baggett Memorial Golf Tournament were held in April at the

Walnut Creek Country Club in Mansfield.

Thank you so much to everyone who came out to play golf on Thursday, April 19! It was a fun

and memorable day! Congrats to our tournament winners listed below. Those who attended

the Spring Seminar on Friday, April 20, enjoyed fantastic presentations from our esteemed

speakers.

Professional Development Committee

Chapter 36 members have a tremendous opportunity to en-

hance their careers in right-of-way by obtaining an IRWA desig-

nation. There are several ways in which the Chapter helps indi-

viduals achieve this milestone:

By furnishing Chapter 36 members with discounted IRWA

courses to satisfy their educational requirements for the desig-

nation.

By assisting the membership with counseling and guidance

through the PDC to chart their own path toward a specific des-

ignation.

By encouraging right-of-way firms and government agen-

cies to promote the designation to their employees or agents.

By having SR/WA members available to proctor examina-

tions for individuals and groups of candidates.

These are only a few of the many ways Chapter 36 can help

you fulfill the IRWA designation requirements. The pPofessional

Development Committee is available to help you reach your

right-of-way goals. Our success and the Chapter’s are not only

measured by the sheer number of members we attract, but al-

so by the professional advancement our organization can

offer.

Greetings Chapter 36 members!

First, we want to be sure to thank everyone who came out to the Spring

Seminar and Walnut Creek Country Club for hosting Course 102 for us! Addi-
