4. Contract will valid till completion of crushing season 2020-21.

5. List of spares required will be submitted by party within 15 days of Award of contract.

6. The party will attend all complaints as expeditiously as possible and no case beyond 4 hrs of the information failing which 5% of balance payment will be forfeited his first act of negligence . The party will be liable for forfeiture of remaining amount of AMC.

7. Party will depute our expert/technical qualified person per month for supervision of overall working of system.

Terms & Conditions of Work Order for Contractor work in Mills

1. Last date of receipt of tender up to 13.10.2020 at 5.00 P.M.

2. The Press Tender should be submitted in the Prescribed NIT in the sealed envelope,

subscribing the envelope “ Tender for AMC of PLC Drive A Cfg.Machine Item No B-1

3. Negotiations, if required will be done with the lowest tenderer on same date.

4 . Any damage done to the mill property during the working by the workers of contractor

shall be recovered from contractor after assessing the damage by the mills Management.

5. Provident fund of the contractor’s labour shall be the responsibility of the contractor and

rate quoted are inclusive of PF liability..

6. In case the contractor’s rates are found less in any other Coop. the same rates will be

applicable. The contractor will have to quote the following and shall provide proof of the same at the time of negotiation.

The labour rate contract shall be valid for one year, on expiring the present rate contract, it can be extended at the discussion on General Manager for the period of one month. However, it can further be extended on the willingness of both the parties.

7. It will be obligatory on the part of contractor to pay minimum wages to his labour at per Govt. rules and regulations. The contractor will be fully responsible for accidental damage/ losses involving his employee shall be responsible for observance of all formalities and expenses under various labour laws as may be applicable form time to time.

8. Contractor shall have to abide by Rules & Regulations of the Mills and shall be responsible for observation of all Govt. Rules & Regulations with regard to the labour engaged by him. In case of any accident etc. he will be fully responsible for total compensation, medical treatment etc. of the labour so engaged by him.

9. Labour contractor shall be fully responsible for all expenses/contribution in respect of his employees as required to be payable by employer payable under various provision of the labour law i.e. ESI,EPF etc.

10. The contract shall be liable to discharge all or any liability arising out of this contract under any labour laws.

11. Labour contractor should obtain required license from labour department and a copy of that should be given in this office within two months period of allotment of annual labour rate contract for record purpose.

12. a) Income tax will be deducted from the contractor’s bills as applicable from time to time. He also provided for deduction of income tax. If any.

b) Service tax as applicable shall be deducted from the contractor’s bills.

13. Any dispute arising out of this contract shall be subject to jurisdiction of court-Jalandhar.

14. The contract is non-transferable. However, if General Manager is satisfied that the contractor is not in a position to continue with the contract and wishes to transfer to another genuine contractor at the request of the contractor.

15. In case the contractor fails to execute the contract in accordance with the terms and conditions of the agreement/order we reserve the right to get the work done from some other party at his risk, cost and responsibility. Extra expenditure thus incurred shall be recovered from the contractor.

18. Any extra expenditure incurred/ loss suffered by the plant due to non- execution of work within the stipulated time or loss caused to the property will also be recoverable from the contractor.

19. The contractor will have to provide man power from time to time as per the directions/instructions of the Chief Engineer/General Manager or his representative. For discharging of smooth working.

20. The contractor will have to carry out any other job related to the contract and assigned by Management from time to time.

21. The Purchase Committee of the Mills reserves the right to alter any terms & conditions of the tender if required.

22. The Purchase Committee of the Mills reserves the right to reject/accept any tender without assigning any reason, any time by giving an advance notice of 15 days.

Lifting of Press Mud “AS IS WHERE IS BASIS”

Transportation, loading/unloading/Diesel and driver etc. will be arranged & borne by contractor

Dumping of press mud will be on directed place, on open land outside of mills with radius of 5 km.

Lifting of press mud from the mud conveyor belt should be round ‘O’ clock.

Earnest money is Rs. 20000/- refundable basis after satisfactory lifting of whole press mud and end of crushing operation 20202-21

Rate should be quoted per quintal basis

Engage sufficient labour for the job.

Preference will be given to hydraulic lifter trolley.If the mill stopped due to non-lifting of mud, entire responsibility shall be of contractor.

Payment will be made fortnightly.

80% payment may release against work done and 20% after satisfactory completion of job and your earnest money will release also after end of crushing operation.

Tractor should be in good conditions and with all related documents.

Mill will not be responsible for any mis-happening.

During long stoppage and general cleaning your tractor trolley will be at disposal of concern head of department.

2.Mills responsibilities

1) Supply of chemicals and outer materials required to run the ETP.

2) Repair of machinery, electrical fitting and civil work as required.

3 Contractor responsibilities

1. To start seeding and development of biological culture around the clock well before the start of crushing season 2020-21.

1. Your supervisor will visit at least once a week or as and when required by mill to supervise operating of ETP/APCD.

1. To ensure that treated pollutions (air & water) conform to the prescribed standard of PPCB /CPCB .

1. To maintain regular inlet and outlet flow of treated and untreated water effluent.

1. Supervisor will ensure that log book for ETP will proper maintained.

1. You will submit the environment of audit report as per requirement of PPCB.

1. i. Self monitoring (monthly) will be done both of APCD/ETP as per requirement of PPCB.

ii. Sampling and testing of effluent sample of ETP as and when required by the PPCB shall be done by you. Necessary charges for the sample with drawn will be borne by mills.

1. Each order will be come in force w.e.f. 45 days prior to the start of mill till the washing of plant after close the crushing season 2020-21.

1. i. Payment - 50% of the monthly payment will be released after satisfactory running of ETP/APCD as per standard laid down by PPCB and 50% will be released after successful completion of crushing season subject to the conditions that samples drawn by the PPCB authorities shall conform to the standards laid down by PPCB and submission of annual environmental audit report.

Ii. Payment for monthly operation shall be made on pro rata basis if the working is less than 30 days for a particular month .

iii. If the rates charged to any CSM in Punjab found less the same will be applicable to our mill also.

6. Any queries to be resolved regarding analyzer as per direction of CPCB/PPCB.

7. Cleaning & servicing of analyzer weekly & periodically as per guidelines of CPCB/PPCB.

8. During running of analyzer ,servicing is required on monthly basis.

9. Analyzer to be cleaned dismantled & packed after close of online monitoring system( after one months close of crushing season 2020-21)

3. Any defective spare parts of the analyzer will be procured by the mills.

4. Comprehensive maintenance contract will be valid up to one year from the date of expire of the previous contract

5. You will have to install your own server at PPCB Patiala at and CPCB Delhi as per guidelines issued from time to time

6. If there will be any operation fault in the system, you will attend it within 72 hours during the contract period

7. You will ensure satisfactory receipt of data at the server of PPCB and CPCB in case of problem in the analyzer

8. 60% payment will be made after successful performance of the system during the season as per recommendation of the Chief Chemist, 20% payment after close the season 2020-21 against satisfactory performance and 20% payment after completion of contract period

9. You will depute of service of the site engineer once in month and as per requirement during the season in case of any defects in the analyzer.

10. GST will be applicable as per rule.
