HUNDREDS of thousandsof taxpayers’ dollars will bewasted as a result of theNT’s new mandatorysentencing laws, accordingto a legal expert.
NT Criminal Lawyers As-sociation president RussellGoldflam said that manda-tory minimum sentencing
for serious assault offenderswould clog the courts andthe prisons.
The Government an-nounced this week seriousassault offenders who had aprior conviction of violencewould serve a minimum12 months in jail.
Mr Goldflam said of-fenders would now be lessinclined to plead guilty with
the knowledge they wouldcop the steep sentence.
He said prison sentencescould be reduced by about25 per cent if a criminalenters an early guilty pleabefore these changes tosentencing.
Mr Goldflam said a dropin early guilty pleas wouldbump up court costs as morecases would go to trial,
which cost staff and judgewages, jurors’ lost wagesand lawyers’ work.
He said a trial was alsoundesirable because it couldbe stressful and incon-venient for witnesses.
Mr Goldflam questionedwhether serious assault of-fenders who committedminor violent offences intheir youth would be sub-
jected to a mandatory mini-mum sentence. He alsoquestioned which instancesa court could apply the newsentencing loophole, whichsays courts do not have tohand down a mandatoryminimum sentence in ‘‘ex-ceptional circumstances’’.
Justice Minister JohnElferink said the change inlaw under the Sentencing
Act would hold criminalsaccountable for their ac-tions. First-time serious vi-olent offenders will now besentenced to a minimumthree months jail.
Sentences for assaulting aworker where the victimsuffers harm will be raisedto a mandatory minimumthree months and maxi-mum seven years jail.
Car vandalism witnesses soughtPOLICE are calling for witnessesand victims of two 14-year-old boyswho allegedly used water pistols fullof paint to spray cars at Alice Plazaon Tuesday morning.
The offenders also sprayed twoCCTV cameras.
They are in custody, but policewant to talk to witnesses and victimsthat have yet to contact police.
