BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the Thames Harbour Act, 1922. Short Title. 2. In this Act the expression " the said Act " means the Thames Interpretation.

Harbour Board Loan and Empowering Act, 1920. 3. The First Schedule to the said Act is hereby repealed, and Harbour district

the First Schedule to this Act is substituted therefor. All references reconstituted-in the said Act to the First Schedule to that Act shall hereafter be deemed to be references to the First Schedule to this Act.

4 . The Third Schedule to the said Act is hereby repealed, Maximum and the Second Schedule to this Act is substituted therefor. All proportion of rates references in the said Act to the Third Schedule to that Act shall hereafter be deemed to be references to the Second Schedule to this Act.

5. (1.) The levy to be made pursuant to subsection three of Section 23 of section twenty-three of the said Act shall be made upon the capital S^L^and* value of all rateable property as such term is defined by the Rating Empowering Act, Act, 1908, and amendments, in the boroughs of Thames, Waihi, 1920'amended-Paeroa, Te Aroha, and Morrinsville, the town districts of Turua and Matamata, and such portions of the counties of Thames, Hauraki Plains, Ohinemuri, Piako, and Matamata as are within the area defined in the First Schedule hereto. Such levy shall not exceed in respect of each such local authority the respective amounts set out in the Second Schedule hereto :

Provided, however, that the Governor-General may from time to time, by Order in Council, on application in that behalf made by the Board, vary the proportions specified in the Second Schedule hereto as from a date to be fixed by that Order.

(2.) The last preceding subsection is in substitution for subsection four of section twenty-three of the said Act, and that subsection is hereby accordingly repealed.

Alteration of 6 . (1.) If a proposal to raise a loan under the provisions of the pdUariied011 lf said Act is duly carried as provided by that Act, then (but only in

such event) the constitution of the Thames Harbour Board shall be varied as by this Act is provided, and that portion of the First Schedule to the Harbours Amendment Act, 1910, relating to the Thames Harbour Board, and section seven of the Hauraki Plains, Thames, Ohinemuri, and Piako Counties Act, 1919, shall be and be deemed to be repealed.

(2.) The Thames Harbour Board shall, on and after such day as the Governor-General shall by Order in Council appoint, consist of nine members, of whom five shall form a quorum, and such members shall be respectively elected or appointed as follows:—

One to be appointed from time to time by the Governor-General :

Two to be elected by the electors of Thames and Hauraki Plains Counties and the Turua Town District:

Two to be elected by the electors of the Piako County and the boroughs of Te Aroha and Morrinsville:

One to be elected by the electors of the Matamata County and Matamata Town District:

One to be elected by the electors of Ohinemuri County and boroughs of Waihi and Paeroa:

One to be elected by the electors of the Borough of Thames: One to be' elected by the payers of harbour dues.

New election, how 7 . (1.) The Thames Harbour Board shall, on a day to be fixed and when held. j y Governor-General by Order in Council, hold an election of

elective members of the Board, and by the same or any subsequent Order the Governor-General may make all such provisions as he deems necessary for the purpose of that election, and may fix the time and place for the first meeting of such Board.

(2.) Such election shall be deemed to be a first election held under the provisions of the Harbours Amendment Act, 1910, and the members of such Board shall hold office and may be respec-tively re-elected and appointed in accordance with the provisions of that Act.

ALL that area of land comprising the boroughs of Thames, Waihi, Paeroa, Te Aroha, and Morrinsville, the town districts of Matamata and Turua, the Hauraki Plains County, and portions of the Thames, Ohinemuri, Piako, and Matamata Counties : Commencing at a point on the ordinary high-water mark on the Firth of Thames upon the left bank of the Waikawau Stream at the mouth of such stream ; thence bounded on the north generally by the Coromandel County to the summit of the main range between Oteao and Kapowai Streams; thence proceeding southward along the summit of the main dividing watershed of the Hauraki Peninsula which separates the streams flowing into the Tasinan Sea from the streams flowing into the Firth of Thames and the Waihou River: bounded towards the east generally by portions of the Thames and Ohinemuri Counties to the boundary of the Tauranga County; thence on the south-east and north-east by the Tauranga County to Puwhenua Trigonometrical Station No. 27 ; thence on the south-east by the Rotorua County to the point of intersection of the said county boundary with the southern boundary of Block VI, Ngautuku Survey District; thence along the southern boundaries of Blocks VI and V, Ngautuku Survey District, and of Blocks XII, XI, X, and IX, Patetere South Survey District, to its inter-section with the right bank of the Waikato River opposite . Wharepuhunga No. 18 ; thence on the west by the Waikato River to the southern boundary of Section 9, Block XII, Maungatautari Survey District; thence towards the north generally by the southern boundaries of the said Section 9, and also of Sections 8, 5, 3, and 1, and the eastern boundaries of Sections 1, 2, and 17, all the said sections being part of Block XII, Maungatautari Survey District; thence along the southern boundaries of Sections 4 and 5, and the southern and eastern boundaries of Section 6, ail in Block IX, and the eastern boundary of Section 3, the southern and eastern boundaries of Section 9, and the eastern boundary of Section 8, all in Block V, Patetere North Survey District; thence along the southern boundary of Lot 44 (L.T. 4280A) to the road shown on L.T. plan 7337 ; thence along the western side of that road in a northerly direction generally to the south-eastern corner of Lot 130, and along the southern and western boundaries of Lot 130 and the western boundary of Lots 131 and 132 to the Cambridge Road ; thence along that road in a westerly direction generally to the south-western corner of Lot 4 (L.T. 7203) ; thence along the south-westerly boundaries of Lots 4 and 5, and along the road forming the north-west boundaries of Lots 5 and 6 to its junction with Buckland's Road ; thence along that road in a westerly direction to and along the north-east boundary of Lot 10 to the southernmost corner of Lot 42 (part of Hinuwera No. 2) ; thence along the south-west boundary of Lots 42 and 43 to the Piako County boundary, and along the boundary of the said county in an easterly direction generally to the south-eastern corner of Tawawhakapuoro Block ; thence in a northerly direction generally along the eastern boundaries of the said Tawawhakapuoro Block, Te Konehu Block, Kiwitahi Nos. IF and 1E ; thence proceeding in a westerly direction along the northern boundaries of the said Kiwitahi No. 1E, crossing the Kiwitahi No. 2E Block to the north-east corner of Section 73s, Temiro Settlement; thence along the northern boundaries of Sections 73s, 22s, 21s, and 20s and the north-eastern boundaries of Sections 25s, 72s, and 26s, all in Temiro Settlement, and the north-eastern boundary of Tahuroa No. 1 Block to the Tauwhare-Morrinsviile Road ; thence along the southern side of that road to its intersection with the Waikato County boundary ; thence on the south-west by the said Waikato County to Pukorokoro on the ordinary high-water mark of the Firth of Thames ; thence on the north and west by the ordinary high-water mark of the Firth of Thames to the point of commencement at Waikawau Stream : as the same is delineated on the plan marked M.D. 5585.
