The rail authority advises that the application has been assessed in accordance with the requirements of clause 86(4) of the SEPP and it has been determined to grant concurrence to the development subject to Council imposing a deferred commencement condition and operational conditions that will need to be complied with upon satisfaction of the Deferred Commencement Condition (refer to attachment). CONSIDERATION In light of the above, it is recommended that the resolution of the Panel be amended to delete all reference to any impending comments from Railcorp, and to replace the rail-related conditions contained in the report with the terms of approval of the rail authority. RECOMMENDATION (A) To amend the resolution as follows: THAT the North Sydney Independent Planning Panel, under the delegation of the General Manager as the consent authority, grant deferred commencement consent to Development Application No. 201/14 for the demolition and reconstruction of a weatherboard cottage with new lower ground level, excavation and drainage works, retaining walls, and landscaping at 10 Munro Street, McMahons Point, subject to the Terms of Approval of the rail authority (Sydney Trains), and the attached standard conditions and following site specific conditions. ADDENDUM DATED 2 SEPTEMBER 2014 Page 2 Re: IPP05 – 10 MUNRO ST, McMAHONS POINT (B) To add the following deferred commencement condition:

Deferred Commencement Condition Terms of approval of Sydney Trains This consent is not to operate until the Applicant satisfies the Council, within 12 months of the date of this consent, that it has obtained written confirmation from Sydney Trains that it has complied with the following matters. A1. The Applicant shall provide to Sydney Trains the following documentation:

1. Final Geotechnical and Structural report/drawings. 2. Final Construction methodology with construction details pertaining to

structural support during excavation. 3. Final cross sectional drawings showing the rail corridor, proposed

excavation and structural design of sub ground support. All measurements are to be verified by a Registered Surveyor.

4. Certification from both a Geotechnical Engineer and Structural Engineer experienced in developments adjoining the rail corridor that the proposed works will have no negative impact on the stability of the rail embankment, rail tracks and infrastructure, and stability of Victoria Street bridge over the rail corridor.

Should either of the Engineers listed in item 4 above advise that the required certification cannot be provided, then the Applicant is required to obtain Sydney Trains requirements regarding the protection of the rail corridor and Victoria Street bridge. Alternate excavation and/or construction solutions may be required for endorsement by Sydney Trains. Any conditions issued as part of the approval/certifications from Sydney Trains will also form part of the consent conditions that the Applicant is required to comply with.

(C) To replace condition A5 Protection of Railway Infrastructure with the following

condition: Requirements of Sydney Trains A5. The development is to comply with the following:

(a) If required by Sydney Trains, prior to the commencement of works and

prior to the issue of the Occupation Certificate, a joint inspection of the rail infrastructure and property in the vicinity of the project is to be carried out by representatives from Sydney Trains and the Applicant. These dilapidation surveys will establish the extent of any existing damage and enable any deterioration during construction to be observed. The submission of a detailed dilapidation report will be required unless otherwise notified by Sydney Trains.

(b) An acoustic assessment is to be submitted to Council prior to the issue of a Construction Certificate demonstrating how the proposed development will comply with the Department of Planning’s document titled “Development Near Rail Corridors and Busy Roads- Interim Guidelines”.

(c) Prior to the issue of a Construction Certificate the Applicant is to engage an Electrolysis Expert to prepare a report on the Electrolysis Risk to the development from stray currents. The Applicant must incorporate in the development all the measures recommended in the report to control that risk. A copy of the report is to be provided to the Principal Certifying Authority with the application for a Construction Certificate.

(d) If required by Sydney Trains, prior to the issue of a Construction Certificate a Risk Assessment/Management Plan and detailed Safe Work Method Statements (SWMS) for the proposed works are to be submitted to Sydney Trains for review and comment on the impacts on rail corridor. The Principal Certifying Authority is not to issue the Construction Certificate until written confirmation has been received from Sydney Trains confirming that this condition has been satisfied.

(e) Prior to the issuing of a Construction Certificate the Applicant is to submit to Sydney Trains a plan showing all craneage and other aerial operations (eg concrete pumps) for the development and must comply with all Sydney Trains requirements. The Principle Certifying Authority is not to issue the Construction Certificate until written confirmation has been received from Sydney Trains confirming that this condition has been satisfied.
