Thank you for being part of the New Mexico Environmental Law Center. In 2013, you made a tremendous difference for our communities and our resources, during a time when they needed you the most. Three years into the administration of Governor Susana Martinez, we had one foot in administrative hearing rooms, and one foot in judicial courtrooms. They are both important arenas for New Mexico’s environment and communities. Administrative rulemakings (where regulations like the Copper Rule and Pit Rule were born and gutted, respectively) are held on the Governor’s home turf. They are presided over by her appointees, and the appointees of her appointees. And it shows. But courtrooms are another matter. There, judges are striking down the illegal, anti-environment and anti-public decisions made by the Administration. The decisions that are coming out of courtrooms are good news for communities throughout our state…and bad news for an Administration that is still trying to evade the law. While that system keeps us in the good graces of the IRS, it can make our Annual Reports appear unbalanced. For instance, using the GAAP system, it seems that our expenses exceeded our revenue in 2013. In reality, we received payments for several grants that were booked in previous years, and met all of our expenses last year. Victory for public participation in the Mount Taylor uranium mine case.

NMELC won a major victory that requires the State to take public input into account when making decisions about uranium and other hardrock mines.

Victory for government transparency in Energy Conservation Codes case.

NMELC affirmed a legal requirement that State decision-makers must explain the reasons for their decisions.

Victory in defending New Mexico Mining Act from assault by humate mining industry.

Mineris Vitae, LLC asked the NM MiningCommission to change the Mining Act regulations so that the company couldoperate bigger humate mines with fewer rules. After wemade our argument against the scheme, the Commissiongave the company just a fraction of what it asked for. And we convinced legislators that they should not exempthumate mines from the Mining Act.

Built strong case for appeal in Copper Rule case.

NMELC took part in a challenging rulemaking in 2013, in which the Water Quality Control Commission overturned more than three decades of regulations, policies and court rulings to allow an entire industry to pollute groundwater. But webuilt a strong record, and now we’ve taken the Commission to the Court of Appeals.

Built strong case for appeal in Oil &Gas Pit Rule case.

In another rulemaking that favored industry profit overgroundwater protection, the Oil Conservation Commission

gutted New Mexico’s Pit Rule (which governs thewaste from oil and gas drilling.) Again, you made it

possible to build a strong case during the hearing, and now we’ve taken the Commission to court.

Still no new uranium mining in New Mexico!

18 years after the Law Center becameinvolved in the fight to stop new uraniummining in the Eastern Agency of the NavajoNation, no new mines have opened. Butwe now have 17 uranium cases on our docket, rangingfrom advocating for the cleanup of Cold War-era minesand a mill to preventing the opening of new mines.

Challenged a water grab in East Mountains near Albuquerque.

As water becomes more valuable, speculators are attemptingnew ways to get a hold of New Mexico’s scarcesupply; 2013 saw us in a multi-week hearing in front of the State Engineer, fighting to keep a developer from grabbing rights to water in the East Mountains. We expect a decision in 2014.

Challenged State’s failure to regulate industrial dairies.

Where there are good environmental regulations in place, like the Dairy Rule, the New Mexico Environment Department has suspended enforcement of them. With your help, we're working with citizens who live near dairies to hold the line on existing protections, get contaminated water cleaned

up and prevent new contamination from occurring.

Successfully killed every bad environmental bill we tracked during the legislative session.

It’s hard to protect the environment andcommunities when bad laws are on thebooks. That’s why NMELC attorneysspend much of the legislative sessionworking to defeat industry-sponsoredlegislation that would harm our naturalresources and threaten communitywellbeing.

Began defense of Mora County ban on oil and gas extraction.

Mora County came to the Law Centerto defend its landmark county-level banon oil and gas extraction – the first of itskind in the U.S. Litigation began in December 2013 in federal district court and will continue through 2014.

Victory in defending New Mexico Mining Act from assault by humate mining industry.

Mineris Vitae, LLC asked the NM MiningCommission to change the Mining Act regulations so that the company couldoperate bigger humate mines with fewer rules. After wemade our argument against the scheme, the Commissiongave the company just a fraction of what it asked for. And we convinced legislators that they should not exempthumate mines from the Mining Act.

Built strong case for appeal in Copper Rule case.

NMELC took part in a challenging rulemaking in 2013, in which the Water Quality Control Commission overturned more than three decades of regulations, policies and court rulings to allow an entire industry to pollute groundwater. But webuilt a strong record, and now we’ve taken the Commission to the Court of Appeals.

Built strong case for appeal in Oil &Gas Pit Rule case.

In another rulemaking that favored industry profit overgroundwater protection, the Oil Conservation Commission

gutted New Mexico’s Pit Rule (which governs thewaste from oil and gas drilling.) Again, you made it

possible to build a strong case during the hearing, and now we’ve taken the Commission to court.

Still no new uranium mining in New Mexico!

18 years after the Law Center becameinvolved in the fight to stop new uraniummining in the Eastern Agency of the NavajoNation, no new mines have opened. Butwe now have 17 uranium cases on our docket, rangingfrom advocating for the cleanup of Cold War-era minesand a mill to preventing the opening of new mines.

Challenged a water grab in East Mountains near Albuquerque.

As water becomes more valuable, speculators are attemptingnew ways to get a hold of New Mexico’s scarcesupply; 2013 saw us in a multi-week hearing in front of the State Engineer, fighting to keep a developer from grabbing rights to water in the East Mountains. We expect a decision in 2014.

Challenged State’s failure to regulate industrial dairies.

Where there are good environmental regulations in place, like the Dairy Rule, the New Mexico Environment Department has suspended enforcement of them. With your help, we're working with citizens who live near dairies to hold the line on existing protections, get contaminated water cleaned

up and prevent new contamination from occurring.

Successfully killed every bad environmental bill we tracked during the legislative session.

It’s hard to protect the environment andcommunities when bad laws are on thebooks. That’s why NMELC attorneysspend much of the legislative sessionworking to defeat industry-sponsoredlegislation that would harm our naturalresources and threaten communitywellbeing.

Began defense of Mora County ban on oil and gas extraction.

Mora County came to the Law Centerto defend its landmark county-level banon oil and gas extraction – the first of itskind in the U.S. Litigation began in December 2013 in federal district court and will continue through 2014.

Thank you for being part of theNew Mexico Environmental LawCenter. In 2013, you made atremendous difference for ourcommunities and our resources,during a time when they needed you the most.

Three years into the administration of Governor SusanaMartinez, we had one foot in administrative hearing rooms,and one foot in judicial courtrooms. They are both importantarenas for New Mexico’s environment and communities.

Administrative rulemakings (where regulations like theCopper Rule and Pit Rule were born and gutted, respectively)are held on the Governor’s home turf. They are presided

over by her appointees, and the appointees of her appointees.And it shows.

But courtrooms are another matter. There, judges are strikingdown the illegal, anti-environment and anti-public decisionsmade by the Administration. The decisions that are coming outof courtrooms are good news for communities throughout ourstate…and bad news for an Administration that is still tryingto evade the law.

You’re making it possible for us to win those critical decisions –some of which are discussed in this Annual Report. Thank you.

The Law Center keeps its books according to “Generally Accepted AccountingPrinciples” (GAAP), which require us to book the entirety of a multi-year grant in theyear that we receive the grant pledge. While that system keeps us in the good graces of the IRS, it can make our Annual Reports appear unbalanced. For instance, using theGAAP system, it seems that our expenses exceeded our revenue in 2013. In reality,

we received payments for several grants that were booked in previous years, and

met all of our expenses last year.
