Context  •  Much  analysis  to  determine  impacts  of  possible  diversions  for  the  2004  AWSA  

solu>on  in  accordance  with  CUFA.    However  there  is  an  absence  of  publicly  disclosed  details  regarding  legally  diver7ble  water.  

•  The  process  recognized  “diversion  of  water  under  the  AWSA  is  only  peak  flows  –  not  base  flows”.  1  –  So  sporadic  water  delivery  should  not  be  a  surprise.  The  public  needs  to  understand  the  diversion  implica>ons.  

•  How  much  &  when  will  diver>ble  water  be  available  using  diversion  alterna>ves?  Through  the  beginning  of  2014,  statements  made  similar  to  “an  annual  average  of  14,000  acre-­‐feet  of  addi>onal  water  from  the  Gila  Basin”.  

•  The  Excel  spreadsheet  calculates  NM  Daily  Diver>ble  Right  (DDR)  yearly  mean  around  ~12000  AF  per  year  between  the  corrected  spreadsheet  (12,423)  and  the  uncorrected  but  extended  ISC  secret  spreadsheet(12,235).  2    –  Good  news:  different  spreadsheet  results  close  –  However,  calculated  12,423  AF  is  already  11%  less  than  the  14000  AF/yr  ceiling  –  This  water  is  not  available  except  sporadically  and  in  many  years,  not  at  all

Process  to  Calculate  Gila  AWSA  Diver>ble  Water  

•  Researched  New  Mexico  Consump>ve  Use  and  Forbearance  Agreement  (CUFA)  to  understand  diversion  guidelines  defined  in  the  2004  Arizona  Water  Seolements  Act  (AWSA)  

•  Used  exis>ng  models  and  formaoed  for  comparison  •  Extended  appropriate  USGS  gages  and  water  level  datasets  to  make  

current  from  1937  to  2013  •  Reviewed  and  corrected  copy  of  the  ISC  spreadsheet  based  on  

CUFA  defini>ons    •  Analyzed  Corrected  model  for  diver>ble  water,  crea>ng  detailed  

report-­‐outs  by  event  and  year      •  Provided  Corrected  ISC  model  out  for  input  into  the  PowerSim  

model

•  Obtained,  extended  data  to  2013,  compared  and  corrected  ISC  spreadsheets  based  on  CUFA

Conclusion  •  Gila  water  is  either  feast  or  famine  (in  Flood  or  Dry)  •  Need  to  be  able  to  store  water  from  feast  years  to  get  through  the  

famine  years    •  CUFA  appears  to  be  wrioen  to  preclude  New  Mexico  Diversions  

much  of  the  >me.  –  Even  with  different  calcula>ons  (Errors  in  ISC  Secret  Spreadsheet  &  

Corrected  spreadsheet)  -­‐-­‐  liole  booom  line  impact  –  There  is  not  enough  water  available  under  CUFA  for  a  constant  supply  –  Even  under  these  restric>ve  CUFA  terms,  water  diverted  under  these  

junior  water  rights  needs  to  be  prepaid  so  the  federal  government  can  replace  for  downstream  users  all  the  water  that  New  Mexico  diverts.  

•  It’s  a  fact  there  will  be  no  reliable  supply  of  water  legally  available  for  diversion,  much  less  of  new  usable  water.  It’s  also  a  fact  the  costs  will  be  enormous.

Diver>ble  Water  Priority  •  When  Commissioner  Anderson  asked  during  a  February  29,  

2012  ISC  mee>ng  “whether  the  water  rights  available  to  New  Mexico  under  the  act  could  be  jeopardized  in  terms  of  drought”,    

•  Craig  Roepke  responded    sta>ng  “that  in  terms  of  water  rights  New  Mexico  has  the  senior  right  on  the  Central  Arizona  Project.  Before  New  Mexico’s  14,000  acre-­‐feet  per  year  would  be  curtailed  all  the  rights  held  by  other  users  would  have  to  dry  up  first.”  

•  While  that  may  be  true  for  the  Central  Arizona  Project  exchange  water  delivered  to  the  Gila  River  downstream  of  San  Carlos  Reservoir,  it  clearly  is  not  true  for  legally  diver>ble  water  from  the  Gila  River  in  New  Mexico.
