Note: 1. The powers given in column 4 & 8 above are only for works connected with restoration of traffic. 2. For invitation on single tender basis for specialised nature of works, prior concurrence of FA&CAO and personal

administrative approval of GM/CAO(Con) will be required irrespective of value. 3. Once administrative approval for awarding the work on single tender has been accorded by the competent authority, the

reasonableness of rates quoted by the tenderer as also other terms and conditions etc. would require to be considered by tender committee and accepted by the competent authority.

4. In case single tender, tender committee and accepting authority should be one step higher than in case of open tender except where GM is the accepting authority.

5. Selection of agency for award of work on single tender basis should be from the approved list of contractors except in respect of work of a specialised nature.

6. Detailed reasons justifying the need for resorting to single tender should be spelt out. Tender value should be worked out carefully based on realistic quantities and rates. Routine nature of work like transportation of ballast P.Way, Cement, Renovation of canteen, complex and renovation of officers’ chamber should not be undertaken on a single tender.

7. The grant of extension in date of completion and increase in value of single tender is to be governed as per Board's letter No. 93/WZ/PQR/SC/4 dt. 27.09.96.

For the purpose of these instructions , works of value upto Rs 50 lakhs shall be deemed as "small value works"

5. The existing eligibility criteria may normally be taken as a general guideline for adoption in works tenders. However GM/CAO(Con) with the personal concurremnce of FA&CAO/FA&CAO(Con), may effect relaxation in the existing eligibility criteria prescribed in para 2-3-4-1 and 2-3-4-2 of Railway Board’s letter no. 94/CE-I/CT-4 dt 17.10.2002 and subsequent amendments issued vide Rly. Bd’s letter no. 2007-CE-I/CT/18 dated 07.03.2008 thereon. This relaxation would need personal approval of GM/CAO(Con) and exercise of this power shall not be redelegated. Moreover these powers shall be exercised judiciously duly recording the special circumstances surrounding the tender in question and not in routine manner.

(a) Special Limited Tenders may be adopted in the following situations in consultation with FA&CAO :

(To be approved by the GM personally) (iv) Besides above CAO(C) with the concurrene of FA&CAO(C) may also invite special limited tenders not only for specialized nature of work but all types of works depending upon the merit of the case. (b) Special Limited Tenders may be invited from specialized and reputed contractors / organizations / agencies. (c) A proposal dealing the circumstances and the necessity for going in for Special Limited Tenders should be initiated and got concurred by FA&CAO (in respect of Open Line) and FA&CAO(C) in respect of Construction Organization) before personal approval of the PHOD/GM ((in respect of Open Line) and CAO/Con (in respect of Construction) is obtained. (d) Tenderers from whom Special Limited Tenders are to be invited should preferably be more than six but not less than four. (e) Tenderers need not necessarily be borne on the Approved list (Authority for item 10 (a) (i)to (iii), 10 (b),(c),(d )&(e) Railway Boards letter no.-94/CE-1/CT/4 dt. 17.10.2002.)

4. The advance granted to the contractor should be recovered in full from the on account bill by the time the value of the works reaches 75% of original value of the contract. G. bond of Nationalised bank or SBI.

1. In terms of Para 1268E. Variation beyond 25% depending on the nature of the particular category work to be done is not considered reasonable; as such it should not be done in routine way.

2. It should be seen that after inclusion of the variation, the revised face value of the agreement does not exceed the powers of the tender accepting authority which accepted the original tender other wise the case should be put up to the next higher authority.

3. Variation to be approved should be limited so as not to completely change the scope, character and purpose of the original contract. 4. For decrease in items beyond 25% of individual item or 25% of total value of contract agreement. The contracting authority can do so

after obtaining ‘no claim certificate’ from the contractor and with finance concurrence giving detailed reasons for such decrease in the quantities. It should be certified that the work proposed to be reduced, will not be required in the same work.

5. In case where decrease is involved in the variation of the quantity of any item beyond 25% of the quantity provided in original contract, it will require prior finance concurrence.

6. In respect of contract approved by GM, PCE/CE(C) can sanction variation for item upto 25% of the face value of original contract or 25 lakhs whichever is less.

7. If additional quantity of work can be got done by another agency, action should be taken as per Board's letter No. 94/CE-1/CT/37 dt. 05.05.95

8 In case of contract entered with containing conditions as per para 5-3-6 of Rly. Bd's letter no94/CE-1/CT/4 dt. 22.10.01 read with letter of even no dated 17.10.02 the variation above 25% & up of 50% will be regularized as per statutory mechanism provided in the contract without finance concurrence.

9. Tender schedules are to be prepared with utmost care, following all the existing provisions in the code as also administrative instructions without fail, after detailed site inspection and soil investigation wherever necessary, eliminating as far as possible the need for bringing any new item during execution of works.

10. These tender schedules may be approved by the JAG/SAG officers. Vetting of tender schedule should be necessary only in the rare urgent cases where tenders are called withoutsanction of detailed estimates. Pre-vetting will also not necessary in case of zonal works and revenue works in open line for which detailed estimates are not to be framed

11. System of indicating rates for individual items in the schedule(s) and asking the tenderers to quote a common percentage for all items in a schedule/all schedules may be preferred where ever possible.

12. In case where decrease is involved up to 25% or above 25% of the accepted value of the C.A. involving vitiation of the tender, sanction of the competent authority as per single tender should be obtained.

dispensed with. The procedure detailed below shall be adopted for dealing with variations in quantities during execution of works contracts :- 1. I n d i v i d u a l N.S. item in contracts shall be operated with variation of plus or minus 25% and payment would be made as per agreement

rate. For this no finance concurrence will be required 2. In case of increase in quantity of an individual item by more than 25% of the agreement quantity is considered unavoidable, the same

shall be got executed by floating a fresh tender. If floating a fresh tender for operating that item is considered not practicable, quanti t y of tha t i tem ma y be opera t ed in excess of 125% of the agreement quanti t y subject t o the fol lowing condit ions : (a) Operation of an item by more than 125% of the agreement quantitiy needs the approval of an officer of the rank not less than SAG.

(i) Quantities operated in excess of 125% but upto 140% of the agreement quantitiy of the concerned item, shall be paid at 98% of the rate awarded for that item ikn that particular tender.

(ii) Quantities operated in excess of 140% but upto 150% of the agreement quantity of the concerned items shall be paid at 96 % of the rate awarded for that item in that particular tender.

(iii) Variation in quantities of individual items beyond 150% will be prohibited and would be permitted only in exceptional unavoidable circumstances with the concurrence of associate finance and shall be paid at 96% of the rate awarded for that item in the particular tender.

(b) The variation in quantities as per the above formula will apply only to the individual items of the contract and not on the overall contract value.

(c) Execution of quantities beyond 150% of the overall agreemental value should not be permitted and, if found necessary, should be only through fresh tenders or by negotiating with existing contractor with prior personal concurrence of FA&CAO/FA&CAO© and approval of General Manager.

3. In cases where decrease is involve during execution of contract: (a) The contracts signing authority can decrease the items upto 25% of individual item without financial concurrence. (b) For decrease beyond 25%for individual items or 25% of contrac t agreement value , the approval of an officer not less than rank of SAG

may be taken after obtaining ‘No Claim Certificate’ from the contractor and with finance concurrence giving detailed reasons for each such decrease in the quantities.

(c) It should be certified that the work proposed to be reduced will not be required in the same work. 4. The limit for varying quantities for minor value items shall be 100% (as against 25% prescribed for other items). A minor value item for this

purpose is defiened as an item whose original agreement values is less than 1% of the total original agreemental value. 5. No such quantity variation limit shall apply for foundation items. 6. As for as SOR items are concerned, the limit of 25% would apply to the value of SOR schedule as a whole and not on individual SOR items.

However, in case of NS items, the limit of 25% would apply on the individual items irrespective fof the manner of quoting the rate (single percentage rate or individual item rate).

7. For the tenders accepted at Zonal Railways level, variations in the quantities will be approved by the authority in whose powers revised value of the agreement lies.

8. For tenders accepted by General Manager, variations upto 125% of the original agreement value may be accepted by General Manager. 9. For tenders accepted by Board Medmbers and Railway Ministers, variations upto 110% of the original agreement value may be accepted by

General Manager. 10. The aspect of vitiation of tender with respect to variation in quantities should bechecked and avoided. In case of vitiation of the tender (both

for increase as well as decrease of value of contract agreement), sanction of the competent authority as per single tender should be obtained. 14 . For pest control contracts, specialized contracts involving large component of mechanized cleaning and contracting one time claning o any area,

the competent officer of the department (Commerical, Mechanical, Engineering, etc.) who will execute the work will exercise this power. CMS of the Medical department of the division will exercise the power as given for ADRM.
