New laws ‘will clog the courts’ Katie Weiss HUNDREDS of thousands of taxpayers’ dollars will be wasted as a result of the NT’s new mandatory sentencing laws, according to a legal expert. NT Criminal Lawyers As- sociation president Russell Goldflam said that manda- tory minimum sentencing for serious assault offenders would clog the courts and the prisons. The Government an- nounced this week serious assault offenders who had a prior conviction of violence would serve a minimum 12 months in jail. Mr Goldflam said of- fenders would now be less inclined to plead guilty with the knowledge they would cop the steep sentence. He said prison sentences could be reduced by about 25 per cent if a criminal enters an early guilty plea before these changes to sentencing. Mr Goldflam said a drop in early guilty pleas would bump up court costs as more cases would go to trial, which cost staff and judge wages, jurors’ lost wages and lawyers’ work. He said a trial was also undesirable because it could be stressful and incon- venient for witnesses. Mr Goldflam questioned whether serious assault of- fenders who committed minor violent offences in their youth would be sub- jected to a mandatory mini- mum sentence. He also questioned which instances a court could apply the new sentencing loophole, which says courts do not have to hand down a mandatory minimum sentence in ‘‘ex- ceptional circumstances’’. Justice Minister John Elferink said the change in law under the Sentencing Act would hold criminals accountable for their ac- tions. First-time serious vi- olent offenders will now be sentenced to a minimum three months jail. Sentences for assaulting a worker where the victim suffers harm will be raised to a mandatory minimum three months and maxi- mum seven years jail. Car vandalism witnesses sought POLICE are calling for witnesses and victims of two 14-year-old boys who allegedly used water pistols full of paint to spray cars at Alice Plaza on Tuesday morning. The offenders also sprayed two CCTV cameras. They are in custody, but police want to talk to witnesses and victims that have yet to contact police.
